As is well known, § 6 of Kant’s Metaphysical First Principles of the Doctrine of Right contains five paragraphs that do not belong there. The article shows that their correct location is at the end of § 16. This sheds some new light on Kant’s theory of property and its significance for Kant’s doctrine of cosmopolitan right.

English title: Kant and the Right to Vote The article is a contribution to the ongoing debate in NFT about the moral responsibility of voters. Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. Kristian Skagen Ekeli har i to artikler argu- mentert for at uvitende borgere har en plikt til ikke å stemme, noe han begrunner ut fra en kantiansk pliktetikk. Det er imidlertid uklart hvordan en uvitende borgers plikt til å avstå fra å stemme skulle følge av Kants plikt til å respek- tere personer, noe Cornelius og Herman Cappelen kort antyder i sin kommentar til Ekeli. I denne artikkelen foretar jeg en analyse av de pliktene som Ekeli tar til orde for, og undersøker hvordan disse eventuelt kunne passe inn i Kants system av plikttyper. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

À primeira vista, o que parece razoavelmente defensável na posição kantiana, com base na Fundamentação da Metafísica dos Costumes, é que as ações imorais são insondáveis, mas não o são como as ações morais. Estas são sempre insondáveis, aquelas quando vestem a conformidade ao dever, pois quando são contrárias ao dever são sondáveis. Mas na Crítica da Razão Pura (1980b, p.279, n.; B 579, n.80) Kant afirma que “a moralidade própria das ações (mérito e culpa), mesmo a de nosso próprio (...) comportamento, permanece-nos totalmente oculta”, pois não sabemos o quanto devemos imputar ao efeito puro da liberdade ou à simples natureza. Assim, ao que parece Kant defende duas posições. Uma, apregoando a insondabilidade parcial das ações imorais, outra uma opacidade total da qualidade moral das ações. Julgo, contudo, que, no fundo, Kant pode sustentar, sem cair em contradição, tanto a posição de que (a) as ações contrárias ao dever sinalizam a maldade de uma máxima como a tese de que (b) o mérito ou demérito moral jamais pode ser observado. A primeira alternativa é a que verificamos, por exemplo, na Fundamentação da Metafísica dos Costumes e que também na Religião desempenha um importante papel, uma vez que Kant tem de assumir, de algum modo, a experiência de ações más. Já a segunda tese parece ter um fundo eminentemente especulativo. Ela visa a mostrar a indecidibilidade metafísica acerca da qualidade moral de uma máxima. (shrink)

An invalid promise is one whose breach does not wrong the promisee. I describe two different accounts of why duress and deception invalidate promises. According to the fault account duress and deception invalidate a promise just when it was wrong for the promisee to induce the promisor to promise in that way. According to the injury account, duress and deception invalidate a promise just when by inducing the promise in that way the promisee wrongs the promisor. I demonstrate that the (...) injury account is superior. I then argue that in this respect promising is like any exercise of a normative power. I conclude by distinguishing two theories of promissory obligation, a widely held view which I call the information interest theory and an alternative which I call the authority interest theory. I argue that the points established earlier support the authority interest theory over its rival. (shrink)

Most of the reports on synthetic biology include not only familiar topics like biosafety and biosecurity but also a chapter on ‘ethical concerns’; a variety of diffuse topics that are interrelated in some way or another. This article deals with these ‘ethical concerns’. In particular it addresses issues such as the intrinsic value of life and how to deal with ‘artificial life’, and the fear that synthetic biologists are tampering with nature or playing God. Its aim is to analyse what (...) exactly is the nature of the concerns and what rationale may lie behind them. The analysis concludes that the above-mentioned worries do not give genuine cause for serious concern. In the best possible way they are interpreted as slippery slope arguments, yet arguments of this type need to be handled with care. It is argued that although we are urged to be especially vigilant we do not have sufficiently cogent reasons to assume that synthetic biology will cause such fundamental hazards as to warrant restricting or refraining from research in this field. Up to a certain age, young people are denied the right to vote. In this paper, it is argued that this general exclusion from democratic participation is unjustified and should be abandoned. After a short survey of some of the pedagogic, legal, and political arguments that have been brought forward to support a liberalisation of electoral law in favour of children, the essay presents a basic moral argument against any age limit with respect to voting rights. First of all, it (...) is argued that the right to vote is grounded in a fundamental claim of human beings to equal participation and, therefore, can be denied only for severe and cogent reasons. Subsequently, the essay purports to establish – and defends against objections – that there are no such reasons that sufficiently justify an age limit. The paper concludes with some remarks on practical consequences of the argument. (shrink)

Die Sekundärnutzung klinischer Daten für Forschungs- und Lernaktivitäten hat das Potenzial, medizinisches Wissen und klinische Versorgung erheblich zu verbessern. Zur Realisierung dieses Potenzials bedarf es einer ethischen und rechtlichen Grundlage für die Datennutzung, vorzugsweise in Form der Einwilligung von Patient*innen. Damit stellt sich die grundsätzliche Frage: Haben Patient*innen eine moralische Pflicht, ihre klinischen Daten für Forschungs- und Lernaktivitäten zur Verfügung zu stellen?Auf Basis eines ethischen Ansatzes, der als „sorgender Liberalismus“ bezeichnet werden kann, werden folgende Argumente zur Begründung einer Pflicht von (...) Patient*innen zur Bereitstellung ihrer klinischen Daten für Forschungs- und Lernaktivitäten auf Plausibilität und moralisches Gewicht untersucht: die allgemeine Hilfspflicht; Solidarität; die Pflicht zu gemeinwohlförderlichem Handeln; das Trittbrettfahrerargument; transgenerationale Gerechtigkeit; das Prinzip des Zurückgebens; das Prinzip des Nicht-Schädigens; die Forschungsfreiheit und der Wert der Wissenschaft.Die allgemeine Hilfspflicht und die Pflicht zu gemeinwohlförderlichem Handeln sind gewichtige Gründe für eine moralische Pflicht von Patient*innen zur Bereitstellung ihrer klinischen Daten für Forschungs- und Lernaktivitäten. Abstract Carl Schmitt distinguishes between political theories in terms of whether they rest on the anthropological assumption that man is evil by nature or on the anthropological assumption that man is good by nature, and he claims that liberal political theory is based on the latter assumption. Contrary to this claim, I show how Kant's liberalism is shaped by his theory of the radical evil in human nature, and that his liberalism corresponds to the characterization of liberalism that Schmitt himself (...) offers. My discussion of this issue will be shown to have certain implications with respect to the view that for Kant evil is the product of society. I show that this view is mistaken insofar as it fails to recognize that Kant's political philosophy implies that human beings require the type of society that best suits their radically evil natures, namely, a commercial one in which the ?vices of culture? largely have free play, while the state's role is limited to that of preventing the antagonisms found in society leading to the mutual destruction of its members. The purpose of this article is to discuss the criminalization of conduct based on human dignity arguments. It proposes a modest version of integrating human dignity into discussions about criminalization. After a critical examination of both the notion of “human dignity as an objective value” and the assumption that the meaning of human dignity can be explained by referring to Kant’s moral philosophy, human dignity violations are characterized as severe humiliations.

Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

ZusammenfassungDie Zulässigkeit später Schwangerschaftsabbrüche nach Pränataldiagnostik wirft die Frage auf, ob die deutsche Rechtspraxis nicht widersprüchlich ist, die einerseits Ärzte dazu verpflichtet, zu früh und behindert geborene Kind zu behandeln, andererseits bei einer vorgeburtlich diagnostizierten Behinderung des Kindes aber den Abbruch einer Schwangerschaft bis zur Geburt zulässt. Der Beitrag geht der Frage nach, ob die Unterschiede, die im gesetzlichen Schutz des Lebens einerseits von ungeborenen und neugeborenen Kindern und anderseits von behinderten und nichtbehinderten Föten gemacht werden, aus ethischer Sicht verteidigt (...) werden können. Hierzu werden zunächst weltanschaulich liberale, konservative und vermittelnde Positionen in der Bioethik zum moralischen Status menschlicher Wesen diskutiert. Abschließend wird ein eigener Vorschlag vorgestellt, der von weiten Sorgepflichten der Schwangeren gegenüber ihrem ungeborenen Kind ausgeht und die außergewöhnliche Beziehung zwischen Frau und Kind in der Schwangerschaft berücksichtigt. Diese Argumentation zeigt, dass eine liberale Regelung des Schwangerschaftsabbruchs mit einer allgemeinen medizinischen Behandlungspflicht zu früh oder behindert geborener Kinder aus ethischer Sicht vereinbar ist. The purpose of this paper is to address some of the questions on the notion of agent and agency in relation to property and personhood. I argue that following the Kantian criticism of Aristotelian metaphysics, contemporary biotechnology and information and communication technologies bring about a new challenge—this time, with regard to the Kantian moral subject understood in the subject’s unique metaphysical qualities of dignity and autonomy. The concept of human dignity underlies the foundation of many democratic systems, particularly in Europe (...) as well as of international treaties, including the Universal Declaration of Human Rights. Digital agents, artificial organisms as well as new capabilities of the human agents related to their embeddedness in digital and biotechnological environments bring about an important transformation of the human self-appraisal. A critical comparative reflection of this transformation is important because of its ethical implications. I deal first with the concept of agent within the framework of Aristotelian philosophy, which is the basis for further theories in accordance with and/or in opposition to it, particularly since modernity. In the second part of this paper, I deal with the concept of personhood in Kantian philosophy, which supersedes the Aristotelian metaphysics of substance and builds the basis of a metaphysics of the moral human subject. In the third part, I discuss the question of artificial agents arising from modern biology and ICT. Blurring the difference between the human and the natural and/or artificial opens a “new space” for philosophical reflection as well as for debate in law and practical policy. (shrink)

Human rights are a contested concept. One important strand of criticism concerns the charge of their Eurocentrism, formulated in particular by postcolonial theorists and scholars. Although postcolonial perspectives are now increasingly acknowledged, attempts to incorporate non-Western approaches into the discourse on human rights are still rare. This article considers whether Islamic human rights concepts can address the postcolonial critiques and decenter human rights discourse and politics from the West. Working within the methodological framework of comparative political thought, the article regards (...) Islamic approaches not simply as counter-discourses but analyzes their potential to supplement the dominant theory and practice of human rights and correct some of its inherent flaws. Informed by the critical analysis of Makau Mutua and Gayatri C. Spivak, the primary focus is on alternatives to the liberal individualist framework of human rights as evident in the concept of the autonomous individual subject of rights, and the balancing of individual rights with ethics and notions of responsibility in particular. In an earlier article I argued that individuals are obligated not to exceed their fair share of emissions entitlements, that many exceed their fair share at present and thus ought to reduce their emissions as far as can reasonably be demanded. The peer commentators raised various insightful and pressing concerns, but the following objections seem particularly important: It was argued that the fair share argument is insufficiently justified, that it is incoherent, that it would result in more far-reaching duties than (...) acknowledged by me, that it is unable to provide a clear account of individual duties, and that duties to reduce individual emissions are not Kantian imperfect duties. This reply aims at clarifying the fair share argument and at addressing the major challenges. (shrink)

Addressing the question in the form of Kant’s maxim, this paper moves on to a more controversial topic in biomedical ethics, physician-assisted suicide. However, my conclusion is tentative, and what is worse, negative: I partially approve suicide. It does not imply a moral hazard. The situation is opposite: in the present times, terminal patients seriously wish it. I, as an author, put an emphasis on this very respect. Now suicide is, for certain circles, nothing but justice. The arguments of thinkers (...) who approve suicide are also cited from this angle. (shrink)

I analyze then Eggert Winter´s critic of Cohen´s concept of moral autonomy, who questions the integration of the levels of the particularity and the universality in this fundamental moment of the theory. This essay presents a theory of ethical action as heading out from non-uniform, bare cognitions of good or bad, right or wrong. It describes the path running from bare cognitions to rational ethical non-judgements and judgements, the latter of which may result in ethical either action or non-action. The concepts of ethical availability and judgements of opinion, or of mere morality, are introduced. The concept of moral facts is refuted. The reigning confusion between Ethics and Aesthetics is deprecated. Five laws (...) ensue: No chain of agent-dependent ethical judgements can deliver ethical betterment; Moral utterances can be made sense of only de dicto, not de re, as they have no trans-world identity; Moral uncertainty is of the essence of Ethics; Afortioriness is the foundation of ethical betterment; The strengthening of features of character conduces to ethical betterment.
