In this stimulating work of political philosophy, acclaimed philosopher G. A. Cohen sets out to rescue the egalitarian thesis that in a society in which distributive justice prevails, peopleâes material prospects are roughly equal. Arguing against the Rawlsian version of a just society, Cohen demonstrates that distributive justice does not tolerate deep inequality. In the course of providing a deep and sophisticated critique of Rawlsâes theory of justice, Cohen demonstrates that questions of distributive justice arise not (...) only for the state but also for people in their daily lives. The right rules for the macro scale of public institutions and policies also apply, with suitable adjustments, to the micro level of individual decision-making. Cohen also charges Rawlsâes constructivism with systematically conflating the concept of justice with other concepts. Within the Rawlsian architectonic, justice is not distinguished either from other values or from optimal rules of social regulation. This paper critically engages Cohen’s rejection, in Rescuing Justice and Equality, of Rawls’s conception of redistributive justice. I argue that Cohen’s reading of Rawls is flawed and that his suggested revisions to Rawls’s theory are no improvement. The better interpretation involves seeing Rawls’s project as closer to Kant’s than, as Cohen assumes, to libertarians and egalitarians of his own stripe. Once we interpret Rawls as providing a so-called “public right” account and we add Kant’s account of (...) “private right”, Rawls escapes the problems Cohen charges him with and we obtain good reasons to side with Rawls’s Kantian liberalism against Cohen’s egalitarian anarchism. One of the central motifs of G. A. Cohen's work was his opposition to capitalism in the name of justice. This motif was fully in view in Cohen's work on Robert Nozick's libertarianism: Cohen carefully reconstructed and relentlessly criticized Nozick's apologetics of the free market, which, he thought, was internally coherent but unconvincing. This article suggests that Cohen's opposition to libertarianism did not, however, go far enough, and identifies two respects in which Cohen's position could and should have been (...) more critical of that philosophy. This paper engages G. A. Cohen's "Rescuing Justice and Equality." The paper was originally written as a part of the NASSP (North American Society for Social Philosophy) Book Award session in 2008.

G. A. Cohen wanted to rescue justice and equality from John Rawls and his followers. In this, his final book, Cohen presents a clear, focused, and all-together powerful attack on the Rawlsian approach to political philosophy and distributive justice.

Though John Rawls's treatment of stability has received less attention than other parts of his work, it promises help in understanding how liberal institutions can reproduce themselves under non-ideal conditions like ours. But stability in Rawls's sense seems to depend ineliminably on society's justice, and Gerald Cohen powerfully criticized the connection Rawls drew between the two. Cohen contends that stability is ‘alien’ to justice rather than conceptually connected to it. It is therefore a consideration that should be studied (...) separately. If we are to draw on Rawls's treatment, it needs to be defended against Cohen's critique. I argue that it can be. The defense depends upon establishing a conclusion that Cohen thought inconsistent with Rawls's theory and that might have discomfited Rawls himself: that the arguments he offered for the stability of a just society were more limited and tentative than he acknowledged. Locating those limits has two valuable payoffs. It sheds light on some of the more obscure and difficult, but neglected parts of Rawls's work. More important for our current political moment, it shows the points at which unjust societies such as our own need to be shored up. (shrink)

This essay reviews G.A. Cohen’s final major work, Rescuing Justice and Equality. In the book, Cohen challenges the Rawlsian account of the content and the concept of justice. This essay offers a summary of Cohen’s main arguments, and develops objections to several of those arguments, particularly Cohen’s claim that his proposed egalitarian ethos is not vulnerable to a well-known trilemma (liberty, equality, efficiency) that might be pressed against it. G. A. Cohen has argued that egalitarian justice proscribes equality-upsetting economic incentives, but that individuals nevertheless are required to make a sufficiently large productive contribution to society. This article argues, however, that Cohen’s claim that justice is insensitive to Pareto concerns and simply is equality, undermines such a duty. In fact, Cohen cannot say that justice prefers a distribution where everyone is equally well off to one where everyone is equally badly off. Individuals hence cannot (...) have a duty of justice to use their talents at a more productive level. This indifference risks removing Cohen’s egalitarianism’s appeal as an alternative to the Rawlsian position it challenges. Several ways of avoiding this problem are proposed and evaluated. Ultimately, it is argued that such a duty to contribute must instead be based on a concern for both equality and human flourishing. The ethos Cohen defends must hence be made pluralist, and encourage a commitment to both principles. (shrink)

In his recent Rescuing Justice and Equality, G. A. Cohen mounts a sustained critique of coerced labour, against the background of a radical egalitarian conception of distributive justice. In this article, I argue that Cohenian egalitarians are committed to holding the talented under a moral duty to choose socially useful work for the sake of the less fortunate. As I also show, Cohen's arguments against coerced labour fail, particularly in the light of his commitment to coercive (...) taxation. In the course of defending those claims, I claim that Cohen's remarks on freedom of occupational choice and taxation exhibit partiality towards the interests of the better-off to the detriment of the less fortunate – a partiality which is in tension with his commitment to equality. In Rescuing Justice and Equality , G. A. Cohen reiterates his critique of John Rawls's difference principle as a justification for inequality-generating incentives, and also argues that Rawls's ambition to provide a constructivist defence of the first principles of justice is doomed. Cohen's arguments also suggest a natural response to my earlier attempt to defend the basic structure objection to Cohen's critique, which I term the alien factors reply. A societal goal to which more and more people in the United States appear to be committed--at least officially--is the assurance of comprehensive health services for every person irrespective of income or geographic location. This paper offers one possible moral justification of the goal. It does so by attempting to apply various standard conceptions of social justice to considerations about health care and to reflect about the reasons why some of the conceptions seem more relevant than others. “Does the existence of unequal social and economic starting points in life nullify capitalism's claims to justice?” Notice is hereby given that this essay's answer to this question is an unequivocal “maybe.” For it is a banal but true claim that everything depends upon what is meant by capitalism, justice and life's starting point. And it is a less banal but no less true claim that their meanings are opaque or controversial or both. In what follows I shall (...) devote little attention to the question of what justice is and shall simply presume that it is best characterized by historical entitlement theory. The last part of the essay discusses the notion of life's starting point and vacillates over what it would mean for one such point to be equal to another. Hence, the bulk of my argument is taken up with exploring what capitalism must be like to conform to historical entitlement theory. And my conclusion will be that, insofar as capitalism respects every person's right of self-ownership, its claims to justice require that no one be denied one type of equal payment – a payment which might be rendered at each life's starting point. The principle that each individual is entitled to an equal opportunity to benefit from any public health care system, and that this entitlement is proportionate neither to the size of their chance of benefitting, nor to the quality of the benefit, nor to the length of lifetime remaining in which that benefit may be enjoyed, runs counter to most current thinking about the allocation of resources for health care. It is my contention that any system of prioritisation of the resources (...) available for healthcare or of rationing such resources must be governed by this principle. -/- This can have apparently paradoxical conclusions in that it can seem wasteful to give someone with a very slim chance of a lifesaving treatment the same priority as someone with a much better chance. In an important and thoughtful recent paper, Julian Savulescu has concentrated on this apparent weakness and has argued for a particular conception of the good or benefit to be achieved by a healthcare system which purports to demonstrate the inadequacies of an equal opportunities approach to prioritisation and to replace it with an altogether better account. This paper will show that a rational ‘reasons based consequentialism’ is more in line with the equal opportunities approach, which I defended some time ago in these pages, than with that of Savulescu. I shall then examine more closely the conception of equal opportunities in health care and show that if we give weight to an individual's reasons, and what is expected to be good for them, we will opt for exactly the equality based account of distributive justice that I have recommended. G. A. Cohen's Rescuing Justice and Equality proposes that both concepts need rescuing from the work of John Rawls. Especially, it is concerned with Rawls' famous second principle of justice according to which social primary goods should be distributed equally unless an unequal distribution is to the benefit of the worst off. The question is why this would ever be necessary if all parties are just. Cohen and I agree that Rawls cannot really justify inequalities (...) on the basis given. But he also thinks equality is the correct analysis of justice, though he provides no actual direct arguments for this. He does, however, provide a striking analytical argument claiming that fundamental principles of justice must be fact insensitive, and that Rawls's view of justice violates this requirement. I argue that the requirement is itself misconceived and that principles of justice cannot possibly be fact insensitive in the sense developed by Cohen. Few philosophers share this view of Cohen's—which I argue is due to several conceptual mistakes. With these ironed out, the contractarian view, broadly speaking, is seen to be plausible and powerful. Meanwhile Cohen appears to embrace intuitionism, a stance that cannot possibly be acceptable in social philosophy. In the end, Cohen is successful in arguing that Rawls cannot have what he wants, but neither is Cohen successful in claiming that justice is equality. (shrink)
