A partir de las críticas que el igualitarismo fraternal lanzó contra el igualitarismo de la suerte, G. A. Cohen propuso un compromiso a través del denominado modelo de campamento. Puesto que dicho trade-off no quedó formalizado, en este artículo se intenta aportar algunos elementos en tal dirección. En concreto, se argumenta: a) que Cohen tiende un primer puente hacia el igualitarismo fraternal al distinguir los aspectos de equidad y legitimidad en una concepción de lo justo, conjuntamente con la afirmación de (...) que la suerte en las opciones nunca preserva la justicia; b) que los principios igualitario y comunitario, que Cohen postula como deseables para el socialismo, operan sobre la base de la distinción equidad-legitimidad, de modo que las desigualdades generadas por elecciones genuinas y mala suerte en las opciones son justas en tanto resultan legítimas pero no son justas en términos de equidad y, en consecuencia, las desigualdades que rasgan el tejido social son causalmente fundamentales mientras que el principio comunitario es normativamente fundamental; y c) que los elementos comunitarios que impulsan el compromiso de Cohen ya están presentes en sus nociones de igualdad voluntaria, ethos igualitario, lectura estricta del Principio de Diferencia rawlsiano y comunidad justificatoria. That we can learn something from literature, as cognitivists claim, seems to be a commonplace. However, when one considers matters more deeply, it turns out to be a problematic claim. In this paper, by focusing on general revelatory facts about the world and the human spirit, I hold that the cognitivist claim can be vindicated if one takes it as follows. We do not learn such facts from literature, if by “literature” one means the truth-conditional contents that one may ascribe (...) to textual sentences in their fictional use, i.e., in the use in which one makes believe that things unfold in a certain way. What we improperly call learning from literature amounts to knowing actually true conversational implicatures concerning the above facts as meant by literary authors. So, in one and the same shot, we learn both a general revelatory fact and the fact that such a fact is meant via a true conversational implicature by an author. The author draws that implicature from the different truth-conditional content a sentence possesses when the sentence is interpreted in a fictional context, meant as Kaplan’s (1989) narrow context, i.e., a set of circumstantial parameters (agent, space, time, and world). Many theories of racism presuppose that ordinary usage of the term “racism” should be preserved. Rarely is this presupposition—the presumption of conservatism—defended. This paper discusses the work of Lawrence Blum, Joshua Glasgow, Jorge Garcia, Tommie Shelby, and others, in order to develop a critique of the presumption of conservatism. Against this presumption, I defend the following desideratum: If ordinary usage of “racism” prompts significant practical difficulties that can be averted by revising ordinary usage, then this counts as a mark against (...) the normative status of ordinary usage and so counts as a reason for revising it. The significance of this argument is that it clears the way for a rigorous defense of revisionism. My paper provides a prima facie case for revisionism, built on two practical criticisms of the ordinary usage of “racism.” First, ordinary usage reflects incompatible norms that promote conceptual confusion and misunderstanding, among other problems. Second, ordinary usage reflects an individualistic conception of racism that serves the interests of whites. By championing ordinary usage in our philosophical theories, we (unwittingly) promote the interests of whites over nonwhites. (shrink)

In this paper, against a new imagination-based account defended by Anna Ichino in some recent works, I defend the intuitive and traditional idea that so-called religious beliefs are indeed those doxastic attitudes that they are traditionally taken to be, i.e., bona fide beliefs. Yet I take that the objects of such beliefs amount to be different from what religious believers consciously take them to be; namely, they are mythological characters, a species of fictional characters – namely, fictional characters not consciously (...) recognized as such – instead of being concrete individuals possibly endowed with supernatural powers. Yet religious believers also unconsciously recognize the fictional nature of religious objects of belief as mythological characters, as their behavior ultimately shows. This account indeed allows me to give a different yet still doxastic explanation of the two main reasons that Ichino advocates in favor of her account; namely, the incompatibility of so-called religious beliefs with other beliefs and their imperviousness to evidence, especially of a negative kind. In this paper I want to hold, first, that one may suitably reconstruct the relevant kind of mental representational states that fiction typically involves, make-beliefs, as contextually unreal beliefs that, outside fiction, are either matched or non-matched by contextually real beliefs. Yet moreover, I want to claim that the kind of make-believe that may yield the mark of fictionality is not Kendall Walton’s invitation or prescription to imagine. Indeed, in order to appeal in terms of make-believe to a specific form (...) of imagination that fiction distinctively involves, one must move away from the realm of norms in order to attain a cognitive realm; namely, one must look at a specific form of metarepresentational state. This metarepresentational state of make-believe is a second-order representation that is about both real beliefs and make-beliefs, as the first-order representations it compares by acknowledging their contextual distinctness. The Covid-19 pandemic has further intensified a crisis in the functions and the perception of the state. It has also revealed underlying contradictions in both mainstream and radical ideologies of the state. A desire for the state as guarantor of public welfare vies with fear of the state’s hypertrophic capacities for surveillance and control. Following a brief exploration of the intimate modern connection between plagues and the state, the article tries to map some of the ways in which the state (...) has been at stake in political and theoretical commentaries on the pandemic. Is an epidemiological politics from below, beyond the plague state, possible? Can recent emergency measures be seen as incomplete or inverted anticipations of a communist use of the state of exception? Or is the primacy of the political we are currently experiencing a mere fetish, indissociable from the rule of capital? (shrink)

In his (2001a) and in some related papers, Tim Crane has maintained that intentional objects are schematic entities, in the sense that, insofar as being an intentional object is not a genuine metaphysical category, qua objects of thought intentional objects have no particular nature. This approach to intentionalia is the metaphysical counterpart of the later Husserl's ontological approach to the same entities, according to which qua objects of thought intentionalia are indifferent to existence. But to buy a metaphysically deflationary approach (...) does not mean to buy an ontologically deflationary approach, according to which we have to accept all the intentional objects there apparently are. Being metaphysically deflationary on intentionalia rather means that from the ontological point of view one must really allow only for those intentionalia for which one is entitled to say that there are such things; typically, for which an ontological proof is available. From metaphysical schematism plus conditional, or partial, ontological committment to intentionalia, further interesting consequences follow. First, this theoretical combination allows one to deal with the ‘too-many entities’ problem (may one fail to accept an ontological proof for an entity of a given kind if she thinks that the entity we would have to be committed to is an entity of another kind?). Second, it allows one to deal with the ‘genuinely true report’ problem (how is it that if we exercise mindreading with respect to a somehow deluded person, we want our reports to come out as really, not merely fictionally, true?). All over Europe, the provision of healthcare services is widely considered a primary duty of the government. Universal access to medical care can be considered a basic ingredient of the so-called “European social model.” But if universal access to medical care is seldom questioned, European governments—faced with expanding costs caused by an increasing demand driven by an aging population and technology-driven improvements—are contemplating the possibility of “rationing”1 treatments, or the possibility of allowing a greater role for private suppliers. If a (...) “multi-tier” healthcare system has long been anathema to the European leadership, guaranteeing a uniform access to state-of-the-art care seems to be well beyond the means of states suffering from persisting debt crisis. Was the failure of state-controlled “adequate” healthcare totally unpredictable? Far-sighted criticisms had been offered by two eminent thinkers in the classical liberal tradition, Herbert Spencer and Friedrich A. von Hayek . Neither author is usually recognized as a forerunner of contemporary critics of the welfare state, and both investigated the issue of the state financing and providing health services well before or right after the establishment of national health services. With the benefit of hindsight, reading Spencer and Hayek helps us to understand how the crisis of state-supplied healthcare is not rooted in the mere progress of clinical technology, but is rather the logical consequence of the theoretical basis of the model itself. Whereas modern theorists of the welfare state tend to offer theories that are impervious to a critical appraisal of their unintended consequences—insofar as they are framed in a language of “rights”—both Hayek and Spencer understood that human systems are complex, and that unwanted effects of public policy should be taken into account. Although Spencer emphasized the moral hazards accruing from the paternalism involved in governmental provision of health services, Hayek explained how modern healthcare systems differ from real, private insurance designed to offer proper coverage against risks. These authors appreciated that the politicization of healthcare was bound to result in both standardization of care and disregard for the responsibility that comes with personal freedom. These two “diagnoses before the illness” can help us in defining the challenges and the potential solutions that healthcare systems face today. Understanding the fatal conceits inherent in the very architecture of national health services can be the first step toward healing our healthcare systems. (shrink)

Some authors argue that it is permissible for clinicians to conscientiously provide abortion services because clinicians are already allowed to conscientiously refuse to provide certain services. Call this the symmetry thesis. We argue that on either of the two main understandings of the aim of the medical profession—what we will call “pathocentric” and “interest‐centric” views—conscientious refusal and conscientious provision are mutually exclusive. On pathocentric views, refusing to provide a service that takes away from a patient's health is professionally justified because (...) there are compelling reasons, based on professional standards, to refuse to provide that service (e.g., it does not heal, and it is contrary to the goals of medicine). However, providing that same service is not professionally justified when providing that service would be contrary to the goals of medicine. Likewise, the thesis turns out false on interest‐centric views. Refusing to provide a service is not professionally justified when that service helps the patient fulfill her autonomous preferences because there are compelling reasons, based on professional standards, to provide that service (e.g., it helps her achieve her autonomous preferences, and it would be contrary to the goals of medicine to deny her that service). However, refusing to provide that same service is not professionally justified when refusing to provide that service would be contrary to the goals of medicine. As a result, on either of the two most plausible views on the goals of medicine, the symmetry thesis turns out false. (shrink)

In Defining Racism, I offer the first comprehensive examination of the philosophical literature on racism and argue for a new methodological approach that I call conventionalism. Framing my argument within this approach, I defend an oppression theory of racism. In this article, I will attempt to accomplish two goals: offer a reply to the thoughtful comments of my critics, and lay out the main argument and major themes of my book in an accessible manner. First, I will describe the philosophical (...) problem of defining “racism” and explain why I think a new methodological approach is necessary to address this problem. Second, I will present the moralist presupposition of my project and extend my oppression theory of racism in response to the challenge of assigning responsibility for oppression. Finally, I will address several criticisms to my prescriptive approach, including: my prescriptive approach unjustifiably privileges moralist explanation over social explanation ; the tool of semantic clarification, which my conventionalist framework draws upon, is inadequate for resolving conceptual disagreement; my call for scholars to negotiate the meaning of “racism” is unlikely to succeed and would be insufficient to inspire social change if it were to succeed; and, finally, my conventionalist approach is wedded to a misguided intensionalist semantics, for an extensionalist semantics is more appropriate for the term “racist.”. In the Tractatus, Wittgenstein seems to appeal to the idea that thoughts manage to explain how sentences, primarily elementary sentences, can be such that their subsentential elements refer to objects. In this respect, he seems indeed to appeal to the claim that thoughts, qua endowed with not only original, but also intrinsic, intentionality, lend this intentionality to names, by transforming them into ‘names-of’, i.e., symbols endowed with intrinsic intentionality as well. Such a claim, however, entails that there must be necessary (...) superfacts. Since according to the Tractatus’ ontology there cannot be necessary facts in the world, but at most only in its logical scaffolding, the most likely chance is that such facts are facts for the limit of the world, i.e., the transcendental subject. Curiously enough, in his later critique, in the Investigations, of mentalist semantics, Wittgenstein fails to appeal to this claim, which can block the infinite regress that he there changes the mentalist position with. Since in the Investigations necessary facts seem to be allowed, this failure is even more striking. (shrink)

As many people have underlined, as regards pictures there are at least two different layers of content. In Voltolini, these layers are: i) the figurative content of a picture, i.e., what one can see in it viz. what the picture presents; ii) the pictorial content of a picture, i.e., what the picture represents, as constrained by its figurative content. As regards ii), there undoubtedly ispictorial misrepresentation. Having the possibility of misrepresenting things is a standard condition in order for a picture (...) to be a representation. Yet as regards i), things are more problematic. First, if one intends that a picture is seen in a way that is impossible for the picture to be seen, there definitely is intentional failure, but there is no figurative mispresentation. Second, alleged cases in which one literally sees in a picture something that does not match what the picture presents are not cases of figurative presentational failure either. (shrink)

Não se trata de determinar as crenças do filósofo, senão de situar, no âmbito da tradição, os conteúdos doutrinais e/ou poéticos expressados nesta parte fundamental do seu poema, para fazer ver o que têm de poderosamente originais e, em consequência, tratar de determinar o significado do proêmio no conjunto da obra. Desde la perspectiva de las ciencias jurídicas y, en particular, del derecho internacional ambiental, la presente intervención aborda la emergencia de un Derecho internacional contemporáneo y acude a las ideas del cosmopolitismo blando y la vertiente normativa del constitucionalismo global, como debates filosóficos-jurídicos que podrían cimentar un terreno fértil, un sustrato material, para incidir en las fuentes formales de creación de normas internacionales para enfrentar los problemas globales ambientales. En ese sentido, hace mención a la emergencia y reconocimiento del derecho (...) humano al ambiente sano y saludable como un derecho humano autónomo y exigible, desde su vertiente sustantiva y procesal, lo que puede vislumbrase como el embrión de una ciudadanía global ambiental. A theory of intentionality is outlined, in which the desideratum that the intentional be the same as the real object is argued for in terms of an anti-realist ontology. According to such an ontology, an ordinary object is in itself an object of discourse taken as intentional when posited phenomenologically and as possible when posited naturalistically, i.e. as not existing in some possible worlds but as existing in others. If the actual world is included among the latter, the object deserves (...) to be called "rear". Qua possible object, it answers to a principle of individuation which also works as a criterion of discrimination. According to such a principle, any possible object has a counterfactual individualising property which takes substance plus origin in a given spacetime as the object's essential properties, where it exists. It is, moreover, an object of discourse insofar as it generically depends, for its own being, on a singular term being publicly used to refer to it. (shrink)

The paper attempts at yielding a language-independent argument in favour of fictional entities, that is, an argument providing genuinely ontological reasons in favour of such entities. According to this argument, ficta are indispensable insofar as they are involved in the identity conditions of semantically-based entities we ordinarily accept, i.e. fictional works. It will also be evaluated to what extent this argument is close to other arguments recently provided to the same purpose.

In this paper, I want to claim that, in conformity with overall intuitions, there are some aesthetic properties that are perceivable. For they are high-level properties that are not only grasped immediately, but also attended to holistically—just like the grouping properties they depend on and that are responsible for the Gestalt effects or switches through which they are grasped. Yet, unlike such grouping properties, they are holistically attended to in a disinterested modality, where objects and their properties are regarded for (...) their own sake. (shrink)

According to an intuitive claim, in saying that one sees a picture's subject, i.e., what a picture presents, in the picture's vehicle, i.e., the picture's physical basis, by ‘in’ one does not mean the spatial relation of being in, as holding between such items in the real space. For the picture's subject is knowingly not in the real space where one veridically sees the picture's vehicle. Some theories of pictorial experience have actually agreed with this intuition by claiming that the (...) picture's subject lies in a pictorial space of its own, disconnected from the real space that includes the picture's vehicle. Yet, not only linguistic evidence suggests that when used as above, ‘in’ means precisely that very relation, but an appropriate theory of pictorial experience can justify the above claim. (shrink)

RESUMO O objetivo deste artigo é analisar a concepção de liberdade encontrada em "Discourses concerning government" de Algernon Sidney. Mantendo a perspectiva republicana, a liberdade é definida pela ausência de dominação, ou seja, pela não submissão, sujeição ou exposição à vontade arbitrária de outra pessoa; e assumindo a perspectiva jusnaturalista, a liberdade é considerada um direito natural, inerente à condição humana, que deve ser preservado e assegurado pela autoridade política. Pretende-se discutir como Sidney articula essas duas perspectivas em sua teoria (...) política, projetando a concepção republicana de liberdade na modernidade.ABSTRACT The objective of this paper is to analyze the concept of freedom found in Algernon Sidney’s "Discourses Concerning government". Keeping the republican thought, freedom is defined by the absence of domination, i.e., the denial of submission, bondage or exposure to the arbitrary will of another person; and taking the jusnaturalist thought, freedom is considered a natural right inherent to the human condition, which must be preserved and guaranteed by the political authority. This essay attempts to offer some reflections on what it is that Jacques Derrida found uncomfortable in Martin Heidegger’s thought at the level of fundamental gestures. The region of disagreement is located in Derrida’s self-identification in a marrano register at an autographic level. This paper studies the notions of propriation and expropriation in Heidegger’s late texts and compares them to Derrida’s ‘uncanny propriation’ as a marrano notion. I offer four propositions regarding Derrida’s marranismo, which I align with Derrida’s proposal for (...) desecularization, tentatively described as a ‘messianic engagement with the khora’. I conclude with a proposal for the development of ontic models of marrano action that would antecede the theory/practice divide. (shrink)

Once one draws a distinction between loyal non-existent items, which do not exist in a non-universal sense of the first-order existence predicate, and non-items, which fail to exist in a universal sense of that predicate, one may allow for the former but not for the latter in the overall ontological domain, so as to adopt a form of soft Parmenideanism. There are both theoretical and empirical reasons for this distinction.

In any kind of evolution, the transitions from simplicity to complexity and from indistinctness to distinctness follow strictly similar courses. Three phases are recognizable: a pre‐apogean phase of slow enrichment, an apogean phase of original polymorphism, and a post‐apogean phase of segregation and specialization. It is necessary to distinguish between:1. the archaic simplicity of truly primitive forms and secondary simplicity of impoverished and specialized forms;2. original polymorphism and secondary polymorphism due to hybridization. This paper reconstructs the natural philosophical method of Geminiano Montanari, one of the most prominent Italian natural philosophers of the late seventeenth century. Montanari’s views are used as a case study to assess recent claims concerning early modern experimental philosophy. Having presented the distinctive tenets of seventeenth-century experimental philosophers, I argue that Montanari adheres to them explicitly, thoroughly, and consistently. The study of Montanari’s views supports three claims. First, experimental philosophy was not an exclusively British phenomenon. Second, in spite of (...) some portrayals of experimental philosophy as an ‘atheoretical’ or ‘purely descriptive’ enterprise, experimental philosophers could consistently endorse a variety of natural philosophical explanations and postulate theoretical entities. Third, experimental philosophy and mechanical philosophy were not, as such, antagonistic. They could be consistently combined in a single philosophical enterprise. (shrink)

The author presents his views on the factors that led the Church to dialogue with Jews, after a history marked by Catholic rule and persecution of the Jewish people. Also exposes some biblical Jewish contribution to the topic such as technic of discussion / study called pilpul and the content of extensive discussions found in the Talmud, that demonstrate the central role that dialogue and philosophical inquiry have in Judaism. It also adds the contemporary Jewish contributions to the universal thought (...) made by the philosophy developed by the Jewish thinker Martin Buber, corroborating the central and uninterrupted place of dialogue in Judaism since its birth. Throughout the presentation connections are made with the Nostra Aetate Declaration, showing the Church key position in the theme of dialogue with the Jews and the 10 points of Seelisberg and the “12 points of Berlin”, result of the interaction between Christians and Jews after the Holocaust. Antonio Rosmini-Serbati was one of the first natural law scholars to bring natural law thinking into a conversation with the market economic order that was beginning to emerge in Europe in the 19th century. His reflections on matters such as the origin, nature, and limits of private property, the role of the state, and the nature of human reason show him to be a unique, innovative thinker who nonetheless was determined to work within the parameters of Catholic doctrine.
