This research paper focuses on the comprehensive description and analysis of the structure of judgments from the Court of Justice of the European Union (CJEU). Despite the growing interest in examining the rhetorical and linguistic aspects of legal texts, the genre structure of judgments has remained a little-explored area. While headings and paragraph enumeration provide a systematic reference system for citation and cross-referencing they do not reveal the dynamic relations between individual text chunks in judgments. The current analysis combines Swales (...) and Bhatia's genre theory with Hoey's approach to patterning in discourse and corpus linguistics analyses. The findings show that the complexity of CJEU judgments extends beyond surface-level information with linguistic expressions playing a crucial role in highlighting dynamic relations and discourse patterning. The results reveal how the structure of CJEU judgments has changed over time and point to the intratextual relations between different sections. Additionally, the study provides a detailed description of the textual organisation of CJEU judgments in terms of move structures and conventionalised discourse patterns. (shrink)

Jung's affirmation of the plausibility of intuitionism seems to be a final blow to all forms of postmodern and skeptical accounts of antifoundationalist forms of ethical theories; he successfully defends an intuitionist account of morality against its naturalist and religious critics.The last chapter offers three types of relationship between commonsense morality and Christian morality. The identity model reduces Christian morality to commonsense morality. The two-tier model considers Christian morality to be a superior form of morality with instrumental value of commonsense morality. And, finally, integration, Jung's favorite model, considers commonsense morality as neither identical nor subordinate but central to Christian morality (163). With this he affirms that Christian morality is unique not because of differences in moral beliefs but because "it is fully committed to recognizing the oneness of humanity and the universally accessible nature of basic moral truths for all human beings" (166). Jung's reflection is exceptionally insightful. Building the case as a good lawyer, he leads us to the defenseless nature of constructivist postmodern moral theories and their revisions as well as to a commitment of Christian morality to the objective commonsense morality. On this view, even heroic moral acts based on obedience to God (such as Christian sacrificial love) might be compatible with commonsense morality. It is surprising, however, that Jung never consulted or quoted Bernard Gert's account of the common morality, especially when discussing differences between moral duty and ideals (167). The Laozi expounds a thoroughgoing and sustained criticism of government and society. In this paper, I will demonstrate that although this criticism is addressed to the ancient Chinese state, it can also have some validity for the modern state of today. I will first briefly discuss the metaphysical grounds of this criticism and stress that the ruler should use wuwei in governing. Then, I will examine the Laozi’s criticism of the oppressive governments that use unnatural governing through youwei which increases (...) the state disorder, as well as how this criticism is supported by its metaphysical grounds. Third, I will show that the selfish desires may significantly contribute to the state disorder and that the only one to be blamed for the arousing of them is the ruler. At last, I will attempt to show that this criticism may also to a certain extent be directed toward today’s modern state. (shrink)

This article explores three dimensions of the current state of gender equality in Serbia: public policy on gender equality, public opinion on gender equality and the context of Serbia’s accession to the EU. Using data from the recent public opinion survey of citizens’ attitudes towards gender equality, the authors address the following issues: harmonization of public policy on gender equality in Serbia with EU policies; differences between public policy on gender equality in Serbia and citizens’ preferences; convergences/divergences between citizens of (...) Serbia and EU citizens regarding gender equality. As Serbia’s policy of promoting gender equality in the last decade has been dominated by the political goal of accession to the EU, it shows where the opinions converge, and where there are certain differences. The authors show the complexity of ideological positions among average Serbian citizens, while highlighting different paradigms in the official public policy on gender equality. While Serbian citizens still do not place gender equality high on their political agenda, they are convinced that it has a certain value, which does provide some important pointers for the future. Between the two World Wars, in Belgrade and Serbia, seven musical journals were published:?Musical Gazette?,?Music?,?Herald of the Musical Society Stankovic?,?Sound?,?Journal of The South Slav Choral Union?,?Slavic Music? and?Music Review?. The influence of marxism can be observed in?Musical Herald?,?Sound? and?Slavic Music?. A Marxist influence is obvious through indications of determinism. Namely, some writers observed elements of musical art and its history as consequences of sociopolitical and economic processes. Still, journals published articles of domestic and foreign authors who interpreted the relation between (...) music, society and economy in a much more moderate and subtle manner. Editors and associates of these journals also had proscriptive ambitions - they recommended and even determined regulations for composers about what kind of music to write according to social goals and needs. According to tendencies in Marxism, there was a follow up of musical work in the Soviet Union. Editors tried not to be one-sided. There were writings about the USSR by left orientated associates as much as emigrants from that country, and articles of Soviet authors were translated. Also, there were critical tones about musical development in the first country of socialism. Serbian musical periodicals recognized the enormous threat from fascism. Also, there were articles about influence of Nazi ideology and dictatorship on musical prospects in Germany. Since Germany annexed Sudetenland in 1938,?Musical Herald? expressed support to musicians and people of that friendly country by devoting the October and November 1938 issue to Czechoslovak music, along with an appropriate introduction by the editor, Stana Djuric-Klajn. The aim of the paper is to suggest that the traditional understanding of Leibniz as a pluralist or parallelist, though not completely untrue, is not always completely revealing and fruitful concerning its possible value for the philosophy of the mind. This paper will use the concept of hyperreality to compare the so-called ideal state described by ancient Chinese philosopher Laozi with the world of The Truman Show. The concept of hyperreality is defined by Jean Baudrillard as the generation by models of a real without origin or reality. A hyperreal world is a simulation, or kind of a copy without its original. It is generally accepted, and confirmed by Baudrillard himself, that the world of The Truman Show is hyperreal. In (...) order to compare Laozi’s ideal state with the world of the film, this paper will give a hyperrealist interpretation of the former, which will be only hypothetical, without intending to substitute any other existing interpretations. Laozi imagines that people live simple lives, with few desires and without traveling to other places. If we accept that the ideal state is a hyperreal world, we can make comparison between the two worlds; find out their similarities, as well as differences. (shrink)

As a counterpoint to demonstrative proofs in metaphysics, Robert Nozick presented the case for God’s existence based on the value of personal experiences. Personal experiences shape one’s life, but this is even more evident with extraordinary experiences, such can be religious ones. In the next step, says the argument, if those experiences can be explained only by invoking the concept of the Supreme Being, then God exists. The second step mirrors scientific explanation constituting what Nozick calls the “argument to the (...) best explanation.” The argument is set against the background of Nozick’s methodology which rejects demonstrative proofs in metaphysics. Its purpose is threefold. It aims to establish a certain sort of experience (religious/spiritual) as a legitimate basis for the argumentation; it aims to show that it is not philosophically blasphemous to explain such experiences by introducing a concept of divinity. Finally, it seeks to showcase the non-dogmatic, investigative nature of the argument. By exploring the merits of Nozick’s proposal, I will try to elucidate all three components, which should pave the way for a broader discussion on the role of non-demonstrative arguments in metaphysics. There is a widespread belief in Hinduism that Vyāsa, the alleged editor of the Vedas and author of the Mahābhārata, is identical with Bādarāyaṇa, the author of the Brahma-sūtra. The identification of these two mythic characters, however, originated between 800–980 CE, after the likes of Śaṅkara, Padmapāda, and Bhāskara, but before Vācaspati Miśra, Prakāśātman, Sarvajñātman, and Yāmuna. The purpose of this paper is to understand how and why such identification took place. The argument developed here is that the Bādarāyaṇa-Vyāsa identity (...) was invented by the author of or community behind the Bhāgavata Purāṇa as part of a complex of self-representation strategies. The Bhāgavata intentionally makes itself a work of Vedānta, indeed the Brahma-sūtra itself, over which it builds a new soteriology that is centered on the idea of bhakti. Two factors in particular stand out in light of the Bhāgavata’s Vedāntic background: Vyāsa’s paradigmatic character as the preserver of old dharma and the innovator, visionary, of new soteriologies; and the image of Vyāsa’s son Śuka as the model ascetic and ideal candidate for the new soteriological vision, through whom the Bhāgavata community chose to represent itself. The need for philosophical practice to integrate various methods, both conceptual and those based on the use of emotions, raises the question as to whether its methodology is necessarily eclectic, in terms of the collection of various methodologies used in philosophy, or whether there is a way to move beyond eclecticism. This is the main subject of this paper. In other words, the question is whether there is such a thing as an ‘integrative’ methodology and, if so, what distinguishes such (...) a method from mere eclecticism. In this text, we define the methodological procedure of integrativeness as the process of systematizing perspectives into an orientational answer to the demands of a specific problem. What differentiates such an approach from mere summation is a new contribution that results from a synergistic and systematic meeting of positions and argumentations whose final result differs from its initial elements. Diversity in the form of a multidimensional relationship towards life and the world results in numerous perspectives, which is a value that should be cultivated and integrated into a reflective and actional perception of the world. In this paper, the authors first emphasise the connection that exists between bioethics and law. However, special attention is given to the link between bioethics and human rights, which share the idea of protecting similar values, especially the protection of life and human dignity. Identifying the interdependence and interrelation of these concepts is a prerequisite for further exploration of how and in what context the European Court of Human Rights decides on bioethical issues it encounters when ruling on classical human (...) rights guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms. Once the important features that determine the relationship between bioethics and human rights are identified, these features will be practically examined through the group of cases in which the Court has addressed the issue of mandatory vaccination, which has been in the public spotlight in recent years. Mogućnost samouništenja čovečanstva čini stalnu prateću temu u svim knjigama Svetozara Stojanovića napisanim posle njegovog doktorata o metaetici. Kakve god da su teme inače obrađivane, našlo bi se ponešto i o ovome, isprva kao usputno zapažanje i mogući ugao gledanja na glavnu temu, a kasnije, sve više kao posebna oblast razmatranja ili čak kao vodeća perspektiva. U ovom radu rekonstruišem Stojanovićevo tretiranje ove teme. Pošto je kod Stojanovića reč o apokalipsi u sekularnom smislu, ja za nju predlažem, u otvorenoj protivrečnosti (...) sa izvornim značenjem reči, izraz apokalipsa bez otkrivenja. Reč je o apokalipsi u kojoj je preostao samo još kataklizmički aspekt, i utoliko ovaj izraz dobro sledi Stojanovićeve izvorne intencije. U radu izlažem i komentarišem sve faze Stojanovićevog rada na ovoj temi tvrdeći da ona čini jedinu konstantu u filozofskim i političkim menama njegovog mišljenja. (shrink)

A comparison of Sidgwick?s and Kant?s approach to the problem of the dualism of practical reason is presented only in general terms, but the author concludes that this is sufficient for grasping the advantage of Kant?s solution to the problem.

How can performance transform places of urban renewal and regeneration? What does performance contribute to the creation of community? These are some of the questions addressed in this study of the relationship of performance to urban space. Marrying theory with a series of international case studies of performance practice and interviews with practitioners, this interdisciplinary study examines how space is performatively produced to create a sense of 'placeness'. The paper explores the extent to which Epicurean ethics as a general philosophy of life can be integrated in a composite pragmatist approach to philosophical counseling. Epicureanism emerged in a historical era that was very different from the modern time and addressed a different philosophical ethos of the time. This alone makes it difficult for Epicureanism to satisfy all of the normative criteria for a modern ethics. On the other hand, the paper discusses aspects of the modern ‘external’, duty- and (...) demand-driven ethics that may contribute to the emergence of some of the main issues for modern philosophical counseling. The author points out aspects of Epicurean ethics that are potentially powerful tools to address the issues of mood and meaning in philosophical counseling, and thus serve as a contemporary complement to a complex duty-bound, yet pragmatist view of ethics. There are two reasons why Christian theology introduces the concept of the absolute nothing into its doctrine of creation. Firstly, unlike platonic non-being, the absolute nihil is not eternally co-existent with God and it does not limit His creative freedom. We notice that God’s freedom is identified with the freedom to create. Platonic non-being represented a necessity. To create, therefore, means to be able to overcome every form of necessity. The concept of the absolute nothing, therefore, needs to provide an (...) ontological ground for the creation of the absolute novum. Sergius Bulgakov and Nikolai Berdyaev, the authors I am quoting in this essay, agree that the apology of the world is inconceivable on the level of monistic ontology, for which substance or ousia is the main category. They are aware that simultaneous communion and otherness between God and the world is imaginable only on the level of the person or hypostasis. Christian theology introduces absolute nothing to secure God’s creative freedom. God is free if He can overcome givenness and create a newness in being. But Bulgakov stresses that to “create out of nothing” means that God creates out of Himself. God can create only what is already given in Him. Berdyaev’s God does not create out of Himself but out of uncreated freedom. Berdyaev explicitly confirms uncreatedness of freedom by stressing that this freedom is outside of God. This is why God can break through the givenness of the world and create an absolute newness. (shrink)

The relationship of tradition towards Bruno is twofold, and the analysis of this relationship will show that Bruno is interpreted either as a pioneer of new science or as a mystic, mage, and follower of hermetic tradition. Following these two viewpoints, Bruno’s ars memoriae will be interpreted either as a mere memory technique in the service of empirical science or as an occult, magical art. This paper aims to open up and analyse the ways by which we can approach and (...) understand Bruno and his method, that goes beyond the mentioned strict division. In the period of Renaissance, which represents an incredible combination of tradition and the new, magic and science do not exclude one another; in search for knowledge, each method finds its proper place. Ars memoriae is precisely that: a universal method that allows knowledge to be understood in its multiplicity. In this paper, we will present some of the key elements of Bruno’s philosophy, by exploring different interpretations and perspectives, and show why Bruno was understood and interpreted in the way in which he was and why is it necessary to access the ars memoriae by striving to unite scientific and magical elements. In Bruno’s thought there are many places where scientific and magical are not only not opposed to each other, but are complementary, and represent an inseparable whole within which knowledge is commonplace both to former and latter. The task, therefore, is not to analyse ars memoriae in detail, but to examine possible approaches to that method. Understanding of Bruno depends upon understanding his method of ars memoriae. This paper analyzes the notion of recollection in Hans Georg Gadamer and Paul Ricoeur?s thought, in the context of time distance as?obstacles? towards understanding the past. Particular attention is paid to the understanding the phenomenon of?Death? as a time gap between the past and the present. In connection with this problem, we find efforts of philosophical hermeneutics on the one hand and historicism on the other. Differences between historicism and hermeneutics can be outlined in relation to the role that memory (...) plays in the process of understanding in Gadamer and Ricoeur. What does Death mean in terms of understanding for history, and what for hermeneutics? How can we understand temporal distance? Is it possible and necessary to overcome it? What is the role of recollection and how does it participate in understanding? - these are some of the main issues that will be addressed in the text. Finally, the task of the text is to offer the meaning and significance of the hermeneutics of recollection in relation to the mentioned questions, through the interaction of the thoughts of the two authors. One facet of Stefan Lorenz Sorgner’s scholarship is immediately visible in his diligent academic production: the 21st Century is a leading spatio-temporal unit of his analyses. Although such assessment could be considered a rough generalization, it should not be taken for granted. To be placed in the contextual core of the current epoch is of particular relevance with respect to multiple academic trajectories Sorgner navigates and is almost always an achievement rather than an expected, ready-made content. Namely, more often than (...) not, especially in authorship with transhumanist labels, the temporal and conceptual curves are not subtly controlled and fine-tuned into a well-balanced thinking product that contributes to facing the current and potential issues of the relatively near and projectively feasible futures. Such gross asymmetry has various dangerous consequences Sorgner unequivocally warns about, opting deliberately to be an active chronicler of the ‘history of the present’ instead. This approach entails the dismissal of ‘guaranteed’ futurity vectors, be it Christian linearity or Kurzweilian exponentiality, but no less of petrified presentism or conventional historical layers of any inherited anthropology and the specific ethical account it is built upon. The article examines the patient-doctor relationship, relying on Michel Foucault’s concept of the clinical gaze. We argue that during the last decades, a profound transformation of the social nature of medicine took place, one that Foucault’s understanding of the clinical gaze cannot adequately account for. First, the article offers an elaboration of the three-node network of clinical gaze, the clinic, and nosology to explain the positioning of the doctor and the patient within the specific social ontology generated by the rise (...) of medicine. We then discuss intensive but irresolute developments brought by technological advancements, especially the X-ray tube. Finally, we argue that in the contemporary clinic, equipped with a plethora of sophisticated devices, the position of the doctor endured the most radical transformation in comparison with Foucault’s proponent of the clinical gaze at the dawn of modern medicine.
