Benjamin’s Critique of Violence (1921) has been a relevant source of legal and political philosophy about the nature of law, from Derrida to Menke. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. ABSTRACT For Victoria Kahn, Hobbes' argument that fear of violent death is “the passion to be reckoned upon” in explaining what inclines men to peace must be interpreted as a mimetic argument. However, Kahn then notes a paradox that makes Hobbes' thinking problematic: whereas love and the desires are appetites that produce an imitative effect, fear is different. Though also a passion, fear lacks that capacity to produce a mimetic effect or, therefore, to generate a contract. My hypothesis is that (...) resolving the dilemma presented in Kahn's interpretation of Hobbes requires a shift in attention from mimesis to rhetoric and, more specifically, to biological rhetoric as defined by Nancy Struever. This approach to Hobbes makes it possible to understand the rhetorical role of fear in generating and maintaining the social contract, and how the problem that Kahn signals—the impotence of fear in relation to mimesis—can be resolved. First, his philosophical project can be described as the construction of a formal ethics, grounded upon the transcendence of the other human being and a subject's spontaneous responsibility toward that other. Second, Levinas has (...) written extensively on, and as a member of, the cultural and textual life of Judaism. These two concerns are intertwined. Their relation, however, is one of considerable complexity. Levinas' philosophical project stems directly from his situation as a Jewish thinker in the twentieth century and takes its particular form from his study of the Torah and the Talmud. It is, indeed, a hermeneutics of biblical experience. If inspired by Judaism, Levinas' ethics are not eo ipso confessional. What his ethics takes from Judaism, rather, is a particular way of conceiving transcendence and the other human being. It owes to the philosophy of Franz Rosenzweig and Martin Buber a logos of the world and of the holy, which acknowledges their incom mensurability without positing one as fallen and the other as supernal. Beauchamp and Childress’ definition of autonomous decision‐making includes the conditions of intentionality, understanding, and non‐control. In genetics, however, a relational conception of autonomy has been increasingly recognized. This article aims to empirically assess aspects of social influence in genetic testing decision‐making and to connect these with principlist and relational theories of autonomy. We interviewed 18 adult genetic counsellees without capacity issues considering predictive genetic testing for cancer predisposition for themselves and two counselling physicians in Switzerland. We conducted a qualitative analysis, (...) building on a grounded theory study about predictive genetic testing decision‐making. We found that some participants agreed to predictive genetic testing predominantly because relatives wanted them to do it, with some even acting contrary to their own convictions. Others, in contrast, based their decision on purely individualistic reasons but expressed difficulties in explaining their decision to their social environment. Healthcare professionals had a critical influence on decision‐making in many cases without being manipulative, as perceived by counsellees. Still, cases of coercion and social pressure occurred within social relationships. In conclusion, predictive genetic testing decision‐making includes relational and individualistic aspects, and both are compatible with autonomous decision‐making. While the principlist and relational notions of autonomy compete on a theoretical level, they are two sides of the same coin when used as analytical lenses for genetic testing decision‐making. Social acceptance of refusal of testing should be improved to mitigate social pressure. Individuals should be encouraged to decide for themselves how much their social environment influences their decision regarding predictive genetic testing. (shrink)

The term ‘locked-in’ syndrome (LIS) describes a medical condition in which persons concerned are severely paralyzed and at the same time fully conscious and awake. The resulting anarthria makes it impossible for these patients to naturally communicate, which results in diagnostic as well as serious practical and ethical problems. Therefore, developing alternative, muscle-independent communication means is of prime importance. Such communication means can be realized via brain–computer interfaces (BCIs) circumventing the muscular system by using brain signals associated with preserved cognitive, (...) sensory, and emotional brain functions. Primarily, BCIs based on electrophysiological measures have been developed and applied with remarkable success. Recently, also blood flow–based neuroimaging methods, such as functional magnetic resonance imaging (fMRI) and functional near-infrared spectroscopy (fNIRS), have been explored in this context. After reviewing recent literature on the development of especially hemodynamically based BCIs, we introduce a highly reliable and easy-to-apply communication procedure that enables untrained participants to motor-independently and relatively effortlessly answer multiple-choice questions based on intentionally generated single-trial fMRI signals that can be decoded online. Our technique takes advantage of the participants’ capability to voluntarily influence certain spatio-temporal aspects of the blood oxygenation level–dependent (BOLD) signal: source location (by using different mental tasks), signal onset and offset. We show that healthy participants are capable of hemodynamically encoding at least four distinct information units on a single-trial level without extensive pretraining and with little effort. Moreover, realtime data analysis based on simple multi-filter correlations allows for automated answer decoding with a high accuracy (94.9%) demonstrating the robustness of the presented method.. This paper explores two main methods, employed for the analysis of regulatory law, empirical and systems-theoretical approaches. These two approaches are often portrayed in the literature as very different, mainly for two reasons. First, it is contended by some authors that systems-theoretical approaches—in contrast to empirical approaches—do not see a role for individuals in shaping social reality and regulatory law as one aspect of it. This paper, however, claims that systems-theoretical accounts do provide for human agency while empirical accounts have (...) limitations in their analysis of the role of ‘real individuals’ in shaping regulatory law. The paper argues that both empirical and systems-theoretical approaches need to provide a deeper analysis of the notion of ‘the individual’. This requires taking into account how ‘feeling rules’ influence the management of emotions. Secondly, empirical and systems-theoretical approaches are portrayed as distinct because they are considered as employing different methodologies. While systems theory involves speculative grand theory, empirical approaches are based on specific techniques of empirical data collection and analysis. This paper argues, however, that systems-theoretical ideas on how knowledge about the social world can be generated are close to qualitative empirical approaches, which stress the relativity and subjectivity of the meaning systems of the particular actors studied. This book consists of transcripts from two lecture courses Levinas delivered in 1975-76, his last year at the Sorbonne. They cover some of the most pervasive themes of his thought and were written at a time when he had just published his most important—and difficult—book, _Otherwise than Being, or Beyond Essence._ Both courses pursue issues related to the question at the heart of Levinas's thought: ethical relation. The Foreword and Afterword place the lectures in the context of his work as (...) a whole, rounding out this unique picture of Levinas the thinker and the teacher. The lectures are essential to a full understanding of Levinas for three reasons. First, he seeks to explain his thought to an audience of students, with a clarity and an intensity altogether different from his written work. Second, the themes of God, death, and time are not only crucial for Levinas, but they lead him to confront their treatment by the main philosphers of the great continental tradition. Thus his discussions of accounts of death by Heidegger, Hegel, and Bloch place Levinas's thought in a broader context. Third, the basic concepts Levinas employs are those of _Otherwise than Being_ rather than the earlier _Totality and Infinity_: patience, obsession, substitution, witness, traumatism. There is a growing recognition that the ultimate standing of Levinas as a philosopher may well depend on his assessment of those terms. These lectures offer an excellent introduction to them that shows how they contribute to a wide range of traditional philosophical issues. (shrink)

Mhealth technology is mushrooming world-wide and, in a variety of forms, reaches increasing numbers of users in ever-widening contexts and virtually independent from standard medical evidence assessment. Yet, debate on the broader societal impact including in particular mapping and classification of ethical issues raised has been limited. This article, as part of an ongoing empirically informed ethical research project, provides an overview of ethical issues of mhealth applications with a specific focus on implications on autonomy as a key notion in (...) the debate. A multi-stage model of references to the potential of mhealth use for strengthening some or other form of self-determination will be proposed as a descriptive tool. It illustrates an assumed continuum of enhanced autonomy via mhealth broadly conceived: from patient to user autonomy, to improved health literacy, and finally to the vision of supra-individual empowerment and democratised, participatory health and medicine as a whole. On closer examination, however, these references are frequently ambivalent or vague, perpetuating the at times uncritical use of established autonomy concepts in medical ethics. The article suggests zooming in on the range of autonomy-related aspects against the backdrop of digital innovation and datafied health more generally, and on this basis add to existing frameworks for the ethical evaluation of mhealth more specifically. We consider the problem of choosing the location of a public facility either (a) on a tree network or (b) in a Euclidean space. (a) (1996) characterize the class of target rules on a tree network by Pareto efficiency and population-monotonicity. Using Vohra's (1999) characterization of rules that satisfy Pareto efficiency and replacement-domination, we give a short proof of the previous characterization and show that it also holds on the domain of symmetric preferences. (b) The result obtained for model (a) (...) proves to be crucial for the analysis of the problem of choosing the location of a public facility in a Euclidean space. Our main result is the characterization of the class of coordinatewise target rules by unanimity, strategy-proofness, and either replacement-domination or population-monotonicity. (shrink)

School psychologists are asked to systematically evaluate the effects of their work to ensure quality standards. Given the different types of methods applied to different users of school psychology measuring the effects of school psychological services is a complex task. Thus, the focus of our scoping review was to systematically investigate the state of past research on the measurement of the effects of school psychological services published between 1998 and 2018 in eight major school psychological journals. Of the 5,048 peer-reviewed (...) articles published within this period, 623 were coded by two independent raters as explicitly refering to school psychology or counseling in the school context in their titles or abstracts. However, only 22 included definitions of effects of school psychological services or described outcomes used to evaluate school psychological services based on full text screening. These findings revealed that measurement of the effects of school psychological services has not been a focus of research despite its' relevance in guidelines of school psychological practice. Numerous studies argue that perceived group deprivation is a risk factor for radicalization and violent extremism. Yet, the vast majority of individuals, who experience such circumstances do not become radicalized. By utilizing models with several interacting risk and protective factors, the present analysis specifies this relationship more concretely. In a large United Kingdom nationally representative survey, we examine the effects of group-based relative deprivation on violent extremist attitudes and violent extremist intentions, and we test whether this relationship is contingent upon (...) several individual differences in personality. The results show that stronger group-based injustices lead to increased support for and intentions to engage in violent extremism. However, some of the effects are much stronger for individuals who exhibit a stronger need for uniqueness and for status and who demonstrate higher levels of trait entitlement. Conversely, several effects are lessened for those individuals high in trait forgiveness, demonstrating a strong capacity for self-control and for those who are exerting critical as well as open-minded thinking styles, thus constituting buffering protective factors, which dampen the adverse effects of perceived group injustice on violent extremism. The results highlight the importance of considering the interaction between individual dispositions and perceptions of contextual factors the conditional and cumulative effects of various risk and protective factors and the functional role of protective factors when risk factors are present. Collectively, these findings bring us one step closer to understanding who might be more vulnerable to violent extremism as well as how. Overall, the study suggests that preventing and countering violent extremism programs must take account of the constellation of multiple factors that interact with one another and which can be targeted in preventions strategies. The aim of this book is to understand and critically appraise science-based transgression dynamics in their whole complexity. It includes contributions from experts with different disciplinary backgrounds, such as philosophy, history and sociology. Thus, it is in itself an example of boundary transgression. Scientific disciplines and their objects have tended to be seen as permanent and distinct. However, science is better conceived as an activity that constantly surpasses, erases and rebuilds all kinds of boundaries, either disciplinary, socio-ethical or ecological. The differences between the "habits of the heart" in German and U.S.-American corporations can be described by analyzing the way corporations deal with norms and values within their organizations. Whereas many U.S. corporations have introduced formal business ethics programs, German companies are very reluctant to address normative questions publicly. This can be explained by the different cultural backgrounds in both countries. By defining these different "habits of the heart" underlying German and American business ethics it is possible to show the (...) problems and questions within the intercultural management of values, but also the possible solutions. Goal-setting theory states that challenging, specific, and concrete goals (i.e., subordinate goals) are powerful motivators and boost performance in goal pursuit more than vague or abstract goals (i.e., superordinate goals). Goal-setting theory predominantly focuses on single, short-term goals and less on broad, long-term challenges. This review article extends goal-setting theory and argues that superordinate goals also fulfill a crucial role in motivating behavior, particularly when addressing broad, long-term challenges. The purpose of this article is to show theoretically that people pursue (...) long-term goals more successfully when they focus on subordinate and superordinate goals simultaneously than when they focus on either subordinate or superordinate goals alone. Although lie detection procedures have been fundamentally criticized since their inception at the beginning of the 20th century, they are still in use around the world. In addition, they have created some remarkable appeal in the context of counterterrorism policies. Thereby, the links between science and fiction in this topic are quite tight and by no means arbitrary: In the progressive narrative of the lie detection devices, there is a promise of changing society for the better, which is entangled in (...) a fictional narrative provided by many cinematic and literary examples. By drawing on the concept of “diegetic technologies” formulated by David Kirby, we want to highlight the role of science fictional narratives in the historical development and current application of lie detection procedures. We therefore aim to use this conceptual frame to analyze the role of prevention-oriented mind reading procedures, which are developed for or already used in the “war on terror” with reference to their fictional predecessors. One virulent factor has to be highlighted in this context: The fictional engagement with possible new lie detection practices is in itself creating a legitimating ground for future security technologies.
