Retrospective rule-making has few supporters and many opponents. Defenders of retrospective laws generally do so on the basis that they are a necessary evil in specific or limited circumstances, for example to close tax loopholes, to deal with terrorists or to prosecute fallen tyrants. Yet the reality of retrospective rule making is far more widespread than this, and ranges from ’corrective’ legislation to ’interpretive regulations’ to judicial decision making. The search for a rational justification for retrospective rule-making necessitates a reconsideration (...) of the very nature of the rule of law and the kind of law that can rule, and will provide new insights into the nature of law and the parameters of societal order. This book examines the various ways in which laws may be seen as retrospective and analyses the problems in defining retrospectivity. In his analysis Dr Charles Sampford asserts that the definitive argument against retrospective rule-making is the expectation of individuals that, if their actions today are considered by a future court, the applicable law was discoverable at the time the action was performed. The book goes on to suggest that although the strength of this ’rule of law’ argument should prevail in general, exceptions are sometimes necessary, and that there may even be occasions when analysis of the rule of law may provide the foundation for the application of retrospective laws. This book examines Australian spaces in feminist terms. Each chapter uses a different key feminist theoretical framework--liberal, socialist, radical, postmodern, and postcolonial--to generate a range of Australian feminist geographies.

Two experiments employed experience sampling to examine the factors associated with a prospective and retrospective focus during mind wandering. Experiment One explored the contribution of working memory and indicated that participants generally prospect when the task does not require continuous monitoring. Experiment Two demonstrated that in the context of reading, interest in what was read suppressed both past and future-related task-unrelated-thought. Moreover, in disinterested individuals the temporal focus during mind wandering depended on the amount of experience with the topic matter—less (...) experienced individuals tended to prospect, while more experienced individuals tended to retrospect. Together these results suggest that during mind wandering participants’ are inclined to prospect as long as the task does not require their undivided attention and raise the intriguing possibility that autobiographical associations with the current task environment have the potential to cue the disinterested mind. The decision to divorce marks a turning point for every individual involved. It can be viewed as more than just a legal process. From a psychological perspective, it does not matter who initiated the divorce, since it always comes with emotional ramifications for all those involved. Statistically, there is a high rate of divorce in South Africa and there have been significant shifts in trends over time. While black South African men’s experience of divorce has been relatively neglected in the (...) research on divorce, it is important for understanding contemporary social arrangements and processes, and, in particular, for broadening the understanding of black South African men’s lives. How black South African men describe their experience and respond to marital dissolution may point to their positions in the gender-structured community as well as illuminate how they interpret the nature of social practice, marriage, divorce and their position in society. The aim of the research reported on in this paper was to explore black South African men’s experience of divorce. The theoretical framework underpinning this qualitative study was broadly that of Symbolic Interactionism, with Interpretative Phenomenological Analysis employed as both the research design and data analytic theory and process. The eight participants were volunteers who were recruited purposively. In keeping with IPA guidelines, data-collection proceeded by means of biographical questionnaires and semi-structured interviews. The emerging themes were grouped into three superordinate themes, namely, perceptions of divorce, social support, and experiencing of pain. Each superordinate theme had corresponding subordinate themes and experiential claims. Weed’s recommendations for the interpretative synthesis of interview data were applied. (shrink)

Animal data suggest that jet fuels such as JP-8 are associated with hearing deficits when combined with noise and that the effect is more pronounced than with noise exposure alone. Some studies suggest peripheral dysfunction while others suggest central auditory dysfunction. Human data are limited in this regard. The aim of this study was to investigate the possible chronic adverse effects of JP-8 combined with noise exposure on the peripheral and central auditory systems in humans. Fifty-seven participants who were current (...) personnel from the Royal Australian Air Force were selected. Based on their levels of exposure to jet fuels, participants were divided into three exposure groups. Groups were also categorised based on their noise exposure levels. All participants were evaluated by tympanometry, pure-tone audiometry, distortion product otoacoustic emissions, auditory brainstem response, words-in-noise, compressed speech, dichotic digit test, pitch pattern sequence test, duration pattern sequence test and adaptive test of temporal resolution. All auditory tests were carried out after the participants were away from the Air Force base for a minimum of two weeks, thus two weeks without jet fuel and noise exposure. Jet fuel exposure was significantly associated with hearing thresholds at 4 and 8 kHz; average hearing thresholds across frequencies in the better ear; DPOAEs at 2.8, 4 and 6 kHz; ABR wave V latency in the right ear; compressed speech and words-in-noise. Further analyses revealed that participants with low exposure level to jet fuels showed significantly better results for the aforementioned procedures than participants with moderate and high exposure levels. All results were controlled for the covariates of age and noise exposure levels. The results suggest that jet fuel exposure, when combined with noise exposure, has an adverse effect on audibility in humans. Taking all the test results into consideration, jet fuel exposure combined with noise exposure specifically seems to affect the peripheral hearing system in humans. (shrink)

Preview: In this essay, drawing on the case of Australia in particular, we develop the argument of “schools for democracy” as part of communities that prioritize developing people’s civic agency for human flourishing. We begin with the concept of social capital – norms, values, and practices of trust and reciprocity essential to vibrant civic life and healthy democratic society – and discuss social capital’s decline in recent years as well as its relationship to what we call public work. Declining social (...) capital and growing demands for politicians and experts to “fix things” turn citizens into spectators, largely devoid of responsibility for addressing public challenges like AI and erode hope for the future. Here, we concentrate mainly on a specific danger related to this dynamic that threatens the cultural and social foundations of democracy and is directly connected to schools and their potential for addressing the danger: In the context of declining community life, social media and other digital platforms shaped by AI can spread an “us-versus-them” mindset that feeds polarization and inflamed divisions, far beyond the formal electoral system. Evaluative processes have their roots in early evolutionary history, as survival is dependent on an organism’s ability to identify and respond appropriately to positive, rewarding or otherwise salubrious stimuli as well as to negative, noxious, or injurious stimuli. Consequently, evaluative processes are ubiquitous in the animal kingdom and are represented at multiple levels of the nervous system, including the lowest levels of the neuraxis. While evolution has sculpted higher level evaluative systems into complex and sophisticated information-processing networks, they do not (...) come to replace, but rather to interact with more primitive lower level representations. Indeed, there are basic features of the underlying neuroarchitectural plan for evaluative processes that are common across levels of organization—including that of evaluative bivalence. (shrink)

Studies of the association between wealth and fertility in industrial populations have a rich history in the evolutionary literature, and they have been used to argue both for and against a behavioral ecological approach to explaining human variability. We consider that there are strong arguments in favor of measuring fertility (and proxies thereof) in industrial populations, not least because of the wide availability of large-scale secondary databases. Such data sources bring challenges as well as advantages, however. The purpose of this (...) article is to illustrate these by examining the association between wealth and reproductive success in the United States, using the National Longitudinal Study of Youth 1979. We conduct a broad-based exploratory analysis of the relationship between wealth and fertility, employing both cross-sectional and longitudinal approaches, and multiple measures of both wealth (income and net worth) and fertility (lifetime reproductive success and transitions to first, second and third births). We highlight the kinds of decisions that have to be made regarding sample selection, along with the selection and construction of explanatory variables and control measures. Based on our analyses, we find a positive effect of both income and net worth on fertility for men, which is more pronounced for white men and for transitions to first and second births. Income tends to have a negative effect on fertility for women, while net worth is more likely to positively predict fertility. Different reproductive strategies among different groups within the same population highlight the complexity of the reproductive ecology of industrial societies. These results differ in a number of respects from other analyses using the same database. We suggest this reflects the impossibility of producing a definitive analysis, rather than a failure to identify the “correct” analytical strategy. Background: There is a growing interest in using cognitive behavioural therapy with people who have Asperger Syndrome and comorbid mental health problems. Aims: To examine whether modified group CBT for clinically significant anxiety in an AS population is feasible and likely to be efficacious. Method: Using a randomised assessor-blind trial, 52 individuals with AS were randomised into a treatment arm or a waiting-list control arm. After 24 weeks, those in the waiting-list control arm received treatment, while those initially randomised to (...) treatment were followed-up for 24 weeks. Results: The conversion rate for this trial was high, while attrition was 13%. After 24 weeks, there was no significant difference between those randomised to the treatment arm compared to those randomised to the waiting-list control arm on the primary outcome measure, the Hamilton Rating Scale for Anxiety. Conclusions: Trials of psychological therapies with this population are feasible. Larger definitive trials are now needed. The rationale and actions of the BSHS in creating its Global Digital History of Science Festival may be a rare genuine confirmation of this mantra. The global COVID-19 pandemic of 2020 meant that the society's usual annual conference – like everyone else's – had to be cancelled. Once the society decided to go digital, we had a hundred days to organize and deliver our first online festival. (...) In the hope that this will help, inspire and warn colleagues around the world who are also trying to move online, we here detail the considerations, conversations and thinking behind the organizing team's decisions. The Internet has quickly gained popularity as a major source of health-related information, but its impact is unclear. Here, we investigate the extent to which advocacy websites for three neurodevelopmental disorders—cerebral palsy (CP), autism spectrum disorder (ASD) and fetal alcohol spectrum disorder (FASD)—inform stakeholders about treatment options, and discuss the ethical challenges inherent in providing such information online. We identified major advocacy websites for each disorder and assessed website accountability, the number, attributes, and accessibility of treatments described, and the valence (...) of treatment information. With the exception of FASD websites, we found that advocacy websites provide a plethora of information about a wide variety of readily available products and services. Treatment information is primarily targeted at families and is overwhelmingly encouraging, regardless of the type or conventionality of treatments. Many websites acknowledge corporate sponsors. While the majority do not overtly advertise or endorse specific brands, they also do not prominently display disclaimers about the nature and intent of treatment information. Thus, while advocacy websites are organized to serve as information clearinghouses, they implicitly appear to provide endorsement of selected treatments and services. We conclude with recommendations for new partnerships between government-funded health organizations, advocacy and investigators to make more transparent the role of online information in informing treatment options and improving the evaluation of information. With this issue we initiate the policy of expanding the scope of Tulane Studies in Philosophy to include, in addition to the work of members of the department, contributions from philosophers who have earned advanced degrees from Tulane and who are now teaching in other colleges and universities. The Editor THE LOGIC OF OUR LANGUAGE ROBERT L. ARRINGTON Wittgenstein wrote in the Tractatus that "logic is not a body of doctrine, but a mirror-image of the world. " 1 In line (...) with his suggestion that a proposition is a 'picture', Wittgenstein argued that propositions 'show' the logical structure of the real. He was insistent, however, that "the apparent logical form of a proposition need not be its real one. " 2 As a result of this we can misunderstand the structure of fact. Philosophical problems arise just when "the logic of our language is mis understood. " 3 It is common knowledge that much of this view of logic was rejected by Wittgenstein himself in the Philosophical Investi gations. There we are told that language has no ideal or sublime 4 logic which mirrors the structure of the extra-linguistic world. Consequently, inferences from the structure of language to the structure of that extra-linguistic world are invalid. Reality can be 'cut up' in any of a number of ways by language. Wittgenstein adopted a view of philosophy which would render that discipline a non-explanatory, non-critical study of the multiple ways in which language can be used. (shrink)

Well-Being in African Philosophy: Insights for a Global Ethics of Development, edited by Bolaji Bateye, Mahmoud Masaeli, Louise Müller, and Angela Roothaan, explores the notion of well-being in African and intercultural philosophy and its insights into global ethics of development. Drawing from longstanding debates on communitarianism in the context of personhood in African philosophy, as well as those in intercultural philosophy, the diverse contributors present manifold ways to philosophize about well-being from African contexts. Hailing from sub-Saharan Africa, Europe, and (...) the Middle East, they address questions of human well-being related to the major global challenges of our time, such as climate change and socio-economic, gender, and racial inequality in society, education, and organization. This collection, building on the work of African independence philosophers as well as oral traditions from a critical development studies perspective, offers fresh views on well-being, development, and morality, thus contributing to global ethics from an African vantage point. This paper is as much about a particular depiction of the tribune P. Sulpicius Rufus as it is about Cicero's De Oratore, a dialogue regularly called upon by historians to give evidence on the 90s b.c. and the characters who take part in the conversation it depicts. My main focus is literary: I will argue that, given what we know about the historical Sulpicius, Cicero's choice of Sulpicius for a prominent minor role in De Oratore drives the tragic historical framework (...) that undercuts the optimism expressed within the dialogue by the main protagonist L. Licinius Crassus for the civic value of oratory. The Rhetorica ad Herennium illustrates a certain type of allegory with the statement ‘as if one should call Drusus a “faded reflection of the Gracchi”’. In De Oratore, Drusus’ friend and successor Sulpicius functions as a reflection of the Gracchi and his eloquence reinforces the problem posed by such orators as the notoriously eloquent Gaius Gracchus for any such grand claims about the civic value of oratory. By examining Cicero's use of relatively recent history, we therefore discover that De Oratore is significantly more pessimistic than it may at first seem. This pessimism, however, has important implications for historians, since expanding our understanding of De Oratore as a literary construct should encourage historians to be significantly more cautious about using the text as a historical source. As Görler points out with regard to Crassus’ swansong at De or. 3.4–5, although ‘a naive reader of Oratorum Romanorum Fragmenta could be left with the impression that some sentences are quite well attested’, most of the fragments of Crassus’ speech can actually be traced back to De Oratore. Likewise, a significant proportion of the standard elements in Sulpicius’ backstory go back to De Oratore and become a great deal less convincing once we accept De Oratore as a sustained fictional account featuring people who were neither as politically ‘safe’ nor as intellectually united as Cicero would have them be. My secondary focus in this paper is therefore on the broader lessons to be drawn from Sulpicius’ role in De Oratore. I will begin by outlining the historical context of the dialogue, which was written in the mid 50s but is set in 91, a few weeks before the natural death of Crassus, one of its two protagonists. Next, I will discuss the dialogue's literary context, specifically the Platonic allusions Cicero embeds within the text. These allusions encourage us to treat De Oratore’s historical framework carefully, if not sceptically, and I will outline the ‘off notes’ struck by references to the Gracchi and by the presentation of Crassus and Antonius before examining the problem Sulpicius poses for a straightforwardly optimistic reading of De Oratore. I will conclude by considering first the literary implications for De Oratore of accepting that Sulpicius is a deliberately problematic character and then the historical implications of taking a sceptical approach towards De Oratore as an historical source for our picture of Sulpicius. Theories of signs, messages and documents need to evolve towards reflections on traceability. Traces are paradoxical objects: linked to the personal yet detachable, automatic yet malleable, they bear witness to the inextricable links between the technical and the political in the digital sphere. In an age of "customized information", personalization makes people more active, and also exposes them to profiling, to the point where identity is being redefined as a collection of traces which we must learn to protect, and also to manage. This new economy based on digital "footprints" is overturning the hierarchical relationships between stock and flow, and between content and interaction. As we ourselves recycle the traces that others have left, we are having to find our way through the shadowlands of digital citizenship. Over and above privacy protection, what is at issue are the memories, but also the forgetting, that bind us to each other. (shrink)

Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation (...) of knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)
