Social appropriateness is an important topic – both in the human-human interaction (HHI), and in the human-machine interaction (HMI) context. As sociosensitive and socioactive assistance systems advance, the question arises whether a machine’s behavior should include considerations regarding social appropriateness. However, the concept of social appropriateness is difficult to define, as it is determined by multiple aspects. Thus, to date, a unified perspective, encompassing and combining multidisciplinary findings, is missing. When translating results from HHI to HMI, it remains unclear whether (...) such insights into the dynamics of social appropriateness between humans may in fact apply to sociosensitive and socioactive assistance systems. To shed light on this matter, we propose the Five Factor Model of Social Appropriateness (FASA) which provides a multidisciplinary perspective on the notion of social appropriateness and its implementation into technical systems. Finally, we offer reflections on the applicability and ethics of the FASA Model, highlighting both strengths and limitations of the framework. (shrink)

This is a translation of the afterword of Legality and Legitimacy, rewritten by Carl Schmitt in 1958 for his collection Verfassungsrechtliche Aufsätze aus den Jahren 1924–1954. In the afterword, Schmitt once again describes the situation in Germany in the early 1930’s, and argues against the influential German lawyers who rejected his interpretation of the Weimar Constitution. He rejects the wide-spread opinion that he wanted a state of emergency in Germany to be introduced, and insists that this book was his (...) final attempt to rescue the presidential republic of Weimar Germany. Schmitt then demonstrates the weakness of legal positivism and specifically stops at the several key points in his argument. First, according to Schmitt, the positivists did not know that legality, an unopposed form of the manifestation of legitimacy, had originally been an essential part of Western rationalism. Second, it is necessary to distinguish between the law and the sanctions because of their different legal statuses. This distinguishing is important because the legislative state was gradually becoming the administrative state. As a result, the governing institutions are more powerful than the parliamentary laws. Any parliamentary decision providing executive bodies relevant authority cannot be executed without an effective parliamentary majority. Thirdly, Schmitt explores the question of the so-called “premiums” for the legal possession of power. The afterword concludes with a brief overview of the situation at the end of the January 1933. This paper provides a critique and re-evaluation of the way that ethics is understood and promoted within mainstream Human Resource Management (HRM) discourse. We argue that the ethics located within this discourse focuses on bolstering the relevance of HRM as a key contributor to organizational strategy, enhancing an organization's sense of moral legitimacy and augmenting organizational control over employee behaviour and subjectivity. We question this discourse in that it subordinates the ethics of the employment relationship to managerial prerogative. In response, (...) we suggest a different model of the relationship between ethics and HRM—one that finds the possibility of ethics in the contestation and destabilization of HRM. Such ethics arises through resistance to moral normalization and the constraint of freedom and difference. The contribution of our paper is in theorising the possibilities of a relationship between ethics and HRM that does not place HRM at its centre, as chief intermediary of the ethics of the employment relationship, but rather sees HRM as being a powerful player in a set of what Mouffe calls 'agonistic' socio-ethical relations. Moderate contextualism, according to which musical works are individuated by context of origin but not by context of reception, thus appears to be an unstable position. And, although a more thoroughgoing contextualism, according to which musical works are individuated both by context of origin and by context of reception, faces a (...) number of problems, it is nonetheless supported (at least to some extent) by critical practice. In this article I discuss the role of the immigrant in Swedish society and especially how such a role is construed through what I call the myth of schooling, that is, the normalization of an arbitrary distribution of wealth and power. I relate this myth to the idea of consensual democracy as it is expressed through an implicit idea of what it means to be Swedish. I not only critique the processes through which immigrants are discriminated against or excluded from (...) Swedish society but also try to shift the understanding of the conditions under which such exclusion is possible in the first place. Being Swedish is that which the immigrant is not. What I argue and give examples of is that the ‘no name’ immigrant becomes a possibility for democracy to happen when he or she claims his or her presence in the demos, in such a way as to make evident a split in the self‐understanding of a purely consensual Swedish democracy. In the article I argue that what is needed in order to go beyond the myth of schooling, is a pedagogy of dissensus contesting the normalizing of an unequal social order by making it contingent. This article uses the concept of partial organization to examine how organizing principles can facilitate the effective operation of networked forms of corruption. We analyze the case study of a corruption network in the South Korean maritime industry in terms of how it operated by selectively appropriating practices normally associated with formal bureaucratic organizations. Our findings show that organizational elements built into the corruption network enabled coordination of corruption activities and served to distort and override practices within member organizations. The (...) network was primarily organized through the hierarchical organization of a bounded and controlled set of members and, to a lesser extent, through processes of monitoring and sanctions. Given its clandestine nature, the network avoided the use of explicit rules to govern behavior, instead relying on habituated routines to ensure consistent and predictable action from members. We find that organizational elements were rescinded when the corruption network was exposed after the sinking of a passenger ferry, the Sewol. By rolling back its hierarchical organization and reverting to core relationships, the corruption network sought to preserve its center. The article illustrates the explanatory value of studying how the activities of corruption networks are enabled and adapt to existential challenges through partial organization. (shrink)

The teaching of ethics in science within the disciplines provides an avenue to deepen students’ scientific understanding and to develop their critical thinking skills. This study showcases a module which connects ethics to science within a large introductory geoscience course. The module components, a tutorial plus homework assignment and an exam question, require students to decide on ethical issues using a 5-step approach that mirrors the scientific decision-making process. The assignment is graded using a developed rubric. An analysis of exam (...) question responses reveals that students correctly identify stakeholders and mention contributions by geoscientists, but have difficulties recognizing their own assumptions. Furthermore, many acknowledge the complexity of the ethical issue at hand. The module provides an example of how disciplinary instructors can include ethics in their teaching and assess students’ ethical decision-making process. (shrink)

The work that we have the honour to present here in its first Italian translation is a short essay published by Carl Schmitt in the first half of the ‘10s in the German Journal Die Rheinlande and titled Don Quixote and the public. A very brief but at the same time dense piece of literary criticism in which the future Kronjurist of the Third Reich, in those years still engaged in his legal practice, offers to the readers a juvenile (...) proof of his vastly and heterogeneous interests, trying to determine which is the proper interpretation of the renowned masterpiece of Miguel de Cervantes: Don Quixote of the Mancha. A juvenile work, therefore, in which Schmitt, as we will try to highlight in the introduction that accompanies the translation, offers an interpretation of the novel and particularly of its main character focusing on the contraposition between the level of the simple reading and that of erudite valorisation, applying a methodology similar to that he used in the coeval Law and Judgement that in some ways anticipate the critique of Romanticism that he will develop just a few years later in Political Romanticism. Glossary occupies a specific place among diary notes of Carl Schnitt. Notes made in 1947-1961 are considered by publishers substantially valuable. In 1952-1958 records have become poor and the majority of them are composed from the press cutting with illegible stenographic commentaries. In 1991 Eberhard Freiherr von Medem published Glossary, that is the most interesting and valuable part was published in Duncker & Humblot. The book drew a wide response and became irreplaceable origin for all who are interested in (...) Schmitt. Starting with this issue we are going to publish selections of Schmitt’s records of various volumes which do not always fit together. In our opinion they are both of historical and theoretical interest. (shrink)

Many photographs seem to be images of absences: for instance, a photograph of a shadow seems to be an image of an absence, as shadows are plausibly thought of as being absences of light. Absence photography is puzzling, however, as, first, it is a common idea that photographs can only be images of things that have caused them, and, second, it is unclear whether absences can cause anything. The question “What makes a group of simultaneous experiences the experiences of a single person?” has been nearly ignored in the philosophical literature for the past few decades. The most common answer to this much neglected question is “Two simultaneous experiences belong to a single person if there is a common consciousness or awareness of them.” However, consciousness and awareness are difficult concepts to analyze, so that little of substance has been said of the answer. Recently, Oaklander has argued that (...) the awareness answer is deficient for a different reason, claiming that it fails because “it ultimately rests on an analysis of the unity of consciousness that is itself circular or otherwise inadequate” Oaklander 1987, p. 525). Oaklander's criticism is especially interesting because, according to it, the awareness account of synchronic personal identity falls prey to the main problem facing the memory account of diachronic identity, namely the problem of branching. In this paper, I shall argue that there is no important symmetry. Whatever its other flaws may be, the awareness account is immune to the branching problem; its immunity is due to formal differences between synchronic and diachronic identity. (shrink)
