Unangemessene Behandlung wie Unter- oder Überversorgung zu erkennen und zu vermeiden, stellt Ärztinnen/Ärzte und Pflegende am Krankenbett vor schwierige Entscheidungen. Hier ist die Entwicklung von praxistauglichen Orientierungshilfen angezeigt, die wissenschaftlichen Kriterien genügen und nicht allein auf Konsens beruhen. Die vorliegende Arbeit versucht, zentrale Normen zur Vermeidung von Über- und Unterversorgung zu formulieren und theoretisch zu fundieren. „Rechtsgefühl“ kann das individuelle Gerechtigkeitsempfinden, das Judiz der Richterin im Entscheidungsfindungsprozess, das emotionale Aufbäumen der unterlegenen Partei nach der Entscheidung, eine kollektive Rechtsüberzeugung bezeichnen. Verweise auf das „Rechtsgefühl“ werden oft genutzt, um Rechtssysteme oder einzelne Rechtsakte von innen oder von außen zu legitimieren oder zu delegitimieren. IN THE winter and spring of 1031,1 was invited to give a series of ten lectures at Harvard University. The subject chosen was the Philosophy of Art; the lectures are the origin of the present volume. The Lectureship was founded in memory of William James and I esteem it a great honor to have this book associated even indirectly with his distinguished name. It is a pleasure, also, te recall, in connection with the lectures, the unvarying kindness and hospitality of (...) my colleagues in the department of philosophy at Harvard. I am somewhat embarrassed in an effort to acknowledge indebtedness to other writers on the subject. Some aspects of it may be inferred from authors mentioned or quoted in the text. I have read on the subject for many years, however, more or less widely in English literature, somewhat less in French and still less in German, and I have absorbed much from sources which I cannot now directly recall. Moreover, my obligations to a number of writers are much greater than might be gathered from allusions to them in the volume itself. Epistemic logic has grown from its philosophical beginnings to find diverse applications in computer science, and as a means of reasoning about the knowledge and belief of agents. This book provides a broad introduction to the subject, along with many exercises and their solutions. The authors begin by presenting the necessary apparatus from mathematics and logic, including Kripke semantics and the well-known modal logics K, T, S4 and S5. Then they turn to applications in the context of distributed systems and (...) artificial intelligence. These include the notions of common knowledge, distributed knowledge, explicit and implicit belief, the interplays between knowledge and time, and knowledge and action, as well as a graded (or numerical) variant of the epistemic operators. The authors also discuss extensively the problem of logical omniscience. They cover Halpern & Moses' theory of honest formulas, and they make a digression into the realm of nonmonotonic reasoning and preferential entailment. They discuss Moore's autoepistemic logic, together with Levesque's related logic of "all I know". Furthermore, they show how one can base default and counterfactual reasoning on epistemic logic. Graduate students in philosophy or in computer science, especially those with an interest in AI, will find this book useful. (shrink)

Ulrich Meyer defends a novel theory about the nature of time, and argues against the consensus view that time and space are fundamentally alike. Certain species of fish have recently become important model systems in comparative genomics and in developmental biology, in certain instances because of their small genome sizes (e.g., in the pufferfish) and, in other cases, because of the opportunity they provide to combine an easily accessible and experimentally manipulable embryology with the power of genetic approaches (e.g., in the zebrafish). The resulting accumulation of genomic information indicates that, surprisingly, many gene families of fish consist of more members than in mammals. Most (...) modern fish, including the zebrafish and medakka, are diploid organisms; however, the greater number of genes in fish was possibly caused by additional ancient genome duplications which happened in the lineage leading to modern ray-finned fishes but not along the lineage leading to tetrapods. Since these two lineages shared their last common ancestor (in the Devonian about 360 million years ago) individual duplicated members of gene families were later lost in fish. Interestingly, comparative data indicate that, in some cases, genes in mammals even serve somewhat different functions than their homologues in fish, highlighting that the degree of evolutionary relatedness of genes is not always a reliable predictor of their evolutionary conservation and their similarity of function. Since fish are phenotypically probably not more complex than mammals, it is possible that evolution took alternative paths to the “economics of genomics” through alternative solutions to gene regulation. It is suggested that the more complex genomic architecture of fish permitted them to adapt and speciate quickly in response to changing selective regimes. Germany is considered to be a pioneer of social security systems; nonetheless, globalization and demographic changes have put enormous pressure on them. A solution is not yet in sight as the debate on the future of the German social security systems still lacks consensus. We argue that ideas matter and that the debate can benefit from a deeper reflection on the concept of social security. This objective is pursued along two lines. First, we take a historical perspective and reconstruct the (...) development of Germany's social security systems. Second, we scrutinize from a theoretical perspective how social security is conceptualized in public and theoretical debates. Behind the various positions, we identify four basic ideal types. We then analyze how these ideal types account for the benefits of social security systems and what role they assign to corporations in providing social security. While two ultimately reinforce potential conflicts between different groups in society, the other two ideal types reveal possible benefits for all. The last ideal type actually conceptualizes social security systems as insurance that fosters risky but overall productive investments in human and other forms of capital. Therefore, it can be shown that social security systems are not necessarily threatened by globalization and that incentives exist for corporations to invest in the provision of social security. The central ternary relation R relates theories L,T and U, where U consists of all of the outputs C got by applying modus ponens to major premises from L and minor premises from T. Underlying this relation is a modus ponens product operation on theories L and T, whence RLTU iff LTU. (...) These ideas have been expressed, especially with Routley, as worlds semantics for relevant and other substructural logics.Worlds are best demythologized as theories, subject to truth-functional and other constraints. The chief constraint is that theories are taken as closed under logical entailment, which clearly begs the question if we are using the semantics to determine which theory L is Logic itself. Instead we draw the modal logicians’ conclusion—there are many substructural logics, each with its appropriate ternary relational postulates.Each logic L gives rise to a Calculus of L-theories, on which particular candidate logical axioms have the combinatorial properties expected from the well-known Curry–Howard isomorphism . We apply their bubbling lemma, updating the Fools Model of Combinatory Logic at the pure → level for the system BT. We make fusion an explicit connective, proving a combinator correspondence theorem. Having taken relevant → as a left residual for , we explore its right residual mate →r. Finally we concentrate on and prove a finite model property for the classical minimal relevant logic CB, a conservative extension of the minimal positive relevant logic B+. (shrink)

Born in Vyborg in 1884 by parents of German descent, Vasily (Wilhelm) Sesemann grew up and studied in St. Petersburg. A close friend of Viktor Zhirmunsky and Lev P. Karsavin, Sesemann taught from the early 1920s until his death in 1963 at the universities of Kaunas and Vilnius in Lithuania (interrupted only by his internment in a Siberian labor camp from 1950 to 1956). Botz-Bornstein's study takes up Sesemann's idea of experience as a dynamic, constantly self-reflective, ungraspable phenomenon that cannot (...) be objectified. Through various studies, the author shows how Sesemann develops an outstanding idea of experience by reflecting it against empathy, Erkenntnistheorie (theory of knowledge), Formalism, Neo-Kantianism, Freudian psychoanalysis, and Bergson's philosophy. Sesemann's thought establishes a link between Formalist thoughts about dynamics and a concept of Being reminiscent of Heidegger. Humanitarian interventions aim at saving human lives, but they also take human lives. The death of innocent people is an unintended but foreseen consequence of military actions. Can this be morally justified? Those who argue from a deontological perspective and give an affirmative answer to this question, point to the Principle of Double Effect (PDE). Others, also arguing from a deontological perspective, nevertheless reject the PDE and give a negative answer to the above question. In this paper I argue that (...) an adequate interpretation of the PDE brings these two positions closer together. A deontological (rather than the prevalent consequentialist) interpretation of the reference to proportionality within the PDE should bring even the proponents of the PDE to an approximately pacifist position. Michel Meyer offers a new beginning for philosophy rooted in a theory of questioning that he calls "problematology." Meyer argues that a new beginning is necessary in order to resituate philosophy, science, and linguistic analysis, and he proposes a global view of rationality by returning to the nature of questioning itself. For Meyer, philosophy does not solve problems or give answers but instead shows how propositions are related to a whole field of questions that give them meaning. (...) Reason is identified not with answers but with the question-answer process. Meyer pursues this new theory of reason and meaning in a critique of Western philosophy from Socrates, Plato, and Aristotle through Heidegger, Wittgenstein, and Foucault. He provides a detailed analysis of Descartes' notion of radical doubt and demonstrates its implications for the subsequent philosophical tradition that ignored the questioning process while pursuing an unshakable foundation for knowledge. Meyer argues that recent work in rhetoric points toward a theory of radical questioning and claims that the methods of rhetoric and argumentation must be turned back on philosophy itself in order to recover the original significance of metaphysics as the science of ultimate questions. Es ist in der Literatur weithin bekannt, dass im Gesundheitswesen auf unterschiedlichen Ebenen Allokationsentscheidungen getroffen werden. Während es auf der Makroebene um gesellschaftlich-politische Strukturfragen geht, stehen die Akteure der Mikroebene vor der Aufgabe, begrenzte Ressourcen in einer Organisation sinnvoll einzusetzen. In den ethischen Analysen der Mikro-Allokationsebene werden zumeist Entscheidungen der Healthcare Professionals thematisiert, weil sie eine unmittelbare Auswirkung auf die konkreten Patienten haben. Weniger in den Blick geraten Allokationen des Managements, welche die Rahmenbedingungen für Ressourcenzuteilungen beim Patienten betreffen. Hierbei geht (...) es nicht bloß um den Einsatz von Sachmitteln (z. B. Medikamenten- oder Gerätebudgets), sondern auch um den Personaleinsatz. Das Personalmanagement ist damit in wichtige Allokationsentscheidungen eingebunden und trägt eine dreifache Verantwortung: für die Gesundheit der Patienten, der Mitarbeiter und der Organisation. Der vorliegende Beitrag geht der Frage nach, welche Aspekte der Allokationsethik aus der Sicht des Personalmanagements in einem Krankenhaus zu bedenken sind, um der dreifachen Verantwortung gerecht zu werden. Dadurch zeigt sich, dass Allokationsethik in einem Krankenhaus nicht adäquat erfasst werden kann, ohne sich mit dem Personalmanagement zu beschäftigen, da das Personal die wertvollste Ressource ist, die es in einem Krankenhaus zu allozieren gilt. In _Jacques Derrida: Opening Lines_, Marian Hobson gives us a thorough and elegant analysis of this controversial and seminal contemporary thinker. Looking closely at the language and the construction of some of Derrida's philosophy, Hobson suggests the way he writes, indeed the fact he writes in another language, affects how he can be understood by English speakers. This superb study on the question of language will make illuminating reading for anyone studying or engaged with Derrida's philosophy.
