Buddhism was not really known in the West until a little more than 150 years ago. Although since the thirteenth century there had been numerous contacts with local Buddhist traditions, the travellers and missionaries of the Middle Ages and the Renaissance had not yet brought to light the history of Buddhism and its unity across this immense diversity of worship and doctrine, disseminated through most of the countries of Asia. Of course, since the seventeenth century some Europeans had guessed at (...) the Indian origin of the Buddha and they succeeded in pinning down his historical existence after a fashion. In 1691 and 1693 Simon de la Loubère, Louis XIV's envoy at the court of the king of Siam, published remarkable research which established the possibility of a link between the different regions of Siam, Ceylon, Japan and China and conjured up the possible existence of a single founder long before Christ. But this far too isolated knowledge had scarcely any impact in Europe. It was only with the foundation of the Asiatic Society of Bengal in 1784 that orientalism was to enjoy a rapid and decisive expansion. The word ‘Buddhism’ appeared from the 1820s onwards, and with it the first conceptualization of a tree with many branchings. But it was not until the publication, in 1844, of Eugène Burnouf's magisterial Introduction l'histoire du buddhisme indien, that more detailed knowledge became available, thanks to a critical scrutiny of the most varied sources. The works of the French scholar and of other pioneers in Buddhist studies - mainly Alexander Csoma de Koros and Edmond Foucaux on Tibet, Jean-Pierre Abel-Remusat and Stanislas Julien on China, Christian Lassen and Spence Hardy on Ceylon - were to give rise to a tremendous craze for Buddhism in Europe. Since then there has been no break in the successive waves disseminating it right up to the present day, when the majority of Western countries appear to be so receptive to the message of the Buddha that for some years the media have been insistently questioning the reasons for this ‘Buddhist wave’. L’assimilation du fou, du primitif et de l’enfant a été souvent analysée comme une opposition de l’archaïque par rapport au civilisé ou du normal par rapport au pathologique. On veut montrer ici que le mystique s’ajoute à cette liste, celle-ci désignant alors plutôt des figures de l’altérité qui défient la raison. On étudie alors les liens entre la figure du primitif et celle du mystique dans la sociologie de Lévy-Bruhl, la métaphysique de Bergson et la pratique littéraire de Bataille. Par-delà (...) les divergences entre ces trois œuvres, on montre que le lien entre primitif et mystique vise à élargir le champ de l’expérience en l’ouvrant à une altérité radicale, et en même temps prépare le terrain pour cette expérience vide et formelle que pensera le structuralisme. Oliver Wendell Holmes, Jr, is considered by many to be the most influential American jurist. The voluminous literature devoted to his writings and legal thought, however, is diverse and inconsistent. In this study, Frederic R. Kellogg follows Holmes's intellectual path from his early writings through his judicial career. He offers a fresh perspective that addresses the views of Holmes's leading critics and explains his relevance to the controversy over judicial activism and restraint. Holmes is shown to be an original legal (...) theorist who reconceived common law as a theory of social inquiry and who applied his insights to constitutional law. From his empirical and naturalist perspective on law, with its roots in American pragmatism, emerged Holmes's distinctive judicial and constitutional restraint. Many criticisms have been made of optimization theory (Laville, 1999a). These objections may be explained by the fact that human rationality is bounded – that decisions are constrained by cognitive limitations (Simon, 1982). In the present paper, I will show that if rationality is bounded, then we must study the processes of decision. My thesis is that cognitive limitations lead to procedural rationality. Although this assertion has already been sustained implicitly by Simon (1959) and explicitly by Mongin (1986), it has (...) not been argued in sufficient depth. (shrink)

That which in the philosophical tradition escapes from movement is always in truth an ecstasy of movement, laid by the movement, which happens to be secondary and derivative, for it is ‘sedimented.’ The philosophy of Patočka presents itself therefore inseparably as an ontology and phenomenology of movement, as the author proposes a cosmological deepening of phenomenology largely supported by a theory of sedimentation. The book offers an interpretation as scholarly as it is original of the Patočkian cosmology and anthropo-phenomenology.Il libro di Dragoş Duicu presenta l’opera di Jan Patočka come una fenomenologia del movimento di cui l’autore svolge un’archeologia concettuale, che risale fino ad Aristotele, e al tempo stesso una ricollocazione all’interno del paesaggio fenomenologico. In questa prospettiva, ciò che per la tradizione filosofica si sottrae al movimento è sempre in verità un’estasi del movimento, depositata dal movimento stesso e proprio perciò secondaria, derivata, sedimentata. This article reflects upon the notion of biopower deriving from Paul Rabinow’s work French DNA. This book undertakes an analysis of the relations between biotechnologies analysis of the relation between biotechnologies and bioethics in France informed by Foucault’s concept of biopower. We can retain two theses from this account: biotechnologies pluralise biopower and take it to the limit towards beings situated at the limits of life; bioethics fails to constitute a biopolitics because it is a discourse of sacralisation and not (...) one of resistance. Beyond these two theses, we must apply the concept of biopower to recent transformations in the sciences of life. (shrink)

On propose ici la notion de « rite de la vie quotidienne » en liant les analyses de Goffman sur la « mise en scène de la vie quotidienne » avec sa réflexion, d’inspiration durkheimienne, sur les « rites d’interaction ». Après avoir rappelé l’analyse durkheimienne du rituel, on montre en quoi le pragmatisme de Mead permet à Goffman de refuser un certain nombre de présupposés de la sociologie de Durkheim. On montre ensuite que la référence à la mise en (...) scène théâtrale permet à Goffman de se détacher du normativisme de Mead pour proposer une analyse des personnes (selves) qui rejoint le cœur de la pensée durkheimienne, celle qui sera reprise par le structuralisme lévi-straussien et qui s’inscrit dans la réflexion juridique. In its genealogy of past struggles, the book invokes St. Augustine’s model of the city of God. What these two dimensions together show is the need for a spiritual power which will throw light on both the intellectual production constitutive of the multitude and on the mode of writing proper to the book entitled Empire, whose aim is to produce this revolutionary subject, doing so by way of an affective strategy. This paper analyzes a model of sequential parimutuel betting described as a two-horse race with a finite number of noise bettors and a finite number of strategic and symmetrically informed bettors. For generic objective probabilities that the favorite wins the race, a unique subgame perfect equilibrium is characterized. Additionally, two explanations for the favorite–longshot bias—according to which favorites win more often than the market's estimate of their winning chances imply—are offered. It is shown that this robust anomalous empirical regularity might (...) be due to the presence of transaction costs and/or to strategic bettors' subjective attitude to probabilities. (shrink)

Particulièrement mobilisé lors du changement de régime économique de 1982-1983, avec le basculement du Parti socialiste dans le «cercle de la raison» (...) libérale, ce genre est, précisément, une composante à part entière de la construction d'un ordre social libéral dans les années 1980 et 1990. Contemporary analytical jurisprudence holds that the “doubtful” or “hard” case, not resolved by any clear legal authority, is either legally indeterminate or can be resolved only by judicial recourse to principles. There is an aspect of the “doubtful case” that militates against recourse to principle. When viewed as representative of an early stage of a continuing class of disputes, then (especially in controversial cases of broad import) judicial recourse to principles may lead to an improvident choice of reasons, and violates (...) fundamental democratic values. This argues for early judicial minimalism or particularism, where judges resolve decisions narrowly, for two reasons: 1) principled resolution of all doubtful cases is inconsistent with the exploration and classification phase of judicial inquiry, and 2) public debate among scholars and citizens should be permitted to play a role in the development of practical reasoning and the adjustment of practices surrounding broad controversies.
