Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza. There is a common view in medical ethics that the patient's right to be informed entails, as well, a correlative right not to be informed, i.e., to waive one's right to information. This paper argues, from a consideration of the concept of autonomy as the foundation for rights, that there can be no such ‘right’ to refuse relevant information, and that the claims for such a right are inconsistent with both deontological and utilitarian ethics. Further, the right to be informed (...) is shown to be a mandatory right (though not a welfare right); persons are thus seen to have both a right and a duty to be informed. Finally, the consequences of this view are addressed: since the way in which we conceptualize our problems tends to determine the actions we take to resolve them, it is important properly to conceptualize patients' requests not to be informed. There may be many reasons for acting in accord with such a request, but it is a mistake to conceptualize one's act as ‘respecting a right possessed by persons’. In most academic research on politics, emotions are deemed important only to the realm of subjects or citizens, not to power. Emotions are presented as a problem power has to deal with, not something with which power is itself intimately involved. This article discusses recent attempts to reintroduce emotions into political analysis and argue that they are incomplete insofar as they look only at opposition social movements, not at mainstream parties. With a nod to Carl Schmitt, I argue that anger (...) is not something that only occasionally bursts onto the political scene, but is central to ‘normal’ politics as well. Anger is central to politics both as a diffuse, untargeted sentiment citizens experience, usually economically, and as the emotion political organizers need to capture and channel, which they do by offering up an ‘enemy’ they identify as the source of the problem. Opposition movements and parties of power alike succeed when they persuade people to accept the enemy they propose. (shrink)

Quand dire, c’est faire... Quand dire le droit, c’est faire justice... Mais quel droit, et quelle justice? The twelfth camel is a metaphor that has been used by authors such as Niklas Luhmann and Günter Teubner to demonstrate a version of the rationality of modern law. In this paper, François Ost exposes his own thoughts on the metaphor, and tries to go beyond paradoxes by providing twelve original readings, which in turn, give valuable insights for current debates about rationality, function and identity of legal systems. No law in any jurisdiction that permits physician assisted dying offers individuals a medically assisted death without the need to comply with certain criteria. The Netherlands is no exception. There is evidence to suggest that physicians are averse to providing an assisted death even when the Dutch ‘due care criteria’ have been met and the unbearable pain and suffering requirement is especially difficult to satisfy. Some individuals with an enduring desire to die who do not meet the ‘due care’ criteria (...) under the Dutch legislation turn to other means of achieving a self-appointed death. This paper explores two alternative methods of securing a self-determined death (an assisted death involving lay assistors or a self-hastened death by stopping eating and drinking), and raises the question of how far the law should recognise autonomy in the context of physician assisted death. ExcerptVictor Zaslavsky has written a moving and powerful short book that is less about the actual events of the horrendous crimes of Katyn than about the mechanisms that produced them and about the cover-ups—both inside the Soviet Union and in much of the rest of the world—that followed. The crimes themselves, which are still poorly known in the world outside of Poland, took place in March 1940, both in the Katyn forests in Russia and in other camps in the Soviet (...) In the wake of two recent high-profile, controversial cases involving the prosecution and conviction of Drs Bramhall and Bawa-Garba, this article considers when it is socially desirable to criminalise doctors’ behaviour, exploring how the matters of harm, public wrongs and the public interest can play out to justify—or not, as the case may be—the criminal law’s intervention. Dr Bramhall branded his initials on patients’ livers during transplant surgery, behaviour acknowledged not to have caused his patients any harm by way of (...) injury to their organs. Dr Bawa-Garba misdiagnosed and failed to properly assess a 6-year-old boy with pneumonia and sepsis under her care, who subsequently died. Taking account of contextual and public interest concerns, can and should there be exceptions to imposing criminal liability where a doctor’s behaviour is deemed grossly negligent and a significant contribution to a patient’s death? And is it really appropriate to subject a doctor to penal sanction where he may have committed a private wrong against a patient, but does not set back their interests? (shrink)

The plethora of tripartite bodies in postcommunist countries seems to suggest the emergence of an East European corporatism. Analysis of arrangements in Bulgaria, Czech Republic, Hungary, Slovakia, and Poland indicates instead the prevalence of illusory corporatism. Token negotiations, nonbinding agreements, and exclusion of the private sector demonstrate that tripartite procedures are deployed to introduce neoliberal, not social democratic, outcomes. A path-dependent argument stressing labor's weak class identity best explains these outcomes. East European labor, unlike historic Western counterparts, is marked by (...) a weak sense of class interests, disinclination to organize the private sector, and declining support from the workforce, making it unable to emerge as a strong force. It is not labor but the new elites that seek tripartism, hoping thereby to share burdens, conform to European norms, and demonstrate responsiveness to society. Formal tripartism also follows from the legacy of state socialism, giving symbolic voice to the formerly included now headed for exclusion. In the end, tripartism helps secure labor's acceptance of its own marginalization. (shrink)
