It argues that language is the one essential tool in the ¿social construction of reality¿ ¿ the way in which our environment as we perceive and respond to it is actually created by the cultural constructs we bring to bear on it ¿ and that it is also the means by which this reality, once constructed, is preserved and transmitted from person to (...) person and from generation to generation. There are Humeans and unHumeans, disagreeing as to the validity of the Treatise’s ideas regarding practical reason, but not as to their importance. The basic argument here is that the enduring irresolution of their Hume centric debates has been fostered by what can be called the fallacy of normative monism, i.e. a failure to distinguish between two different kinds of normativity: empirical vs. rational. Humeans take the empirical normativity of personal desire to constitute the only real kind, while unHumeans insist (...) that only the objective rationality associated with categorical morality can provide reliable normative guidance. In turn, the failure to recognize the dual nature of normativity has helped engender motivational obscurantism: as essentially causal notions, motive and motivation obscure the rational processes that lie at the heart of deliberation and choice. Once it is realized that normativity takes two different forms, each with its own distinctive role, it becomes possible to mediate if not mitigate the differences between Humeans and unHumeans. Choice will be the key to understanding practical reasoning, and its analysis will provide the basis for a belief/desire model that upends conventional wisdom regarding motivation and desire. The distinction between ‘comprehensive’ and ‘political’ liberalisms, explored in the previous chapter, has become central to contemporary political theory. My aim in this chapter is to examine various ‘comprehensive’ liberalisms, with particular care to identifying in what sense they are comprehensive. As I have argued elsewhere (Gaus, 2003: chap. 7), the distinction between political and comprehensive liberalisms is elusive. Rawls repeatedly describes as ‘comprehensive’ ‘philosophical’, ‘moral’ and ‘religious’ ‘doctrines’ (1996: xxv, 4, 36, 38, 160) or ‘beliefs’ (1996: 63). Indeed, so (...) often does Rawls characterize comprehensiveness in terms of moral, religious and philosophical doctrines or beliefs that a reader may be tempted to conclude that doctrine C is comprehensive if and only if it is a moral, religious or philosophical doctrine or belief. But though it is tempting to understand ‘comprehensive conceptions’ in this way, it would be wrong. Rawls is clear that ‘the distinction between the political conception and other moral conceptions is a matter of scope; that is, the range of subjects, to which a conception applies and the content a wider range requires’ (1996: 13). Comprehensive and general doctrines cover a wide range of topics, values and ideals applicable to various areas of life. Even given the terms of Rawls’s own analyses, rather than conceiving of comprehensive liberalisms as all relying on a fully comprehensive doctrine, it is better to conceive of them in terms of a spectrum of theories, from those that rely on something like a fully comprehensive view to those that rely on, say, only a general theory of the right. Nowhere has H.L.A. Hart's influence on philosophical jurisprudence in the English-speaking world been greater than in the way its fundamental project and method are conceived by its practitioners. Disagreements abound, of course. Philosophers debate the extent to which jurisprudence can or should proceed without appeal to moral or other values. They disagree about which participant perspective—that of the judge, lawyer, citizen, or “bad man”—is primary and about what taking up the participant perspective commits the theorist to. However, virtually unchallenged is (...) the view that jurisprudence is fundamentally interpretive or “hermeneutic”; that it takes for its subject a certain kind of social practice, constituted by the behavior and understandings of its participants; that its task is to explain this practice and its relations to other important social practices; and that it can properly be explained only by taking full account of participant understandings. It is, perhaps, some measure of the hegemony of Hart's influence that Ronald Dworkin mounts his fundamental challenge to Hart's positivism squarely from within this jurisprudential orthodoxy. Dworkin may have exceeded the limits of the method as Hart conceived it, but, as Stephen Perry has argued, “the seeds of Dworkin's strong version of inter-pretivism were sown by Hart himself.”. This research consists of two studies with interrelated objectives. The purpose of the first study is to develop and validate scales measuring whistle-blowing subjective norms, attitudes, and intentions. The objective of the second study is to test a model of whistle-blowing intentions, motivated by the theory of reasoned action, across two contrasting cultures: the collectivist Thai and the individualistic American. To achieve cross-cultural comparisons, we first perform measurement and structural invariance tests. Tests of latent mean differences lend support for our (...) prediction that individuals in the collectivist Thai culture have higher means on subjective norms, attitudes, and intentions for whistle-blowing than members of the individualist American culture. Our models indicate that subjective norms for whistle-blowing, even though significantly different for American and Thai participants, have a direct effect on whistle-blowing attitudes as well as direct and indirect effects on reporting intentions for both subject groups. Compared to American subjects, the whistle-blowing intentions of Thai participants are more strongly influenced by subjective norms for whistle-blowing. (shrink)

An extensive scholarly literature, written in the past century holds that in ancient Greek and Roman thought history is understood as circular and repetitive - a consequence of their anti-temporal metaphysics - in contrast with Judaeo-Christian thought, which sees history as linear and unique - a consequence of their messianic and hence radically temporal theology. Gerald Press presents a more general view - that the Graeco-Roman and Judaeo-Christian cultures were fundamentally alien and opposed cultural forces and that, therefore, Christianity's (...) victory over paganism included the replacement or supersession of one intellectual world by another - and then shows that, contrary to this view, there was substantial continuity between "pagan" and Christian ideas of history in antiquity, rather than a striking opposition between cyclic and linear patterns. He finds that the foundation of the Christian view of history as goal-directed lies in the rhetorical rather than the theological motives of early Christian writers. (shrink)

Raunig develops a philosophy of dividuality as a way of addressing contemporary modes of production and forms of life. The animal of the molecular revolution will be neither mole nor snake, but a drone-animal-thing that is solid, liquid, and a gas. —from Dividuum As the philosophical, religious, and historical systems that have produced the “individual” (and its counterparts, society and community) over the years continue to break down, the age of “dividuality” is now upon us. The roots of the concept (...) of the “dividuum” can be traced back to Latin philosophy, when Cicero used the term to translate the “divisible” in the writings of Epicurus and Plato; later, medieval scholars utilized the term in theological discussions on the unity of the trinity. Grounding himself in the writings of the medieval bishop Gilbert de Poitiers and his extensive commentaries on Boethius, Gerald Raunig charts a genealogy of the concept and develops a philosophy of dividuality as a way of addressing contemporary modes of production and forms of life. Through its components of dispersion, subsistence, and similarity, dividuality becomes a hidden principle of obedience and conformity, but it also brings with it the potential to realize disobedience and noncompliant con/dividualities. Raunig's bad news is that dividuality is responsible for much of the intensified exploitation and enslavement taking place under contemporary machinic capitalism. Algorithms, derivatives, big data, and social media technology all contribute to the rampant expansion of divisive management strategies and desires for self-division. The good news, however, is that this same terrain of dividuality presents an opportunity for a new kind of resistance, one that can be realized in the form of con/division. (shrink)

The aim of this book is to show how McTaggart's atemporal vision of reality is a serious attempt to describe a coherent world without time. It proposes that the answer to the puzzling nature of time is not to be found in the components of time itself, but in an atemporal reality that lies behind it. McTaggart takes an idealist view that reduces all that is real to spirit, that any expression of reality is dependent on a manifestation of consciousness. (...) McTaggart's argument that time is unreal, has been the subject of much philosophical debate since it first appeared in 1908; but much discussion has ignored McTaggart's positive account of time and concentrated on his negative proof. The author argues that the negative thesis should be separated from the positive account, he attacks the standard approaches to interpreting time and provides a full account of McTaggart's atemporal world. The conclusion is drawn that the timeless world has psychological appeal and can form the basis for an atemporal thinking which can break away from the confusing philosophical models of temporality that often bear little resemblance to our experience of it. The Matrix exposes us to the uncomfortable worries of philosophical skepticism in an especially compelling way. However, with a bit more reflection, we can see why we need not share the skeptic’s doubts about the existence of the world. Such doubts are appropriate only in the very special context of the philosophical seminar. When we return to normal life we see immediately that they are groundless. Furthermore, we see also the drastic mistake that Cypher commits in turning his back upon (...) reality and re-entering the matrix. Not only does reason compel us to admit the existence of the external world, it also requires us to face this world, to build for ourselves meaningful lives within it, and to engage, as adults, in the serious business of living. . A structured awareness of time lies at the core of the law's distinctive normativity. Melody is offered as a rough model of this mindfulness of time, since some important features of this awareness are also present in a hearer's grasp of melody. The model of melody is used, first, to identify some temporal dimensions of intentional action and then to highlight law's mindfulness of time. Its role in the structure of legal thinking, and especially in precedent‐sensitive legal reasoning, is (...) explored. This article argues further that melody‐modeled mindfulness of time is evident also at a deeper and more pervasive level, giving structure to the distinctive mode of law's normative guidance. The article draws one important theoretical consequence from this exploration, namely, that the normative coherence of momentary legal systems depends conceptually on their coherence over time.
