Aims and background: The present work assessed the impact of two decrees on ethics committees in Italy, aimed at bringing the national laws on the conduct of clinical trials into line with the rest of the EC, and regulating and facilitating not-for-profit research.Material and methods: Prospectively collected data from an Italian multicentre study were examined with respect to the ethics review process. Administrative and time elements of the review process were audited. Main outcome measures were time between the application submission (...) and the ethics committee definitive opinion, type and number of application submission forms, number of ethics committees that refused fee exemption, and time between the ethics committee approval and the administrative authorisation.Results: A total of 134 local research ethics committees were approached. Application submission procedures and application forms varied greatly; paper submission was mandatory. The median time from submission to approval was 72 days. Only two LRECs refused the fee exemption. The median time from LREC approval to administrative agreement was 50 days and only 9.6% of local authorities came to a verbal agreement with the sponsor.Conclusions: Italian LRECs are still not sufficiently efficient in complying with the Directive 2001/20/EC requirement . Better coordination of LRECs work is needed although the optimal level of coordination between them is still not known. In the meantime, national guidelines are needed concerning the application of Directive 2001/20/EC. The behaviour of Italian LRECs towards not-for-profit research was excellent although only the fee exemption was requested. (shrink)

Resumo: O presente artigo tem como objetivo propor uma hipótese para superação das críticas feitas por Robert Nozick e Michael Sandel à teoria da justiça de John Rawls, no que concerne à necessidade de se considerar aspectos históricos e práticos, na formulação de princípios na posição original. Para tanto, é preciso analisar inicialmente as correntes filosóficas do liberalismo, do libertarianismo e do comunitarismo, a fim de fundar as bases necessárias ao desenvolvimento do estudo. Na sequência, será apresentada a teoria da (...) justiça de John Raws, seguida das críticas formuladas pelo libertário Robert Nozick, no que se refere à necessidade de se levar em conta o princípio histórico. Nozick comprova, por meio do exemplo de Wilt Chamberlain, como aspectos históricos podem alterar as estruturas pré-estabelecidas pelas teorias de estado final. Após, serão examinados os apontamentos feitos por Michael Sandel, especialmente no que concerne ao individualismo metodológico. Sandel também chama a atenção para o fato de que, para garantir efetividade aos princípios, é preciso que os indivíduos se utilizem de sua experiência e das particularidades da comunidade e de seus integrantes. Ao final, será sugerida uma proposta de superação das críticas dirigidas a Rawls, mediante a relativização da abstração da posição original.: The present article aims to overcome the criticisms made by Robert Nozick and Michael Sandel of John Rawls’ theory of justice, specifically with regard to the need for considering historical and practical aspects in the formulation of principles in the original position. We first analyze the philosophical currents of liberalism, libertarianism, and communitarianism, in order to lay the foundations necessary for the development of the study. Next, Rawls’ theory of justice is presented, followed by the critique made by the libertarian Robert Nozick of the need to consider the historical principle. Nozick proves, through the example of the American basketball player Wilt Chamberlain, how historical aspects can alter structures that are pre-established by theories of final state. Michael Sandel’s observations are then analyzed, especially with regard to methodological individualism. Sandel draws attention to the fact that to ensure the effectiveness of principles, individuals need to draw on their experience and on the particularities of the community and its members. Finally, a proposal is made for overcoming the criticisms directed at Rawls; this is achieved by relativizing the abstraction of the original position. (shrink)

Inicialmente, o texto indaga sobre o significado do exercício do filósofo social; pretende também localizar as origens do debate moderno sobre ‘subjetividade’ no pensamento filosófico e social. As idéias norteadoras de Kant, se situam na confluência e na disjunção entre razão (conhecimento) e subjetividade (moral). A partir dessa referência, o debate entre alguns pensadores considerados como pós-modernos (Badiou e Zizek), por um lado, e por outro Castoriadis que recusa esta nomenclatura, vão derivando idéias novas sobre ‘sujeito’ e ‘verdade’. Esse debate (...) não é sem conseqüências para a teoria sociológica que assume para si o desafio de introduzir a categoria de ‘sujeito’ em seus cânones (Touraine). As reflexões de Stengers servem também para questionar e aproximar as práticas da produção do conhecimento e dos discursos científicos. Finalmente, restam desafios para se pensar teorias e práticas sócio-ambientais à luz desses conceitos apresentados ao longo do texto. (shrink)

Parte-se da idea de que as territorialidades contra-hegemônicas no mundo rural são resultantes de um duplo processo de aprendizagem e/ou adaptación: um interno ao próprio território, resultante da coevolução entre ecosisstemas e comunidades, e outro externo e entre territórios –o que envolve os processos de territorialização do capital sobre territórios tradicionais. Estas dinâmicas adaptativas dos territórios tradicionais e alternativos são expressas em hibridismos de práticas e representações sociais modernas e tradicionais acerca dos atributos reprodutivos da natureza: a fertilidad da natureza (...) nos territórios tradicionais subsume a reprodutibilidade do complexo socioambiental, ao passo que o imaginário de natureza na cultura científica moderna subsume a produtividade objetivada dos ecossistemas. Em outros termos, trata-se de interpretar narrativas e políticas de natureza. De fato, o entendimiento da complexidade da reprodução socioterritorial da agricultura e pesca tradicionais e alternativas (como aquelas da agricultura familiar de base ecológica) subsume, portanto, a indissociabilidade dos aspectos objetivos e subjetivos acerca da reprodutibilidade de sistema produtivo lato sensu, ou seja, dos condicionantes geoecológicos locais, dos valores e simbolismos tradicionais, que são sintetizados nas estratégias de adaptação e resiliência das comunidades rurais frente aos projetos de (re)territorialização do Capital sobre aqueles territórios contra-hegemônicos. In this article we consider certain elements of the normative theory of Jürgen Habermas in the light of the proposals of Bruce Ackerman, with a view to strengthening a concept of deliberative democracy applied to the legitimation of juridical rules. We do not construct a hierarchy of the two positions, but seek to bring together certain elements to achieve a common project. As the starting point for examining the work of the two authors, we take the scheme proposed by Habermas (...) in Faktizität und Geltung. In this connection, through the work of Ackerman, we intend to fill in some of the gaps that Habermas appears to have left in the theory of radical democracy applied to the law. The work of Ackerman can make a significant contribution to deliberative democracy, to the discourse principle that Habermas defines, and to the contractualist theories from a liberal perspective. The study of these contributions makes possible a critical judgment that enables the legitimation of juridical rules carried out by Habermas to acquire greater practicity. In examining the epistemological status of juridical science and law, we attempt to determine the weight and the performance of normative democracy. In Tarr's view, it is a matter for philosophers to examine direct democracy and its desirability. (shrink)

Banks play a unique role in society. They not only maximize profits but also consider the interests of stakeholders. We investigate whether banks consider firms’ pollution records in their lending decisions. The evidence shows that banks offer significantly higher loan spreads, higher total borrowing costs, shorter loan maturities, and greater collateral to firms with higher levels of chemical pollution. The costly effects are stronger for borrowers with greater risk and weaker corporate governance. Further, the results show that banks with higher (...) social responsibility account for their borrowers’ environmental performance and charge higher loan spreads to those with poor performance. These results support the idea that banks with higher social responsibility can promote the practice of business ethics in firms. (shrink)

By focusing on the works and intellectual network of the Timurid historian Sharaf al Dīn ʻAlī Yazdī (d.1454), this book presents a holistic view of intellectual life in fifteenth century Iran. İlker Evrim Binbaş argues that the intellectuals in this period formed informal networks which transcended political and linguistic boundaries, and spanned an area from the western fringes of the Ottoman State to bustling late medieval metropolises such as Cairo, Shiraz, and Samarkand. The network included an Ottoman revolutionary, a Mamluk (...) prophet, and a Timurid occultist, as well as physicians, astronomers, devotees of the secret sciences, and those political figures who believed that the network was a force to be taken seriously. Also discussing the formation of an early modern Islamicate republic of letters, this book offers fresh insights on the study of intellectual history beyond the limitations imposed by nationalist methodologies, established genres, and recognized literary traditions.
