In this paper, we make explicit the changing configurations of power relations that currently characterize the Brazilian Emergency Care System (SAMU) team in Belo Horizonte, Brazil. The SAMU is a recent innovation in Brazilian healthcare service delivery. A qualitative case study methodology was used to explore SAMU’s current organizational arrangements, specifically the power relations that have developed and that demonstrate internal team struggles over space and defense of particular occupational interests. The argument advanced in this paper is that these professionals (...) are developing their work in conditions of exposure, that is, they are always being observed by someone, and that such observational exposure provides the conditions whereby everyday emergency care practices are enacted such that practice is shaped by, as well as shapes, particular, yet recognizable power relationships. Data were collected through the observation of the SAMU’s work processes and through semi‐structured interviews. Research materials were analyzed using discourse analysis. In the emergency care process of work, visibility is actually embedded in the disciplinary context and can thus be analyzed as a technique applied to produce disciplined individuals through the simple mechanisms elaborated by Foucault such as hierarchical surveillance, normalizing judgment, and the examination. The purpose of this article is to understand how academic integrity educational tutorials are administered across Canadian higher education. Results are shared from a survey of publicly funded Canadian higher education institutions, including universities and colleges, across ten provinces where English is the primary language of instruction. The survey contained 29 items addressing institutional demographic details, as well as academic integrity education questions. Results showed that academic integrity tutorials are inconsistent across Canadian higher education, with further differences evident within the (...) university and college sectors. (shrink)

This article deals with the relationship between philosophy and science in the writings of Karl Jaspers and with its reception in the wider scholarly literature. The problem discussed is how to characterize the relationship that exists between science—defined on pure Kantian grounds as a universally valid knowledge of phenomenal objects—and philosophy—conceived by Jaspers as the transcending mode of thinking of personal Existenz rising towards the totality and unity of Being. Two solutions to that problem arise from Jaspers’s writings. The oppositionist (...) view is based in his earlier philosophy of Existenz. It describes the discrepancy between determinateness, bestowed by science to its objects, and freedom of self-determination, which is both a synonym and a condition of possibility for Existenz. The reciprocal view is based in Jaspers’s later works, where he focuses on exploration of his concept of Being (das Umgreifende). By contrast with most of Jaspers’s commentators, the present interpretation is anchored in a developmentaland contextual understanding of Jaspers’s thought. Showing the transcendental background of this topic, the proposed interpretation allows us to abstain from viewing the two solutions as incoherent or contradictory and instead to see them as constitutive of a single philosophical course. In recent decades, developing and middle-income countries around the globe have adopted path-breaking reforms to their social protection systems. Latin America has been a pioneer region, expanding the state’s commitment on behalf of low-income citizens in key policy areas in many countries. This paper undertakes two tasks. First, it documents the surprising extension of noncontributory social protection policies across many Latin American countries, highlighting how tax-financed programs have come to play a central role in a variety of settings. Second, it (...) examines citizen-level preferences that support this trend, arguing that employment vulnerability and threats to income continuity play a decisive role in shaping demand for public, rather than private, social protection. Survey data on labor-market risks and social policy preferences from eighteen countries corroborate these claims. Our findings suggest that other countries undergoing labor-market strains may experience similar demands for a “return of the state” as a guarantor of social protection in the coming years. (shrink)

The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

This volume, the first of its kind written in English, interprets the realistic-phenomenological philosophy of Hedwig Conrad-Martius (1888-1966). She was a prominent figure in the Munich-Göttingen Circle, the first generation of phenomenology after Edmund Husserl (1859-1938), and was known as the “first lady of German philosophy”.The articles included in this collection deal with the two main themes constituting her realistic-metaphysical phenomenology: Being and the I. The new edition includes an additional chapter opening a new path into the study of Conrad-Martius (...) with Heidegger. In addition, the collection includes a comprehensive Introduction that describes the personal background and the social and philosophical contexts behind Conrad-Martius’s thought, with an emphasis on the mutual influence and fertilization of the group of early phenomenologists in the Munich-Göttingen Circle. The relativistic optics of the nondispersive media endowed with the metric gij(x) [Eq. (1.6)] and with a nonlinear connection [Eq. (1.2)] is studied. The d-connection [Eqs. (3.3)– (3.4)] relates the conformal and projective properties of the space- time. A post-Newtonian estimation for the metric gij(x) is also given. It is shown that the solar system tests impose a constraint [Eq. (4.20)] on a combination of the post- Newtonian parameters describing the model.

ResumoEste ensaio examina a sobrevida textual de uma cabeça — a de Antônio Vicente Mendes Maciel, o Antônio Conselheiro (1830-1897), a partir de sua morte na Guerra de Canudos (1896-1897). Traçam-se as figurações do crânio de Conselheiro na imprensa brasileira do fim do século XIX e nos trabalhos do médico legista Raimundo Nina Rodrigues e do engenheiro e escritor Euclides da Cunha. Embora ambos esperassem que o crânio de Conselheiro apresentasse evidências físicas de degeneração racial, as observações craniométricas de Nina (...) Rodrigues revelaram um crânio normal. Argumenta-se que esse fracasso da aproximação materialista à psique humana deu proeminência a explicações sociológicas para o fenômeno de Canudos, além de levantar questões sobre visibilidade, raça e racismo científico na virada do século XX e no mundo contemporâneo.Palavras-chave: Raça. AbstractThis essay examines the textual afterlife of a head—that of Antônio Vicente Mendes Maciel (Antônio Conselheiro [1830-1897]), after his death in the Canudos War (1896-1897). It traces figurations of Conselheiro’s skull in the late nineteenth-century Brazilian press and in the works of Raimundo Nina Rodrigues and Euclides da Cunha. Although these two social scientists expected Conselheiro’s skull to display physical evidence of racial degeneration, Nina Rodrigues’s craniometric measurements and observations revealed a perfectly normal skull. It is argued that this failure of a materialist approach to the human psyche allowed a stronger reliance on sociological explanations for the Canudos phenomenon that opens up questions on scientific racism and the visibility of race in the turn of the twentieth century and in contemporary times.Keywords: Race. This paper deals with the idea of the search for self, mainly in the thinking of Karl Jaspers. The discussion will focus on the very nature of this search and the power that motivates it. For this purpose, it will employ a phenomenological viewpoint that will follow Jaspers’ course from its first point of departure, in which the self appeared. As an object of observation, up to the point where the self acquired the status of the subject, i.e., appeared as (...) a personal and existential issue. The positively achieved insights about the self and the frustrations involved in this search will be clarified systematically. The author argues that Jaspers’ search was inspired by a constant experience of dissatisfaction, which directed the self to transcend every present understanding of the self and to look for an improved one. Lastly, the search for the self will appear as leading to another search, i.e. that for Being and transcendence. (shrink)

Developments in professional practice can be related to ongoing changes in relations of power among professionals, which often lead to changes in the boundaries of practices. The differing contexts of practices also influence these changing relations among health professionals. Legislation governing professional practice also differs from country to country. In Brazil, over the past 12 years, in a climate of deep disagreement, a new law to regulate medical practice has been discussed. It was sanctioned, or made into law, but with (...) some notable changes, in July 2013. Of interest to us in this paper are the ways the proposed legislation, by setting out the boundaries and scope of medical practice, ‘interfered’ in the practices of other health professions, undermining many ‘independent’ practices that have developed over time. However, even taking into account the multiple routes through which practices are established and developed, the role of legislation that seems able to contradict and deny the historical realities of multiple, intersecting practices should be critically interrogated. In this paper, we use the theoretical resources of poststructuralist thinking to explore gaps, ambiguities, and power relations implicit in the discourses that constituted this law. We argue that although the new law can be understood as a social and political device that will interfere in the organization of other health professions’ practices, such legislation is only part of what constitutes change in a consolidated professional practice. And while it is important to understand the effects of such legislation, healthcare practices are also realized or ‘made real’ through ongoing relations of knowledge and power, including, as we will see in this case, activities of resistance. The problem, then, is to understand the practical arrangements, including legislation, traditions and routines, values and knowledge that come to shape the practices of nursing in a particular context. Señala el olvido de la perspectiva de género, mainstreaming, en el diseño de las políticas públicas familiares de los estados de bienestar europeos. Apunta a que tras ese olvido se esconde la división sexual del trabajo: hombres espacio productivo, mujeres tareas domésticas y la no consideración del trabajo doméstico y de los cuidados como trabajo. Finalmente, el artículo hace una revisión crítica de los (...) diez años de política de conciliación en España y distingue dos tipos de políticas públicas familiares: políticas de conciliación y políticas de igualdad. In this study, we analyzed the academic integrity policies of colleges in Ontario, Canada, casting a specific lens on contract cheating. We extracted data from 28 individual documents from 22-publicly-funded colleges including policies and procedures (n = 27) and code of conduct (n = 1). We analyzed the characteristics of the documents from three perspectives: (a) document type and titles; (b) policy language; and (c) policy principles. Then we examined five core elements of the documentation including (a) access; (b) approach; (...) (c) responsibility; (d) detail; and (e) support. Key findings revealed that specific and direct language pertaining to contract cheating was largely absent from the policy documents, that underlying policy principles lacked clear definition, and that exemplary policy has yet to be developed in this context. We conclude with recommendations for increased policy research in the area of academic integrity and a call for policy revision in Canadian higher education institutions to more explicitly address the issue of contract cheating, as well as provide more support to students and other campus stakeholders to better understand how contract cheating impacts and impedes teaching and learning. The question „what is reality?“ that opens Realontologie (1923), the establishing book in Hedwig Conrad-Martius’s (CM) oeuvre, establishes her realistic metaphysics. In her opinion, the firmly established „blinding insight“ in modern philosophy regarding the unfathomable contrast between the ideal and the real blocks any access to the question of reality. Her realontological philosophy seeks the „gate of reality“, meaning the datum-point where things „elevate“ themselves from non-existence or mere ideal existence but do not yet arrive at „operative Being“ or realistic (...) fulfillment. CM identifies three characteristics of the real by which it meets the „task of Being“ imposed upon it to personally describe and fulfill the essence inherent in it: formationality (Leibhaftigkeit), self-standing and primordiality. The suggested interpretation of each of these three seeks to unravel the seeming contrast between the real and the ideal in favor of what she regards as the only genuine and primordial opposition that separates the real from nonexistence. _Husserl and Other Phenomenologists_ addresses a fundamental question: what is it in the thinking of the founding father of phenomenology, Edmund Husserl, that on the one hand enables the huge variety in the phenomenological discourse and, at the same time, necessitates relying on his phenomenology as a point of departure and an object before which philosophizing is conducted. The contributors to this volume, each with his or her own focus on a specific figure in the phenomenological school vis-à-vis Husserl's thinking, (...) demonstrate that every reference to Husserl is necessarily bound up with modifying his ideas and crossing the boundaries of his phenomenology. In this sense, and given the insight that Husserlian phenomenology is already imbued with the potential modifications and revisions, the post-Husserlian phenomenologies may be included together with Husserl in one so-called ‘Phenomenological Movement’. The discussions in the book open for philosophers and intellectuals a window upon phenomenology, which has been one of the richest and most influential cultural phenomena since its very appearance at the beginning of the twentieth century. The book also conveys the complex interpretive dynamic within which a given framework of ideas becomes a sort of magnetic field, with attracting and repelling forces acting on its participants, and thanks to which the great ideas of modernity maintain their vitality and relevance a hundred years after their first appearance. The article seeks to elucidate the status of transcendence in the historiography of secularization through the perspective of collective memory. It discusses two typological models dealing with the basic metaphysical problem concerned with the presence and meaning of transcendence in real human existence. According to the first, the historical reality of secularization causes a break from the collective memory whose roots are in religion. In contrast, the second model considers that despite the deep transformations in the status of religion in (...) a reality of secularization, an experience of historical continuity may also occur there. These models denote the two poles in the argument about the meaning and value of history for modern people. The article suggests a phenomenological analysis of the two models and criticizes their deficiencies. Finally, the “tension model” is outlined as a third alternative that aims at overcoming the binary situation created by the first two in favor of a perspective that necessitates and contains both immanence and transcendence. The widely accepted approach in scholarly literature on Hannah Arendt’s The Human Condition emphasizes its political meaning and implications while neglecting its ontological dimensions. Against this trend, in this article I seek to uncover the implicit ontology that underlies her conception of the human condition. This human ontology appears to be comprised of five realms – the private, the public, intimacy, the social and the self. While Arendt explicitly bases her conception upon the first two, the paper shows that the (...) remaining three, although not defined as realms, are explored by her as such. These appear as autarchic contexts of human activity, which are not supposed to refer to each other. The problematic of this split between the different realms is widely discussed in the paper. Yet, the split of the self from the two pivotal realms – the private and the public – acquires a special interest, for it undermines the entire project of the human condition. (shrink)

This is a study of the work of the German philosopher Karl Jaspers (1883-1969), from his beginnings as a young psychiatrist to his mature days as an existentialist philosopher. This critical study of Jasper's philosophy traces his effort to instill meaning into the human quest for self-understanding and reveals the difficulties and frustrations inherent in this search. The book presents to the reader Jasper's attempts to deal with these difficulties by means of a philosophical approach to the concept of being (...) as a whole, beyond the individual – the other, the world and transcendence. In this book the author conducts an ongoing dialogue with existing research on Jasper's works and proposes a new reading for them. Along with a critical interpretation, the author reveals the challenges that the figure of Jaspers posed to his readers. Unlike most researchers, who ignored Jasper's early writings dealing with psychiatry and psychology, this book proposes a philosophical reading of these works, revealing the unity of the world in which Jaspers created – first as a psychologist and later as a philosopher. This approach enables the reader to discover in Jasper's work a daring effort to formulate an original philosphy regarding two basic concepts central to philosophy and human culture throughout all times – "selfhood" and "being". This article discusses the main arguments of Hedwig Conrad-Martius against the worldview of idealism in connection to her phenomenological idea of reality. The discussion focuses on her most far-reaching critical argument concerning the damage caused by idealism to the possibility for metaphysics by turning the real into the ideal, thereby reducing reality to an idea. This article analyses Conrad-Martius’ understanding of the evolution of idealism and of her criticism regarding the metaphysical absolutizing of the ideal in idealism. This article aims to identify the main cultural factors that have contributed to East Timor’s conflict with Indonesia by increasing vulnerability, instability and violence and at presenting the structural fazes of the conflict. Please note that despite being grouped into categories, many of the cultural conflict factors are, infact, closely inter - linked and often act to reinforce one another.

The pivotal insight that paved Conrad-Martius’ (1880–1966) (CM) way in elucidating the ontological exclusivity of the I, denoted as “I-adhering being” (Ichhaftes Sein), is that despite its peculiarity and incomparability to any other mode of being, only the ontological foundations of the real being in general might enable a faithful comprehension of the I. The phenomenological interpretation suggested in this article presents CM’s ontological understanding of the I vis-a-vis her philosophy of Being, in particular in regard to three of its (...) general characteristics – existence, intelligibility, and self-adherence (Sichheit/Selbsthaftigkeit) – which provide the critical approach to the ontological study of the I. Finally, the understanding of the ontological exclusivity of the I-adhering being is achieved by means of an explication of the joining together of its typical affinities and discrepancies in regard to Being in general. This article seeks to extricate and explicate the unique vocabulary that was consolidated by the realistic phenomenologist Hedwig Conrad-Martius in her establishing book Realontologie, published in 1923. Among the concepts are: “Essence”, “Bearer”, Self-adherence, Capability, Tangentiality, Incorporation, Internality, “Quiet,” Fullness, Depth, Layeredness, Abyss, and others. CM does not always coin them as distinguished concepts, but they function as philosophical concepts due to the meaning she pours into them and the way she uses them. The author suggests that these terms can (...) inaugurate the realistic discourse on reality, which is noticeably almost absent in the modern philosophy that has been almost sweepingly conquered by the literal and advanced idealistic discourse. According to Brehm's intensity of emotion theory, if an emotion has motivational properties, its intensity should be non-monotonically affected by factors similar to those determining the intensity of motivational states. These factors are called deterrents. In the case of emotion, one category of deterrents consists of factors that can potentially interfere with feeling the emotion, such as reasons for not feeling the emotion. Two experiments were carried out to examine whether happiness is a motivational state and, thus, if its intensity (...) is non-monotonically determined by the importance of reasons for not feeling happy. We expected happiness to be reduced by a low importance reason for not feeling happy, to remain high in the presence of a moderately important reason, and to be reduced or eliminated by a very important reason. Both experiments supported the cubic function that results from these expectations, and when the results of the two studies were combined, each of the individual legs of the cubic function was found to be reliable along with the cubic function itself.
