Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Autor prostredníctvom skúmania literárnych diel Charlesa Dickensa, Williama Makepeaca Thackeryho, George Eliotovej a Thomasa Hardyho vytvára mozaiku viktoriánskej morálky Anglicka 19. storočia. Dospel k záveru, že uvedená doba vôbec nebola taká puritánska, ako si ju zvykneme predstavovať a morálne problémy, ktoré ľudstvo rieši v priebehu svojho vývoja sú vo svojej podstate univerzálne, hoci nie totožné. Líšia sa vo svojich individuálnych podobách, v akých sa s nimi stretávame v jednotlivých obdobiach dejín ľudstva.

We make use of natural induction to propose, following John Ju Sakurai, a generalization of Bell's inequality for two spin s=n/2(n=1,2,...) particle systems in a singlet state. We have found that for any finite integer or half-integer spin Bell's inequality is violated when the terms in the inequality are calculated from a quantum mechanical point of view. In the final expression for this inequality the two members therein are expressed in terms of a single parameter θ. Violation occurs for θ (...) in some interval of the form (α,π/2) where α parameter becomes closer and closer to π/2, as the spin grows, that is, the greater the spin number the size of the interval in which violation occurs diminishes to zero. Bell's inequality is a relationship among observables that discriminates between Einstein's locality principle and the non-local point of view of orthodox quantum mechanics. So our conclusion may also be stated by saying that for large spin numbers the non-local and local points of view agree. (shrink)

The application of the state immunity doctrine with regard to the guarantee of access to court in the case-law of the European Court of Human Rights has been proved to be a complicated issue. In the ECHR’s case-law before the case Cudak v. Lithuania, the application of the state immunity doctrine had been considered as a proportionate restriction of the right of access to court even in cases of the realization of the protection of the jus cogens norm which was (...) very much criticized by the scholars of international law. Thus, the referral of the case Cudak v. Lithuania to the Grand Chamber could or should change the ECHR’s case-law in this sphere or at least develop certain criteria which would afford ground for a more effective protection to the right of access to court in cases of the application of the state immunity doctrine despite the fact that this right is not absolute. However, the case Cudak v. Lithuania has not fully satisfied these aims. Contrary, the case Cudak v. Lithuania left much obscurity, giving a strong indication that, what regards the realization of the right of access to court, the state immunity doctrine is more a material than a procedural ban, since the argumentation given by the ECHR in this case does not guarantee practical protection of this right. Ker nimamo avtorskih didaskalij, je celoten svet drame (vključno s psihično in materialno realnostjo) predstavljen izključno z besedami, ki jih govorijo dramski liki. Roman Ingarden imenuje takšen način predstavljanja shematična reprezentacija: na ta način predstavljeni predmeti so namreč samo skicirani, nešteta nedoločena mesta v njihovi predstavitvi vabijo bralca, da jih v procesu konkretizacije alirekonstrukcije zapolni z intelektualnimi in domišljijskimi operacijami in se pri tem opira na svoje znanje in izkušnje. Tako konkretizacijo kot rekonstrukcijo je treba ločevati od literarnega dela samega; (...) ker ju oblikuje bralec s svojo domišljijsko dejavnostjo, predstavljata oviro pri spoznavanju dela samega. Ingardnovo teorijo so kritizirali prav zaradi tega, ker daje bralcu preveč manevrskega prostora pri konstituiranju in tudi pri rekonstrukciji literarne umetnine (Ray, Kos, Holub, Calinescu). Zdi se, da te kritike temeljijo v nekoliko poenostavljenem razumevanju Ingardnove izredno kompleksne analize, v kateri se kaže, da je vloga bralca sicer omejena s tekstom, a vendarle vitalnega pomena za sekundarno eksistenco literarne umetnine. V članku so obravnavani neverbalni dejavniki motivacije v Sofoklovi tragediji; razdeljeni so v tri skupine: značajske poteze, dramska klima in čutne izkušnje. Članek se zaključi z analizo Odisejeve neverbalne motivacije v tragediji Ajant, ki predstavlja poseben primer, saj je tu odločilni dejavnik motivacije Odisejeva izkušnja numinoznega. (shrink)

V Heteronomiji umetnosti in avantgard se Aleš Erjavec ukvarja zlasti z radikalnimi politiziranimi avantgardami, se pravi s futurizmom in s konstruktivizmom, in tako nadaljuje svoje delo z začetka osemdesetih let 20. stoletja, ko je pričel svojo "ekspedicijo na severni pol človeškega duha". V pričujoči študiji so tako posebne pozornosti deležne radikalne avantgarde ter politična in ideološka vloga novejše umetnosti, še zlasti one z vzhoda. Nekateri vidijo v teh avantgardah skrajno obliko modernizma, drugi jih obravnavajo kot specifični vzhodnoevropski pojav, tretji pa (...) jih preprosto zreducirajo na njihove zahodne ekvivalente. Podobna ali celo še bolj neustrezna podoba spremlja postsocialistične avantgarde oziroma avantgarde tretje generacije. Te so bile imenovane nekonformistična in neuradna umetnost, vzhodni modernizem, konceptualna umetnost itd. Erjavec dokazuje, da se estetsko krilo teh avantgard v resnici navezuje na estetske avantgarde z začetka 20. stoletja, s čemer so klasične avantagarde s postsocializmom doživele svojo postmoderno ponovitev. In kakor avantgarde nenehno reflektirajo svoj odnos do siceršnje umetnosti, tako tudi estetika kot del filozofije reflektira svoj odnos do umetnosti in avantgarde, pa če ju dojemamo kot avtonomni ali heteronomni. V nadaljevanju obravnava novejšo zgodovino umetnosti in kulture v Vzhodni Evropi. (shrink)

Gregory Vlastos je v svoji znani rekonstrukciji argumenta »tritos anthropos« menil, da je regres tretjega človeka usodna napaka platonske teorije idej, saj vpeljuje najmanj dve protislovni logični značilnosti tega nauka: predpostavlja namreč dve načeli, samopripis in neistovetnost. Argument tretjega človeka zato obravnavam na podlagi upoštevanja omenjenih načel in njune veljavnosti v dveh inačicah, ki ju je podal Aleksander Afrodizijski. V prvi, ki je tradicionalno pripisana Aristotelu pod imenom O idejah in jo najdemo v Aleksandrovem komentarju k Metafiziki, in nato še (...) v Evdemovi inačici, kakršno domnevno ta navaja pri svoji aristotelski kritiki Platonove teorije idej. V drugem delu prispevka je narejena primerjava med Aristotelovima inačicama tretjega človeka in Platonovim pripoznanjem neskončnega regresa v obeh verzijah iz njegovega Parmenida: regres iz ideje velikega in regres iz idej kot vzorov, ki prav tako končujeta v neskončnem regresu novih idej: te po svojem bistvu ne bodo več ene, ampak brezmejno mnoge. »In vino metaphora« pomeni delno slavljenje Nietzschejevega preseganja nihi-lizma. Za afirmacijo življenja v voljo do moči kot izvoru vse dejavnosti, ki ustvarja vrednote se izkaže, da presega nihilizem, ki ga Nietzscheju pogosto očitajo njegovi kritiki. Ena od pomembnejših oblik volje do moči v tem smislu je intoksikacija ali dionizicno. V Nietzschejevem zgodnjem opusu je bilo dionizicno metafizično in umetniško načelo. Njegov kasnejši opus kontrastira dionizicno intoksikacijo z drugimi oblikami in dionizicno postane tako psihološki kot fiziološki pojav. Članek tudi primerja Nietzschejeve (...) poglede o intoksikaciji s pogledi Walter j a Benjamina ter ju obravnava v zvezi s pojavi kakršna sta rock glasba in severnoameriško izkustvo šestdesetih let. We propose a three-way interaction model based on substitutes for leadership theory to explore the relationship among ethical leadership, moral personality, and moral ideology on two types of employee voluntary behaviors. Results from a sample of 218 supervisor–subordinate dyads indicate that moral personality attenuates the relationship between ethical leadership and employee voluntary behaviors. Idealism serves as the boundary condition for the moderating effect of moral personality. Pregledujem sedanje slepe ulice zahodne filozofije in predlagam nov začetek. V sedanjem trenutku prevladujejo tri najmočnejše pojmovne opcije; skepticizem, kognitivni privilegij in historicizem. Prvi je škandal, drugega zavračajo vse strani, tretji pa je trenutno dokaj zanemarjen. Historicizem ali zgodovinskost - pojem, daje mišljenje notranje historizirano, da je mišljenje zgodovina - je edini velik nov prispevek moderne filozofije k glavnim pojmovnim virom zahodne tradicije. Sodobna filozofija, posebno angloameriška analitična filozofija, je v bistvu nadaljevanje filozofije 17. stoletja in predkantovske filozofije 18. stoletja, (...) ki ju begajo »nepomembnosti« 19. stoletja; kontinentalna filozofija, v glavnem francoska in nemška, pa se je zdaj pripravljena prilagoditi ahistoricizmu analitične filozofije. Predlagam ponovno odkritje historicizma in prepoznam številne različne strategije, ki dajejo prednost taki politiki, za katero napovedujem, da bo še enkrat prišla na vrsto v naslednjem stoletju. Še posebej skrbno raziskujem vidike prve filozofije, zaprtih sistemov, rešitev problemov reference in predikacije, odnos med naravo in kulturo, odnos med realizmom in idealizmom in naravo ter funkcijo osebe ali sebstva. Ugotavljam, da se sodobna filozofija mora spoprijeti s prispevki Kantovega konstruktivizma in Heglove simbioze in iti preko obeh. Med dokazovanjem orišem splošno krivuljo zahodne filozofije vse do današnjih časov. (shrink)

Alfred Edward Housman (1859–1936), ki je kasneje postal angleški pesnik in eden največjih filologov svojega časa, je svoj zafrkantski »fragment« objavil pri triindvajsetih, leta 1883, v reviji Bromsgrovian. Revijo je izdajala Bromsgrove School, kjer se je šolal kot najstnik (1870–77); na šolo, ki je prva prepoznala njegov jezikovni in pesniški talent, se je za kratek čas (1881–82) vrnil kot pomožni učitelj po ne­pričakovanem študijskem porazu na Oxfordu. Kot ugotavlja Ralph Marcellino, ni naključje, da besedilo paro­dira predvsem Ajshila, ki je bil (...) Housmanov najljubši pesnik. V njem odzvanja Oresteja, zlasti drami Agamemnon in Prinašalke pitnih darov, verjetno zato, ker so ju dijaki na šoli, kjer je poučeval, pri pouku največ brali. Prav ta ciljna publika je znala ceniti norčevanje iz retoričnih figur ter sintaktičnih konstrukcij, ki jim jih je njihov pomožni učitelj vbijal v glavo. (shrink)

K?ú?ový zlomok – „po?iatkom výchovy je skúmanie mien“ – je dokladom o úzkom spojení logiky a etiky, aké môžeme nájs? aj v Platónových a Xenofóntových dialógoch. Autor ?lánku porovnáva Antisthenov koncept paideie s Isokratovým rétorickým ideálom a poukazuje na variácie sókratovského modelu výchovy u významných predstavite?ov Sókratovho krúžku . Na rozdiel od Platóna Antisthenés neprejavuje záujem o metafyzické rozvinutie náuky svojho u?ite?a, ale ponúka pozitívny etický ideál, ktorý treba (...) nasledova?. Práve v tomto bode neskôr na sókratovskú tradíciu nadviazali kynici a stoici, pri?om kynici kládli vä?ší dôraz na osobnú etiku, zatia? ?o stoici ju dop??ali aj logickými skúmaniami. (shrink)

Banks play a unique role in society. They not only maximize profits but also consider the interests of stakeholders. We investigate whether banks consider firms’ pollution records in their lending decisions. The evidence shows that banks offer significantly higher loan spreads, higher total borrowing costs, shorter loan maturities, and greater collateral to firms with higher levels of chemical pollution. The costly effects are stronger for borrowers with greater risk and weaker corporate governance. Further, the results show that banks with higher (...) social responsibility account for their borrowers’ environmental performance and charge higher loan spreads to those with poor performance. These results support the idea that banks with higher social responsibility can promote the practice of business ethics in firms. (shrink)

For millennia, diagnosticians distinguished natural sadness that arose from social circumstances from depressive disorders that were disproportionate to their contexts. In 1980, the DSM-III transformed this tradition through equating depressive disorders with symptoms without regard to context. Nevertheless, it excluded grieving people without especially severe or enduring symptoms from diagnosis. Subsequently, considerable empirical research indicated that bereavement was not unique but a model for all stressor-maintained conditions. Yet, despite the evidence showing that the causes, prognoses, and optimal treatments for context-specific (...) depressions differ from those that aren’t, the DSM-5 removed the bereavement exclusion from the diagnostic criteria for major depression. This article considers the reasons behind this elimination and its implications for the research, labeling, and treatment of depression. (shrink)

Er hat auf vielfältigen Gebieten gearbeitet, unter anderem zur Metaphysik und ihrem Grundbegriff der Substanz, zu grossen Philosophen von der Antike bis zur Gegenwart, zur philosophischen Aktualität der jüdischen Tradition, vor allem aber zur Philosophie Nietzsches. The global corporate scandals such as Enron, Worldcom and Global Crossing have raised fundamental issues of business ethics as well as economic, social and anthropological questions concerning the nature of business competition and global capitalism. The purpose of this conceptual paper is to introduce the concept of "welfare exchange" to the existing notions of economic, social and anthropological notions of business and exchange in markets and society in the 21st century. Global competition and business success in the 21st century continue (...) to raise the nature of economic value and the interaction among diverse actors in international markets, institutions and society. We believe that the nature of such exchange between consumers and organizations, which can also be termed social marketing, need to increasingly take into account a welfare and ethical component. Prispevek kritično obravnava znano Bobbievo tridelbo pravnega pozitivizma na pozitivizem kot splošni pristop k učenju prava, nauk o pravu in ideologijo. Avtor uvodoma opozori na nekaj problemov same tridelbe, nato pa se osredotoči na Bobbievo samoopredelitev znotraj nje. Na primeru Bobbieve obravnave pojmov temeljne norme in pravila priznavanja pokaže, kako ga njegovo kasnejše zavračanje teh dveh pojmov nezavedno privede do sprejemanja pravnega pozitivizma kot nauka o pravu in pravne ideologije – ki ju je sicer zavračal. Avtor vidi razlog za ta (...) nezavedni Bobbiev zdrs predvsem v njegovi vpetosti v specifično pravnokulturno okolje, ki ga prežema notranji pogled na pravo. Ob tem predlaga, da zavrnemo tridelbo pravnega pozitivizma in ga namesto tega proučujemo kot skupek ne vedno ločljivih stališč, ki tvorijo specifično pravnokulturno okolje. (shrink)

ABSTRACT In this paper we argue that the standard focus on problems of informed consent in debates about the ethics of human experimentation is inadequate because it fails to capture a more fundamental way in which such experiments may be wrong. Taking clinical trials as our case in point, we suggest that it is the moral offence of using people as mere means which better characterizes what is wrong with violations of personal autonomy in certain kinds of clinical trials. This (...) account also helps bring out another important way in which the autonomy of the participants in clinical trials my be violated, even in cases where they have given informed consent to their involvement. Where relevant information about the trial is framed in such a way as to induce a patient's participation by appeal to their nonrational preferences, this is also a violation of their autonomy, and one which is distinct from a failure of informed consent. The underlying wrongness of both kinds of violations, we argue, is plausibly captured by the moral offence of using people as mere means. (shrink)

This article examines the configuration of domestic service within local milieus under globalization. Using Taiwan as a case study, the author argues that the state continues to have an impact even in this age of global interdependence. The management of foreign domestics within employers’ households is not only important for labor control but also central to the state’s administration over alien subjects. Knjiga, ki ji je posvečena pričujoča recenzija, prinaša prevod dveh krajših Bonaventurovih del, O trojni poti (De triplici via) in Kako se različne umetnosti zvajajo na teologijo (De reductione artium ad theologiam). Prevedla ju je filozofinja in klasična filologinja Nena Bobovnik, ki na KU Leuven pripravlja doktorat iz srednjeveške filozofije. Poleg spremne besede z naslovom »Zaris srednjeveške in skicaBonaventurove filozofije« sta še dva uvoda v piščevo misel. Najprej tri kateheze, ki jih je papež Benedikt XVI. – ki se je na (...) Bonaventurovo teologijo zgodovine osredotočil v habilitacijski nalogi – spomladi leta 2010 posvetil svojemu »prijatelju«, kot se sam izrazi; nato pa še esej »Teološko-filozofska hermenevtika pri sv.
