Beginning with one of the most remarkable characteristics of cyber art, ‘interactivity’, in a context of generalized hybridization of the procedures and technological devices available in the current hyper-technological era, this article will highlight the festive dimension within contemporary artistic practices, especially in its technological and digital components. In order to take both its ‘creationist’ and ‘reflexionist’ aspects into consideration, the proposed interpretation will adopt as its starting point the questions introduced by classical anthropology about festivity: What establishes community in (...) cyber art? Which kind of community is established there and what is sacrificed in digital or cybernetic art? These questions are articulated with the discussion proposed by Hans-Georg Gadamer and Richard Schechner about the task of building the reflexive play that is found in the work of art as such. The purpose is to gradually present, throughout the article, the peculiarity of the experience of ‘the festive’ in computing and numerical arts. (shrink)

This article explores Leila Ahmed’s A Border Passage, and Nawal El Saadawi’s Memoirs from the Women’s Prison, A Daughter of Isis, and Walking Through Fire. It contrasts their works and argues that location and genderawareness play an important role in the writing of autobiographies. The focus is on showing how El Saadawi’s positioning as a feminist activist in Egypt and Ahmed’s location in the USA determine the texts’ themes and shape the construction of the autobiographical “I.”.

As artificial intelligence technologies become increasingly prominent in our daily lives, media coverage of the ethical considerations of these technologies has followed suit. Since previous research has shown that media coverage can drive public discourse about novel technologies, studying how the ethical issues of AI are portrayed in the media may lead to greater insight into the potential ramifications of this public discourse, particularly with regard to development and regulation of AI. This paper expands upon previous research by systematically analyzing (...) and categorizing the media portrayal of the ethical issues of AI to better understand how media coverage of these issues may shape public debate about AI. Our results suggest that the media has a fairly realistic and practical focus in its coverage of the ethics of AI, but that the coverage is still shallow. A multifaceted approach to handling the social, ethical and policy issues of AI technology is needed, including increasing the accessibility of correct information to the public in the form of fact sheets and ethical value statements on trusted webpages, collaboration and inclusion of ethics and AI experts in both research and public debate, and consistent government policies or regulatory frameworks for AI technology. Today, the US pursues the global capture of data (understood as a significant engine of growth) by way of bi- and plurilateral trade agreements. However, the project of securing the global free flow of data has been pursued ever since the dawn of digital telecommunication in the 1960s and the US has made significant legal efforts to institutionalise it. These efforts have two phases: In the first 1970s and 80s “freedom of information” phase, the legal justification (and contestation) of the (...) global free flow of data hinged on imagining data as information, and its exchange as a practice of liberty. The second phase began in the late 1990s and continues today. In this phase, the free flow of data is aligned with a free-trade agenda in the context of first e-commerce and, starting in the 2000s, through attempts at creating a global public domain of personal data for the platform economy. The global free flow of data is an intrinsic aspect of informational capitalism. Assuming a constitutive, but not commanding role for law in informational capitalism, we conclude that the US attempt at ensuring free flow for its informational corporations is neither an entirely contingent nor a necessary outcome. A concretização do direito à saúde deve ser viabilizada pelo Estado, com foco na efetivação das políticas públicas para garantia da implantação e funcionamento dos serviços demandados pelos respectivos grupos populacionais. Destarte, essa escrita objetivou analisar como o direito à saúde é contemplado em comunidades quilombolas de uma região geográfica baiana. Metodologicamente enquadra-se como de abordagem qualitativa, com informações obtidas por meio de entrevistas estruturadas (sobre a infraestrutura e/ou serviços públicos de saúde) desenvolvidas com as representações das Associações de Moradores (...) de 14 quilombos da região geográfica de Guanambi/Bahia durante o ano de 2016. Os achados indicam que uma comunidade possuía estrutura física específica para atendimentos básicos em saúde, no entanto, estava desativada. Três comunidades não tinham cobertura do Programa de Agentes Comunitários de Saúde (PACS). Entre as 11 que indicaram cobertura do Programa, em sete as(os) profissionais não residiam no território do quilombo. Diante da ampla ausência de infraestrutura e recorrente inadequação na prestação de serviços do PACS, evidencia-se a permanente negligência ao direito à saúde nesta população quilombola. (shrink)

This paper investigates the effect of female representation on the board of directors on corporate response to stakeholders’ demands for increased public reporting about climate change-related risks. We rely on the Carbon Disclosure Project as a sustainability initiative supported by institutional investors. Greenhouse gas emissions measurement and its disclosure to investors can be thought of as a first step toward addressing climate change issues and reducing the firm’s carbon footprint. Based on a sample of publicly listed Canadian firms over the (...) period 2008–2014, we find that the likelihood of voluntary climate change disclosure increases with women percentage on boards. We also find evidence that supports critical mass theory with regard to board gender diversity. These findings reinforce initiatives being undertaken around the world to promote gender diversity in corporate governance while demonstrating board effectiveness in stakeholder management. (shrink)

Whereas the concept of "socialist rule of law" punctuated political discourse in the late 1990s, the idea of a "socialist harmonious society" is today casting a strange light on Chinese legal reform. Is there a Confucian vision of China's marketing law and practice? To what extent have China's norms for marketing, mainly intellectual property and advertising law, been challenged by the new government policy toward a harmonious society? In the post World Trade Organization accession period, the theoretical framework of the (...) "socialist harmonious society" has turned law into a disciplinary principle given over to society's moral construction. If law is seen as an instrument for legitimizing power, it remains implicitly bound primarily to ensure the regime's durability. Although more and more ordinary citizens and foreign companies are seizing hold of normative tools being put at their disposal, this does not necessarily mean that Chinese law is implemented in a uniform and timely manner throughout China's territory. China still suffers from a lack of coherence and political will in the drafting of a legal reform that aims mainly at preserving the current fragile political balance. Contradictory forces are indeed at work in this legal construction that is torn between liberal leanings and socialist authoritarianism. Without a deep change in perspective, one can expect only relatively slow progress in protecting the intellectual property rights of the many Chinese and foreign goods and services that can be found on the Chinese market. Dung’s (1995) argumentation framework takes as input two abstract entities: a set of arguments and a binary relation encoding attacks between these arguments. It returns acceptable sets of arguments, called extensions, w.r.t. a given semantics. While the abstract nature of this setting is seen as a great advantage, it induces a big gap with the application that it is used to. This raises some questions about the compatibility of the setting with a logical formalism (i.e., whether it is possible to (...) instantiate it properly from a logical knowledge base), and about the significance of the various semantics in the application context. In this paper we tackle the above questions. We first propose to fill in the previous gap by extending Dung’s (1995) framework. The idea is to consider all the ingredients involved in an argumentation process. We start with the notion of an abstract monotonic logic which consists of a language (defining the formulas) and a consequence operator. We show how to build, in a systematic way, arguments from a knowledge base formalised in such a logic. We then recall some basic postulates that any instantiation should satisfy. We study how to choose an attack relation so that the instantiation satisfies the postulates. We show that symmetric attack relations are generally not suitable. However, we identify at least one ‘appropriate’ attack relation. Next, we investigate under stable, semi-stable, preferred, grounded and ideal semantics the outputs of logic-based instantiations that satisfy the postulates. For each semantics, we delimit the number of extensions an argumentation system may have, characterise the extensions in terms of subsets of the knowledge base, and finally characterise the set of conclusions that are drawn from the knowledge base. The study reveals that stable, semi-stable and preferred semantics either lead to counter-intuitive results or provide no added value w.r.t. naive semantics. Besides, naive semantics either leads to arbitrary results or generalises the coherence-based approach initially developed by Rescher and Manor (1970). Ideal and grounded semantics either coincide and generalise the free consequence relation developed by Benferhat, Dubois, and Prade (1997), or return arbitrary results. Consequently, Dung’s (1995) framework seems problematic when applied over deductive logical formalisms. (shrink)

ABSTRACT Banks provide a valuable but inherently unstable combination of deposit‐taking and lending functions that were successfully held together for several decades after the New Deal by tough banking rules. The weakening of the rules after the 1970s promoted the displacement of traditional relationship‐based banking with securitized, arms‐length alternatives that encouraged banks to undertake activities about which bankers lacked deep relationship‐based knowledge of the risks. Ironically, this risky behavior, encouraged by loosened regulation, was reinforced by progressively tightened securities regulation, which (...) promoted stock‐market liquidity but also deprived large banks (and other publicly traded companies) of oversight by investors with “insiders’” knowledge. Both the underregulation of banking and the overregulation of securities were underpinned by economic theories that favored blind diversification in liquid, anonymous markets, and that ignored the value of relationship‐based knowledge and case‐by‐case due diligence. Since Xi Jinping has taken office in 2012, China’s political repression has only but intensified so that the regime is definitively turning away from the 1990s legal reforms and the many expectations that followed in terms of rule of law and other rights fostering. In replacing these recent developments in a larger perspective including that of a “socialist harmonious society”, which had already shaded a particular light on Chinese reforms, this article proposes to envisage contemporary Chinese legal culture in an (...) evolutionary and theoretical framework. In doing so, it stresses the tensions between a language of rights now fully integrated by the Chinese citizens and the politics of law used, in a last legal ditch struggle, by the Chinese Communist Party as a tool for social stability in disciplining the people by all means including by the threat of its very legal creations. It then concludes in reflecting upon the legal culture emerging out of this great divide between the people and the State. (shrink)

This article discusses findings from a mixed method literature review that investigated cancer patients’ perceptions of what constitutes a good nurse. To find pertinent articles, we conducted a systematic key word search of five journal databases (1998—2008). The application of carefully constructed inclusion criteria and critical appraisal identified 12 relevant articles. According to the patients, good nurses were shown to be characterized by specific, but inter-related, attitudes, skills and knowledge; they engage in person-to-person relationships, respect the uniqueness of patients, and (...) provide support. Professional and trained skills as well as broad and specific nursing and non-nursing knowledge are important. The analysis revealed that these characteristics nurtured patient well-being, which manifests as optimism, trust, hope, support, confirmation, safety and comfort. Cancer patients’ perceptions of what constitutes a good nurse represent an important source of knowledge that will enable the development of more comprehensive and practice-based views on good nursing care for such patients. These perceptions help us to understand how nurses effectively make a difference in cancer patient care. (shrink)

This chapter gives a survey of the field of philosophy where the philosophical foundations of modern logic were discussed and where such themes of logic were discussed that were on the borderline between logic and other branches of the philosophical enterprise, such as metaphysics and epistemology. The contributions made by Gottlob Frege and Charles Peirce are included since their work in logic is closely related to and also strongly motivated by their philosophical views and interests. In addition, the chapter pays (...) attention to a few philosophers to whom logic amounted to traditional Aristotelian logic and to those who commented on the nature of logic from a philosophical perspective without making any significant contribution to the development of formal logic. Recently, the second author, Briseid, and Safarik introduced nonstandard Dialectica, a functional interpretation capable of eliminating instances of familiar principles of nonstandard arithmetic—including overspill, underspill, and generalizations to higher types—from proofs. We show that the properties of this interpretation are mirrored by first-order logic in a constructive sheaf model of nonstandard arithmetic due to Moerdijk, later developed by Palmgren, and draw some new connections between nonstandard principles and principles that are rejected by strict constructivism. Furthermore, we introduce a variant of (...) the Diller–Nahm interpretation with two different kinds of quantifiers, similar to Hernest’s light Dialectica interpretation, and show that one can obtain nonstandard Dialectica by weakening the computational content of the existential quantifiers—a process called herbrandization. We also define a constructive sheaf model mirroring this new functional interpretation, and show that the process of herbrandization has a clear meaning in terms of these sheaf models. (shrink)

The impact of stress and other psychological variables on Inflammatory Bowel Disease prognosis, treatment response, and functional level is well-established; however, typical IBD treatment focuses on the physiological pathology of the disease and neglects complementary stress-reducing interventions. Recent pilot studies report the benefits of mindfulness-based interventions in people living with IBD, but are limited by small sample sizes. Recruitment challenges to in-person studies may be in part due to the difficulty IBD patients often have adhering to fixed schedules and travel (...) as a result of IBD symptoms such as pain, fatigue, and incontinence. The current study aimed to address this barrier by offering participants access to online mindfulness training, allowing individuals to engage with intervention materials to fit their own schedule. Online mindfulness programs have gained popularity in recent years, as they increase access and flexibility and decrease cost to the user; however, the dropout rate tends to be high. The current study compared the rate of adherence and efficacy of mindfulness training as a function of level of support: self-guided versus supported. Analysis revealed no significant difference in the benefits received between participants in the two groups; however, a significant difference group was found in terms of rate of completion, with 44.1% of the supportive group completing the protocol compared to 11.7% of the self-guided. Common challenges to meditation were measured, but did not significantly predict adherence to the intervention, and experience of these challenges did not significantly change over the duration of the study. Implications of the current research, future directions for the use of MBI for IBD patients, and a discussion of methodological considerations are provided. (shrink)

This article explores the traditional basis of modern human rights doctrines and exposes some of the systemic shortcomings. It then posits that a number of these problems are advanced via integrating some developments in the philosophy of science and substantive scientific research into legal philosophy. This article argues that supervening holism grounded in quantum mechanics provides an alternative basis to human rights by positing an ontological construct that is congruous with many of the wisdom traditions practiced around the world. This article presents the results of a case study that aims to highlight the processes by which French female migrants in London and Manchester attempt to de/re/construct identities to negotiate the challenges of the cultural and social structures in England. This research centres on 15 semi-structured interviews with French women residents of diverse backgrounds. The interviews conducted represent counter-narratives to existing studies which focus only on highly skilled French migrants in London and define them as free movers and ‘invisible migrants’. (...) This study attempts to fill a gap by examining solely French women migrants in Manchester and London as a strategic research site for a number of key research questions taken from the current literature of intra-European migration, gender and identity. Indeed, the ways in which migrants negotiate their identity are crucial to migration studies and have to be analysed in relation to women’s specific experience. The study exemplifies how migrants’ identities are a ground of negotiation, contestation, deconstruction and reconstruction. Patterns that emerged in this study first highlight the high heterogeneity among women’s strategies of self-identification and definition and sense of belonging in a changing Europe. The article concludes by proposing a refined notion of transculturality as a useful concept for future explorations of changes in contemporary European societies and the role women can have in them. During a dialogue, agents exchange information with each other and need thus to deal with incoming information. For that purpose, they should be able to reason effectively about trustworthiness of information sources. This paper proposes an argument-based system that allows an agent to reason about its own beliefs and information received from other sources. An agent's beliefs are of two kinds: beliefs about the environment and beliefs about trusting sources . Six basic forms of trust are discussed in the paper (...) including the most common one on sincerity. Starting with a base which contains such information, the system builds two types of arguments: arguments in favour of trusting a given source of information and arguments in favour of believing statements which may be received from other agents. : In his paper "Explanation of Curiosity the First" Charles Peirce describes Euclid's procedure in proving theorems. Euclid first presents his theorem in general terms and then translates it into singular terms. Peirce pays attention to the fact that the generality of the statement is not lost by that move. The next step is construction, which is followed by demonstration. Finally the ergo-sentence repeats the original general proposition. Peirce lays much emphasis on the distinction between corollarial and theorematic reasoning in (...) geometry. He takes an argument to be corollarial if no auxiliary construction is needed. For Peirce, construction is "the principal theoric step" of the demonstration. Peirce also stresses that it is the observation of diagrams that is essential to all reasoning and that even if no auxiliary constructions are made, there is always the step from a general to a singular statement in deductive reasoning; that means introducing a kind of diagram to reasoning.This paper seeks to argue for two theses. One is that the way of thinking of reasoning which stresses the role of observation is essential to Peirce's discovery of the new logic. The other is that Peirce wants to consider both logical reasoning and philosophical thinking in general via the model of geometry. However, it is argued in this paper that it is the model of problematic analysis in geometry that is the most important for Peirce when he discovers the new structure of propositions. Moreover, this paper seeks to show that this very feature in Peirce's thought connects him with philosophers and logicians who emphasise the role of praxis instead of theoretic contemplation and that one who wants to reconstruct Peirce's metaphilosophical views must pay special attention to the model of problematic analysis.Key-words: construction; demonstration; corollarial and theorematic reasoning; diagrams.Resumo: Em seu artigo "Explanation of Curiosity the First", Charles Peirce descreve o procedimento de Euclides para demonstrar teoremas. Euclides primeiramente apresenta seu teorema em termos gerais, e então o traduz para termos singulares. Peirce presta atenção ao fato de que a generalidade do enunciado não é perdida por esse movimento. O próximo passo é a construção, que é seguida pela demonstração. Finalmente, a sentença-ergo repete a proposição geral original. Peirce dá bastante ênfase à distinção entre o raciocínio corolarial e o teoremático em geometria. Ele considera um argumento como corolarial se nenhuma construção auxiliar se fizer necessária. Para Peirce, a construção é "o principal passo teórico" da demonstração. Peirce também enfatiza que a observação de diagramas é essencial para todo raciocínio e que, mesmo se não são feitas construções auxiliares, há sempre o passo de um enunciado geral para o particular no raciocínio dedutivo; o que significa introduzir um tipo de diagrama no raciocínio.Este artigo procura defender duas teses. A primeira, que a maneira de pensar o raciocínio que enfatiza o papel da observação é essencial para a descoberta da nova lógica por Peirce. A outra, que Peirce deseja considerar tanto o raciocínio lógico quanto o pensamento filosófico em geral pelo modelo da geometria. Entretanto, defende-se neste artigo que o modelo de análise problemática em geometria é o mais importante para Peirce, quando ele descobre a nova estrutura das proposições. Este artigo procura mostrar, ainda, que é exatamente essa característica do pensamento de Peirce que o liga aos filósofos e lógicos que enfatizam o papel da práxis em vez da contemplação teórica, e que quem deseje reconstruir as visões metafilosóficas de Peirce deve prestar atenção especial ao modelo da análise problemática.Palavras-chave: construção, demonstração, raciocínios corolarial e teoremático, diagrama.
