I argue that assertion and practical reasoning must be governed by the same epistemic norm. This is because the epistemic rule governing assertion derives from the epistemic rule governing practical reasoning, together with a plausible rule regarding assertion, according to which assertion must manifest belief.

The “ontological turn” is a recent movement within cultural anthropology. Its proponents want to move beyond a representationalist framework, where cultures are treated as systems of belief that provide different perspectives on a single world. Authors who write in this vein move from talk of many cultures to many “worlds,” thus appearing to affirm a form of relativism. We argue that, unlike earlier forms of relativism, the ontological turn in anthropology is not only immune to the arguments of Donald Davidson’s (...) “The Very Idea of a Conceptual Scheme,” but it affirms and develops the antirepresentationalist position of Davidson’s subsequent essays. While consensus exists among many practitioners of ethics consultation about the need for and identification of core competencies and standards, there has been virtually no attempt to determine how these competencies and standards are best taught and assessed. We believe that clinical ethics consultation has reached a state of sufficient maturity that expert practitioners can evaluate those who are new to the field. We will outline several steps that can facilitate the creation of a certification process for clinical ethics consultants, (...) assuring the competency and quality of consultation for the patients, families, and healthcare professionals who utilize ECSs. It became obvious in classroom case discussions in a required MBA course, Corporate Social Responsibility and Business Ethics, that subjective opinion often prohibited complete and thorough case analyses. Over a two-year period an attempt was made to identify the parameters of situations involving corporate social responsibility in order to develop a methodology which would facilitate classroom learning. The model described in the following manuscript is the result of these efforts.

This article offers a thorough and critical reading of Husserl’s Thing and Space. This reading is principally motivated by the effort to methodologically design a phenomenological–topological approach to the research of lived sonic environments. In this book, Husserl lays foundations of phenomenological topology by understanding perceptions as places and defining, consequently, the space as a system of places. The critical reading starts with pointing out the ambiguity of location in Thing and Space, which consists mainly in the insufficient implementation of (...) the distinction between the location and the localization. Further investigations then reveal the roots of this ambiguity in both the preference of visual perception and the omission of subjective aspects of kinesthesia. The article critically examines Husserl’s notion of the appended localization that expresses the marginalization of acoustic experience. In conclusion, the article utilizes the critical findings to formulate the project of a place-based, medium-centered, and multi-sensory approach to sonic environments. (shrink)

We investigate the relationship between the dark triad personality traits (Machiavellianism, narcissism, and psychopathy) of managers and the practice of reporting manipulation using a primary survey of 837 professionals working in accounting and finance departments. We find that (a) managers who exhibit dark personality traits are associated with a higher prevalence of fraudulent accounting practices in their accounting and finance departments and (b) traditional risk management mechanisms are only partially effective in mitigating this effect. Internal audits are effective in curtailing (...) the negative behavior of managers with dark triad traits only if these internal audits are outsourced and performed by independent external personnel but not if they are conducted by internal personnel. This suggests that managers with dark triad traits are able to manipulate other employees quite effectively. Consequently, having external personnel perform the auditing task provides a safeguard against such unethical practices and manipulation. This finding has strong practical implications, as it provides support for outsourcing internal audits rather than keeping them in-house. (shrink)

There exist two notions of equivalence of behavior between states of a Labelled Markov Process (LMP): state bisimilarity and event bisimilarity. The first one can be considered as an appropriate generalization to continuous spaces of Larsen and Skou’s probabilistic bisimilarity, whereas the second one is characterized by a natural logic. C. Zhou expressed state bisimilarity as the greatest fixed point of an operator that there is such a process with an uncountable Zhou ordinal.

Morgan's canon can be construed as claiming that an intentional explanation of a behavior should be ruled out if there exists an explanation of this behavior in terms of 'lower' mechanisms. Unfortunately, Morgan's conception of higher and lower faculties is based on dubious evolutionary considerations. I examine alternative interpretations of the terms 'higher' and 'lower', and show that none can turn the canon into a principle that is both correct and useful in drawing the line between thinkers and non-thinkers. In (...) the process, I identify a number of problems that an adequate formulation of the canon should avoid. I then consider two more recent versions of the canon, proposed by Elliott Sober and Jonathan Bennett. Both are found unsatisfactory, but I argue that a version of Bennett's unity condition that is restricted to the attribution of recognitional concepts is on the right track. (shrink)

The wide-ranging and brilliant ideas of the French psychoanalyst Jacques Lacan have had a major influence on twentieth and twenty-first century thought. His 'followers' are loyal and legion. Yet his ideas are complex and were conveyed in a dense and abstract form. Lacan's detractors have accused him of obscurantism, pretentiousness and even incoherence. Context Opioid treatment agreements (OTAs) are documents that clinicians present to patients when prescribing opioids that describe the risks of opioids and specify requirements that patients must meet to receive their medication. Notwithstanding a lack of evidence that OTAs effectively mitigate opioids’ risks, professional organizations recommend that they be implemented, and jurisdictions increasingly require them. We sought to identify the jurisdictions that require OTAs, how OTAs might affect the outcomes of lawsuits that arise when things go wrong, and instances in (...) which the law permits flexibility for clinicians and health care institutions to adopt best practices. -/- Methods We surveyed the laws and regulations of all 50 states and the District of Columbia to identify which jurisdictions require the use of OTAs, the circumstances in which OTA use is mandatory, and the terms OTAs must include (if any). We also surveyed criminal and civil judicial decisions in which OTAs were discussed as evidence on which a court relied to make its decision to determine how OTA use influences litigation outcomes. -/- Findings Results show that a slight majority (27) of jurisdictions now require OTAs. With one exception, the jurisdictions’ requirements for OTA use are triggered at least in part by long-term prescribing. There is otherwise substantial variation and flexibility within OTA requirements. Results also show that even in jurisdictions where OTA use is not required by statute or regulation, OTA use can inform courts’ reasoning in lawsuits involving patients or clinicians. Sometimes, but not always, OTA use legally protects clinicians from liability. -/- Conclusions -/- Our results show that OTA use is entwined with legal obligations in various ways. Clinicians and health care institutions should identify ways for OTAs to enhance clinician–patient relationships and patient care within the bounds of relevant legal requirements and risks. (shrink)

Despite widespread acceptance in the United States of neurological criteria to determine death, clinicians encounter families who object, often on religious grounds, to the categorization of their loved ones as “brain dead.” The concept of “reasonable accommodation” of objections to brain death, promulgated in both state statutes and the bioethics literature, suggests the possibility of compromise between the family’s deeply held beliefs and the legal, professional and moral values otherwise directing clinicians to withdraw medical (...) interventions. Relying on narrative to convey the experience of a family and clinical caregivers embroiled in this complex dilemma, the case analyzed here explores the practical challenges and moral ambiguities presented by the concept of reasonable accommodation. Clarifying the term’s meaning and boundaries, and identifying guidelines for its clinical implementation, could help to reduce uncertainty for both health care professionals and families and, thereby, the incremental moral distress such uncertainty creates. This paper does not deal with the topic of ‘the generosity of artificial languages from an Asian or a comparative perspective’. Rather, it is concerned with a particular case taken from a development in the Western tradition, when in the wake of the rise of formal logic at the end of the nineteenth and the beginning of the twentieth century people in philosophy and later in linguistics started to use formal languages in the study of the semantics of natural languages. (...) This undertaking rests on certain philosophical assumptions and instantiates a particular methodology, that we want to examine critically. However, that in itself is still too broad a topic for a single paper, so we will focus on a particular aspect, viz., the distinction between grammatical form and logical form and the crucial role it plays in how the relationship between natural languages and formal languages is understood in this tradition. We will uncover two basic assumptions that underlie the standard view on the distinction between grammatical form and logical form, and discuss how they have contributed to the shaping of a particular methodology and a particular view on the status of semantics as a discipline. But before we turn to the topic at hand, a few more words on the general nature of the investigation are in order. Its general aim is to find out how semantics constructs its object, i.e., we are interested in what semanticists view as the proper object of study, how they think this object can best be approached, and how they view the relations between their own undertaking and neighbouring disciplines that deal with related, or even the same kind of phenomena, such as cognitive psychology, cognitive neuroscience, philosophy, anthropology. The background assumption is that, much like in other disciplines, semantics, too, does not have its object of investigation cut out for itself by nature, but constructs it in a complex process that involves empirical elements (‘facts’ being already too dangerous a term), philosophical assumptions, and borrowings.... To claim that there is a politics to or expressed within media technology is of course by no means new, but it remains controversial and not always well understood. Walter Benjamin’s (1986b) essay from 1936 on the political import of media technology is often regarded as the starting point of such discussions, since it foregrounds a key theme in critical theory, namely the politics of perception. In what follows, I would like to review the importance of the politics of perception (...) by first outlining Benjamin’s political analysis of cinema and then engaging with a critique of Benjamin by recent American cognitivist philosophy. This will allow a consideration of the competing phenomenological cognitive science of embodied cognition that I argue offers a better account of the mind and cognition than cognitivism. As a result of this analysis of cognition, I conclude that the philosophy of embodied cognition supports Benjamin's political theory of media technology. (shrink)

Many have been struck by Hannah Arendt’s remarks on loneliness in the concluding pages of The Origins of Totalitarianism, but very few have attempted to deal with the remarks in any systematic way. What is especially striking about this state of affairs is that the remarks are crucial to the account contained therein, as they betray a view of agency that undergirds the rest of the account. This article develops Arendt’s thinking on loneliness throughout her corpus, showing how loneliness is (...) connected to thoughtlessness. In so doing, the article also suggests a connection between Arendt’s notion of loneliness and Stanley Cavell’s notion of skepticism. This connection, it is argued, allows us not only fully to answer a question Arendt leaves unaddressed (the cause loneliness), but also allows us to see how we, as agents and users of language, are perpetually prone to loneliness. The problem of dual use is characterized by a wide range of activities or types of research and technology utilization. In this article, I explore the phenomenon of dual use in several steps to make it accessible for ethical inquiries: first, I examine the phenomenon in more detail; is it a genuine property of technologies and methods, a fundamental problem for research ethics, or a specific precondition for trade-off situations? Second, I show that various factors contribute to a certain good (...) becoming a real dual use good. Third, I propose to develop a three-dimensional classification and evaluation system for dual use risks. (shrink)

“All Authority is from God”. An Aspect of Kant’s Theologico-Political Legacy In this essay, the position of Kant’s metaphysical idea of political authority is examined, first from the point of view of its distinctive position with regard to other modern thinkers on this issue, second – and more substantially – from the point of view of how Kant thinks political authority as being intrinsically dependent from a theological idea. Scrutinizing this theological idea, we argue, first, that it is of a (...) mere aesthetic use; further, that its noumenal referent is a fictitious God as Obligator; furthermore that the necessity by which this idea is inserted into a juridico-political setting is a merely subjective necessity; finally that its expected impact on external freedom is exclusively dependent from the ethical momentum by which external lawgiving is internally formatted. Das Anliegen der Metaphysik, die Welt aus wenigen Grundprinzipien zu begreifen, ist seit Hume und Kant häufig als illusionär kritisiert worden. Dennoch hat die 'totgesagte' Metaphysik immer wieder 'Auferstehungen' erlebt. Auch in der Moderne werden die alten Fragen nach Welt, Mensch und Gott gestellt, doch geschieht dies vor einem veränderten wissenschaftlichen Hintergrund und auch häufig mit anderen Methoden. Insgesamt zeigt sich in der Moderne ein allmählicher Übergang von einer apriorischen zu einer hypothetischen, wissenschaftsorientierten Metaphysik. Die vorliegende Abhandlung thematisiert acht zentrale (...) Strömungen der Metaphysik seit der Mitte des 19. Jahrhunderts. Im Zentrum stehen dabei die philosophischen Weltbilder ihrer Hauptvertreter sowie ihre Standpunkte zum Leib-Seele-Problem und zum Problem der Willensfreiheit, aber auch ihre Stellungnahmen zu den Fragen nach Gott, Unsterblichkeit und dem Sinn des Lebens. Die Bedeutung Schopenhauers für Nietzsches Denken wird in der Nietzsche-Forschung kontrovers beurteilt. Während zu Beginn des 20. Jahrhunderts Schopenhauers Einfluss häufig als bedeutend eingeschätzt wurde, haben ihn spätere Interpreten wie Jaspers, Heidegger und Löwith als unwesentlich veranschlagt. In jüngerer Zeit zeichnet sich wieder eine Aufwertung der Rolle Schopenhauers ab. 0In Anknüpfung an die jüngere Nietzsche-Forschung zeigt diese Arbeit, dass sich die Entwicklung von Nietzsches Denken in immer wiederkehrender Auseinandersetzung mit der Philosophie Schopenhauers vollzogen hat. Vor allem seine Überlegungen zur Metaphysik (...) und Ethik werden häufig vor dem Hintergrund der Schopenhauerschen Auffassungen erst richtig verständlich. (shrink)

De acordo com a visão padrão, a teoria da referência direta e o essencialismo são independentes. Jubien, no entanto, afirma que aplicamos nomes próprios a objetos com propriedades sortais essenciais e deixamos de aplicá-los se os objetos perderem estas propriedades. O objetivo deste artigo é defender esta tese. Em primeiro lugar, argumentarei que nomes próprios são geralmente usados para se referir a objetos que possuem tipos de propriedades sortais socialmente relevantes. A comunidade linguística determina através da divisão do trabalho linguístico (...) a propriedade sortal relevante do referente. Em seguida, apresentarei uma defesa contra as objeções de contraexemplos plausíveis em duas etapas. Em primeiro lugar, mostrando que, em muitos casos, a mudança de propriedade sortal é apenas aparente. Em segundo lugar, descreverei o mecanismo da metonímia, que explica por que usamos nomes homônimos para objetos diferentes, contudo, contíguos. Finalmente, empregarei uma modificação do Princípio do Benefício da Dúvida de Putnam para lidar com o problema do erro radical, isto é, casos em que a comunidade linguística está inteiramente enganada com respeito à propriedade sortal do referente. Os resultados lançam luz sobre o esquema conceitual mais profundo subjacente às nossas práticas de nomeação na linguagem comum. (shrink)
