In this paper, I offer a solution to the Capacity/Equality Puzzle. The puzzle holds that an account of the franchise may adequately capture at most two of the following: (1) a political equality-based account of the franchise, (2) a capacity-based account of disenfranchising children, and (3) universal adult enfranchisement. To resolve the puzzle, I provide a complex liberal egalitarian justification of a moral requirement to disenfranchise children. I show that disenfranchising children is permitted by both the proper political liberal and (...) the proper political egalitarian understandings of the relationship between cognitive capacity and the franchise. Further, I argue, disenfranchising children is required by a minimalistic, procedural principle of collective competence in political decision-making. At the same time, I show that political equality requires the enfranchisement of all adults, regardless of cognitive capacities, and that the collective competence principle does not ground adult disenfranchisement. This justifies the progressive legal trend that holds the capacity-based disenfranchisement of adults to be incompatible with liberal democratic principles. (shrink)

(OPEN ACCESS) This paper offers a novel substantive justification for mandatory electoral quotas—e.g., gender or racial quotas—and a new methodological approach to their justification. Substantively, I argue for a political egalitarian account of electoral quotas. Methodologically, based on this account and a political egalitarian grounding of political participatory rights, I offer an alternative to the External Restriction Approach to the justification of electoral quotas. The External Restriction Approach sees electoral quotas as at best justified restrictions on political participatory rights. I (...) argue for the Internal Restriction Approach instead, which can justify electoral quotas by specifying the pro tanto scope of political participatory rights rather than by justifying restrictions on the pro tanto scope of these rights. On this approach, adequately set electoral quotas do not even conflict with and are not balanced against political participatory rights, while electoral quotas—when justified—are pro tanto required rather than merely permitted. (OPEN ACCESS) In this article, I explore the implications of three moral grounds for the justification of supported voting – respect as opacity, respect as equal status, and respect as political care. For each ground, I ask whether it justifies surrogate voting for voters unable to either communicate or give effect to their electoral judgments, due to some cognitive or communicative disability. (Henceforth: incommunicability cases.) I argue that respect as opacity does not permit surrogate voting, and equal status does not (...) justify such support – although the latter account can make sense of the value loss involved in the persistent non-participation of individuals with cognitive and communicative disabilities. Finally, I argue that an account of supported voting based on the ethics of political care can accommodate a pro tanto moral permission to provide surrogate voting as a form of support in incommunicability cases, and it can account for the inclusive approach of the UN Convention on the Rights of Persons with Disabilities to supported decision-making. However, I show that in incommunicability cases, what the political community and individual caretakers ultimately owe to adult fellow citizens as equal members of the political community is some adequate form of political care – but not necessarily surrogate voting. (OPEN ACCESS) This paper establishes moral duties for intermediaries of political advertising in election campaigns. First, I argue for a collective duty to maintain the democratic quality of elections which entails a duty to contain some forms of political polarization. Second, I show that the focus of campaign ethics on candidates, parties and voters—ignoring the mediators of campaigns—yields mistaken conclusions about how the burdens of the latter collective duty should be distributed. Third, I show why it is fair to require (...) intermediaries to contribute to fulfilling this duty: they have an ultimate filtering position in the campaign communication process and typically benefit from political advertising and polarization. Finally, I argue that a transparency-based ethics of campaign advertising cannot properly accommodate a concern with objectionable polarization. By contrast, I outline the polarization-containing implications of my account, including a prohibition on online targeted advertising, and intermediaries’ duties to block hateful political advertising. (OPEN ACCESS) In this paper, I criticize two views on how political equality is related to equally distributed political power, and I offer a novel, pluralist account of political equality to address their shortcomings—in particular, concerning their implications for affirmative action in the political domain, political representation, and the situation of permanent minorities. The Equal Power View holds that political equality requires equally distributed political power. It considers affirmative action—e.g., racial or gender electoral quotas—, representation, and more-than-equal power to permanent (...) minorities pro tanto objectionable. The Equal Status View, in contrast, holds that political equality concerns equal relations and status, and it is only contingently related to equally distributed power. I argue that while the Equal Status View is right that equal power can be insufficient for—or even objectionable from the viewpoint of—political equality, it is wrong to conclude that equal power has no independent significance in an account of political equality. My pluralist account shows that political equality entails not only status-based requirements but also independent egalitarian requirements to distribute political power equally. This account provides a finer-grained understanding of affirmative action in the political domain. It justifies affirmative action but holds that it should only be used to realize equal political status until thorough-going social reform allows us to maintain both equal political status and equally distributed political power at the same time. Similarly, representation should be amended with power-balancing institutions, and permanent minorities should enjoy equal status with minimal compromise to power equality. (shrink)

While some descriptive and normative theories of legislation account for an extensive role of legal interpretation in legislation, others see its legislative role as marginal. Yet in contemporary constitutional democracies, where legislation is limited and guided by constitutional norms, as well as international and supranational law, legal interpretation must play some role in legislation—even if all or most of legislative activity may not be adequately described and evaluated as legal interpretation. In this chapter, I aim to explore some implications of (...) recognizing the role of legal interpretation in legislation—notably, for the conceptualization and significance of legal expertise in the legislative process, as well as for determining the moral duties of legislative representatives. First, I argue that the role of legal interpretation in legislation calls for institutional reforms in legislatures in order to ensure that legal expertise is adequately channeled into the legislative process, including agenda-setting. Second, I argue that interpreting legal norms through legislation implies specific moral duties for legislative representatives, both in their relations to one another and in their relations vis-à-vis their constituents. I show that giving legal interpretation its due in a descriptive and normative account of legislative activity does not imply an elitist understanding of legislation, and it does not compromise our conception of legislatures as loci of political and moral disagreement and democratic representation. The author presents the history of education as a part of the larger picture of the development of civilization. Therefore, the historic and philosophical antecedents of our current education system are explained.

Kripke-style models with two accessibility relations, one intuitionistic and the other modal, are given for analogues of the modal systemK based on Heyting's prepositional logic. It is shown that these two relations can combine with each other in various ways. Soundness and completeness are proved for systems with only the necessity operator, or only the possibility operator, or both. Embeddings in modal systems with several modal operators, based on classical propositional logic, are also considered. The Kiki-Bouba effect comprises a relation between two abstract figures and two non-words: the star-shaped figure is called 'Kiki' and the rounded figure 'Bouba'. The effect is explained by a sound-vision synaesthesia: certain sounds are associated with certain shapes in a non-arbitrary manner.When we asked the participants to decide which of the two figures, the star-shaped or the rounded one, to call yin and which yang, some 85% choose the star-shaped figure as yin. There are previous cases of synaesthesia where (...) personality is attributed to numbers or letters. In our results, the word Kiki is overall happy, clever, small, thin, young, unpleasant, and nervous. The starshaped figure is overall clever, tall, small, slim, nervous, unpleasant, and upper-class. That is, the correspondence above all concerns the qualifying adjectives clever, unpleasant, and nervous, as well as the physical appearance small and thin. This brings us to the fat-thin effect. Cinema, literature, comics, and children's programmes are full of contrasting figures: Don Quixote and Sancho Panza, Laurel and Hardy , Asterix and Obelix, Tintin and Captain Haddock, Bert and Ernie , or the Spanish comic about very naughty twin boys called Zipi and Zape . Our main conclusion is that first names and last names are not entirely arbitrary. There is a correspondence between names and physical characteristics and concepts . The Kiki-Bouba effect is a semantic one. (shrink)

:There are manifold intriguing issues located within largely unexplored borderlands of bioethics, future studies, and astrobiology. Human enhancement has for quite some time been among the foci of bioethical debates, but the same cannot be said about its global, transgenerational, and even cosmological consequences. In recent years, discussions of posthuman and, in general terms, postbiological civilization have slowly gained a measure of academic respect, in parallel with the renewed interest in the entire field of future studies and the great strides (...) made in understanding of the origin and evolution of life and intelligence in their widest, cosmic context. These developments promise much deeper synergic answers to questions regarding the long-term future of enhancement: how far can it go? Is human enhancement a further step toward building a true postbiological civilization? Should we actively participate and help shape this process? Is the future of humanity “typical” in the same Copernican sense as our location in space and time is typical in the galaxy, and if so, can we derive important insights about the evolutionary pathways of postbiological evolution from astrobiological and Search for ExtraTerrestrial Intelligence studies? These and similar questions could be understood as parts of a possible unifying research program attempting to connect cultural and moral evolution with what we know and understand about their cosmological and biological counterparts. Količina ohranjenega besedila, avtorjev slog z dolgimi stavčnimi periodami, izbranim besediščem in različnimi retoričnimi prijemi, vse to pred­stavlja za prevajalca gotovo precejšnjo oviro. Z novo knjigo, ki je pred kratkim izšla pri Slovenski matici in prinaša prvih pet Livijevih knjig v prevodu Primoža Simonitija, se sedaj to spreminja. Knjigo je uredil David (...) Movrin, ki je napisal tudi spremno besedo in pripravil obsežen spremni aparat. Prevod zajema nekje sedmino ohranjenega Livijevega dela, ob predvidenem nadaljevanju s skupino prevajalcev si lahko obetamo izid nadaljnjih zvezkov in v doglednem času tudi prevod vsega, kar se je od Livija ohranilo v rokopisnem izročilu. Quantification is particularly seductive in times of global uncertainty. Not surprisingly, numbers, indicators, categorizations, and comparisons are central to governmental and popular response to the COVID-19 pandemic. This essay draws insights from critical data studies, sociology of quantification and decolonial thinking, with occasional excursion into the biomedical domain, to investigate the role and social consequences of counting broadly defined as a way of knowing about the virus. It takes a critical look at two domains of human activity that play a (...) central role in the fight against the virus outbreak, namely medical sciences and technological innovation. It analyzes their efforts to craft solutions for their user base and explores the unwanted social costs of these operations. The essay argues that the over-reliance of biomedical research on “whiteness” for lab testing and the techno-solutionism of the consumer infrastructure devised to curb the social costs of the pandemic are rooted in a distorted idea of a “standard human” based on a partial and exclusive vision of society and its components, which tends to overlook alterity and inequality. It contends that to design our way out of the pandemic, we ought to make space for distinct ways of being and knowing, acknowledging plurality and thinking in terms of social relations, alterity, and interdependence. Many tasks in statistical and causal inference can be construed as problems of entailment in a suitable formal language. We ask whether those problems are more difficult, from a computational perspective, for causal probabilistic languages than for pure probabilistic (or “associational”) languages. Despite several senses in which causal reasoning is indeed more complex—both expressively and inferentially—we show that causal entailment (or satisfiability) problems can be systematically and robustly reduced to purely probabilistic problems. Thus there is no jump in computational complexity. (...) Along the way we answer several open problems concerning the complexity of well-known probability logics, in particular demonstrating the ${\exists \mathbb {R}}$ -completeness of a polynomial probability calculus, as well as a seemingly much simpler system, the logic of comparative conditional probability. This article approaches the paradigm shift of datafication from the perspective of civil society. Looking at how individuals and groups engage with datafication, it complements the notion of “data politics” by exploring what we call the “contentious politics of data”. By contentious politics of data we indicate the bottom-up, transformative initiatives interfering with and/or hijacking dominant processes of datafication, contesting existing power relations or re-appropriating data practices and infrastructure for purposes distinct from the intended. Said contentious politics of data is (...) articulated in an array of practices of data activism taking a critical stance towards datafication. In data activism, data as mediators take a central role, both as part of an action repertoire or as objects of struggle in their own right. Leveraging social movement studies and science and technology studies, this theoretical essay argues that data activism can be mapped along two analytical dimensions: “data as stakes” vs. “data as repertoires”, and “individual practice vs. collective action”. Mapping action repertoires and tactics along these axes allows us to chart the potential emergence of a political data subject at the intersection of these two dimensions. This furthers our understanding of people’s engagement with data in relation to other forms of activism and existing work in social movement studies. It also helps us interpreting potential trajectories of contemporary social movements, as they increasingly interface with data, devices and platforms. (shrink)

Recent discussion of the alleged adverse consequences of space colonization by Phil Torres in this journal is critically assessed. While the concern for suffering risks should be part of any strategic discussion of the cosmic future of humanity, the Hobbesian picture painted by Torres is largely flawed and unpersuasive. Instead, there is a very real risk that the skeptical arguments will be taken too seriously and future human flourishing in space delayed or prevented.

We describe a significant practical consequence of taking anthropic biases into account in deriving predictions for rare stochastic catastrophic events. The risks associated with catastrophes such as asteroidal/cometary impacts, supervolcanic episodes, and explosions of supernovae/gamma-ray bursts are based on their observed frequencies. As a result, the frequencies of catastrophes that destroy or are otherwise incompatible with the existence of observers are systematically underestimated. We describe the consequences of the anthropic bias for estimation of catastrophic risks, and suggest some directions for (...) future work. (shrink)

Lewis ruefully puzzled over The Problem of Pain, the theologians invented their own word - 'theodicy' - to describe the futile attempts (to date) to resolve monotheism's conundrum - that of an omnipotent, all-loving deity magisterially presiding over a world in which widespread evil is so pervasive. And what a mind bender this is!

The paper reconsiders the Weber Thesis of a linkage between Calvinism and capitalism. It first restates this sociological Thesis in terms of the Calvinist doctrine of predestination as its theological core and premise in virtue of being treated as the crucial religious factor of the spirit of modern capitalism. Consequently, it proposes that the Weber Thesis’ validity and consistency depends on that doctrine, succeeding or failing as a sociological theory with the latter depending on whether or not it is unique (...) in theological terms, as well as economic-social consequences. For that purpose, it reexamines and compares the Calvinist doctrine of predestination with the pre-Calvinist versions and infers that it is basically identical to or compatible with these. It then draws the implications for the Weber Thesis in respect of the degree of its validity or consistence. It concludes that the Weber Thesis likely is fail as a sociological-economic theory with the Calvinist doctrine of predestination to the extent that the latter is its theological ground and revealed not to be unique and new theologically and probably in terms of its societal effects. Paulus spricht das Thema der Beschneidung zum ersten Mal im Galaterbrief 5, 2–6 ausdrücklich an. Die genaue Bedeutung der Beschneidung, sowohl historisch als auch exegetisch, wurde jedoch in der paulinischen Forschung viel diskutiert. Wenn es um die Beschneidung und die Argumentation des Gal geht, geht es um mehr als das, was die Neutestamentler normalerweise betont haben. Historisch gesehen war die Beschneidung auch mit der Unterwerfung von Gedanken und Leidenschaften unter den Willen Gottes sowie mit Idealen der Vollkommenheit und Heiligkeit verbunden. (...) Exegetisch ist Paulus in Gal 5, 2–6 gegen die Beschneidung, weil dies die Aufrechterhaltung der fortwährenden Glaubenserfahrung der Gläubigen, d. h. der Heiligung, gefährden würde. Paulus antwortet auf die Sorge, seine Erfahrung in Christus aufrechtzuerhalten, indem er schreibt, dass der Christus durch seine völlige Hingabe an Gott durch Glaube erkannt werden sollte, eine Hingabe an das heiligende Werk des Geistes, das im Leben des Gläubigen Früchte trägt. Daher analysiert diese Studie, die sich der zeitgenössischen Diskussion der paulinischen Theologie anschliesst, Paulus’ Beziehung zur Beschneidung in Gal 5, 2-6 im Kontext der galatianischen Welt des neutestamentlichen Zeitalters. This paper is based on field-work performed in a Thai Buddhist Temple in Prague in the year 2016. The aim is to describe and in describing analyze rituals organized in and through the temple from a materialist phenomenological point of view, as well as based on an ideal-type Theravāda cosmology. In drawing on post-colonial philosophy, part of the focus lies also on the process of becoming other. This is achieved in situating practice and mimesis at the center of methodological inquiry. (...) The aim of the paper is to improve availability classifications of components for application in construction systems. Construction production systems belong to project-based systems with serial-parallel structures with or without redundant components, and the availability function has a significant impact on the performance indicators of components and systems. The main indicators of function of the components are the availability, capacity, costs, and project time. A new approach to classification makes it possible to choose the most appropriate methodology for assessing component (...) availability in the bidding phase, and managing company’s machine park. The new classification approach was tested on a practical example. The results obtained confirmed the justification for extending the classical approach to the classification of the availability of components. (shrink)
