PDZ (also called DHR or GLGF) domains are found in diverse membraneassociated proteins including members of the MAGUK family of guanylate kinase homologues, several protein phosphatases and kinases, neuronal nitric oxide synthase, and several dystrophin‐associated proteins, collectively known as syntrophins. Many PDZ domain‐containing proteins appear to be localised to highly specialised submembranous sites, suggesting their participation in cellular junction formation, receptor or channel clustering, and intracellular signalling events. PDZ domains of several MAGUKs interact with the C‐terminal polypeptides of a subset (...) of NMDA receptor subunits and/or with Shaker‐type K+ channels. Other PDZ domains have been shown to bind similar ligands of other transmembrane receptors. Recently, the crystal structures of PDZ domains, with and without ligand, have been determined. These demonstrate the mode of ligand‐binding and the structural bases for sequence conservation among diverse PDZ domains. (shrink)

As in other countries, the traditional doctor-patient relationship in the Japanese healthcare system has often been characterised as being of a paternalistic nature. However, in recent years there has been a gradual shift towards a more participatory-patient model in Japan. With advances in technology, the possibility to use digital technologies to improve patient interactions is growing and is in line with changing attitudes in the medical profession and society within Japan and elsewhere. The implementation of an online patient engagement platform (...) is being considered by the Myotonic Dystrophy Registry of Japan. The aim of this exploratory study was to understand patients’ views and attitudes to using digital tools in patient registries and engagement with medical research in Japan, prior to implementation of the digital platform. We conducted an exploratory, cross-sectional, self-completed questionnaire with a sample of myotonic dystrophy patients attending an Open Day at Osaka University, Japan. Patients were eligible for inclusion if they were 18 years or older, and were diagnosed with MD. A total of 68 patients and family members attended the Open Day and were invited to participate in the survey. Of those, 59 % submitted a completed questionnaire. The survey showed that the majority of patients felt that they were not receiving the information they wanted from their clinicians, which included recent medical research findings and opportunities to participate in clinical trials, and 88 % of patients indicated they would be willing to engage with digital technologies to receive relevant medical information. Patients also expressed an interest in having control over when and how they received this information, as well as being informed of how their data is used and shared with other researchers. Overall, the findings from this study suggest that there is scope to develop a digital platform to engage with patients so that they can receive information about medical care and research opportunities. While this study group is a small, self-selecting population, who suffer from a particular condition, the results suggest that there are interested populations within Japan that would appreciate enhanced communication and interaction with healthcare teams. The rapid rise of international collaborative science has enabled access to genomic data. In this article, it is argued that to move beyond mapping genomic variation to understanding its role in complex disease aetiology and treatment will require extending data sharing for the purposes of clinical research translation and implementation.

Zizek insisted on the ‘temporal gap between the production of value and its actualization’ (Zizek, 2009b [2006], p. 52): ‘the temporality here is that of the futur antérieur: value “is” not immediately, it only “will have been,” it is retroactively actualized, performatively enacted’ (ibid.). His use of the word ‘gap’ calls to mind the psychoanalytic literature on which Zizek draws, which provides a way to understand the 2007 Global Financial Crisis (GFC) and its aftermath. This paper presents three key ideas (...) about the GFC. First, the GFC was a traumatic encounter with lack, in which global capitalism confronted a gap at the centre of its chain of signifiers. Whether the financial system is seen as a series of promises or a system for allocating and hedging risk, a gap or lack remained at the origin of its chain of signifiers. Secondly, many explanations of the crisis focus on ‘getting back to fundamentals’, which can be read as an attempt to paper over the lack. Finally, in the panic to re-establish the master signifier, global finance tossed aside core justifications for capitalism, and it is not yet clear what the results will be: re-establishment of the old regime, a return to a Primal Father, or a turn to the analyst’s discourse. Hilbert's tenth problem for a theory T asks if there is an algorithm which decides for a given polynomial p() from [] whether p() has a root in some model of T. We examine some of the model-theoretic consequences that an affirmative answer would have in cases such as T = Open Induction and others, and apply these methods by providing a negative answer in the cases when T is some particular finite fragment of the weak theories IE1 or IU-1.

WE ARE GRATEFUL to the journal for prviding the opportunity for exchange and discussion of some of the themes raised in our paper, "The impact of phenomenology on North American psychiatric assessment" and we are pleased (...) to be able to reply to the two excellent commentaries by McMillan and Morley. Both McMillan and Morley question the prospect of employing phenomenology and its methods in psychiatric assessment, and in psychiatric practice more generally. McMillan questions the utility of such a step, and Morley is pessimistic about its feasibility. We shall address each author's concerns in turn.Initially, let us restate the aims of our paper to contextualize our arguments and those made in the commentaries. First, we sought an understanding of what is meant by North American psychiatrists, working within the DSM framework, when they refer to the phenomenological approach to psychiatric assessment. To elucidate this meaning, we compared the contemporary North American usage to a small number of definitions of phenomenology, particularly those definitions that were, and are now, applied to clinical psychiatric work. Contrary to McMillan's suggestion, we did not intend to state definitively what should or should not count as phenomenological, but rather to compare North American psychiatric assessment to what typically has counted as phenomenological. Second, we sought to examine phenomenology's influence on North American psychiatric practice, particularly psychotherapy.Morley argues that such influences usually exemplify the inappropriate appending of phenomenology to psychiatric practice rather than true integration of different paradigms. Although we do not disagree with this general contention, we will argue that the deployment of phenomenological methods in psychiatric assessment is a necessary first step toward the kind of integration he proposes.McMillan makes two related but unintegrated points. First, he argues that objective, behavioral data are phenomenological, according to his broad definition of the term. Second, he proposes that, if the behavioral and the phenomenological are different, we are better off staying with the behavioral when it comes to psychiatric nosology. Let us consider these two points in succession.McMillan seeks to broaden Jasper's definition of phenomenology to include objective observations [End Page 93] as phenomenological. To this end, he distinguishes methods from aims. He summarizes Jasper's definition of phenomenology as "an empirical method for investigating 'individual psychic experience (p 55)" and claims that this is a statement of aim or objectives. He then urges us to "consider the merits of different phenomenological methodologies in terms of their success in achieving this objective" whether or not they utilize "all the methods" of phenomenology. This is much like saying that if we treat waving one's hand as a method for greeting someone, we are then free to treat the objective of the wave as one of greeting someone, and then say that anything that serves as a greeting is, by definition, a "wave." Whatever else McMillan's objective observations are, he has not convinced us that they are phenomenological, anymore than we are likely to convince you that a kiss on the lips is really just a wave.Nonetheless, it is worthwhile seeing what McMillan does with this argument. He tells us that we can "read the first-person experience from behavior in a fairly accurate and informative way." He uses the example of a father gazing at his young child and notes that it is not unreasonable to infer that he is experiencing loving and nurturing feelings. It is, indeed, not unreasonable to draw such an inference. But it is far more reasonable to infer that the father is experiencing a cacophony of feelings, including, but not limited to, love, concern, anxiety, pride, envy, hope, and sadness (Stern 1995, 18-58). We expand the notion of resplendency to theories of the kind T + p", where T is a fi rst-order theory and p" expresses that the type p is omitted. We investigate two di erent formulations and prove necessary and sucient conditions for countable recursively saturated models of PA. Some of the results in this paper can be found in one of the author's doctoral thesis [3].

Qualitative comparative analysis (QCA) opens up two new forms of knowledge: (1) knowing about alternative pathways to one outcome (equifinality) and (2) perceiving nuances of necessary cause and sufficient cause. Several misunderstandings of QCA occur in the article by Lucas and Szatrowski (this volume, p. 1). First, there are minor problems with expressions. Second, there are differences between their philosophy of science (arguments 1, 2, and 3 below) and a realist approach. Third, they misinterpret what was meant by sufficient and (...) necessary cause (arguments 4 and 5 below). The minor problems with expressions arise in sections 2.2 and 3. In section 2.2, the authors define consistency, but here they miss out on two key points. First, they neglect to say that this particular measure of consistency is a measure of sufficiency of cause, not of necessary cause. Second, they ignore the way that the consistency level exists for each possible configuration of characteristics. A configuration can be shown in one row of a truth table, with n1 = 28, n2 = 17 within a larger sample of 155, and so on (see Byrne 2009:262). Using QCA’s definition of “consistency,” we can discern more about the pattern of causality than one might initially expect. This learning is possible whether N overall is 155, or just 39, or thousands of cases. The essential task is to simplify and rank the list of configurations (Ragin 2001, 2006). (shrink)

Bununla yazı, Sekkâ neşrinin sebep olduğu el-Metâlibü’l-âliye’nin adı ve kapsamıyla ilgili iki temel yanlışı düzeltmekte ve el-Metâlibü’l-âliye’nin mantık, ontoloji, fizik ve teoloji kısımlarını içeren kuşatıcı bir ansiklopedik eser olduğunu göstermeyi amaçlamaktadır.

Osmanlı şer‘iyye sicillerinin bir kısmı Arapça olarak tutulduğu için söz konusu dile hâkim olamayanlar pek yararlanamamaktadırlar. Arapça kayıtlardan istifade etme ve bunların tercümesi ek bir uzmanlık gerektirir. İstanbul kadı sicilleri dahil birkaç örnek dışında bu alanda pek çalışılmamıştır. Bu makalemizde, Arapça siciller üzerinde çalışacaklar için Bursa B-18 numaralı sicilden nitelikli kayıt örnekleri seçilerek günümüz Türkçesi’ne tercüme edilmiştir. Bunun yanında bir kaydın muhteva açısından hangi konuları içerdiğine de değinilmiştir. Ayrıca sicilde yer alan Arapça methiye ve lakaplar da günümüz Türkçesi’ne çevrilmiştir. Sicillerde, (...) The current literature on presupposition focuses almost exclusively on the projection problem: the question of how and why the presuppositions of atomic clauses are projected to complex sentences which embed them. Very little attention has been paid to the question of how and why these presuppositions arise at all. As Kay (1992, p.335) observes, “treatments of the presupposition inheritance problem almost never deal with the reasons that individual words and constructions give rise, in the first place, to the particular presuppositions (...) that they do.”1 This is the question on which this paper will focus. Dynamic Consent is both a model and a specific web-based tool that enables clear, granular communication and recording of participant consent choices over time. The DC model enables individuals to know and to decide how personal research information is being used and provides a way in which to exercise legal rights provided in privacy and data protection law. The DC tool is flexible and responsive, enabling legal and ethical requirements in research data sharing to be met and for online health (...) information to be maintained. DC has been used in rare diseases and genomics, to enable people to control and express their preferences regarding their own data. However, DC has never been explored in relationship to historical collections of bioscientific and genetic heritage or to contexts involving Aboriginal and Torres Strait Islander people.In response to the growing interest by First Peoples throughout Australia in genetic and genomic research, and the increasing number of invitations from researchers to participate in community health and wellbeing projects, this article examines the legal and ethical attributes and challenges of DC in these contexts. It also explores opportunities for including First Peoples' cultural perspectives, governance, and leadership as a method for defining DC on cultural terms that engage best practice research and data analysis as well as respect for meaningful and longitudinal individual and family participation. Objective Futile treatment, which by definition cannot benefit a patient, is undesirable. This research investigated why doctors believe that treatment that they consider to be futile is sometimes provided at the end of a patient9s life. Design Semistructured in-depth interviews. Setting Three large tertiary public hospitals in Brisbane, Australia. Participants 96 doctors from emergency, intensive care, palliative care, oncology, renal medicine, internal medicine, respiratory medicine, surgery, cardiology, geriatric medicine and medical administration departments. Participants were recruited using purposive maximum variation sampling. (...) Results Doctors attributed the provision of futile treatment to a wide range of inter-related factors. One was the characteristics of treating doctors, including their orientation towards curative treatment, discomfort or inexperience with death and dying, concerns about legal risk and poor communication skills. Second, the attributes of the patient and family, including their requests or demands for further treatment, prognostic uncertainty and lack of information about patient wishes. Third, there were hospital factors including a high degree of specialisation, the availability of routine tests and interventions, and organisational barriers to diverting a patient from a curative to a palliative pathway. Doctors nominated family or patient request and doctors being locked into a curative role as the _main_ reasons for futile care. Conclusions Doctors believe that a range of factors contribute to the provision of futile treatment. A combination of strategies is necessary to reduce futile treatment, including better training for doctors who treat patients at the end of life, educating the community about the limits of medicine and the need to plan for death and dying, and structural reform at the hospital level. BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Construction-based approaches to syntax (Croft, 2001; Goldberg, 2003) posit a lexicon populated by units of various sizes, as envisaged by (Langacker, 1987). Constructions may be specified completely, as in the case of simple morphemes or idioms such as take it to the bank, or partially, as in the expression what’s X doing Y?, where X and Y are slots that admit fillers of particular types (Kay and Fillmore, 1999). Constructions offer an intriguing alternative to traditional rule-based syntax by hinting at (...) the extent to which the complexity of language can stem from a rich repertoire of stored, more or less entrenched (Harris, 1998) representations that address both syntactic and semantic issues, and encompass, in addition to general rules, “totally idiosyncratic forms and patterns of all intermediate degrees of generality” (Langacker, 1987, p.46). Because constructions are by their very nature language-specific, the question of acquisition in Construction Grammar is especially poignant. We address this issue by offering an unsupervised algorithm that learns constructions from raw corpora. (shrink)

Indigenous people (IP) have faced multiple difficulties in education. Indigenous students often do worse academically than non-indigenous student peers. These stated the low enrollment rates showed a dropout rate, absenteeism, repetition rates, literacy rate, and thus the educational outcomes, with retention and completion being two significant issues. Further, this study explores the lived experiences and challenges faced by indigenous high school students amidst the new normal education. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) The reason (...) why IP learners were not satisfied with their performance is that they cannot understand some of the lessons due to the language barrier. (2) IP learners are committed to finishing their studies, however, some of the students lack resources for studying, like gadgets for researching, and they do not have cell phones. And the other students may have gadgets or cellphones, but their internet connection is low or not accessible in some places at their location. (shrink)

The concept of the gene has been the central organizing theme of 20th century biology. Biology has become increasingly influential both for philosophers seeking a naturalized basis for epistemology, ethics, and the understanding of the mind, as well as for the human sciences generally. The central task of this work is to get the story right about genes and in so doing provide a critical and enabling resourse for use in the further pursuit of human self-understanding. ;The work begins with (...) a wide-ranging historical reconstruction and conceptual analysis of the meaning of "the gene" that results in defining and distinguishing two different "genes". Each of these can be seen as an heir to one of the two major historical trends in explaining the source of biological order---preformationism and epigenesis. The preformationist gene predicts phenotypes but only on an instrumental basis where immediate medical and/or economic benefits can be had. The gene of epigenesis , by contrast, is a developmental resource that provides templates for RNA and protein synthesis but has in itself no determinate relationship to organismal phenotypes. The seemingly prevalent idea that genes constitute information for traits is based, I argue, upon an unwarranted conflation of these two senses which is in effect held together by rhetorical glue. Beyond this historical, conceptual, and rhetorical inquiry the bulk of the dissertation then concerns itself with an empirically up-to-date analysis of the cell and molecular basis of biological order and of the pathological loss of same. In each of these chapters I structure my analysis with the idea in mind that the "conflated" view can be held empirically accountable. Major touchpoints in this work include the ideas of I. Kant, J. Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Beylikler devri Türk-İslam ciltleri hem tezyînatları hem de üzerlerindeki dini içerikli ibareler, dua ve mücellid mühürleri vasıtasıyla cilt sanatı araştırmacılarının yayınlarına konu olmuştur. Ancak ciltlerdeki dua ifadelerini müstakil olarak konu edinen yayın sayısı oldukça azdır. Türk-İslam ciltlerinin gerek kapak yüzeyinde gerekse kapak içlerinde dua içerikli ibarelere rastlamak mümkündür. Makalenin konusu, Beylikler devrinde üretilen Türk-İslam ciltlerinin deri kaplı kapak içlerinde yer alan el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) yazısı, bu yazının yer aldığı desen kompozisyonu ve yazının analizidir. Makaledeki amaç, şimdiye kadar cilt (...) literatüründe müstakil olarak ele alınmamış el-İzzü’d-Dâim ve’l-İkbâl yazılı cilt kapak içi tezyînatı hakkında tespit edilebilen örneklerin detaylı desen ve yazı analizleriyle bilimsel birikim oluşturabilmek ve aynı ya da benzer ibarenin yer aldığı diğer İslam sanat eserlerini tespit ederek bu dua ibaresinin ciltlerdeki kullanım amacını ve kullanıldığı dönemleri belirlemeye çalışmaktır. Cilt sanatı literatürü ve yazma eser kütüphanelerinde yaptığımız araştırmalar neticesinde, Beylikler dönemine ait ciltlerin altı tanesinin kapak içinde el-İzzü’d-Dâim ve’l-İkbâl ibaresi tespit edilmiştir. Bu tespitlerin sayısı, yapılacak yeni araştırmalarla artabilecektir. Tespit edilen yazma eserler; Amasya YEK: 217, İnebey YEK Hüseyin Çelebi: 481 ve Ulu Cami: 318, Kastamonu YEK: 2856 ve 3435 ve Süleymaniye YEK Fatih: 5004’tür. Ciltlerin kapak, sertâb ve mikleb yüzeylerindeki tezyînatları, Beylikler dönemi cilt sanatı üslûbunu yansıtan süslemelerdir. Ciltlerin teknik ve tezyînatları, -mevcut olanların- istinsâh kayıtları incelendiğinde üç örneğin (Amasya YEK: 217, Kastamonu YEK: 2856 ve 3435) 14. yüzyıl tarihli olduğu ya da tarihlendirildiği, üç örneğin (İnebey YEK Hüseyin Çelebi: 481 ve Ulu Cami: 318, Süleymaniye YEK Fatih: 5004) ise 15. yüzyıl tarihli olduğu ya da tarihlendirildiği görülmektedir. Ciltlerin kapak içi deseni, bitkisel ve rûmî motiflerle bezeli tam zemin geometrik bir tasarıma sahiptir. Geometrik desenin içerisindeki altıgen paftalarda el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) yazısı yer almaktadır. İbarenin, cilt kapak içlerine tek satırda (İnebey YEK Ulu Cami: 318, Kastamonu YEK: 3435) ve çift satırda -½ oranında ters simetrik- (Amasya YEK: 217, İnebey YEK Hüseyin Çelebi: 481, Kastamonu YEK: 2856, Süleymaniye YEK Fatih: 5004) olmak üzere iki türde yazıldığı tespit edilmiştir. Her iki tasarımda da sülüs yazı çeşidi tercih edilmiştir. İnebey YEK Hüseyin Çelebi: 481 envanter numaralı 15. yüzyıla ait cildin kapak içinde ise diğer örneklerden farklı olarak yazı paftalarının bazılarında mücellit kitabesi bulunmaktadır. Kitabede, “Amel-i Mücellid Haydar b. Turbegî” yazılıdır. Kapak içi tezyînatının aynı olması nedeniyle, Kastamonu YEK: 2856 ve Süleymaniye YEK Fatih: 5004 envanter numaralı ciltlerin de Haydar b. Turbegî adlı mücellidin eseri olma ihtimali vardır. Ciltlerin kapak içlerinin tümü, çeşitli tonlarda kahverengi sahtiyanla kaplıdır. Derilerin gözenek türü bunu ispat eder niteliktedir. Süsleme tekniği, tüm kapak içlerinde soğuk baskı tekniğidir. Bu teknik adını, uygulanması esnasında altının kullanılmamasından almaktadır. Soğuk baskı tekniğinde, desenin deriye genellikle sıcak pres uygulaması yapılarak aktarıldığı bilinmektedir. Uygulamada yüzeyinde motif veya desenin yer aldığı kalıp, çivi ve diğer ciltçilik aletleri kullanılmaktadır. Çalışma kapsamındaki ciltlerde kapak içi deseninin kalıpla uygulandığı, deri üzerindeki desenin kesintili çizgilerden anlaşılmaktadır. Kapak içi tezyînâtını oluşturan desenin simetrik bir parçası, kalıba işlenmiş ve kalıp deri üzerine simetrik bir şekilde, boşluk bırakılmadan basılmıştır. Yapılan incelemelerden anlaşıldığı kadarıyla kalıbın basıldığı deri, kapak içine yapıştırıldıktan sonra kapak kenarlarından cilt ebadına uygun şekilde kesilmiş olmalıdır. Kalıbın bazı örneklerde hatalı basıldığı da görülmektedir. Bu da desenin devamlılığını kısmen bozmuştur. Soğuk baskı tekniğinde, desenin deriye genellikle sıcak pres uygulaması yapılarak aktarıldığı bilinmektedir. Desenin deri renginden daha açık olması, uygulamanın ısıyla yapılmış olduğunu doğrulamaktadır. Ciltlerin kapak yüzeylerinin kullanıma bağlı olarak yıprandığı ve bu nedenle desenlerin deforme olduğu tespit edilmiştir. Ancak kapak içleri böyle bir yıpranmaya maruz kalmadıkları için korunarak günümüze ulaşmıştır. el-İzzü’d-Dâim ve’l-İkbâl (العزّ الدّائم والإقبال) ibaresi Arapça bir terkip olup “sonsuz güç ve yüksek mevki” anlamına gelmektedir. Terkip; güç, kudret ve ihtişam anlamına gelen العزّ ve ferah, parlak ve yüksek mevki anlamındaki الإقبال kelimelerinden oluşmaktadır. İbare dua, temenni vb. maksatlarla kullanılmış olmalıdır. Çalışma kapsamındaki ciltler ve diğer İslam sanatı örneklerinden anlaşıldığı kadarıyla İslam sanat eserleri üzerinde el-İzzü’d-Dâim ve’l-İkbâl ibaresine 12. yüzyıldan 15. yüzyıla kadar geniş bir dönemde yer verilmiştir. Çalışma Hıristiyanlığın Protestanlık mezhebinden doğan, özellikle Amerika Birleşik Devletleri’nde kümelendiği gözlemlenen, İsrail’i ve Yahudileri orantısızca desteklemesiyle bilinen ve aynı zamanda İslam’a ve Müslümanlara karşı düşmanca yaklaşımları haiz “Hıristiyan siyonistlerini” ele almaktadır. Hareketin mahiyeti, doğuşu, teolojisi, faaliyetleri ve kendisinde mündemiç olan antisemitizm ile anti-İslamizm olguları incelenmektedir. Bulgulara göre, Hıristiyan siyonizmi çeşitli açılardan bakıldığında bir anomali teşkil etmektedir. Bunlardan en önemlisi, Yahudilerin ve Hıristiyanların yüzyıllarca birbirlerine en üst seviyede düşmanlık etmiş olan iki topluluk oluşudur. Hıristiyan siyonistler dünya tarihini Mesih’in zuhuruyla birlikte kurulacak (...) olan bin yıllık küresel krallık öncesindeki yedi bölüm olarak ele alan, sınırları büyük ölçüde İngiliz-İrlandalı teolog John Nelson Darby tarafından çizilen ve “premillennial dispensationalism (premilenyal dispensasyonalizm)” olarak bilinen teolojinin öngördüğü kıyamet senaryosuna inanmaktadır. Bu senaryo hareketin varlık sebebini, amaçlarını, dostlarını ve düşmanlarını belirlemektedir. Dost-düşmanlar olarak Yahudilerin buradaki rolü bazı çelişkiler ve ihtilaflar barındırırken, düşmanlar olarak Müslümanların rolü açıkça olumsuz bir görünüm arz etmektedir. Bunun sonucu olarak Hıristiyan siyonistler Müslümanları şeytanlaştırma eğilimine girmektedir. Her ne kadar dindaşları tarafından ahlak, siyaset ve özellikle teoloji eksenlerinde ağır eleştirilere tabi tutulsalar da Hıristiyan siyonistler emperyalist güçlerle olan uzun ittifaklarının da bir meyvesi olarak dünya politikasında kayda değer bir güce sahiptir. Hıristiyan siyonizminin mahiyeti ve dahi antisemitizm ve anti-İslamizm ile irtibatı konusunda Türkçe yazılmış eserlerin azlığına binaen çalışma literatürdeki bu boşluğu kapatma amacı taşımaktadır. Özet: İçinde bulunduğumuz dönemde anti-İslamizm kavramı ele alınırken kendisine özellikle Amerika Birleşik Devletleri’nin (ABD) teopolitik dekorunda yer bulan “Hıristiyan siyonizmi” adlı grubun etkisine işaret edilmektedir. Bu grup literatür tarafından İsrail’i Yahudilerin vatanı olarak destekleyen Hıristiyanlar olarak tanımlanmaktadır. İsrail için Birleşen Hıristiyanlar (CUFI) gibi organizasyonlar aracılığıyla İsrail’in desteklenmesi noktasında etkin faaliyetler yürütmektedirler. Orta Doğu’da barışın tesis edilmesini inandıkları kıyamet senaryosunun önünde bir engel olarak gördükleri için kategorik olarak reddetmektedirler. Özellikle 19. yüzyılda başlayıp, 11 Eylül olayları ile birlikte ciddi bir ivme yakalayan ABD’deki anti-İslami hareketlerin büyük bir kısmı Hıristiyan siyonizmi ile ilişkilendirilen şahıslar tarafından başlatılıp desteklenmektedir. ABD’de yaklaşık 20 ila 30 milyon arasında Hıristiyan’ın bu ideolojiyi benimsediği tahmin edilmektedir. ABD dışında İngiltere, İskandinavya, Avustralya, Güney Afrika ve hatta Güney Kore ve Honduras gibi coğrafyalarda da taraftar bulmuşlardır. Birçok açıdan bakıldığında Hıristiyan siyonizmi bir anomali teşkil etmektedir. Bunun özünde Yahudilerin ve Hıristiyanların birbirlerine olan düşmanlıkları yatmaktadır. Yahudiler dini kaynaklarında Hıristiyanlığın en kutsal şahsiyetlerine ağır hakaretler ederken, Hıristiyanlar Yahudileri Tanrı katilleri olarak görmektedir. Ancak Hıristiyan siyonistlerin çoğunluğu İsrail konusunda adeta kraldan daha kralcı davranmaktadır. Hıristiyan siyonizminin teolojik zeminini incelemek isteyen bir araştırmacı eskatoloji (kıyamet bilimi), Armageddon savaşı, istiğrak, püritenler, premilenyalistler, dispensasyonalistler, fundamentalistler, restorasyonistler, evanjelistler, John Nelson Darby ve Cyrus I. Scofield gibi bazı kavram ve aktörlerle karşılaşacaktır. İrlandalı-İngiliz bir teolog olan Darby birçokları tarafından Hıristiyan siyonizminin kurucusu olarak görülmektedir. Hareket için hayati önem teşkil eden ikinci isim ise Cyrus Ingerson Scofield’dir. Scofield Reference Bible ’ı yayınlayarak Hıristiyan siyonizminin milyonlar tarafından benimsenmesine yol açmıştır. Hıristiyan siyonistler “premilenyal dispensasyonel teolojinin” gerçek olduğuna ve gerçekleşeceğine inanmaktadır. Buna göre dünya tarihi yedi çağdan oluşan doğrusal bir olgudur. İnsanlığın halihazırda altıncı çağda olduğuna, yedinci çağın ise çok yakında olduğuna inanmaktadırlar. Bu teolojinin öngördüğü kıyamet senaryosu Antichrist ’ın gelişi, Sahte Peygamber ve Şeytan ile birlikte cehennem teslisini kurması, Müslümanların da onlarla müttefik olarak hareket edip İsrail’e saldırmaları (Armageddon savaşı), Hz. İsa’nın gökten tekrar inerek İsrail’i kurtarması ve barışı tesis edeceği Milenyum Krallığı’nı kurması gibi öğeleri içermektedir. Siyonist olmayan Hıristiyan teologlar Hıristiyan siyonizminin teolojisini defaatle eleştiriye tabi tutmuştur. Yahudilerin seçilmiş ırk olarak görülmesi, Yeni Ahit’in bu ideolojiye destek vermemesi, “Armageddon savaşının” büyük mezheplerde karşılığının olmayışı ve hareketin Yahudi karakteri taşıması gibi sebepler yüzünden bazı Hıristiyan teologlar Hıristiyan siyonizmini heretik ilan etmiştir. Hıristiyan siyonizminin teolojisinin eleştirildiği bir diğer husus ise onun emperyal teoloji olarak yerine getirdiği işlev ile ilgilidir. Birçok düşünür Hıristiyan siyonizmi, Yahudi-Hıristiyan Batı anlatısı ve emperyalizm arasında sağlam bağlar olduğunu iddia etmektedir. Hıristiyan siyonizmi anomalisine bir açıklama getirmek isteyen şahıslar Hıristiyan siyonizmi içerisinde yer alan antisemitizme işaret etmektedir. Buna göre Hıristiyan siyonistler, Yahudilerin ve Yahudi devletinin kurulmasının gerçekleşmesinde hayati bir rol oynadığı kıyamet senaryolarını yürürlüğe koymak adına İsrail’i her şartta desteklerken, bu senaryo Yahudilerin kendisini Mesih gibi gösteren Antichrist tarafından yönetilmesini ve Yahudilerin çoğunluğunun Mesih’in gelişinden sonra ölmesini içermektedir. Aynı zamanda neredeyse daima İsrail yanlısı açıklamalar yapan bazı Hıristiyan siyonistlerin zaman zaman doğrudan antisemitik söylemlere başvurduğu gözlemlenebilmektedir. Bu sebeple Hıristiyan siyonistler ve Yahudiler arasındaki teopolitik ittifakın bir noktada bozulacak pragmatik bir ittifak olduğu iddia edilmektedir. Anti-İslamizm noktasındaki bulgulara göre Hıristiyan siyonistlerin %70’i Araplara karşı ya kayıtsız ya da düşmanca hisler beslemektedir. 11 Eylül’den sonraki dönemde İslam’ın şeytanlaştırılması operasyonu büyük ölçüde Robertson, Graham, Lindsey, Vines ve Falwell gibi Hıristiyan siyonistler tarafından gerçekleştirilmiştir. Yine İsrail’in 1948 yılında kuruluşu, Filistinliler için doğurduğu sonuçlara rağmen Hıristiyan siyonistlerin çoğu için bir kıyamet alametinin gerçekleşmesi anlamına gelmektedir. Hıristiyan siyonistlerin inandıkları kıyamet senaryosunda Müslümanlar ancak düşman saflarında savaşan Gog ve Magog olarak anlam bulabilmektedir. Onlar Şeytan, Antichrist ve Sahte Peygamber ’den oluşan cehennem teslisinin müttefikleridir. Filistinliler, Araplar ve Müslümanlar senaryonun gerçekleşmesi önünde doğrudan engel teşkil etmektedir. Bu hususlar birlikte değerlendirildiğinde halihazırda Hıristiyan siyonistlerin İslam’a ve Müslümanlara neden bu kadar olumsuz yaklaştıkları hususu açıklık kazanmaktadır. Görüldüğü üzere karşı karşıya olunan, gerçek dünyadaki gerçek olaylar ve aktörler hakkında rasyonalizasyona ve değişime kapalı olan, son derece tehlike arz eden dini inançlardır. Hıristiyan siyonizmi üç dinin etkileşime girdiği, üç dinin de bağlılarını ilgilendiren bir fenomendir. Teolojik analiz hareketin Hıristiyanlık dininin kutsal metinlerini İsrail lehine yorumladığını, ancak siyonist olmayan Hıristiyan teologlarca desteklenmediğini göstermektedir. Emperyalist ajandalar dahilinde ABD ve İngiltere gibi devletlerce de destek bulan bu hareketin kıyamet senaryosuna göre Müslümanlar Şeytan’ın müttefikleri olarak kötülüğün tarafındadır. Hz. İsa’nın yeryüzüne dönüşüyle yenilecekler ve yok edileceklerdir. Milyarlarca dolarlık bütçeleriyle, sayıları on binlerle ifade edilen propagandist vaizleriyle, Kuran-ı Kerim yakmak ve Hz. Muhammed’e terörist demek gibi eylemleriyle, Yahudileri İsrail’i Filistinlilerden temizlemeye teşvik etmeleriyle, bu uğurda onlara ciddi bir finansal ve manevi destek sağlamalarıyla ve Batı devletlerini İsrail’in düşman olarak algıladığı Müslüman komşularıyla savaşmaya teşvik eden lobicilik faaliyetleriyle Hıristiyan siyonistler halihazırda İslam’ın yüzleştiği en ciddi meydan okumalardan birisini teşkil etmektedir. Bu hareketin zararlı sonuçlarıyla mücadele etmek için atılması gereken en önemli adım araştırmaları derinleştirerek kitleleri doğru şekilde bilgilendirmek olacaktır. (shrink)
