This edited volume examines the realizations between theological considerations and natural law theorizing, from Plato to Spinoza.Theological considerations have long had a pronounced role in Catholic natural law theories, but have not been as thoroughly examined from a wider perspective. The contributors to this volume take a more inclusive view of the relation between conceptions of natural law and theistic claims and principles. They do not jointly defend one particular thematic claim, but articulate diverse ways in which natural law has (...) both been understood and related to theistic claims.In addition to exploring Plato and the Stoics, the volume also looks at medieval Jewish thought, the thought of Aquinas, Scotus, and Ockham, and the ways in which Spinoza's thought includes resonances of earlier views and intimations of later developments. Taken as a whole, these essays enlarge the scope of the discussion of natural law through study of how the naturalness of natural law has often been related to theses about the divine. The latter are often crucial elements of natural law theorizing, having an integral role in accounting for the metaethical status and ethical bindingness of natural law. At the same time, the question of the relation between natural law and God-and the relation between natural law and divine command-has been addressed in a multiplicity of ways by key figures throughout the history of natural law theorizing, and these essays accord them the explanatory significance they deserve. Freedom and moral responsibility have one foot in the practical realm of human affairs and the other in the esoteric realm of fundamental metaphysics—or so we believe. This has been denied, especially in the metaphysics-bashing era occupying the first two-thirds or so of the twentieth century, traces of which linger in the present day. But the reasons for this denial seem to us quite implausible. Certainly, the argument for the general bankruptcy of metaphysics has been soundly discredited. Arguments from Strawson (...) and others that our moral practices are too deeply embedded in human life to rest on anything as tenuous as a metaphysical doctrine far from the thoughts of ordinary people would seem to prove too much: we can easily imagine fantastic scenarios far from the thoughts of ordinary people—involving, say, alien manipulation or massive deception—that, if true, would clearly undermine claims to freedom and responsibility. For still other philosophers, the separation of the moral life from (some) metaphysical issues is prescriptive, not descriptive: it is a recommendation that we revise ordinary moral thought by severing its allegedly problematic links to metaphysics. (Some philosophers appear to hover undecided between such a prescriptive project and a Strawsonian descriptive claim.) We suspect that the prospects of retaining the binding force of ordinary moral thought, were such a reconceived moral practice widely embraced, are bleak. A transition to something closer to moral nihilism seems at least as likely. In any case, our interest here is in descriptive metaphysics, not revisionary. -/- To say as we do that freedom and moral responsibility have a partly metaphysical character is not to suggest that they can be had only if some highly specific version of a particular metaphysical framework is correct. Instead, we suggest in what follows, it is a broadly neo-Humean metaphysics that is not hospitable to freedom (for reasons distinctive to the metaphysics), while a broadly neo-Aristotelian metaphysics is. But we also think (and it is the main aim of our paper to show) that different versions of the neo- Aristotelian metaphysics lead to rather different metaphysical accounts of free and responsible action. Specifically, we will argue that (1) the most satisfactory account of human freedom within the broadly neo-Aristotelian metaphysics is agent-causal, but that (2) two different versions of the general metaphysics will lead to important differences in the agent-causal account of freedom. Adjust the details of your general metaphysics, and the details of your account of freedom are transformed in significant ways. Action theory cannot properly be pursued in isolation from general metaphysics. (shrink)

The vast majority of studies on affective processes in reading focus on single words. The most robust finding is a processing advantage for positively valenced words, which has been replicated in the rare studies investigating effects of affective features of words during sentence or story comprehension. Here we were interested in how the different valences of words in a sentence influence its processing and supralexical affective evaluation. Using a sentence verification task we investigated how comprehension of simple declarative sentences containing (...) a noun and an adjective depends on the valences of both words. The results are in line with the assumed general processing advantage for positive words. We also observed a clear interaction effect, as can be expected from the affective priming literature: sentences with emotionally congruent words (e.g., The grandpa is clever) were verified faster than sentences containing emotionally incongruent words (e.g., The grandpa is lonely). The priming effect was most prominent for sentences with positive words suggesting that both, early processing as well as later meaning integration and situation model construction, is modulated by affective processing. In a second rating task we investigated how the emotion potential of supralexical units depends on word valence. The simplest hypothesis predicts that the supralexical affective structure is a linear combination of the valences of the nouns and adjectives (Bestgen, 1994 ). Overall, our results do not support this: The observed clear interaction effect on ratings indicate that especially negative adjectives dominated supralexical evaluation, i.e., a sort of negativity bias in sentence evaluation. Future models of sentence processing thus should take interactive affective effects into account. (shrink)

Armstrong famously claims that deterministic laws of nature are contingent relations between universals and that his account can also be straightforwardly extended to irreducibly probabilistic laws of nature. For the most part, philosophers have neglected to scrutinize Armstrong’s account of probabilistic laws. This is surprising precisely because his own claims about probabilistic laws make it unclear just what he takes them to be. We offer three interpretations of what Armstrong-style probabilistic laws are, and argue that all three interpretations (...) are incompatible either with some feature of Armstrong’s broader metaphysics or with essential features of his account of laws (or both). We present an original emergent individuals view of human persons, on which persons are substantial biological unities that exemplify metaphysically emergent mental states. We argue that this view allows for a coherent model of identity-preserving resurrection from the dead consistent with orthodox Christian doctrine, one that improves upon alternatives accounts recently proposed by a number of authors. Our model is a variant of the “falling elevator” model advanced by Dean Zimmerman that, unlike Zimmerman’s, does not require a closest continuer account (...) of personal identity. Digressions in argumentative discussion are a kind of failure of relevance. Examination of what actual cases look like reveals several properties of argumentative relevance: (1) The informational relevance of propositions to the truth value of a conclusion should be distinguished from the pragmatic relevance of argumentative acts to the task of resolving a disagreement. (2) Pragmatic irrelevance is a collaborative phenomenon. It does not just short-circuit reasoning; it encourages a failure to take up the demands of an argumentative task. (3) (...) Pragmatic irrelevance can occur not simply by the absence of a connection between what is said and some standpoint in dispute, but also by the presence of a connection between what is said and a competing use of the information. In 1948 Karl Popper sent a copy of his paper, ‘Utopia and Violence’, to Michael Oakeshott. Popper had recently read Oakeshott’s essay ‘Rationalism in Politics’, appreciating its relevance to views he had expressed in The Open Society. Oakeshott wrote to Popper at some length, explaining his thoughts about reason, tradition and kindred matters, to which Popper responded. This paper reproduces these letters and discusses them with reference to pertinent writings of Popper and Oakeshott. While showing there was much common ground (...) between the two men and that they significantly influenced each other, the writings reveal important differences over the role of reason and tradition in social and political life. Michael Polanyi argues in Personal Knowledge (1958) that conceptual frameworks involved in major scientific controversies are separated by a `logical gap'. Such frameworks, according to Polanyi (1958: 151), are logically disconnected: their protagonists think differently, use different languages and occupy different worlds. Relinquishing one framework and adopting another, Polanyi's scientist undergoes a `conversion' to a new `faith'. Polanyi, in other words, presaged Kuhn and Feyerabend's concept of incommensurability. To what influences was Polanyi subject as he developed his concept of the (...) logical gap? The answer, as unfolded in this article, is twofold: Evans-Pritchard's Witchcraft, Oracles and Magic among the Azande and the Confessions of St Augustine. (shrink)

Early in the 1980s, a new category of crime appeared in the criminal law lexicon. In response to what was said to be an epidemic of prejudice-motivated violence, Congress and many state legislatures passed a wave of 'hate crime' laws that required the collection of statistics and enhanced the punishment of crimes motivated by certain prejudices. This book places in socio-legal perspective both the hate crime problem and society's response to it. From the outset, Jacobs and Potter adopt a (...) skeptical if not critical stance. They argue that hate crime is a hopelessly muddled concept and that legal definitions of the term are riddled with ambiguity and subjectivity. Moreover, no matter how hate crime is defined, the authors find no evidence to support the claim that the US is experiencing a hate crime epidemic—nor that the number or rate of hate crimes is at an historic zenith. This article considers the topic of the prior parental right in the education of their children, unequivocally asserted in the United Nations’ Declaration of Human Rights. Discussion focuses upon the origins and nature of this right as it is described in Catholic Church teaching as well as the Supreme Court’s 1925 decision in Pierce v. Society of Sisters, both of which antedate and provide principled support for UDHR’s assertion. The purpose here is to use these principles to identify the injustice (...) arising when a State or its agents deny parental choice in education by limiting that choice to public schools. In the United States, this action imperils the foundation of UDHR’s goal that education be “the foundation of freedom, justice and peace in the world.”. (shrink)

In _The Persistence of the Sacred in Modern Thought,_ Chris L. Firestone, Nathan A. Jacobs, and thirteen other contributors examine the role of God in the thought of major European philosophers from the seventeenth to the nineteenth century. The philosophers considered are, by and large, not orthodox theists; they are highly influential freethinkers, emancipated by an age no longer tethered to the authority of church and state. While acknowledging this fact, the contributors are united in arguing that this is (...) only one side of a complex story. To redress the imbalance of attention to secularism among crucial modern thinkers and to consolidate a more theologically informed view of modernity, they focus on the centrality of the sacred in the thought of these philosophers. The essays, each in its own way, argue that the major figures in modernity are theologically astute, bent not on removing God from philosophy but on putting faith and reason on a more sure footing in light of advancements in science and a perceived need to rethink the relationship between God and world. By highlighting and defending the theologically affirmative dimensions of thinkers such as Thomas Hobbes, Gottfried Leibniz, John Locke, Immanuel Kant, F. W. J. Schelling, G. W. F. Hegel, and others, the essayists present a forceful and timely correction of widely accepted interpretations of these philosophers. To ignore or downplay the theological dimensions of the philosophical works they address, they argue, distorts our understanding of modern thought. Are there key respects in which character and character defects are voluntary? Can agents with serious vices be rational agents? Jonathan Jacobs answers in the affirmative. Moral character is shaped through voluntary habits, including the ways we habituate ourselves, Jacobs believes. Just as individuals can voluntarily lead unhappy lives without making unhappiness an end, so can they degrade their ethical characters through voluntary action that does not have establishment of vice as its end. Choosing Character presents an account (...) of ethical disability, expanding the domain of responsibility and explicating the role of character in ethical cognition. Jacobs contends that agents become ethically disabled voluntarily when their habits impair their ability to properly appreciate ethical considerations. Such agents are rational, responsible individuals who are yet incapable of virtuous action. The view develops and modifies Aristotelian claims concerning the fixity of character. Jacobs' interpretation is developed in contrast to the overlooked work of Maimonides, who also used Aristotelian resources but argued for the possibility of character change. The notion of ethical disability has profound ramifications for ethics and for current debates about blame and punishment. (shrink)

We examine how the shift to remote work altered responsibilities for domestic labor among partnered couples and single parents. The study draws on data from a nationally representative survey of 2,200 US adults, including 478 partnered parents and 151 single parents, in April 2020. The closing of schools and child care centers significantly increased demands on working parents in the United States, and in many circumstances reinforced an unequal domestic division of labor.

Differences in family factors in determining academic achievement were investigated by testing 432 parents in nine independent, coeducational Melbourne schools. Schools were ranked and categorized into three groups , based on student achievement scores in their final year of secondary school and school improvement indexes. Parents completed a questionnaire investigating their attitudes towards the school environment, their aspirations, expectations, encouragement and interest in their child’s education . They also responded to six open‐ended questions on their attitudes to achievement and to (...) their school. Multiple regression analyses revealed that parental expectations of their children’s educational level made the strongest unique prediction of high achievement followed by the length of time they had maintained their expectations. Limitations discussed include the disparity in meaning associated with the definition of school success and whether these results can be generalized to all students considering the biased sample. In this article we examine the specific contributions Native American thought can make to the ongoing search for a Western ecological consciousness. We begin with a review of the influence of Native American beliefs on the different branches of the modem environmental movement and some initial comparisons of Western and Native American ways of seeing. We then review Native American thought on the natural world, highlighting beliefs in the need for reciprocity and balance, the world as a living being, and (...) relationships with animals. We conclude that Native American ideas are important, can prove inspirational in the search for a modem environmental consciousness, and affirm the arguments of both deep ecologists and ecofeminists. Femtech is the collective name for technologies that address female health needs. Femtech applications can help women digitally track their period, manage their fertility, and support their pregnancy. Although femtech has beneficial potential, there are various ethical concerns to be raised with current femtech apps. In this article, we discuss three of the main ethical concerns with femtech apps regarding (1) medical reliability, (2) privacy, and (3) gender stereotyping and epistemic injustice, and we explore how Capability Sensitive Design, a novel (...) design framework for health and well‐being technologies, is able to mitigate these concerns and help create morally sensitive femtech. A long tradition of research including classical rhetoric, esthetics and poetics theory, formalism and structuralism, as well as current perspectives in (neuro)cognitive poetics has investigated structural and functional aspects of literature reception. Despite a wealth of literature published in specialized journals like Poetics, however, still little is known about how the brain processes and creates literary and poetic texts. Still, such stimulus material might be suited better than other genres for demonstrating the complexities with which our brain constructs the world (...) in and around us, because it unifies thought and language, music and imagery in a clear, manageable way, most often with play, pleasure, and emotion (Schrott and Jacobs, 2011 ). In this paper, I discuss methods and models for investigating the neuronal and cognitive-affective bases of literary reading together with pertinent results from studies on poetics, text processing, emotion, or neuroaesthetics, and outline current challenges and future perspectives. We study the claim that multisensory environments are useful for visual learning because nonvisual percepts can be processed to produce error signals that people can use to adapt their visual systems. This hypothesis is motivated by a Bayesian network framework. The framework is useful because it ties together three observations that have appeared in the literature: (a) signals from nonvisual modalities can “teach” the visual system; (b) signals from nonvisual modalities can facilitate learning in the visual system; and (c) visual (...) signals can become associated with (or be predicted by) signals from nonvisual modalities. This paper analyzes Russian-French philosopher Alexandre Kojève’s dialogue with proponents of Hegelianism and phenomenology in Soviet Russia of the 1920–30s. Considering works by Dmytro Chyzhevsky, Ivan Ilyin, Gustav Shpet, and Alexandre Koyré, I retrace Hegelian themes in Kojève, focusing on the relation between method and time. I argue that original reflections on method played a key role in both Russian Hegelianism and Kojève’s work, from his famous Hegel lectures to the late fragments of a system. As I demonstrate, Kojève’s Hegelianism (...) was significantly shaped by his encounter with Ilyin’s 1918 commentary on Hegel, a detailed study of the relation between method and the experience of time. However, in Kojève’s hands, Ilyin’s ideas were transformed, some radicalized, others abandoned. Comparatively reading texts by these thinkers in their respective contexts, I resituate and evaluate claims that Hegel’s method was less dialectical than phenomenological. I finally argue that early Soviet Hegelian discourses not only shaped the trajectory of Kojève’s Hegelianism but also radically anticipated concepts of time in French post-structuralism. (shrink)

Chris L. Firestone and Nathan Jacobs integrate and interpret the work of leading Kant scholars to come to a new and deeper understanding of Kant's difficult book, Religion within the Boundaries of Mere Reason. In this text, Kant's vocabulary and language are especially tortured and convoluted. Readers have often lost sight of the thinker's deep ties to Christianity and questioned the viability of the work as serious philosophy of religion. Firestone and Jacobs provide strong and cogent grounds for (...) taking Kant's religion seriously and defend him against the charges of incoherence. In their reading, Christian essentials are incorporated into the confines of reason, and they argue that Kant establishes a rational religious faith in accord with religious conviction as it is elaborated in his mature philosophy. For readers at all levels, this book articulates a way to ground religion and theology in a fully fledged defense of Religion which is linked to the larger corpus of Kant's philosophical enterprise. It has been said that Robert Boyle gave in the century of The Scientific Revolution the “fullest expression” of the view that laws of nature are continually impressed by God (“occasionalism”). So regarded, the universe is anything but an autonomous machine, its ordered operation depending on God’s continuous imposition of lawful, patterned relations between phenomena and his continuous provision of motion for them to actually enter relations. The present paper contests this treatment of Boyle. Evidence is elicited to show that, (...) for Boyle, most physical relations issue from intrinsic dispositions of phenomena, not divine impositions, dispositions determined by corpuscular textures. Members of classes of phenomena have capacities to make specific changes which members of other classes have capacities to receive, these correlative capacities being necessarily connected, subjects in principle of a priori synthetic necessary knowledge. The same view is found in John Locke’s Essay Concerning Human Understanding. It is additionally argued that Boyle’s God, the quintessentially active being, imparted motion at the creation, whereafter the motion of (at least most) natural phenomena has derived from natural, not supernatural, impulsion. Asia Minor witnessed a resurgence of construction and renovation activities in the Theodosian age, and in particular in the last twenty years of the 4th and the first twenty years of the 5th century AD. In fact, the typical Late Antique city, with its imposing fortification walls, heterogeneous street colonnades and agora porticoes, and monumental churches replacing earlier temples, came into being in these decades. A confrontation of the material remains with contemporaneous historical, political, social and religious events and changes, (...) would suggest that these urbanistic interventions were the result of unrelated factors arising in just a few decades’ time. Despite the absence of a deliberate Theodosian policy of urban renewal, the care for and energy invested in the cityscape does testify to continuance of aesthetic principles and representational concerns, not only at Constantinople, but also in the provincial capitals and even in the smaller cities of the region. Popper believed that Einstein’s general theory of relativity and his attitudes of modesty and self-criticism were all important.This paper challenges details in Popper’s account and suggests an alternative interpretation of the formation of his theory. It is held that his disillusionment with Marxism predated and conditioned his understanding of Einstein, and that the liberalism of J. S. Mill may have exercised an influence. Edward Shils presented his book Tradition (1981) as the first extensive study of the subject. This article casts light on Shils' multifaceted understanding of tradition, comprising pragmatic, Burkean, veridical, and evolutionist perspectives. His typology of traditions is noted, and his view of institutional bearers of tradition described. In assessing Shils' theory, however, we find that it overreaches, collapsing differences that exist between traditions, transmissions, and the traditional.

Currently, value sensitive design (VSD) does not commit to a particular ethical theory. Critiques contend that without such an explicit commitment, VSD lacks a methodology for distinguishing genuine moral values from mere stakeholders-preferences and runs the risk of attending to a set of values that is unprincipled or unbounded. We argue that VSD practitioners need to complement it with an ethical theory. We argue in favour of a mid-level ethical theory to fulfil this role.

Opponents of male circumcision have increasingly used human rights positions to articulate their viewpoint. We characterize the meaning of the term “human rights.” We discuss these human rights arguments with special attention to the claims of rights to an open future and to bodily integrity. We offer a three-part test under which a parental decision might be considered an unacceptable violation of a child's right. The test considers the impact of the practice on society, the impact of the practice on (...) the individual, and the likelihood of adverse impact. Infant circumcision is permissible under this test. We conclude that infant circumcision may be proscribed as violating local norms, even though it does not violate human rights. (shrink)

This article presents the framework Capability Sensitive Design (CSD), which consists of merging the design methodology Value Sensitive Design (VSD) with Martha Nussbaum's capability theory. CSD aims to normatively assess technology design in general, and technology design for health and wellbeing in particular. Unique to CSD is its ability to account for human diversity and to counter (structural) injustices that manifest in technology design. The basic framework of CSD is demonstrated by applying it to the hypothetical design case of a (...) therapy chatbot for mental health. By applying CSD to a design case, the merits of this new framework over the standard VSD approach become apparent. Also, the application demonstrates what a technology design would look like when attention is paid to capabilities right from the start of the design process. (shrink)

I explore two accounts of properties within a dispositional essentialist (or causal powers) framework, the pure powers view and the powerful qualities view. I first attempt to clarify precisely what the pure powers view is, and then raise objections to it. I then present the powerful qualities view and, in order to avoid a common misconception, offer a restatement of it that I shall call the truthmaker view. I end by briefly defending the truthmaker view against objections.

Moral sensitivity is known to be the starting point for moral competence and even is a core concept in the curricula for bachelor’s-level nursing students in the Netherlands. While the development of moral sensitivity in nursing is commonly agreed to be important, there is no clear understanding of how to develop moral sensitivity through nursing education and what components of nursing education contribute to moral sensitivity. Studies on educational interventions could build knowledge about what works in developing moral sensitivity and (...) how to achieve this outcome. Therefore, the aim of this study is to explore if and how educational interventions contribute to the development of moral sensitivity in nursing students. A scoping review was conducted. Four electronic databases were searched: CINAHL, PubMed, MEDLINE and SpringerLink. Articles that were not about formal or initial nursing education and that had no link to moral development or moral sensitivity were excluded. After the final selection on educational interventions, 10 articles out of the initial 964 resources were included in the review. Three different but related dimensions of moral sensitivity emerged from the literature: (1) raising moral awareness, (2) providing the ability to frame and name ethical issues and (3) improving moral reasoning ability. Half of the studies used quantitative measures to evaluate the educational intervention, in particular the Moral Sensitivity Questionnaire; the other half used diverse qualitative evaluation methods. None of the studies presented teaching methods that included all three dimensions of moral sensitivity. Moral awareness of self appears to be more loosely connected to the other two dimensions, which raises the question of whether it can be seen as a prerequisite for them. To encompass all dimensions of moral sensitivity, a mix of quantitative and qualitative measures seems most appropriate to study that topic. (shrink)
