This monograph revisits Uruguay’s remarkable transformation from a volatile product of ‘balkanisation’ in the River Plate area into Latin America’s first welfare-state democracy, associated with President José Batlle y Ordóñez (1903–7, 1911–15). Central to the country’s belated polity formation and nation-building was its school reform. The author investigates this, for the first time, from its start in 1868 under José Pedro Varela to the end of Batlle’s second term and argues that continuities in change prevailed over the alleged rupture of (...) 1903, including at the level of normative ideas. Moreover, by placing Uruguay into the broader context of what scholars have called the “Corridor of Ideas” from Santiago de Chile through Buenos Aires and Montevideo to Porto Alegre, this pioneering study also shows how Uruguay acted as a crossroads of intellectuals and a laboratory for the contestation, assimilation, and merger of global and autochthonous political and pedagogical philosophies. Uruguay is a prime example of how a peripheral country creatively digested foreign experiences and became not only Latin America’s first welfare state democracy, but also a pioneer of free, compulsory, and lay education, the work of two political generations, positivist varelistas and Krausist batllistas. This article, based on new archival sources, contemporary newspapers, official publications, and monographs by protagonists argues that one of their consistent reference points, largely ignored in historiography, was Belgium, a country founded almost at the same (...) time as Uruguay and admired for its liberal constitutionalism. Uruguayan reformers’ fascination with Belgium, but also their risk awareness, increased when, from the 1860s, both countries implemented conflictual secularizing school reforms that aimed at belated cultural nation-building. Positivism, the predominant philosophy of Latin America’s elites at the end of the nineteenth century, found its exemplary expression in Brazil’s castilhismo and Mexico’s porfiriato. Argentina, in contrast, seemed to have deviated from the norm of ‘enlightened dictatorships’. After the end of the Rosas tyranny in 1852, authoritarianism had been discredited. Early positivism, as embodied by Teacher-President Sarmiento, could barely be distinguished from liberalism and no single political philosophy was able to exert hegemony. However, the significance of ‘scientific politics’ should (...) not be downplayed. As this article argues, the merger, in the 1880s, of Comtean positivism and teacher training revolutionised education policies that aimed at erasing frontier backwardness and inserting future generations into an export-led economy, oligarchic polity, and homogenous national organism. Normal schools, especially Sarmiento’s Escuela de Parana´, acted as laboratories for the assimilation, merger, and contestation of European, North American, and autochthonous scientific, philosophical, and pedagogical traditions. The author argues that polity and policies of Getúlio Vargas’s Estado Novo cannot be fully understood without exploring the legacy of Rio Grande do Sul. The southern state’s first republican governor, Júlio de Castilhos, had taken inspiration in Auguste Comte’s multifaceted political philosophy and inculcated its authoritarian traits into political institutions. Yet, he and his followers substantially adapted Comte’s positivism to the specific economic and political circumstances in their republiqueta sui generis. In contrast to Comte, the State merged temporal and (...) spiritual powers to pursue evolutionary political changes, a balanced socioeconomic modernisation, and the incorporation of the populus qua paternalistic public policies, and all this with a strong focus on education. Changing contexts resulted in further adjustments, when Vargas became governor in 1928: an ‘orderly’ inclusion of the opposition into the polity, a stronger state interventionism in the economy and labor market, and an experimentation with state corporatism. These experiences paved the way for this comtismo-turned-castilhismo-turning-varguismo to enter the national stage two years later. Despite all the compromises with other contenders for power that Vargas had to make thereafter, he and his gaúcho and other co-opted protégés remained united in the strong belief in technical solutions to social problems and a quest for rational institutions to carry out transformative policies. For them, the State was to be agent of development, tutor of corporate interest groups, and now also guarantor of national security. While highlighting the significant, and still underestimated, impact of French positivism on Vargas’s first 15 years in government, the article places emphasis on the pragmatic dimensions of its appropriation, propagation, and reinterpretation by two generations of state-builders. Ethics support staff help others to deal with moral challenges. However, they themselves can also experience moral challenges such as issues regarding (breaching) confidentiality when practicing ethics support. Currently there is no insight in these confidentiality issues and also no professional guidance for dealing with them. To gain insight into moral challenges related to Moral Case Deliberation (MCD), we studied a) beliefs and experiences of MCD facilitators regarding breaching confidentiality, b) considerations for (not) breaching confidentiality, and c) needs for an (...) ethics support tool. Data collection consisted of qualitative research methods: six semi-structured interviews; analyses of a) two recorded MCD sessions, and b) a focus group with MCD facilitators. Findings: MCD facilitators mention different conceptions and interpretations of confidentiality and various moral challenges. Questions concerning confidentiality ultimately cause reflections on roles and responsibilities of facilitators. Needs for ethics support vary from seeking advice to procedural and sometimes normative guidance for MCD facilitators. Education for MCD facilitators should focus on developing a concrete tool that stimulates awareness and reflection(skills). (shrink)

Approximately 50 years have passed since Judith Jarvis Thomson wrote A Defense of Abortion (1971). Her article has significantly shaped the philosophical literature on abortion. In this paper, I will summarize some of the interesting and important work done on the topic since Thomson's article. I will highlight Thomson as a defender of the claim that abortion is morally permissible and Don Marquis as an influential opponent of that claim. I will start by articulating Thomson's case, focusing on the violinist (...) analogy. I will underscore key questions, concepts, and objections the analogy raises. I will then examine briefly how philosophers have addressed some of these issues. Next, I will outline Marquis’ work, provide a similar commentary on it, and discuss some of its main responses. I will then survey other philosophers who have addressed abortion beyond the scope of providing specific replies to Thomson or Marquis. I will close by highlighting significant points of agreement and disagreement in the literature, as well as crucial gaps in the current research. The paper is not an attempt to address every work on the topic over the last five decades, nor is it aimed at taking a position on the moral permissibility of abortion. This book assesses and defends Kant's Critical epistemology, and the rich yet neglected resources it provides for understanding and resolving fundamental issues regarding human experience, perceptual judgment, empirical knowledge and cognitive sciences. Kenneth Westphal first examines Kant's methods and strategies for examining human sensory-perceptual experience, and then examines Kant's central, proper, and subtle attention to judgment, and so to the humanly possible valid use of concepts and principles to judge particulars we confront. This provides a comprehensive account of Kant's anti-Cartesianism, (...) the integrity of his three principles of causal judgment, and Kant's account of disciminatory perceptual-motor behaviour, including both sensory reafference and perceptual affordances. Westphal then defends the significance of Kant's subtle and illuminating account of causal judgment for three main philosophical domains: history and philosophy of science, theory of action and human freedom, and philosophy of mind. Kant's Critical Epistemology will appeal to researchers and advanced students interested in Kant and the relations of his thought to contemporary philosophical debates and to the sciences of the mind. For a period of several years the philosopher of science Hasok Chang has promoted various inter-related views including pluralism, pragmatism, and an associated view of natural kinds. He has also argued for what he calls the persistence of everyday terms in the scientific view. Chang claims that terms like phlogiston were never truly abandoned but became transformed into different concepts that remain useful. On the other hand, Chang argues that some scientific terms such as acidity have suffered a form of (...) “rupture”, especially in the case of the modern Lewis definition of acids. Chang also complains that the degree of acidity of a Lewis acid cannot be measured using a pH meter and seems to regard this as a serious problem. The present paper examines some of these views, especially what Chang claims to be a rupture in the definition of acidity. It is suggested that there has been no such rupture but a genuine generalization, on moving from the Brønsted-Lowry theory to the Lewis theory of acidity. It will be shown how the quantification and measurement of Lewis acidity can easily be realized through the use of equilibrium theory and the use of stability constants. (shrink)

In this article, we focus on a particular kind of emotional impact of the pandemic, namely the phenomenology of the experience of moral injury in healthcare professionals. Drawing on Weber's reflections in his lecture Politics as a Vocation and data from the Experiences of Social Distancing during the COVID-19 Pandemic Survey, we analyse responses from healthcare professionals which show the experiences of burnout, sense of frustration and impotence, and how these affect clinicians’ emotional state. We argue that this may relate (...) to the ethical conflicts they experience when they are forced to make clinical decisions where there are no optimal outcomes, and how in turn that impacts on their own emotional state. We then further examine the notion of ‘burnout’ and the phenomenology of ‘moral injury’. Our argument is that these experiences of moral injury across a range of clinicians during the pandemic may be more prevalent and long-standing in psychiatry and mental health than in other areas of healthcare, where ethically difficult decisions and resource constraints are common outside times of crisis. Hence, in these clinical arenas, moral injury and the phenomenology of emotional changes may be independent of the pandemic. The insights gained during the pandemic may provide wider insights into the challenges of developing services and training the workforce to provide appropriate mental health care. (shrink)

Bio-heteronormative conceptions of the family have long reinforced a nuclear ideal of the family as a heterosexual marriage, with children who are the genetic progeny of that union. This ideal, however, has also long been resisted in light of recent social developments, exhibited through the increased incidence and acceptance of step-families, donor-conceived families, and so forth. Although to this end some might claim that the bio-heteronormative ideal is not necessary for a social unit to count as a family, a more (...) systematic conceptualization of the family—the kind of family that matters morally—is relatively underexplored in the philosophical literature. This paper makes a start at developing and defending an account of the family that is normatively attractive and in line with the growing prevalence of non-conventional families and methods of family-formation. Our account, which we call a constitutive-affirmative model of the family, takes the family to be constituted by an ongoing process of relevant affective and affirmative relations between the putative family members. We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. Martial wrote about himself and his participation in the everyday life of Rome more than any other extant poet of the post-Augustan Principate. More particularly, dozens of his epigrams describe the life of the ordinary client and his treatment by great and often arrogant patrons. Unfortunately for social and literary historians, however, Martial was writing satirical epigrams, not autobiography. Consequently, his poetry cannot be taken at face value as a direct reflection of Roman life. With regard to literary patronage, the (...) difficulties of interpretation have allowed modern scholars to reach diametrically opposed conclusions. One editor and commentator baldly labelled Martial ‘a chronic beggar’ who ‘despite his numerous friends and the many patroni to whom he paid court,…dragged on a hand-to-mouth existence’. In a recent and more detailed study, on the other hand, Martial is portrayed as a man of independent means, who looked to his powerful amici not for financial support so much as for help in publicizing his work and for protection in literary squabbles. Deception sometimes results in nonconsensual sex. A recent body of literature diagnoses such violations as invalidating consent: the agreement is not morally transformative, which is why the sexual contact is a rights violation. We pursue a different explanation for the wrongs in question: there is valid consent, but it is not consent to the sex act that happened. Semantic conventions play a key role in distinguishing deceptions that result in nonconsensual sex (like stealth condom removal) from those that don’t (like (...) white lies). The claim that they have no choice but to work and sell on the street, despite the dangers, illnesses, and psychological issues they may face, to provide for their family’s needs is very evident. Therefore, this study explores the quality of life, lived experiences, challenges, and coping mechanisms of senior citizen street vendors in Bulacan, Philippines. The study employed Heideggerian Phenomenology and Interpretative Phenomenological Analysis (IPA). Rather, his project begins from a diagnosis of what ails contemporary literary criticism: that it suffers, not so much from a false view of literature, as from a false view of truth, goodness, and reality. He accordingly undertakes to provide a better view of those fundamental matters, one that he derives from aspects of Aristotle’s thought. According to Groarke, it is these aspects of Aristotle that have the most to offer literary theorists today.Groarke draws his most important Aristotelian inspiration from Aristotle’s discussion of theōria in Nicomachean Ethics 10.7–8. In Groarke’s view, Aristotelian theōria is a truthful vision of a supreme reality that transcends human life and pervades the universe. This vision, for Groarke, is what literature is (or should be) about. On this basis, he critiques forms of literary criticism that see literature as concerned only with politics, or with class distinctions, or with entertainment, or with language itself. As Groarke sums up his argument: “[L]iterature supplies opportunities for intelligence gathered up in an artful and superlative moment of beholding of what is fundamental, real, meaningful, and true. Literature provides an avenue for contemplation (theōria), facilitating a divine-like gaze upon the world.” For Groarke, Aristotelian theōria allows us to behold what is “fundamental, real, meaningful, and true.” It is especially valuable because it affirms the essential unity of these attributes. Like Aristotle’s god, Groarke’s transcendent reality is simultaneously the highest reality and the summation of all value. For Groarke, to engage in theōria is thus to affirm that the universe is suffused with moral significance. It is this stance that Groarke thinks literature should promote.I have a great deal of sympathy both for Groarke’s reading of Aristotle and for his sense that these aspects of his thought are relevant to fundamental questions about literature. But I found the experience of reading this book challenging. The bulk of Groarke’s work is not devoted to developing his Aristotelian conception, applying it to literary case studies, or considering any problems it might raise. My aim in this paper is to engage with C. Thi Nguyen’s characterization of the echo chamber and to propose two things. First, I argue that a proper reading of his concept of echo chamber should make use of the notion of ignorance in the form of a structural epistemic insensitivity. My main contention is that ignorance as a substantive structural practice accounts for the epistemically deleterious effects of echo chambers. Second, I propose that from the talk of ignorance we (...) should be able to see echo chambers in terms of their more harmful impacts in our daily lives. To do that, I argue that we should think of echo chambers as tools to promote hermeneutical domination. If my representation of Nguyen’s concept is accurate, I believe we can see some important theoretical consequences stemming from the way Nguyen understands it. (shrink)

From roughly 1965 to 1995, Columbia University's Department of Sociology was a leading center for social study of science, both nationally and internationally. It was often referred to as the Merton School or Columbia School, and four scholars paved its way : Robert K. Merton, Harriet Zuckerman, Stephen Cole, and Jonathan Cole. The goal of the Columbia School was to create and legitimate a new sociological specialty focusing on the scientific community and the growth of scientific knowledge and they did (...) this by exploring the norms, values, and structure of science. The core values of the scientific and university system and the norms attached to them consisted of deeply held beliefs as well as principles that determined how individuals would act. They were organizing principles designed to support the institution in meeting its goals and mission. They influenced the types of social structures that developed to carry out the activities of scientists. Edited by Jonathan R. Cole, this collection of individually and co-authored papers and essays by Cole represents some of the work produced by Cole and his close collaborators over the past 50 years. the essays are contextualized with an introduction by Cole. The pieces in this volume represent the major concerns on the Columbia School, whose focus of attention was not on the production of individual pieces of knowledge, but on the social systems that made that production possible. This article confronts the challenges and opportunities presented by medical-legal partnerships (MLPs) representing families impacted by the family regulation system. Based on the authors’ experience developing a collaboration between a medical-legal partnership, interdisciplinary law school clinic and nurse home visiting program focused on clients impacted by the family regulation system, the article challenges traditional conceptions of the MLP model and proposes an expanded vision for MLPs to address systemic injustice and improve outcomes for families.

The wave function of quantum mechanics can be understood in terms of the dispositional role it plays in the dynamics of a distribution of matter in three-dimensional space (or four-dimensional spacetime). There is more than one way, however, of specifying its dispositional role. This paper considers Suárez’s theory of ‘Bohmian dispositionalism’, in which the particles are endowed with their own ‘Bohmian dispositions’, and Simpson’s theory of ‘Cosmic Hylomorphism’, in which the particle configuration comprises a hylomorphic substance which has an intrinsic (...) power. I argue that Bohmian dispositionalism fails to capture intuitively correct counterfactuals about what would happen in Small Worlds which have only a small number of particles, but that this problem is avoided by Cosmic Hylomorphism, in which the cosmic power manifests a teleological process. As clinical trials end, little is understood about how participants exiting from clinical trials approach decisions related to the removal or post-trial use of investigational brain implants, such as deep brain stimulation (DBS) devices. This empirical bioethics study examines how research participants experience the process of exit from research at the end of clinical trials of implanted neural devices. Using a modified grounded theory study design, we conducted semi-structured, in-depth interviews with 16 former research participants from clinical trials of DBS (...) and responsive neurostimulation (RNS). Open-ended questions elicited motivations for joining the trial, understanding of study procedures at the time of initial informed consent, the process of exiting from research, and decisions about device removal or post-trial device use. Thematic analysis identified categories related to: limited preparedness for the end of research participation, straightforwardness of decisions to explant or keep the device, reconciling with the end of research participation, reconciling post-trial expectations, and achieving a sense of closure after exit from research. A preliminary theoretical model describes contextual factors influencing the process and experience of exit from research. Experiences of clinical trial participants should guide research practices to enhance the ethical design and conduct of clinical trials in DBS and other brain devices. (shrink)

They provide us with a pragmatic justification that is distinct from those utilized in the current debate, and in many respects superior to the alternatives. In addition to supplying this curative philosophic resource, the early Confucian practices of ancestral memorialization suggest preventative measures we might adopt to minimize the chances of establishing divisive and (...) oppressive memorials in the future. In this essay an engineer and a philosopher, after many conversations, develop an argument for why the Aristotelian version of virtue ethics is the most promising way to develop what we call artificial moral, social agents, i.e. robots. Mysticism is condemned as often as it is praised. Much of the condemnation comes from mysticism’s apparent disregard of morality and ethics. For mystics, the experience of “union” transcends all moral concern. In this careful examination of the works of such practitioners or examiners of mysticism as Paul Tillich, Thomas Merton, Evelyn Underhill, and Martin Buber, the author posits a spectrum of uneasy relationships between mysticism and morality. Selective mutism is an anxiety disorder in which an individual is unable to speak in certain social situations though may speak normally in other settings (Hua & Major, 2016 ). Selective mutism in adults is rare, though people with this condition might have other methods of communicating their needs outside of verbal communication. Healthcare professionals rely on a patient’s ability to communicate to establish if they have decision-making capacity. This commentary responds to a case of a young adult patient with (...) selective mutism and social anxieties that significantly limited his ability to communicate with anyone in the healthcare team.
