In the intellectual confusion prevailing since the demise of Marxism and “marxism”, the attempt is made to define democracy as a matter of pure procedure, explicitly avoiding and condemning any reference to substantive objectives. It can easily be shown, however, that the idea of a purely procedural “democracy” is incoherent and self-contradictory. No legal system whatsoever and no government can exist in the absence of substantive conditions which cannot be left to chance or to the workings of the “market” but (...) must be posited as objectives of political activity. The confusion results from a deficient understanding of what makes a society and an empty idea of “freedom”. The objective of politics is not happiness, an affair to be left to the individuals, but it certainly is liberty understood as participation in the governance of the polity; it is also the pursuit of the common good, defined as the sum of the prerequisites and facilitations of individual autonomy depending on collective action, and as the realization of commonly agreed collective goals. This article is a contribution to the critical sociology of science perspective introduced and developed by Pierre Bourdieu. The paper proposes a transversalist theory of science and technology production and diffusion. It is here argued that science and technology are comprised of multiple regimes where each regime is historically grounded, possesses its own division of labour, modes of cognitive and artifact production and has specific audiences. The major regimes include the disciplinary regime, utilitarian regime, transitory regime and research-technology (...) regime. Though each regime is autonomous, they are simultaneously closely interlaced. In science and technology, autonomy is not antithetical to interdependence and reciprocity. This study demonstrates for the four specified regimes of production and diffusion that differentiation is not contrary to interaction. In science, differentiation and interaction comprise two sides of the same coin. All regimes exhibit a measure of transversality. (shrink)

In this article, the author addresses two feminist issues: first, how to conceptualize intersectionality, the mutual reproduction of class, gender, and racial relations of inequality, and second, how to identify barriers to creating equality in work organizations. She develops one answer to both issues, suggesting the idea of “inequality regimes” as an analytic approach to understanding the creation of inequalities in work organizations. Inequality regimes are the interlocked practices and processes that result in continuing inequalities in all work (...) organizations. Work organizations are critical locations for the investigation of the continuous creation of complex inequalities because much societal inequality originates in such organizations. Work organizations are also the target for many attempts to alter patterns of inequality: The study of change efforts and the oppositions they engender are often opportunities to observe frequently invisible aspects of the reproduction of inequalities. The concept of inequality regimes may be useful in analyzing organizational change projects to better understand why these projects so often fail and why they succeed when this occurs. (shrink)

This study addresses the gap between policy and practice on the issue of women’s right to own rural land through a qualitative study conducted in Pakistan’s two largest provinces, Punjab and Sindh. A recent survey finds that only 4% of women own rural land in Pakistan. Given the relatively large agrarian economy, land is a key resource determining women’s agency. To understand the dynamics that maintain this status quo, I use two distinct strands of feminist theory. First is Joan Acker’s (...) organizational theory of gender and class structures, to explore the inequality regimes embedded in rural patriarchy. Second, I adapt Suad Joseph’s conceptualization of patriarchal connectivity to show how in rural Pakistan, valorizing kinship works to exclude women from matters pertaining to land and silencing demands for their inheritances. This framework simultaneously allows for a fine-grained analysis of the politico-economic and social structures of rural society, while building an intimate understanding of familial relations. The findings show how land is discursively defined as a collective good to ensure that landed patriarchs remain entrenched within the political and economic order of the state, limiting possibilities, for women, of acquiring agency through owning and controlling rural land. The study also upends the widespread myth of Islamic misogyny, for it demonstrates the political economy of patriarchal domination over religion in Pakistan. (shrink)

Like being able to drive a car, being autonomous is a socially attributed, claimed, and contested status. Normative debates about criteria for autonomy (and what autonomy entitles one to) are best understood, not as debates about what autonomy, at core, really is, but rather as debates about the relative merits of various possible packages of thresholds, entitlements, regulations, values, and institutions. Within different “regimes” of autonomy, different criteria for (degrees of) autonomy become authoritative. Neoliberal, solidaristic, and perfectionist regimes (...) entail conflicting understandings of what gets you autonomy and what autonomy gets you—for example, in relation to policies regarding physician-assisted suicide or financial support for senior citizens. In light of this, justifying a particular understanding of autonomy is inseparable from the task of arguing for the context-specific merits of a regime of autonomy as a whole and in relation to other ethical and political commitments. Citizenship regimes are institutionalized systems of formal and informal norms that define access to membership, as well as associated rights and duties. This paper studies illegalized migration as one of the major tests to assess whether citizenship regimes are fair institutions, based on a historical analysis of legislation meant to reduce illegalized migration in the United States between 1995 and 2022. We build our empirical research starting from a simple observation: despite the great number of bills introduced to (...) reduce illegalized migration to the US, most of such initiatives fail to become law. In fact, 93.5% of all immigration initiatives did not even pass the chamber of Congress in which they were originally presented. Such a high rate of failure shows that these proposals are motivated by electoral aspirations, rather than coming from a genuine wish to help migrants or grant them citizenship. Furthermore, there is also an economic interest that justifies the maintenance of low-cost disposable immigrant labor, with no right to citizenship. Our analysis is an example of how state regulation processes seem to work to formalize, rather than alleviate or eradicate, the precarious legal statuses of illegalized migrants. We conclude that a globalized phenomenon such as citizenship requires going beyond merely institutional and formal conceptions. We need to rethink the institutional notion of citizenship, as a merely status held under the authority of a state and consider it from a cosmopolitan perspective and a multilateral basis. But as long as citizenship remains under the responsibility of states, illegalized migrants will continue to experience precarious citizenship. (shrink)

While most studies of low-carbon transitions focus on green niche-innovations, this paper shifts attention to the resistance by incumbent regime actors to fundamental change. Drawing on insights from political economy, the paper introduces politics and power into the multi-level perspective. Instrumental, discursive, material and institutional forms of power and resistance are distinguished and illustrated with examples from the UK electricity system. The paper concludes that the resistance and resilience of coal, gas and nuclear production regimes currently negates the benefits (...) from increasing renewables deployment. It further suggests that policymakers and many transition-scholars have too high hopes that ‘green’ innovation will be sufficient to bring about low-carbon transitions. Future agendas in research and policy should therefore pay much more attention to the destabilization and decline of existing fossil fuel regimes. (shrink)

The food regime concept is a key to unlock not only structured moments and transitions in the history of capitalist food relations, but also the history of capitalism itself. It is not about food per se, but about the relations within which food is produced, and through which capitalism is produced and reproduced. It provides, then, a fruitful perspective on the so-called ‘world food crisis’ of 2007–2008. This paper argues that the crisis stems from a long-term cycle of fossil-fuel dependence (...) of industrial capitalism, combined with the inflation-producing effects of current biofuel offsets and financial speculation, and the concentration and centralization of agribusiness capital stemming from the enabling conjunctural policies of the corporate food regime. Rising costs, related to peak oil and fuel crop substitutes, combine with monopoly pricing by agribusiness to inflate food prices, globally transmitted under the liberalized terms of finance and trade associated with neoliberal policies. This article argues that there is no human right to cross borders without impediment. Receiving states, however, must recognize the procedural rights of those unable to protect their human rights in the place where they currently reside. Asylum claims must be properly investigated, and in the event that the state declines to admit them as refugees, it must ensure that the third country to which they are transferred can protect their rights. Both procedural and substantive rights apply while refugees are (...) physically present in the state’s territory and their immigration status is being investigated. The state’s obligation to protect these rights arises from the power it exercises over them. In contrast, the state does not exercise equivalent power over those it declines to admit in the first place, even though its immigration criteria – if discriminatory in the negative sense – can be faulted on other grounds. Beneath these arguments lie two basic assumptions: one is the need to separate human rights claims from other claims of justice, especially those deriving from citizenship; the other is the need to determine who bears the obligations that correspond to these rights. Attention to the different relations in which prospective immigrants may stand toward the state they hope to enter can help us understand how border regimes may comply with, or violate, human rights. All authors in this symposium use a food regime perspective to ask questions about the present which—as these articles demonstrate—have several possible answers. History suggests a time perspective of 25–40 year cycles so far—a food regime 1870–1914, an experimental and chaotic era 1914–1947, and a food regime 1947–1973. It has been less than 40 years since 1973, when food regime analysts agree that a contested and experimental period began. There is no consensus on whether it has already ended or how (...) it might issue into a new food regime. The conversation is more fruitful than the conclusions. O presente artigo tem o objetivo de discutir os regimes socioeconômicos que permitem a realização da justiça como equidade, focando em especial nos dois regimes apontados por Rawls como capazes de constituir uma sociedade bem ordenada, a democracia de cidadãos proprietários (property-owning democracy ou POD) de um lado e o socialismo liberal do outro. Para tanto, em um primeiro momento serão considerados os argumentos de Rawls a respeito dos regimes socioeconômicos dentro da Uma teoria da justiça. Em (...) seguida, com base em Justiça como equidade: uma reafirmação, serão discutidos os argumentos em favor da POD e do socialismo liberal e contra as outras três opções: capitalismo de laissez-faire, socialismo de Estado dirigido por um partido único e o Estado de bem-estar social. Em seguida, serão considerados os argumentos a favor da POD ou do socialismo liberal, procurando em grande medida traçar quais são as distinções entre ambos os regimes, a partir dos autores que buscam ir além de Rawls. Ao final, conclui-se que nos limites de uma teoria da justiça Rawls está correto ao não definir quem é o regime vencedor, a POD ou o socialismo liberal, mas no avanço atual do capitalismo liberal e no seu movimento de distanciamento das democracias liberais mostra-se necessário discutir qual é o regime mais adequado a partir das bases fornecidas pela justiça como equidade. The article addresses the issue of dynamics of science, in particular of new sciences born in twentieth century and developed after the Second World War (information science, materials science, life science). The article develops the notion of search regime as an abstract characterization of dynamic patterns, based on three dimensions: the rate of growth, the degree of internal diversity of science and the associated dynamics (convergent vs. proliferating), and the nature of complementarity. The article offers a conceptual discussion for the (...) argument that new sciences follow a different pattern than established sciences and presents preliminary evidence drawn from original data in particle physics, computer science and nanoscience. Women are important actors in smallholder farmer milk production. Therefore, female input in the dairy cooperatives is essential to dairy development in emerging economies. Within dairy value chains, however, their contributions are often not formally acknowledged or rewarded. This article contributes to filling this gap by adopting a multileveled institutional perspective to explore the case of dairy development in the Pangalengan mixed-sex dairy cooperative on West Java, Indonesia. The objective is to add evidence from the dairy development practice in Indonesia (...) to the current agenda for gender and development as well as identify pathways for future research on dairy development that will help it do better in practice. Central to the exploration is a discussion of formal and informal institutions as part of the dynamics of the inequality regimes in dairy cooperatives. Evidence from dairy development practices in the Pangalengan cooperative shows, among others, distinct differences between the participation of male and female target groups in dairy development extension, as well as farm size- and resource-related trends in ‘masculinization’ and ‘feminization’ of the smallholder farmer household. The conclusions contribute to debates on more resilient, thus sustainable working relations in food chains, women’s empowerment, gender equality and social justice in agriculture as well as cooperative studies. The essay concerns the negative end of the political argument of the Republic, that injustice—the rule of unreason—is both widespread and undesirable, and that whatever shadows of virtue or order might be found in its midst are corrupt and unstable. This claim is explained in detail in Republic 8 and 9. These passages explain recognizable faults in recognizable regimes in terms of the failure of the rule of reason and the corresponding success of the rule of non-rational forms of (...) motivation. I will first look at degenerate regimes as they appear in a less systematic way in the Ship of State passage in Republic 6 and in the discussion with Thrasymachus in book 1. I then give a general overview of the system of degenerate regimes in book 8 to examine what exactly goes wrong with them and why, and explain how the process of degeneration ought be understood as the progressive decay of the rule of reason. Finally, I argue that a close look at this decay reveals something surprising: that degenerate regimes and characters feature weak versions of virtue, shadow-virtues that are based on appearances and held in place by force. Thus in the end the whole process of degeneration ought be understood as an extended conflict between reason and appetite. (shrink)

During the Second Industrial revolution, consulting professor bridged higher education institutions with industry and government. A concept like the utilitarian research regime by Terry Shinn can explain their material and intellectual production by allowing for a reconstruction of their social networks. Pierre‐Paul LeCointe and Louis Bourgoin , associates in an engineering consultancy office, institutionalised a consultation service at the Laboratory of Industrial Chemistry of the École Polytechnique of Montreal . The two industrial chemists were thereby able to obtain financial, material (...) and human resources through exchanges with industrialists, business men and civil servants; consequently, their material and intellectual production is marked by the preoccupations of the industries and government with whom they exchanged. Industrial development in Canada was, in part, based on the work of these consultants who helped private companies analyse primary resources, standardize fabrication procedures and adapt the production to regulations. The government also offered technological assistance to businesses thanks to consultants, while regulating the markets and producing industrial standards. The inception of a utilitarian research regime results from the conjunction of these different factors. Finally, on Bourgoin's initiative, the École Polytechnique created a research centre based on the model of consulting laboratories. (shrink)

Globally, labor unions have been criticized for being highly gendered, patriarchal organizations that struggle to engage with, and represent, women. In Cambodia, the disparity between women’s activism and organizational power is particularly acute. Women workers are the face of the labor movement, yet they remain excluded from union leadership despite some movement toward more progressive gender policies within unions. Using data from semi-structured interviews with workers and union leaders in the construction and garment sectors, I illustrate how gendered narratives and (...) practices of control are mobilized through gender regimes that operate in the household, the workplace, and unions. I propose an analytical framework that incorporates these three interlocking gender regimes to draw attention to the contradictory role of unions in advocating for worker rights while depoliticizing women’s activism and sustaining gender inequity. I argue that it is the contradictory relationship between these regimes that entrenches women’s subordination within unions despite their numerical strength. (shrink)

The present article aims at postulating cannibalism as a fundamental axis for the analysis of the processes of subjectivation of Spanish America since the 15th century. The hypothesis is that this process has gone through three stages, which allow for the delimitation of the differences of what I shall refer to, for now, as regimes of cannibalism understood as subjectivation processes:(i) Anthropophagic or of ritual war.(ii) Mimetic or of colonial incorporation(iii) Iconic or of mediatic absorption, at a global level.In (...) order to construct the regimes of cannibalism as a concept I have chosen to use two perspectives: the one which speaks of the ritual experimentation of anthropophagy from the inside and the one which moves through the variants of that double desire for the other’s desire that makes every process of colonization possible; in the known forms of territorial annexation, incorporation (productive, spiritual, institutional) and absorption by the global system of mediatization. This article discusses high-technology development in Indonesia. Focusing on the Indonesian Aircraft Industry (IPTN), it critically examines how nationalism becomes an impetus for technological development and addresses the implications of nationalism in the pursuit of high technology. Situated in the NewOrder regime, influential elements of the regime’s economic and political systems that accommodate the idea of technological leapfrog are traced. It is argued that the failure of the leapfrog idea is because of overreliance on a technological determinist view and the (...) practice of strong technocracy. Furthermore, it is posited that technological nationalism is a rhetorical strategy used by technological elites to legitimate the high-technology policy and to absorb ample economic and political resources that unexpectedly produce farreaching implications in society. This article examines the ways that state sexual regimes intersect with migration controls to re-make exclusionary nation-states and geopolitical hierarchies among women. I focus on two important Irish Supreme Court rulings: the X case (1992) and the O case (2002), respectively. X was a raped, pregnant, 14-year-old who sought an abortion in Britain. While the Supreme Court ultimately permitted her to procure an abortion, women's right to travel across international borders without government inquiry into their reproductive status came into (...) question. The O case concerned a Nigerian asylum seeker who invoked the fact that she was pregnant in an effort to avoid deportation. The Supreme Court, however, affirmed that she could be deported, despite the Irish Constitution's pledge to protect the ‘right to life of the unborn.’ Considered together, these cases reveal how overlapping sexual/migration control regimes both reinscribe hierarchies among women based on geopolitical location, and rebound the exclusionary nation-state despite growing transnationalism. Previous research (e.g., Horiuchi, Goldsmith, and Inoguchi, 2005) has shown some intriguing patterns of effects of several variables on international public opinion about US foreign policy. But results for the theoretically appealing effects of regime type and post-materialist values have been weak or inconsistent. This paper takes a closer look at the relationship between these two variables and international public opinion about US foreign policy. In particular, international reaction to the wars in Afghanistan (2001) and Iraq (2003) are examined using (...) two major multinational surveys. The conclusions of previous research are largely reinforced: neither regime type nor post-materialist values appears to robustly influence global opinion on these events. Rather, some central interests, including levels of trade with the US and NATO membership, and key socialized factors, including a Muslim population, experience with terrorism, and the exceptional experiences of two states (Israel, Albania) emerge as the most important factors in the models. There is also a consistent backlash effect of security cooperation with the US outside of NATO. A discussion of these preliminary results points to their theoretical implications and their significance for further investigation into the transnational dynamics of public opinion and foreign policy. In common-sense usage, violence is usually conceptualized as intentional physical harm. This makes violence identifiable, locatable, and it facilitates the governing of those identified as committing infractions upon the non-violent community. In this article it is illustrated how this conception of violence legitimates the state by blocking the state’s own foundational violence from critical scrutiny. It argues that the liberal state rests on the differentiation between active and reactive violence, whereby the latter is seen as the legitimate violence of the (...) people against violent infractions committed by private individuals. The concept of a ‘regime of violence’ describes the relation between various forms of violence, i.e. their selective and differential articulation and negation. Regimes of violence constitute a way of governing conduct in the medium of violence. The current regime of violence consists of what is called a trias violentiae, which is a specific conception of the relations and translations between private violence, state violence and structural violence. Drawing on Foucault’s notion of regimes in the audio and the visual, in particular, through an attention to the interrelationship of the scopic, auditory and textual regimes of ‘Green Tea’, and to the manner in which writing is explicitly figured as both the source (...) of disjunction and the site of interpenetration of the regimes, it is suggested, in conclusion, that a specific understanding of allegory can provide a fresh perspective on ‘Green Tea’ as an archive of the regimes of language and light of its time. Since their inception in the 1980s, complexity sciences have been described as a revolutionary new domain of research. By describing some of the practices and assumptions of its representatives, the present article shows that this field is an association of subdisciplines laying on existing disciplinary footholds. The general question guiding us here is: On what basis do complexity scientists consider their inquiry methods and results as valuable? To answer it, I describe five “epistemic argumentative regimes,” namely the ways in (...) which complexity scientists argue the credibility of their research, and five “ontological views,” that is the ways in which they interpret the material and formal causes of their study objects and models. Finally, the article proposes the term of “regime of evidence” to designate the specific combination of one ontological view with one or more epistemic argumentative regimes. (shrink)

The nutrition transition concept developed by Popkin has gained wide currency within the nutritional sciences literature as a way of understanding population wide changes to diet and energy balance and their related health outcomes in society. It offers a useful template of different nutritional patterns societies progress through, but it has not provided a comprehensive understanding of the why and how of dietary change. Building on insights from the literature on food regimes in the social sciences, this paper argues (...) the concept of dietary regimes can augment the nutrition transition model and can serve as a bridge between social and health sciences around nutrition and dietary change. The political economy analysis of the dietary regime approach provides insights into the historical degradation of food and the diffusion of nutrient-poor products throughout food environments today. It also engages analysis of the key actors shaping food environments and diets in the industrial era. The dietary regime approach can provide fruitful directions with respect to concrete policy options to address the major issue of population wide weight gain that the nutrition transition model has sought to confront in recent iterations. This article traces the metamorphoses of Norwegian reformism during the last two centuries. In the Norwegian system, the shifting political regimes have to a remarkable extent been accompanied by shifting knowledge discourses. Regardless of whether its ideological dress was liberalism or socialism, a central feature of Norwegian reformism has been its basis in different versions of social science: it has been a scientific reformism. The legal knowledge regime of the civil servants’ state was towards the end of the 19th (...) century replaced by a democratic-pedagogical knowledge regime. When the Labour Party gained control of the political centre in 1945, it did so in coalition with the new economists. Following the demise of the Labour Party state in the 1980s, some features of a new knowledge regime have become visible. (shrink)

This article offers a reconstruction of Derrida’s critique of Leibniz. It suggests that in attempting to fit Leibniz into his conception of the history of metaphysics and the all-embracing notion of logocentrism that underwrites it, Derrida presupposes two regimes of logocentrism: one subjective, the other theological. Subsumed into this second mode, Derrida casts Leibniz as a progenitor of structuralism and the new sciences and technologies of information in order to expose their logocentric foundations. However, in doing so, he ends (...) up sidelining the aspect of Leibniz’s ideas that anticipates the specificity of the new epoch of writing he claims to historicise. The article goes on to argue that to grasp this specificity one must look beyond the “expressivist” schema of exterior representation, which Derrida draws from Husserl’s theory of meaning, and instead look to Leibniz’s own formal-combinatorial concept of expression, which exceeds Derrida’s critical framework. Food regime theory focuses upon the dynamics, and agents, of change in capitalist food and farming systems. Its exponents have been able to identify relatively stable periods of capital accumulation in the agri-food industries, along with the periods of transition. Recently, scholars have argued that—following a first food regime based upon colonial trade in bulk commodities like wheat and sugar, and a second food regime typified by industrial agriculture and manufactured foods—there is an emerging third food regime. This new regime (...) is one that is lead by global corporations that are profiting from the re-organisation of agri-food chains. The delivery of ‘fresh/healthy’ foods is one manifestation; another is the sale, by supermarkets, of ready-meals and other own-brand products. This paper argues that behind the movement to a putative Third Food Regime are changes to the financial system. ‘Financialisation’—the increased influence of finance capital on the agri-food system—not only provides new opportunities for profit-making by hedge funds and private equity consortia, but also creates a situation in which agri-food companies, including food manufacturers, international commodity traders and supermarkets, may benefit. Supermarkets for example, are moving into banking, and are altering their role as they move from being retailers of products, into the provision of capital. Food regime theory needs to consider what lies ‘behind’ the transformation of food and fibre production, to examine not only the role of finance capital in re-shaping relations up and down the agri-food supply chain, but also investigating the tendency for agri-food capitals to seek profits from financial transactions. The body of information on the Internet is becoming increasingly geographical. This is both due to the expansion of established categories of geographic information and to the simultaneous enrichment of other types of information through geographic identifiers. As this repository of geographic information expands, it is also a key site for multiple processes of commodification transforming informational resources into market goods. Understanding the dynamics driving the integration of geographic information into the digital economy requires a comprehensive political economic analysis. A (...) key component of this analysis is to explain the logics of creation and allocation of economic value from geographic information on the Internet. Addressing this need, in the present article I deploy the property regimes schema developed by Schlager and Ostrom and expand it to elucidate the differentiated commodification processes of geographic information on the Internet. Property regimes are arrangements that define rules, distribute rights, and delineate roles with respect to particular goods. These arrangements are enabled by elements such as legal frameworks, jurisdictions, type of information, and technologies of access. In this article, I explore how the legal frameworks regulating traditional categories of geographic information have been destabilized in the process of technological innovation, leading to the creation of new informational goods along with their respective property regimes, and rearticulating legal, economic, and sociotechnical relations. To illustrate this, I analyze the case of Google Street View images through their property regimes in various jurisdictions. (shrink)

This paper seeks to establish a connection between the existence of a legal system and the ideal of the rule of law. Its point of departure is the phenomenon of a transitional regime that is attempting to restore or institute the rule of law. Lon Fuller's formulation of the canons of the rule of law as an internal morality of law is expounded as well as his notion of legal pathology as symptomatic of departure from the canons' requirements. The existence (...) of a legal system, it is argued, is a matter of degree, covariant with the degree to which the rule of law is realized. Problems inherent to the implementation of the rule of law are examined, such as the effect of the passage of time on reasonable expectations. While legal pathology is always a matter of degree, police states are shown to suffer seriously from it. Among the examples discussed are Nazi Germany and Communist East Germany, though it is granted that there are moral differences between them. Finally, a response is made to some contemporary critiques of the rule of law. (shrink)

Der Roman erprobt vor allem in seiner um Wilhelm und Lenardo gruppierten Handlung Formen des analeptischen Erzählens, das die Ereignisse nicht chronologisch-linear, sondern in wiederholten Rückgriffen und Zeitschleifen entwickelt. Dieses Erzählen von und in Vorgeschichten folgt einem Schema, das Goethe in den homerischen Epen vorgeprägt sieht, das aber auch mit Zeitreflexionen aus seinen geologischen Studien korrespondiert.The fragmented (...) and apparently contingent structure of Goethe’s novel Wilhelm Meisters Wanderjahre introduces, as will be shown here, a specific time regime. The novel unfolds the stories of its main characters Wilhelm and Lenardo in an analeptical fashion developing its events not in their chronological order, but in time loops and regressions. This narrative of and in ›Vorgeschichten‹ harks back to Goethe’s reading of Homeric epic and also corresponds to temporal reflections voiced in his geological studies. (shrink)

economic theory may be timeless and potentially universal in its application, but macroeconomics has to be seen in its historical context. The nature of the policy regime, the behaviour of the economy and the beliefs of professional economists all interact, and influence each other. This short historical account of monetary regimes since 1900 shows how the role of policy has changed, and how this has related to experience of inflation and the real economy, as well as to changes in (...) political philosophies. The narrative concentrates on developments in America, Europe and Japan from the era of the classical gold standard, via the era of policy intervention and reduced faith in the market to the present 'neo-liberal' regimes. The 'grand narrative' of the century is a journey 'to Utopia and back'. It is argued that no school of macroeconomics is right for all time; different theoretical models may be appropriate, for different periods and regimes. (shrink)

Under the Lithuanian legislation, current and future spouses are allowed to sign marital agreements by which their property rights and obligations are set. However, it underlines that in some cases the court may declare the whole agreement or some of its terms unenforceable. The legislator does not specify which particular terms may be declared unenforceable. Therefore, the implementation of the spouses’ right to choose the terms they want is put under doubt. As a result, it is very important to find (...) out the circumstances and the criteria that should be evaluated before a marital agreement or some of its terms are declared unenforceable. Under the Lithuanian legislation, the validity of a marital agreement is considered only at the moment it is signed. However, it is not the case in other countries. For instance, many courts of the United States in deciding on the validity of a marital agreement take into account all the circumstances and conditions both at the time a marital agreement is signed and at the time of divorce. Some courts analyse if an agreement was executed voluntarily, without any pressure or fraud, and if both parties provided fair and reasonable disclosure of the property or financial obligations as well as what were their bargaining powers and expectations. Other courts attempt to establish the effect an agreement will have on the parties after the termination of their marriage. Currently, Lithuanian courts have no practice in declaring a marital agreement unenforceable. However, due to the particularities of marital agreements and the state’s aim to defend the public interest, the means to evaluate the validity of a marital agreement become unclear. (shrink)

Johannes Geng geht der Frage nach, inwiefern der Film als technologisches Leitmedium des 20. Jahrhunderts auf die geschichtliche Bedingtheit des Sehens und Hörens zu beziehen ist, indem er in einem ersten Schritt den zugehörigen film- und kulturtheoretischen Diskurs systematisch aufarbeitet. Darüber kommt er zu dem filmtheoretischen Modell eines Sensorischen Regimes, das er dann an zwei Fallstudien – dem NS-Propagandafilm und dem Direct Cinema – exemplifiziert. In unserem Wahrnehmen leiten uns kulturell geformte Gewohnheiten, Erwartungen und Einstellungen. Damit ist Wahrnehmung mehr (...) als nur ein biologischer Mechanismus, sondern historisch variabel. This Article highlights that when procedural rules are legislated and there is substantial coordination between the executive and legislative branches, procedures with potential structural impact are weighted against alternative means of policymaking and implementation. This makes many Continental law countries, parliamentary countries, and countries governed by solid national majorities with substantial control over elected branches, and in general places where power is less fragmented, less likely to encourage American-style class actions. This is manifested in legislative choices of a private enforcement (...) regime for class actions, which, when allowed, is designed to be subordinate to or to piggyback on the enforcement of preexisting bureaucracies. The theory is illustrated with the enactment of class actions in Chile, which is a civil law country that has experimented with class actions since 2004. (shrink)

RESUMO Esse artigo trata da relação entre a estética e a representação na teoria de Jacques Rancière. Segundo o autor, a representação é simultaneamente presente e proibida na estética moderna. Ela aparece como um parasita ou um intruso na produção artística. Rancière pergunta: sob quais condições a representação se torna proibida e o que significa a arte não representar? O eixo central da análise explora quais as consequências dessa configuração, com destaque para a política. Segundo Rancière, o conceito de partilha (...) do sensível implica invariavelmente um regime de vida e, portanto, alguma forma de política. Sendo assim, a estética não se limita à arte, mas atinge a vida em seu sentido pleno. A relação entre estética e representação implica necessariamente um modo de vida no qual a representação se torna impossível em todos os sentidos. ABSTRACT This article explores the relationship between aesthetics and representation in Jacques Rancière's theory. According to the author, representation is simultaneously present and prohibited in modern aesthetics. It appears as a parasite or an intruder in artistic production. Rancière asks: under what conditions is representation prohibited and what happens when art does not represent? The central axis in the analysis explores the consequences of this configuration, with emphasis on politics. According to Rancière, the concept of distribution of the sensible invariably implies a regime of life and, therefore, some sort of politics. Hence, aesthetics is not limited to arts, reaching life as a whole. The relationship between aesthetics and representation necessarily implies a mode of life where representation becomes impossible in all senses. (shrink)

O intuito do presente trabalho é discutir o uso do termo desinformação pelo campo da Ciência da Informação (CI). A palavra, desinformação, passou a ser utilizada nos últimos anos – mais notadamente após a eleição de Donald Trump a presidência dos Estados Unidos da América, cargo que ocupou entre os anos de 2016 a 2020 - para caracterizar um comportamento pautado no compartilhamento de notícias falsas via redes sociais digitais, majoritariamente, e, por meio de técnicas de comunicação que almejam fazer (...) usuários de determinada ferramenta de comunicação, acreditar em uma notícia falsa. No entanto, julgamos que o emprego do termo não consegue explicar de forma clara como ocorre ou, se é possível, determinarmos via estudos do campo da CI (informação como dimensão física, informação como dimensão cognitiva, informação como dimensão intersubjetiva social) que exista um fenômeno ou um processo que desinforme sujeitos expostos a determinada informação. Julgamos haver uma contradição no termo, que pode contribuir para uma tábula rasa explicativa sobre como se processa a validação de determinados conteúdos informativos, ou seja, sob quais fundamentos éticos, marcos regulatório e práticas consuetudinárias os sujeitos nesta arena digital produzem, se apropriam e disseminam informação. This study investigates the interrelation of outer appearance and spatial configuration of modern Chinese court buildings with the party-state’s strategy of building regime legitimacy. The spatial element of this relation is explored in four different court buildings in Kunming, Chongqing, Shanghai and Xi’an. It is argued that court buildings contribute to the empowerment of individuals who appear as parties in trials. Courthouses also facilitate the courts’ function of exercising social control and the application of an instrumentalist approach to the principle (...) of public trials. Both the grounding of court buildings in the past and their compliance with international models of a modern independent judiciary are aspects of consolidating regime legitimacy. (shrink)

Em _O Anti-Édipo_, especialmente no terceiro capítulo deste livro, Deleuze e Guattari sustentam que a cada máquina social corresponde um regime de representação que se assenta sobre os fluxos de desejo: a máquina territorial primitiva opera por codificação, a máquina imperial despótica, por sobrecodificação, e a máquina civilizada capitalista, por descodificação e axiomatização. Isso faz com que o uso da língua varie historicamente e conforme a formação social. Neste artigo, buscamos caracterizar cada um desses regimes de signos e detalhar (...) o modo como a representação se organiza na superfície de cada um dos tipos de socius. Neste esforço, recorremos por vezes a autores da linguística que inspiraram Deleuze e Guattari, a saber, Saussure e Hjelmslev, no intuito de lançar luz sobre a relação entre língua e socius no âmbito deste livro. During the Second Industrial revolution, consulting professor bridged higher education institutions with industry and government. A concept like the utilitarian research regime by Terry Shinn can explain their material and intellectual production by allowing for a reconstruction of their social networks. Pierre‐Paul LeCointe (d. 1948) and Louis Bourgoin (1891–1951), associates in an engineering consultancy office, institutionalised a consultation service at the Laboratory of Industrial Chemistry of the École Polytechnique of Montreal (1917). The two industrial chemists were thereby able to obtain (...) financial, material and human resources through exchanges with industrialists, business men and civil servants; consequently, their material and intellectual production is marked by the preoccupations of the industries and government with whom they exchanged. Industrial development in Canada was, in part, based on the work of these consultants who helped private companies analyse primary resources, standardize fabrication procedures and adapt the production to regulations. The government also offered technological assistance to businesses thanks to consultants, while regulating the markets and producing industrial standards. The inception of a utilitarian research regime results from the conjunction of these different factors. Finally, on Bourgoin's initiative, the École Polytechnique created a research centre (1946) based on the model of consulting laboratories. (shrink)
