El presente artículo centra su atención en dos textos de la producción temprana de Walter Benjamin, Sobre el lenguaje en general y el lenguaje de los humanos y Para una crítica de la violencia, con el fin de detectar ciertas huellas conceptuales vinculadas al pensamiento kantiano. A partir de ellas se bosquejan algunos fragmentos del panorama teórico dentro del cual Walter Benjamin plantea aquella tensión tan particularmente dialéctica mediante la que, a pesar de objetar la ilustración, reivindica la crítica como (...) el modo inexcusable de actualizarse el pensamiento filosófico. The Netherlands has waited a long time for parliamentary endorsement of euthanasia, despite it being accepted practice for many years. Until recently, euthanasia and assisted suicide were technically illegal in the Netherlands, although court rulings during the 1970s and 80s indicated that a defence of necessity could be invoked by a doctor who ended the life of a patient. The situations in which that defence could be used were defined and became the Royal Dutch Medical Association's “rules of due care”. (...) Many of the safeguards in the rules passed into statute in April 2001 with the passing of the Termination of Life on Request and Assisted Suicide (Review Procedures) Act. The act decriminalised euthanasia and assisted suicide by doctors acting with “due care”. Doctors will not face prosecution if they terminate the life or assist in the suicide of a patient who has made a voluntary and well considered request, is facing “interminable and unendurable suffering”, understands his or her situation and prospects, and for whom there is no other reasonable solution. A second, independent, doctor must be consulted. There is no requirement for the patient to be terminally ill, and there are specific provisions that allow the euthanasia of young people between the ages of 12 and 16 if they and their parents agree. Parents of 16- and 17-year-olds must be involved in decisions about the young person's end-of-life care, but these patients are entitled to make their own decision. There is no requirement for the patient to be a Dutch resident. Este trabajo explora una línea posible del diálogo entre Walter Benjamin y Hannah Arendt mediante la presentación de algunas intermitencias entre dos figuras relevantes de su pensamiento sobre la historia, la figura que Benjamin determina en su abordaje del Angelus Novus pintado por Paul Klee, y la figura de Er en los términos en que Arendt la elabora a partir de una parábola kafkiana. Retomamos ambas figuras con el objetivo de mostrar en ellas el intento filosófico de organizar un pensamiento (...) crítico que resista la esclerosis del concepto moderno y progresivo de historia: en un contexto en que el pasado pareciera diluirse en la impotencia de su presencia y el futuro se presenta como reproducción apocalíptica del desastre, sostenemos que Benjamin y Arendt convocan al Angelus Novus y al Er kafkiano como imágenes capaces de dislocar el anquilosamiento de la crítica y el flujo epistemológico implicado en la crisis moderna de la experiencia. This article analyzes the claim that “deliberate denial [of genocide] is a form of aggression that ought to be regarded as a contribution to genocidal violence in its own right.” Its objective is to demonstrate that the claim is substantially correct: there are instances of genocide negation that are genocidal acts. The article suggests that one such instance is contained in a letter sent to Professor Robert Jay Lifton by Turkey's ambassador to the United States. The article is divided into (...) three parts. In the first part, it delineates and discusses the unexpected contents of the letter to Lifton. In the second, it primarily deals with three topics: lying, genocide, and Austinian performatives. In the third part, it takes the points made in the second part and applies them to the contents of the letter to Lifton, and demonstrates that the letter is an instance of genocide negation that is genocidal. Introduction The Brazilian national curriculum guidelines for undergraduate medicine courses inspired and influenced the groundwork for knowledge acquisition, skills development and the perception of ethical values in the context of professional conduct. Objective The evaluation of ethics education in research involving human beings in undergraduate medicine curriculum in Brazil, both in courses with active learning processes and in those with traditional lecture learning methodologies. Methods Curricula and teaching projects of 175 Brazilian medical schools were analyzed using a retrospective historical and (...) descriptive exploratory cohort study. Thirty one medical schools were excluded from the study because of incomplete information or a refusal to participate. Active research for information from institutional sites and documents was guided by terms based on 69 DeCS/MeSH descriptors. Curriculum information was correlated with educational models of learning such as active learning methodologies, tutorial discussions with integrated curriculum into core modules, and traditional lecture learning methodologies for large classes organized by disciplines and reviewed by occurrence frequency of ethical themes and average hourly load per semester. Results Ninety-five medical schools used traditional learning methodologies. The ten most frequent ethical themes were: 1 – ethics in research (26); 2 – ethical procedures and advanced technology (46); 3 – ethic-professional conduct (413). Over 80% of schools using active learning methodologies had between 50 and 100 hours of scheduled curriculum time devoted to ethical themes whereas more than 60% of traditional learning methodology schools devoted less than 50 hours in curriculum time to ethical themes. Conclusion The data indicates that medical schools that employ more active learning methodologies provide more attention and time to ethical themes than schools with traditional discipline-based methodologies. Given the importance of ethical issues in contemporary medical education, these findings are significant for curriculum change and modification plans in the future of Brazilian medical education. El siguiente trabajo tiene como objetivo principal describir y analizar la percepción de Manuel Baldomero Ugarte sobre Estados Unidos. Ugarte fue literato y político, pero también fue un pensador interesado por los asuntos internacionales de América Latina. Evidencia de ello son sus propuestas integracionistas y antiimperialistas, en las cuales la presencia de Estados Unidos era evidente. Debido a lo anterior, se estima conveniente explicar qué pensó Ugarte sobre la nación norteamericana, y desde esa perspectiva, contribuir a la discusión sobre tan (...) trascendental intelectual latinoamericano. The purpose of this work is to describe and analyze the perception of Manuel Baldomero Ugarte about the United States. Ugarte was a writer and a politician, but it was also a thinker interested in the Latin America’s international affairs. Testimony of this are his integrationist and anti-imperialist proposals, in which the U.S. presence was evident. Thus, it is considered advisable to explain what he thought about the American nation, and from this perspective, to contribute to the discussion around this important Latin American intellectual. Este artículo sostiene que, a partir del contraste tácito entre obra de arte y naturaleza, Walter Benjamin y Theodor Adorno exploran una estética en la que el proceder antropocéntrico y subjetivista asociado al desencantamiento del mundo retrocede. El propósito del texto, entonces, consiste en articular diversos elementos provenientes de las filosofías de ambos pensadores para configurar un montaje conceptual que evidencie un tratamiento de la relación entre el objeto artístico y el natural, relación que fundamenta la potencia de la experiencia (...) estética como enclave crítico de la razón moderna. A tal fin, en primer lugar, se indica la determinación antropocéntrica de la razón moderna y la especificidad que cobra el objeto artístico en relación a ella. Luego, se señala la remisión de la experiencia estética al objeto natural. Finalmente, se explica la dinámica entre objeto artístico y naturaleza, ampliando su noción. Así, se espera explicitar algunas de las discusiones en relación a la tensión arte-naturaleza a partir de las cuales Adorno y Benjamin buscan desmontar las aporías del antropocentrismo racional. Indirect directives in recipes: a cross-linguistic perspective The present paper is intended as a cross-linguistic study of the range of possible realizations of instructional speech acts as a special type of directives, as realized in the domain of cooking recipes. Even a cursory comparison of orders as directive speech acts across languages brings to light an extreme degree of variation concerning their formal realization. While imperatives are virtually the only possibility in English, a contrastive linguistic perspective reveals that other construction (...) types are attested in other languages, instead, or in addition to the imperative. The central goal of the present paper is to shed light on the motives for these intralingual and interlingual similarities. The data from Germanic, Romance, Slavic languages, and Hungarian are analyzed against the background of the speech-act scenario model, and then discussed with the help of two cultural models of HELP, which are claimed to provide the basis for the motivation of the cross-linguistic distribution of various constructions. El presente texto procura articular una serie de aristas surgidas de una práctica docente en torno al saber filosófico diagramado académicamente. En concreto, constituye una reflexión sobre la alfabetización académica en las carreras de Filosofía de nivel universitario y, más específicamente, en relación con una inquietud fundamental: ¿cómo enseñar a comprender/producir un texto académico en tal marco institucional? Con el objetivo de determinar algunos indicios que ayuden a reflexionar sobre lo que abre tal pregunta, en este trabajo se busca exponer (...) algunos aspectos emanados de mi experiencia como docente universitaria y abordar la comprensión/producción de textos académicos desde una perspectiva filosófica. En concreto, se trata de un ejercicio docente específico desarrollado durante el período 2019-2021 en el espacio curricular “Comprensión y Producción de Textos Académicos”, correspondiente al primer año de la Licenciatura en Filosofía y del Profesorado Universitario en Filosofía, ambas carreras de la Universidad Nacional de Cuyo. Neste artigo, articulo três sentidos distintos da expressão “Fins da Arte” - analítico-filosófico, estético e teleológico – para refletir acerca de um movimento importante no cenário da arte da dança, que transformou radicalmente o modo como nossa cultura ocidental compreende o corpo. Refiro-me à dança pós-moderna americana que se desenvolveu principalmente nas décadas de 60, 70 e 80, e tomo como paradigma o trabalho da coreógrafa, bailarina e cineasta Yvonne Rainer, denominado Trio A. Meu argumento é que, neste trabalho coreográfico, (...) Yvonne Rainer coloca, com seu próprio corpo, a questão do “fim da dança” nos sentidos analítico-filosófico e estético, e como consequência promove uma reflexão sobre o “fim da dança” no sentido teleológico. In this timely and highly original merging of theory and practice, conflict photographer and critical theorist Rita Leistner applies Marshall McLuhan's semiotic theories of language, media, and technology to iPhone photographs taken during a military embed in Afghanistan. In a series of what Leistner calls iProbes—a portmanteau of iPhone and probe—Leistner reveals the face of war through the extensions of man. As digital photography becomes more ubiquitous, and as the phones we carry with us become more advanced, the process (...) of capturing images becomes more democratic and more spontaneous. Leistner's photos result from both access and impulse. The purpose of this study was to illuminate the ethically difficult situations experienced by care providers working in a nursing home. Individual interviews using a narrative approach were conducted. A phenomenological-hermeneutic method developed for researching life experience was applied in the analysis. The findings showed that care providers experience ethical challenges in their everyday work. The informants in this study found the balance between the ideal, autonomy and dignity to be a daily problem. They defined the culture they work in (...) as not supportive. They also thought they were not being seen and heard in situations where they disagree with the basic values of the organization. The results are discussed in terms of Habermas’s understanding of modern society. Care settings for elderly people obviously present ethical challenges, particularly in the case of those suffering from dementia. The care provider participants in this study expressed frustration and feelings of powerlessness. It is possible to understand their experiences in terms of Habermas’s theory of modern society and the concept of the system’s colonization of the life world. (shrink)

This article seeks to trace the origins of the requirement that a squatter must have an intention to possess (animus possidendi) in order to establish title by adverse possession. The requirement has been confirmed by the House of Lords in the recent case of Pye (Oxford) Ltd v Graham [2003] 1 AC 419. Its origins can readily be traced back to the decision of the Court of Appeal in Littledale v Liverpool College [1900] 1 Ch 19, but there is little (...) evidence of any need for intention before that case, and no convincing authority is cited for it. Possible explanations for the source of this requirement are considered by the article (for instance cases on re-entry by landlords and the so-called ‘found chattel’ cases), but these are ultimately rejected. The article goes on to suggest that the reason for this is that the intention requirement was ‘imported’ into English law from German Pandectist writers of the nineteenth century. It suggests that Littledale was the case in which this happened. It seeks to support this hypothesis by reference to biographical details of Lindley MR, who gave the leading judgment in Littledale, and who not only trained in part in Germany but also took an active interest in German scholarship of the time. A brief survey of the relevant German sources is undertaken, focusing primarily on the work of Savigny, but also considering the rival theory of Jhering. Finally, it tracks the development and refinement of the content of animus possidendi, first by 19th century legal scholars and then by 20th century judges, to make it ‘fit’ with English property law. It seeks to address the question of whether the animus possidendi requirement is a free-standing element (the ‘strong’ will theory), or whether it is simply implied from the acts of the squatter (the ‘weak’ will theory), and suggests a solution by reference to the German sources and later English cases. Finally, it considers how the House of Lords decision in Pye reflects the logical culmination of the acceptance of this ‘legal transplant’ into the common law. (shrink)

The doctor patient relationship starts with a story. Doctors' notes, a patient's chart, the recommendations of ethics committees and insurance justifications all hinge on written and verbal narrative interaction. The "practice" of narrative profoundly affects decision making, patient health and treatment and the everyday practice of medicine. In this edited collection, the contributors provide conceptual foundations, practical guidelines and theoretical considerations central to the practice of narrative ethics.

Background:A total of 71,000 people in Norway suffer from some form of dementia in 2013, of whom approximately 30,000 are in nursing homes. Several studies focus on the experiences of those who have close relatives and who are staying in a nursing home. Results show that a greater focus on cooperation between nursing staff and relatives is a central prerequisite for an increased level of care. Benefits of developing systematic collaboration practices include relief for nursing staff, less stress, and greater (...) mutual understanding. Going through studies focusing on the experiences of nursing home patients’ relatives, negative experiences are in the majority. In this study, relatives are invited to share positive experiences regarding the care of their loved ones; a slightly different perspective, in other words.Aim:The aim of the study is to investigate relatives of persons with dementia’s experiences with quality care in nursing homes.Method:The study is a part of a larger project called Hospice values in the care for persons with dementia and is based on a qualitative design where data are generated through narrative interviews. The chosen method of analysis is the phenomenological–hermeneutical method for the study of lived experiences.Participants and research context:Participants in the project were eight relatives of persons with dementia who were living in nursing homes, long-term residences. The sampling was targeted, enrolment happened through collective invitation. All relatives interested were included.Ethical considerations:The Norwegian Regional Ethics Committee and the Norwegian Social Science Data Services approve the study.Findings:Findings show that relatives have certain expectations as to how their loved ones ought to be met and looked after at the nursing home. The results show that in those cases where the expectations were met, the relatives’ experiences were associated with engagement, inclusion and a good atmosphere. When the expectations were not met, the relatives experienced powerlessness, distrust and guilt.Discussion:The results are discussed considering the concepts of trust, power and asymmetry.Conclusion:When asked about experiences with quality care, the relatives spoke both of expectations met and of expectations not met. Results in this study are important knowledge for developing units where performing quality care is the overall aim. (shrink)

In this paper, I consider the claim that a corporation cannot be held to be morally responsible unless it is a person. First, I argue that this claim is ambigious. Person flags three different but related notions: metaphysical person, moral agent, moral person. I argue that, though one can make the claim that corporates are metaphysical persons, this claim is only marginally relevant to the question of corporate moral responsibility. The central question which must be answered in discussions of corporate (...) moral responsibility is whether corporations are moral agents or moral persons. I argue that, though we can make a case for saying corporations are moral agents, they are not moral persons, and hence, we can hold them responsible. In addition, we need not treat them the way we would be obligated to treat a moral person; we needn't have the same scruples about holding a corporation morally responsible as we would a moral person. Introduction:To meet and take care of people with dementia implicate professional and moral challenges for caregivers. Using force happens daily. However, staff also encounter challenges with the management in the units. Managing the caretaking function is also significant in how caretakers experience working in dementia care.Purpose:The purpose of this study is to explore the caregiver’s experiences with ethical challenges in dementia care settings and the significance of professional leadership in this context.Method:The design is qualitative, and data appear through narrative interviews. (...) A total of 23 caretakers participated in the study. The transcribed interviews were subjected to a phenomenological-hermeneutical interpretation.Ethical considerations:The respondents signed an informed consent for participation prior to the interviews. They were assured anonymity and confidentiality in the publication of the data. Ricoeur’s method for interpretation ensures anonymity as the researcher relates to the data as one collective text. The study is part of a larger research project in ethics, in its entirety approved in line with the Helsinki Convention.Results:The findings show that the caretakers experienced inadequacy. Some of them described a negative work atmosphere where they experienced that their leaders did not take them seriously. Because of this, informal negative sub-groups functioned as an exclusive debriefing arena. Some of the informants described the opposite experience where the leaders actively supported them.Discussion:The analyses of the findings are discussed in light of the concepts of trust and mistrust in leadership.Conclusion:There is a correlation between the leadership and the caregivers’ experience of being in difficult situations. Across two studies, a wide age range of participants was interviewed about the nature of death. All participants were living in rural Madagascar in a community where ancestral beliefs and practices are widespread. In Study 1, children (8–17 years) and adults (19–71 years) were asked whether bodily and mental processes continue after death. The death in question was presented in the context of a narrative that focused either on the corpse or on the ancestral practices associated with the afterlife. Participants (...) aged 8 years and older claimed that death brings an end to most bodily and mental processes. Nevertheless, particularly in the context of the religious narrative, they claimed that certain mental processes continue even after death. This assertion of an afterlife was more evident among adults than children, especially with respect to cognitive processes, such as knowing and remembering. In Study 2, 5‐ and 7‐year‐olds were asked similar questions in connection with the death of a bird and a person. Seven‐year‐olds consistently claimed that bodily and mental processes cease at death, whereas 5‐year‐olds were unsystematic in their replies. Together, the two studies replicate and extend findings obtained with Western children showing that, in the course of development, different conceptions of death are elaborated—a biological conception in which death terminates living processes and a religious conception in which death marks the beginning of a new form of spiritual existence. [Sebastian Gardner] German idealism has been pictured as an unwarranted deviation from the central epistemological orientation of modern philosophy, and its close historical association with German romanticism is adduced in support of this verdict. This paper proposes an interpretation of German idealism which seeks to grant key importance to its connection with romanticism without thereby undermining its philosophical rationality. I suggest that the fundamental motivation of German idealism is axiological, and that its augment of Kant's idealism is intelligible in (...) terms of its combined aim of consolidating the transcendental turn and legitimating the kind of relation to value articulated in German romanticism. /// [Paul Franks] German idealists regard Spinozism as both the realism that outflanks Kant's idealism and the source of the conception of systematicity with which to fortify idealism. But they offer little argument for this view. To fill the gap, I reconstruct arguments that could underlie Jacobi's and Pistorius's tentative but influential suggestions that Kant is or should be a Spinozist. Kant is indeed a monist about phenomena, but, unlike Spinoza, a pluralist about noumena. Nevertheless, it is arguable that the Third Antinomy can be solved by a more thoroughgoing Spinozistic monism. The resulting Spinozism outflanks Kant by acknowledging Jacobi's charge that philosophy annihilates immediacy and individuality, whereas Kant's commitment to things in themselves can seem a half-hearted attempt to avoid the charge. However, the German idealist contention is that only a synthesis of such a Spinozism with Kantian idealism can retrieve immediacy and individuality, thus overcoming nihilism. (shrink)
