Methods in comparative work -- The sense of justice in Rawls -- The sense of justice in the analects -- Two senses of justice -- The contemporary relevance of a sense of justice.

This Article focuses both on the changes that have been made to the legal framework governing post-separation parenting of children in Australia, as well as the processes and discourses via which these matters have been dealt with and debated. Alone among comparable common law jurisdictions such as Canada, the United States, and England, Australia’s family law legislation, and the significant changes made to it in the past fifteen years, can be seen to have been particularly responsive to the lobbying of (...) fathers’ rights groups. It will be suggested that changes to the legislative framework that governs family law in Australia have taken place, at best, without any clear rationale or need and perhaps more problematically, have at times flown in the face of, rather than been undertaken by reference to, the evidence-based research about post-separation parenting practices and what we know about children’s welfare or best interests, the paramount consideration that underpins decision-making in this field. The purpose of this discussion is to attempt to posit some possible explanations for this distinctive path of Australian family law “reform”. (shrink)

The protection of species ranks highly among environmentalist priorities, and many environmentalists expect the public to respect and support efforts to protect and rehabilitate endangered species. There are a range of instrumental and anthropocentric justifications for these attitudes, yet some environmentalists want more. It is unclear that more is to be had. In particular, it is challenging to justify some environmentalist attitudes without appealing to some version of the claim that species are intrinsically valuable. However, this has been a notoriously (...) difficult thesis to defend, and it is clearly not available to those who doubt the existence of species. In this paper, I show how a number of environmentalist commitments that appear to be about the value of species can be interpreted and defended in a way that is compatible with antirealism about species. According to my proposal, the proper target of environmentalists’ evaluative concern is the irreplaceable design that is embodied by the individuals that make up a (putative) species. This approach can capture and justify many environmentalist attitudes about the value of biological variety without attributing intrinsic value to species, or even requiring a place for species in our ontology. This enables environmentalists to effectively sidestep a number of puzzling issues surrounding the nature and value of species. (shrink)

I discuss a puzzle that shows there is a need to develop a new metaphysical interpretation of mathematical theories, because all well-known interpretations conflict with important aspects of mathematical activities. The new interpretation, I argue, must authenticate the ontological commitments of mathematical theories without curtailing mathematicians' freedom and authority to creatively introduce mathematical ontology during mathematical problem-solving. Further, I argue that these two constraints are best met by a metaphysical interpretation of mathematics that takes mathematical entities to be constitutively constructed (...) by human activity in a manner similar to the constitutive construction of the US Supreme Court by certain legal and political activities. Finally, I outline some of the philosophical merits of metaphysical interpretations of mathematical theories of this type. (shrink)

The metaphor of the heart or mind as a mirror appears not only in the work of Zhuangzi and Xunzi but also in the work of Western philosophers such as Kierkegaard and Rorty. This essay shows how a properly contextualized comparison of the mirror metaphor in the work of these four philosophers highlights the different ways in which they use it, helping us to understand more clearly critical differences between their views. The significance of the mirror metaphor in the work (...) of each thinker is studied in detail. Distinctively Chinese and Western understandings of mirrors, hearts, and minds are explored, and the importance of studying different cultural and philosophical understandings of metaphors is defended. The essay ends by assessing Edward Slingerland's claim that shared metaphors point toward deeper similarities between different views, in light of the foregoing analysis. (shrink)

Simon Blackburn’s supervenience argument—focusing on the mysterious “ban on mixed worlds”—is still subject to a variety of conflicting interpretations. In this paper, I hope to provide a defense of the argument that clarifies both the argument and the objections it must overcome. Many of the extant objections, I will argue, fail to engage the argument in its true form. And to counter the more compelling objections, it will be necessary to bring in additional argumentation that Blackburn himself does not clearly (...) provide. One important upshot of this discussion is that moral realism is not the only target of the argument: it raises trouble for a variety of metaethical views wed to realist-friendly construals of moral evaluation. Rightly understood, this argument not only survives the prominent responses, but turns out to be more powerful than his critics and Blackburn himself have recognized. (shrink)

Previous research on linguistic relativity and economic decisions hypothesized that speakers of languages with obligatory tense marking of future time reference (FTR) should value future rewards less than speakers of languages which permit present tense FTR. This was hypothesized on the basis of obligatory linguistic marking (e.g., will) causing speakers to construe future events as more temporally distal and thereby to exhibit increased “temporal discounting”: the subjective devaluation of outcomes as the delay until they will occur increases. However, several aspects (...) of this hypothesis are incomplete. First, it overlooks the role of “modal” FTR structures which encode notions about the likelihood of future outcomes (e.g., might). This may influence “probability discounting”: the subjective devaluation of outcomes as the probability of their occurrence decreases. Second, the extent to which linguistic structures are subjectively related to temporal or probability discounting differences is currently unknown. To address these, we elicited FTR language and subjective ratings of temporal distance and probability from speakers of English, which exhibits strongly grammaticized FTR, and Dutch, which does not. Several findings went against the predictions of the previous hypothesis: Framing an FTR statement in the present (“Ellie arrives later on”) versus the future tense (“…will arrive…”) did not affect ratings of temporal distance; English speakers rated future statements as relatively more temporally proximal than Dutch speakers; and English and Dutch speakers rated future tenses as encoding high certainty, which suggests that obligatory future tense marking might result in less discounting. Additionally, compared with Dutch speakers, English speakers used more low-certainty terms in general (e.g., may) and as a function of various experimental factors. We conclude that the prior cross-linguistic observations of the link between FTR and psychological discounting may be caused by the connection between low-certainty modal structures and probability discounting, rather than future tense and temporality. This paper attempts to nudge the reader in the direction of an enlightened account of democratic choice, a sense of reflective choice which undermines our present support of discriminatory sectarian doctrine. I use Gutmann’s and Altman’s views as prologues to my own, though they might well reject my conclusions about discriminatory religion. I contrast my view with Macedo’s, Gray’s, Larmore’s, Rosenblum’s, and Galston’s.My argument utilizes common sense and relatively uncontroversial metaphysical principles to make it more difficult to dismiss as being (...) on an ontic par with the discriminatory doctrines which it challenges. I argue that discriminatory religion might be allowed to continue to be practiced and expressed by those who would pay their own way, much as with hate groups generally, but I view our continued public subsidization of it as a failure to recognize it for what it is. Much of Edmonton’s municipal past lacked any overarching development plan. Once such absentee municipal planning gave way to more concrete forms of municipal planning in terms of shaping the urban environment, conflicting goals soon emerged. Between 1949 and the early 1980s a conflict in planning goals within both the Edmonton District Planning Commission and the City of Edmonton, at this time governed with a commission board became apparent. Often this conflict played out in Edmonton’s river valley with competing visions of (...) preservation and freeway construction. River valley neighborhoods were threatened with land acquisition policies that viewed the river valley as the sole domain of parkland. Concurrently, those neighborhoods and much of the river valley were also threatened by the Metropolitan Edmonton Transportation Study. Citizen engagement in an otherwise politically apathetic city led to its demise, although the threat of large-scale removal of river valley parks and homes throughout the city loomed for some time. The period between 1949 and 1983 represents a period in Edmonton’s history where environmental protection policy clashed with transportation policy that advocated for the wholesale destruction of the river valley and countless homes. It is this conflict that led to increased political awareness that directly contributed to the demise of the METS scheme and gave rise to renewed support for river valley protection while making rapid transit a possibility for Edmonton. Evolutionary debunking arguments purport to undercut the justification of our moral judgments by showing why a tendency to make moral judgments would evolve regardless of the truth of those judgments. Machery and Mallon (2010. Evolution of morality. In J.M. Doris and The Moral Psychology Research Group (Eds.), The Moral Psychology Handbook (pp. 3-46). Oxford: Oxford University Press) have recently tried to disarm these arguments by showing that moral cognition – in the sense that is relevant to debunking – is not (...) the product of natural selection. Specifically, they present a barrage of increasingly influential challenges against reciprocity-based approaches to moral nativism. In the present paper I defend the nativist account of moral cognition against these criticisms, thereby bolstering the skeptical conclusions of evolutionary debunking arguments. However, Machery and Mallon's critique does successfully highlight several vulnerabilities in Richard Joyce's approach to debunking, suggesting several ways in which it can be revised toward generating a more robust version of the argument. This article argues that Kongzi's religious ethics suggests an alternative way of understanding the relationship between the right and the good, in which neither takes clear precedence in terms of being more foundational for ethics. The religious underpinnings of Kongzi's understanding of the Way are examined, including the close relationship between tian ("Heaven") and the Way. It is shown that following the Way is defined primarily by the extent to which one's actions express certain virtues, and not whether one's actions (...) are conducive to the best overall outcome or whether they are inherently right irrespective of consequences. It is then argued that the Way is seen as constitutive of both the right and the good, and that this understanding of the right and the good has important implications for contemporary virtue ethics, religious ethics, and political philosophy. While Richard Joyce’s moral skepticism might seem to be an extreme metaethical view, it is actually far more moderate than it might first appear. By articulating four challenges facing his approach to moral skepticism, I argue that Joyce’s moderation is, in fact, a theoretical liability. First, the fact that Joyce is not skeptical about normativity in general makes it possible to develop close approximations to morality, lending support to moderate moral revisionism over moral error theory. Second, Joyce relies on strong, (...) contentious conceptual and empirical claims in support of his views. Third, Joyce’s evolutionary debunking argument threatens to backfire, generalizing to all normative judgments. Finally, Joyce fails to offer an adequate account of the normativity of desire. Each of these four challenges can be either sidestepped or embraced by radicalizing and defending a global form of normative skepticism. There are thus several ways in which global normative skepticism appears to be in a more robust dialectical position than Joyce’s moral skepticism. Furthermore, I argue, Joyce’s arguments against global normative skepticism are unconvincing. While this discussion is framed in terms of Joyce’s work, its arguments will apply to other moral skeptics who are not also global normative skeptics. The result is an invitation for Joyce and other moral skeptics to leave these problems behind and join the radical camp. (shrink)

Stephen Cole Kleene was one of the greatest logicians of the twentieth century and this book is the influential textbook he wrote to teach the subject to the next generation. It was first published in 1952, some twenty years after the publication of Godel's paper on the incompleteness of arithmetic, which marked, if not the beginning of modern logic. The 1930s was a time of creativity and ferment in the subject, when the notion of computable moved from the realm (...) of philosophical speculation to the realm of science. This was accomplished by the work of Kurt Gode1, Alan Turing, and Alonzo Church, who gave three apparently different precise definitions of computable. When they all turned out to be equivalent, there was a collective realization that this was indeed the right notion. Kleene played a key role in this process. One could say that he was there at the beginning of modern logic. He showed the equivalence of lambda calculus with Turing machines and with Godel's recursion equations, and developed the modern machinery of partial recursive functions. This textbook played an invaluable part in educating the logicians of the present. It played an important role in their own logical education.". (shrink)

Although Tacitus began his writing career during the Principate at the end of the first century CE, the dominant approach to thinking about political life was still guided by Republicanism, a constellation of concepts from the mid-first century BCE Roman Republic. Republicanism held that there was only one type of monarchy and that it necessarily precluded libertas. Tacitus, who was living under different iterations of monopolistic power in the Principate, questions this tenet by examining various Germanic tribes. The Germania explores (...) different types of monarchical arrangements, showing that monarchy is not a one-size-fits-all form and that there are significant political differences among the Germanic monarchies, some of which preserve libertas. In this examination, he highlights the inapplicability of Republicanism to a system as dynamic as the Principate. (shrink)

David Enoch has recently proposed that the deliberative indispensability of irreducibly normative facts suffices to support their inclusion in our ontology, even if they are not necessary for the explanation of any observable phenomena. He challenges dissenters to point to a relevant asymmetry between explanation and deliberation that shows why explanatory indispensability, but not deliberative indispensability, is a legitimate guide to ontology. In this paper, I aim to do just that. Given that an entity figures in the actual explanation of (...) some phenomenon, it is not an open question whether that entity exists. Thus, if you can manage to find actual explanations, you can find answers to ontological questions. In contrast, even if some entity is indispensable to deliberation, it still might not exist. For example, even if some form of libertarian free will is deliberatively indispensable, we still might not have libertarian free will. So even if you manage to discover the indispensable commitments of deliberation, there is still more work to do to get to the bottom of things. That additional work is explanatory work, and so deliberative indispensability is not an independent guide to what there is. (shrink)

Confucianism and Catholicism are among the most influential religious traditions and share a long and intricate relationship. Beginning with the work of Matteo Ricci, the nature of this relationship has sometimes generated great debate, which is still alive today. The ten essays in this volume continue and advance this long conversation. Written by specialists in both traditions, the essays are organized into two groups. Those in the first group focus primarily on the historical and cultural contexts in which Confucianism and (...) Catholicism encountered one another in the four major Confucian cultures of East Asia. These essays seek to understand specific figures, texts, and issues in light of those broader contexts. The essays in the second part offer comparative and constructive studies of specific figures, texts, and issues in the Confucian and Catholic traditions from both theological and philosophical perspectives. Internalists and externalists disagree over how intimately normative judgment and motivation are linked. Proponents on both sides typically try to settle the issue by descriptively interpreting our concept of a normative judgment. Unfortunately, this approach has resulted in deep and apparently intractable disagreement. It is time to consider alternative strategies. In this paper, I argue that the internalist/externalist debate is particularly ripe for revisionary arguments that evaluate conceptions of normative judgment in light of the costs and benefits of their adoption. (...) I then develop a revisionary case for externalism by identifying three practical hazards that come with internalist conceptions of normative judgment. Along the way, I show how these internalist hazards are mirrored by externalist benefits. I also argue that two potential benefits of internalism are not very beneficial. Together, these considerations give us strong practical reasons to adopt externalist conceptions of normative judgment, regardless of which account is descriptively accurate. (shrink)

In December 2007 it was revealed that the British government is considering the exclusion of certain groups of migrants—those considered to be present “illegally”—from primary health care provided by the National Health Service. At present, practitioners have discretion to accept any individual for NHS treatment regardless of their status. A joint Home Office and Department of Health review is examining this access for foreign nationals, and the likely outcome is the restriction of access to irregular migrants, which would, according to (...) the Institute of Public Policy Research, affect around 390,000 people. In 2004 such groups were excluded from NHS secondary care, most controversially from treatment for HIV, and so the present proposal would bar them from all but emergency health treatment. (shrink)

This paper argues that a comparative study of the idea of a sense of justice in the work of John Rawls and the early Chinese philosopher Kongzi is mutually beneficial to our understanding of the thought of both figures. It also aims to provide an example of the relevance of moral psychology for basic questions in political philosophy. The paper offers an analysis of Rawls’s account of a sense of justice and its place within his theory of justice, focusing on (...) the features of this capacity and how it develops. It then provides an account of the sense of justice in Kongzi’s thought as it is seen in the Analects. Finally, it shows how examining the similarities and differences between the two accounts can deepen our understanding of both views, as well as our appreciation for the importance of understanding how a sense of justice develops. This article surveys contemporary scholarship on justice and early Confucianism and builds upon recent work on justice in the Analects by examining the relationship between justice and moral self-cultivation in the Mengzi (Mencius) and the Xunzi. It is argued that focusing on early Confucian accounts of how a sense of justice is cultivated offers insights into Confucian views of justice because it shows how remarks on justice in the Analects, Mengzi, and Xunzi are not tangential, but rather are an important (...) part of their accounts of Confucian moral self-cultivation. The UK government has recently taken steps to exclude certain groups of migrants from free treatment under the National Health Service, most controversially from treatment for HIV. Whether this discrimination can have any coherent ethical basis is questioned in this paper. The exclusion of migrants of any status from any welfare system cannot be ethically justified because the distinction between citizens and migrants cannot be an ethical one.

Thomas Aquinas, one of the "founding fathers" of just war theory, offers an account of virtuous warfare in practice. The author argues that Aquinas's approach to warfare, with its emphasis on justice and charity, is helpful in providing a coherent moral account of war to which Christians can subscribe. Particular attention is given to the role of charity, since this virtue is the distinguishing characteristic of the Christian soldier. Charity compels him to soldier justly, and by fighting justly, he is (...) elevated by God to friendship with God. Notable features of this approach are its emphasis on the criteria for judging whether a war is just and its relativizing of the criteria for proper combat behavior. (shrink)

Stereotypes of social construction suggest that the existence of social constructs is accidental and that such constructs have arbitrary and subjective features. In this paper, I explore a conception of social construction according to which it consists in the collective imposition of function onto reality and show that, according to this conception, these stereotypes are incorrect. In particular, I argue that the collective imposition of function onto reality is typically non-accidental and that the products of such imposition frequently have non-arbitrary (...) and objective features. These conclusions are interesting in and of themselves since they debunk important aspects of our socially constructed conception of social construction. Yet, additionally, they have important implications for the viability of mathematical social constructivism since resistance to such constructivism is frequently grounded in the observation that mathematics is non-accidental, non-arbitrary, and objective. I argue that God’s holiness as conceived in Hebrew Scripture grounds human obligations to obey divine commands. To disobey the commands of a holy God would disrespect a basic good, which we have decisive reason to avoid doing. God’s holiness may be a somewhat obscure property––though I propose transcendence and perfect morality as necessary conditions––but His omniscience and perfect morality guarantee that He would not command human beings to do things that His holiness would not ground His authority to command. Erin M. Cline expresses skepticism of several dimensions of Chun Hin Tsoi’s attempt to establish a classical Confucian view of distributive justice. She admonishes us to distinguish the constructive derivation or development of such a concept from Confucian views from descriptive attribution of those views to the early thinkers themselves. Cline also dissuades us from constructivism that draws indiscriminately across a diversity of texts, since the Analects, Mencius, and Xunzi each offer their own distinct views on matters of (...) justice, which may variously align or conflict. She then further defends her particular interpretations of Analects passages. These rebuttals conclude by pointing to a shared sensitivity to moral luck in early Confucianism and contemporary liberalism that again draws together the sense of justice in Rawls and Confucius. In closing, Cline reminds us that the dimensions of justice she and Tsoi discuss are deeply interwoven into the rich fabric of values and concerns presented in the Analects, and encourages that we take account of the more robust content and context of these records of Confucius’ teachings. Theology is both a human endeavor and something of Divine origin, insofar as it is a human attempt to make sense of certain Divinely revealed propositions. How does one reconcile these two elements? One attempt to do so was on the part of the Anglican theologian Rowan Williams. In sections I and II of chapter 1 of his work ‘On Christian Theology’, Williams speaks of the nature of authentic theological discourse, that is, theological discourse that has integrity. In his work (...) on theological integrity, Williams explores how human intentions or hidden agendas can potentially warp our attempt to make sense of the truths contained within Divine Revelation. He then goes on to speak of how to avoid such pitfalls. In this article, I will respond to the epistemological implications of William's thoughts on this topic. I will use various ideas from Catholic theology, including the development of doctrines and the notion that faith has both a subjective and objective element, to explore both the strengths and weaknesses of Williams's thought.
