A paediatric clinical trial conducted in a developing country is likely to encounter conditions or illnesses in participants unrelated to the study. Since local healthcare resources may be inadequate to meet these needs, research clinicians may face the dilemma of deciding when to provide ancillary care and to what extent. The authors propose a model for identifying ancillary care obligations that draws on assessments of urgency, the capacity of the local healthcare infrastructure and the capacity of the research infrastructure. The (...) model lends itself to a decision tree that can be adapted to the local context and resources so as to provide procedural guidance. The ability of adolescents to access safe and effective new products for HIV prevention and treatment is optimised by adolescent licensure at the same time these products are approved and marketed for adults. Many adolescent product development programmes for HIV prevention or treatment products may proceed simultaneously with adult phase III development programmes. Appropriately implemented, this strategy is not expected to delay licensure as information regarding product efficacy can often be extrapolated from adults to adolescents, and pharmacokinetic properties of drugs (...) in adolescents are expected to be similar to those in adults. Finally, adolescents enrolled in therapeutic HIV prevention and treatment research can be considered adults, based on US Food and Drug Administration regulations and the appropriate application of state law. The FDA permits local jurisdictions to apply state and local HIV/sexually transmitted infection minor treatment laws so that adolescents who are HIV-positive or at risk of contracting HIV may be enrolled in therapeutic or prevention trials without obtaining parental permission. The following description is based upon an actual case in which a patient initiated legal action after suffering a complication subsequent to an invasive diagnostic procedure performed by a senior fellow. Named as codefendants were the senior fellow, attending physician, and the hospital. Because any hospital with house staff is potentially vulnerable to similar litigation, Ethics Committees at Work is addressing the questions raised by this dilemma.

The marketing of health care services raises the prospect that an ethic of strangers will govern relations between providers and patients. A fiduciary model that emphasizes honesty and public accountability, as well as the patient's good and avoiding unnecessary services, can keep marketing consistent with the ethical tradition of medicine.

In his well-known work of art criticism _Art of the Modern Age_, Jean-Marie Schaeffer offered a lucid and powerful critique of what he identified as the historically dominant thinking about art and aesthetics from the Jena Romantics, to Nietzsche, Heidegger, Adorno, and beyond, which he termed “the speculative theory of art.” Here, in _Beyond Speculation, _Schaeffer builds from this significant work, rejecting not only the identification of the aesthetic with the work of art, but also the Kantian association of the (...) aesthetic with subjectively universal judgment. In his analysis of aesthetic relations, he opens up a space for a theory of art that is free of historicism and capable of engaging with noncanonical and non-Western arts. In recent papers [1997, in press] I have explored how two seemingly conflicting paradigms inform the conception and study of picture perception. The dominant paradigm, one especially favored by vision theorists, claims that seeing a pictorial representation of an object is, with qualifications, like seeing the object itself. The picture, being a geometrically sanctioned projection of its object, resembles it, or otherwise serves as a mimetic surrogate, “re-presenting” what it depicts [Danto, 1982]. Accordingly, pictorial representation is at its best when, (...) as in trompe l’oeil paintings, viewers can not tell the picture, the stand in or substitute, from the real thing. An alternative paradigm, the symbolic model, championed most forcefully by Nelson Goodman [1968], focuses attention on syntactic and semantic features of pictures. On this account, pictures are importantly allied with other forms of representation, including languages, maps, and music notation, and picture perception is to be understood in this context. A standard objection to act utilitarian theories is that they are not helpful in deciding what it is morally permissible for us to do when we actually have to make a choice between alternatives. That is, such theories are worthless as decision procedures. A standard reply to this objection is that act utilitarian theories can be evaluated solely as theories about right-making characteristics and, when so evaluated, their inadequacy as decision procedures is irrelevant.
