This article describes research to build an embodied conversational agent as an interface to a question-and-answer system about a National Science Foundation program. We call this ECA the LifeLike Avatar, and it can interact with its users in spoken natural language to answer general as well as specific questions about specific topics. In an idealized case, the LifeLike Avatar could conceivably provide a user with a level of interaction such that he or she would not be certain as to whether (...) he or she is talking to the actual person via video teleconference. This could be considered a extended version of the seminal Turing test. Although passing such a test is still far off, our work moves the science in that direction. The Uncanny Valley notwithstanding, applications of such lifelike interfaces could include those where specific instructors/caregivers could be represented as stand-ins for the actual person in situations where personal representation is important. Possible areas that come to mind that might benefit from these lifelike ECAs include health-care support for elderly/disabled patients in extended home care, education/training, and knowledge preservation. Another more personal application would be to posthumously preserve elements of the persona of a loved one by family members. We apply this approach to a Q/a system for knowledge preservation and dissemination, where the specific individual who had this knowledge was to retire from the US National Science Foundation. The system is described in detail, and evaluations were performed to determine how well the system was perceived by users. (shrink)

The paper makes a twofold contribution. Firstly, it advances a preliminary account of the conditions that need to obtain for constitutional rights to be democratic. Secondly, in so doing, it defends precommitment-based theories from a criticism raised by Jeremy Waldron—namely, that constitutional rights do not become any more democratic when they are democratically adopted, for the people could adopt undemocratic policies without such policies becoming democratic as a result. The paper shows that the reductio applies to political rights, yet not (...) to non-political rights, such as reproductive, environmental, or privacy rights. The democratic status of the former is process-independent. The latter, by contrast, are democratic precisely when they are adopted by democratic means. (shrink)

To this end I resort to Jean Marie Schaeffer’s criticism of the thesis of human exceptionality and the semantic perspective of scientific theories of Ronald Giere. I conclude that the main criticisms are not applicable to evolutionary psychology as a research program. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

La novela póstuma de Macedonio Fernández, Museo de la Novela de la Eterna es una obra paradigmática de la narrativa argentina. Su largo proceso de escritura desde 1904 y su publicación diferida en 1967 despiertan un interés en la historia de su recepción. El objetivo del presente trabajo es señalar algunas paradojas que surgen de las lecturas del texto y de cómo se ha interpretado su autonomía ficcional durante el contexto de su publicación –el boom–. La primera parte busca delimitar (...) la noción de “autonomía ficcional” a partir de las vanguardias, e indagar en su aplicación en Museo. La segunda examina la recepción de la novela entre la crítica latinoamericanista de los años sesenta para describir cómo se ha leído un texto que buscaba alcanzar la autonomía plena de la ficción en una época en que el compromiso político era clave entre los escritores latinoamericanos. We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. Although "the Socratic method" is commonly understood as a style of pedagogy involving cross-questioning between teacher and student, there has long been debate among scholars of ancient philosophy about how this method as attributed to Socrates should be defined or, indeed, whether Socrates can be said to have used any single, uniform method at all distinctive to his way of philosophizing. This volume brings together essays by classicists and philosophers examining this controversy anew. The point of departure for many of (...) those engaged in the debate has been the identification of Socratic method with "the elenchus" as a technique of logical argumentation aimed at refuting an interlocutor, which Gregory Vlastos highlighted in an influential article in 1983. The essays in this volume look again at many of the issues to which Vlastos drew attention but also seek to broaden the discussion well beyond the limits of his formulation. Some contributors question the suitability of the elenchus as a general description of how Socrates engages his interlocutors; others trace the historical origins of the kinds of argumentation Socrates employs; others explore methods in addition to the elenchus that Socrates uses; several propose new ways of thinking about Socratic practices. Eight essays focus on specific dialogues, each examining why Plato has Socrates use the particular methods he does in the context defined by the dialogue. The genetically-modified-organism (GMO) experience has been prominent in motivating science, industry, and regulatory communities to address the social and ethical dimensions of nanotechnology. However, there are some significant problems with the GMO-nanotech analogy. First, it overstates the likelihood of a GMO-like backlash against nanotechnology. Second, it invites misconceptions about the reasons for public engagement and social and ethical issues research as well as their appropriate roles in nanotech research, development, application, commercialization, and regulatory processes. We present here some Boolean connexive logics (BCLs) that are intended to be connexive counterparts of selected Epstein’s content relationship logics (CRLs). The main motivation for analyzing such logics is to explain the notion of connexivity by means of the notion of content relationship. The article consists of two parts. In the first one, we focus on the syntactic analysis by means of axiomatic systems. The starting point for our syntactic considerations will be the smallest BCL and the smallest CRL. (...) In the first part, we also identify axioms of Epstein’s logics that, together with the connexive principles, lead to contradiction. Moreover, we present some principles that will be equivalent to the connexive theses, but not to the content connexive theses we will propose. In the second part, we focus on the semantic analysis provided by relating- and set-assignment models. We define sound and complete relating semantics for all tested systems. We also indicate alternative relating models for the smallest BCL, which are not alternative models of the connexive counterparts of the considered CRLs. We provide a set-assignment semantics for some BCLs, giving thus a natural formalization of the content relationship understood either as content sharing or as content inclusion. (shrink)

One of the early, non-financial uses of blockchain technologies around which several startups have developed was to help manage, monetize, and make the sharing of genomic data more private. Because deidentified genomic data are excluded from HIPAA and many other regulatory contexts worldwide—and is already a widely traded commodity for science valued in the hundreds of millions over the past decade—genomic blockchains proved a promising entry point for using the benefits of blockchains for dissemination and remuneration of data. Several models (...) have been tried, and most have touted their abilities to make users the “owners” of the genomic data in ways in which current models fail. This paper will explore the various existing and potential models for genomic blockchains, review some shortcomings and unmet needs, and explain why no technical solution alone will fulfill the promise of genomic data ownership without regulation. We are causing species to go extinct at extraordinary rates, altering existing species in unprecedented ways and creating entirely new species. More than ever before, we require an ethic of species to guide our interactions with them. In this book, Ronald L. We start this Volume 13 with the usual Editorial Note reviewing the main features of Economics and Business Letters. EBL is an online letter-type journal, free both for authors and readers, covering all areas of economics and business and with theoretical and empirical letters.

In this paper we investigate how inference to the best explanation (IBE) works in engineering science, focussing on the context of malfunction explanation. While IBE has gotten a lot of attention in the philosophy of science literature, few, if any, philosophical work has focussed on IBE in engineering science practice. We first show that IBE in engineering science has a similar structure as IBE in other scientific domains in the sense that in both settings IBE hinges on the weighing of (...) explanatory virtues. We then proceed to show that, due to the intimate connection between explanation and redesign in engineering science, there is a further engineering domain-specific virtue in terms of which engineering malfunction explanations are evaluated, viz. the virtue of redesign utility. This virtue entails that the explanatory information offered by a malfunction explanation should be instrumental in predicting counterfactual dependencies in redesigned systems. We illustrate and elaborate these points in terms of a number of engineering examples, focussing in particular on the 2009 crash of Air France Flight 447. Our extension of analyses of IBE and explanation to engineering science practice offers new insights by identifying a new explanatory virtue in malfunction explanation: redesign utility. (shrink)

In this article, we postulate three items that are considered fundamental for the construction of cultures of peace through a coexistence with dignity and in a fair framework. Together ethics, creativity and imagination rise to face and challenge the various situations of violence that occur in social constructs, as they are realities that involve serious opprobrium for humanity. Thinking of a more humane world will be possible only if we are in it actively from ethical postulates and through procedures that (...) demand creativity and imagination, which are crossed in various situations such as listening and dialogue, involving mutual respect. Imagining oneself in the place of others as an ethical category and articulating it with creative forms allows us to aspire to situations that are different and diverse from those we live in, in order to achieve the construction of peace. This brief essay explores how understanding the treatment of expert evidence requires engaging with its legal and political contexts, and not just focusing on its epistemological aspects. Although the law of evidence and thus its treatment of experts is significantly informed by epistemological considerations, it is also informed by concerns over the organization of trials, larger issues of intelligent governance, social concerns, and enforcement issues. These five aspects to the law of evidence give rise to principles to guide the explicit (...) structuring of the law of evidence that are identified here as well. This complexity helps to explain why the central issue of expert testimony is not the epistemological one of knowledge and belief but instead the conflict between educational and deferential modes of trial. Andrés de Guevara y Basoazábal (1748-1801), jesuita novohispano guanajuatense, escribió las Institutionum elementarium philosophiae, donde su autor ofrece un currículo deseable para la juventud mexicana que incluya la ciencia moderna empírica, la política virtuosa y la sabiduría humana. A través de una traducción comparativa del latín al español del proemio de la citada obra, este artículo pretende: 1) contextualizar al autor novohispano, 2) mostrar la recepción de la ciencia moderna desde los elementos aristotélicos de los que Guevara dispuso, y 3) (...) mostrar que la modernidad y la tradición aristotélica se enriquecieron mutuamente; y lo que debía de reformarse era la escolástica anquilosada. Se concluye que a través del proemio De vicissitundinibus de Guevara se evidencia la recepción mexicana de la modernidad emanada de una mentalidad aristotélica. (shrink)

“Pick a card, any card. This has to be a completely free choice.” the magician tells you. But is it really? Although we like to think that we are using our free will to make our decisions, research in psychology has shown that many of our behaviours are automatic and unconsciously influenced by external stimuli (Ariely, 2008; Bargh & Chartrand, 1999; Newell & Shanks, 2014; Nisbett & Wilson, 1977), and that we are often oblivious to the cognitive mechanisms that underpin (...) our decision (Wegner, 2002, 2003). Magicians have exploited this illusory sense of agency for a long time, and have developed a wide range of techniques to influence and control spectators’ choices of such things as card, word, or number (Annemann, 1933; Banachek, 2002a; Jones, 1994; Turner, 2015). These techniques are instances of what is called forcing. -/- Many forces are extremely effective, illustrating various weaknesses in our sense of control over decisions and their outcomes. Researchers have started to investigate them in various ways (Kuhn, Pailh s, & Lan, 2020; Olson, Amlani, Raz, & Rensink, 2015; Pailhes & Kuhn, 2020b, 2020c; Shalom et al., 2013) and are beginning to obtain valuable insights into decision-making processes as well as a better understanding of the cognitive mechanisms that lead people to experience an illusory sense of free will and of agency. -/- Although magicians have acquired large amounts of knowledge in covertly controlling people’s choices, much of this knowledge is only discussed in the context of individual magic tricks, or in books that are not readily accessible to non-magicans. As we and others have argued elsewhere (Ekroll, Sayim, & Wagemans, 2017; Kuhn, 2019; Kuhn, Amlani, & Rensink, 2008; Kuhn, Caffaratti, Teszka, & Rensink, 2014; Macknik et al., 2008; Olson et al., 2015; Olson, Landry, Appourchaux, & Raz, 2016; Shalom et al., 2013; Thomas, Didierjean, Maquestiaux, & Gygax, 2015), a particularly effective way of making this knowledge more available is via the creation of taxonomies centered around psychological mechanisms (Rensink & Kuhn, 2015). For example, the psychologically based taxonomy of misdirection (Kuhn et al., 2014) helps draw links between misdirection and formal theories of perception and cognition. -/- Our aim here is to apply a similar process to the knowledge magicians have about forcing. The present paper develops a psychologically based taxonomy of forcing techniques with two goals in mind. Firstly, it should help uncover the various psychological mechanisms that underlie forcing techniques. Secondly, it should facilitate knowledge transfer between magicians and psychologists. Among other things, this knowledge will allow researchers to gain new insights into the mechanisms underlying decision-making, and the feeling of free will and of agency over choice. L’article présente les résultats d’une enquête qualitative réalisée pendant le premier confinement au Chili en 2020, dans laquelle 26 personnes de différentes caractéristiques sociales ont été interrogées à trois moments différents de la période, pour un total de plus de 70 entretiens. L’analyse de ce corpus oppose la rationalité techno-expérimentale sur laquelle se fonde la stratégie de confinement et qui réduit les temporalités à un temps objectif, standard et mesurable, aux expériences singularisées du temps social éprouvées par les individus au (...) Chili. Ces expériences du temps confiné ont été façonnées par les propriétés sociales des individus et de leur environnement. Ainsi, trois conditions sociales ont été identifiées – position sociale, activités et étapes du cycle de vie –, dont l’interaction a donné lieu à trois modalités de temporalisation : l’expérience du temps suspendu, l’expérience du temps exigé et l’expérience du temps réinvesti. Si chaque expérience peut fournir une représentation fixe des temporalités sociales pendant le confinement, l’article propose l’idée d’une transition des individus entre ces différentes expériences, en fonction de l’évolution de l’enfermement et des conditions sociales. While the term “metacognition” is sometimes used to refer to any form of thinking about thinking, in cognitive psychology, it is typically reserved for thinking about one’s own thinking, as opposed to thinking about others’ thinking. How metacognition in this more specific sense relates to other-directed mindreading is one of the main theoretical issues debated in the literature. This article considers the idea that we make use of the same or a largely similar package of resources in conceptually interpreting our (...) own mind as we do in interpreting others’. I assume that a capacity for other-directed mindreading is minimally shared with our great-ape relatives, but I argue that the architecture of this system had to be substantially modified before it could efficiently and adaptively be turned inwards on one’s own mind. I contend that an important piece of the overall evolutionary explanation here likely concerns selection pressures arising from the domain of conversational interaction. Specifically, drawing on work carried out in the human interaction studies tradition (e.g., conversation analysis), I argue that the smooth to-and-fro of conversational interaction can be seen to heavily depend on metacommunicative capacities, which, in turn, are underpinned by metacognitive capacities. I conclude with a thumbnail sketch of an evolutionary account of the emergence of these metacognitive capacities in the human line. Their appearance and spread – whether via genes, cultural learning, or more likely, some combination of the two – helps to explain the transition from great-ape communication to human conversation. As consumer lifestyles have changed over recent decades, people have increasingly turned to meals prepared away from home. A major consequence of this shift in eating patterns has been a concomitant rise in obesity rates worldwide. Research has consistently documented that consumers tend to make less healthy choices when purchasing prepared meals away from home. In part, this can be attributed to inadequate information at the time of purchase; both nutrition experts and lay consumers tend, for example, to underestimate calories (...) in food purchased away from home and thus portion sizes tend to be larger. Thus, by requiring restaurants and other purveyors of prepared foods to provide the calorie content and other nutrition information at the point of purchase, consumers should be able to make more informed decisions and public health should be improved. The often maligned Affordable Care Act (i.e., “Obamacare”) addressed this issue in a mandate calling for compulsory nutrition labeling of prepared foods at the point of sale. In response to this effort, conservatives in Congress introduced the “Common Sense Nutrition Disclosure Act” (CSNDA) which, if enacted, would have effectively eviscerated the menu labeling provisions mandated by the Affordable Care Act. The stated rationale behind this legislation: to protect small business and prevent job loss resulting from overly‐burdensome federal regulations. This article provides a historical look at the evolution of federally mandated menu labeling in the United States with particular emphasis on opposition to its passage. The position is taken such that this legislation is beneficial, warranted, and long overdue, and its opposition, as reflected in the CSNDA, points to the need for new metrics when evaluating public policy. The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

El trabajo ensaya un análisis sobre los perfiles subjetivos en la política dentro del esquema comunicacional vigente. El mundo global, la conectividad y las imágenes son elementos que invitan a atender como la palabra y la información funcionan en la actualidad. Esta revisión toma aportes de Sartori, Serres y Rancière, entre otros. Luego se discute el lugar de lo letrado como dispositivo de articulación de la comunidad. Para ello se examinan las tesis de Ángel Rama: el primado de la letra (...) implica un orden social con un impacto severo en la institucionalidad política. Posteriormente, se incorpora la noción de poslexia sugerida por Mark Fisher, quien afirma el carácter “iletrado” de la actualidad. Se construye así un diálogo en el que se profundizan algunas de las perspectivas implicadas. Finalmente, se sugieren algunas interrogantes sus efectos en la subjetividad política. Scientific understanding is a fundamental goal of science. However, there is currently no good way to measure the scientific understanding of agents, whether these be humans or Artificial Intelligence systems. Without a clear benchmark, it is challenging to evaluate and compare different levels of scientific understanding. In this paper, we propose a framework to create a benchmark for scientific understanding, utilizing tools from philosophy of science. We adopt a behavioral conception of understanding, according to which genuine understanding should be recognized (...) as an ability to perform certain tasks. We extend this notion of scientific understanding by considering a set of questions that gauge different levels of scientific understanding, covering information retrieval, the capability to arrange information to produce an explanation, and the ability to infer how things would be different under different circumstances. We suggest building a Scientific Understanding Benchmark (SUB), formed by a set of these tests, allowing for the evaluation and comparison of scientific understanding. Benchmarking plays a crucial role in establishing trust, ensuring quality control, and providing a basis for performance evaluation. By aligning machine and human scientific understanding we can improve their utility, ultimately advancing scientific understanding and helping to discover new insights within machines. (shrink)

From "Materialism and Revolution" through _Hope Now_, Jean-Paul Sartre was deeply engaged with questions about the meaning and justifiability of violence. In the first comprehensive treatment of Sartre’s views on the subject, Ronald Santoni begins by tracing the full trajectory of Sartre’s evolving thought on violence and shows how the "curious ambiguity" of freedom affirming itself against freedom in his earliest writings about violence developed into his "curiously ambivalent" position through his later writings.

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

This paper examines whether there are moral differences between the mitochondrial replacement techniques that have been recently developed in order to help women afflicted by mitochondrial DNA diseases to have genetically related children absent such conditions: maternal spindle transfer and pronuclear transfer. Firstly, it examines whether there is a moral difference between MST and PNT in terms of the divide between somatic interventions and germline interventions. Secondly, it considers whether PNT and MST are morally distinct under a therapy/creation optic. Finally, (...) it investigates whether there is a moral difference between MST and PNT from a human embryo destruction point of view. I conclude, contra recent arguments, that regarding the first two points there is no moral differences between PNT and MST; and that regarding the third one MST is morally preferable to PNT, but only if we hold a gradualist account of the moral value of human embryos where zygotes have slight moral value. Después de Ortega, los demás filósofos, a partir de 1927 con Heidegger, no saben de dónde procede la interpretación etimológica que ellos dan como (...) obvia para sus reflexiones filosóficas sobre la verdad. En realidad no hay textos griegos claros que interpreten el concepto de _alétheia_ ni etimológica ni filosóficamente. Julián Marías descubrió la más antigua discusión etimológica en el lingüista y filósofo Teichmüller (1879), de la cual se sirvió Ortega en fecha tan temprana como 1914 para hacer la primera interpretación filosófica de esa palabra. Under what conditions would it be paradoxical to consider the possibility of false judgment? Here we claim that in the initial puzzle of Theaetetus 187e5–188c9, where Plato investigates the question of what could psychologically cause a false judgment, the paradoxical nature of this question derives from certain constraints and restrictions about causal explanation, in particular, from the metaphysical principle that opposites cannot cause opposites. Contrary to all previous interpretations, this metaphysical approach does not attribute to Plato any controversial epistemological assumptions (...) and fits better with the text and its role within the dialectic of the dialogue. Following Goldman’s seminal work, most contemporary philosophical contributions on the novice-expert relation have adopted a normative, expert-focused approach. In this paper, we aim to shift the focus of the philosophical analysis towards the characteristics of the novices, and how they might determine the choices that experts make. On the bases of recent empirical evidence from social psychology, we discuss how novices evaluate the messages that they receive and distinguish diverse kinds of novices according to their competence in message assessment. Building (...) on that analysis, we discuss the difficulties of approaches to expertise that focus only on the standpoint of novices or assume novices are homogeneous. In our analysis, we introduce the standpoint of experts, and we pay special attention to the heterogeneity of novices. This approach allows us to identify and address the difficulties faced by experts in the context of science communication. In the last part of the paper, we characterise and discuss the problem of experts when choosing a strategy in the issuing of a public campaign to advise or inform certain populations of novices. This explorative article conceptualizes the myth as a cultural locus where different concepts are ordered forming semantic networks and as a social narrative reflecting emotional predispositions toward the social significance of an episode in the past. The article analyzes the semantic network formed within the Arthurian myth by the concepts Britain and imperium. It identifies a persistent semilogical dynamic between both concepts but shifting emotional responses and temporalities: loss and longing among the Welsh (sixth century to eleventh century), fixing the (...) memory in the past; joy among the English (twelfth century to fifteenth century), bringing the memory into the present; and anxiety and desire among Welsh and English (sixteenth century) projecting the memory to the future. During the seventeenth century, the semantic network left the Arthurian myth, which fell into a relative oblivion. (shrink)

The present research was guided by the important need for a diversion from an economistic to a humanistic management perspective of sustainability. It concentrates on the current importance of digital strategic communication, particularly regarding the concept of corporate sustainability in the context of the conflict arena of the oil industry. The focus is on the comparison of the persuasive effectiveness of the framings of corporate versus activist NGO website communications and their impacts on the perception of the triple pillars of (...) sustainability and, corporate greenwashing with respect to a proposed bituminous oil pipeline in Canada. The results of these pro and con messages were analyzed within the Elaboration Likelihood Model demonstrating a “non expert” peripheral route to a positive persuasion from exposure to the corporate communication versus an “expert” central route to a negative persuasion from the activist NGO communication. Subsequent exposure to the opposite website communication further emphasized the predominance of a negative persuasion based on both groups now being motivated as “expert” viewers of these strategic communications, leading to an important perception of greenwashing by participants resulting from vague claims, visual and linguistic contents of the corporate communication versus the mainly verifiable factual ones in that of the activist NGO. In this article, the dominant legitimating discursive strategies around the ever-increasing labour demands and ever-declining standards of safety and well-being at work in Spain are analysed through the lens of Boltanski and Thévenot’s (2006) view of the transformation of capitalism. A qualitative methodology based on semi-structured interviews is used. Results show that the justificatory arguments most commonly put forward by managers and experts are the logic of supply and demand, and values related to flexibility, resilience and adaptability to change. In (...) contrast, the stability and protection established in the twentieth century are widely cherished values, particularly among union representatives and some human resources specialists. We found that discourse practices map two specific legitimating categories (market values and a projects orientation), and one critical category (Civic World), but the critical category has no practical impact, as the predominant feeling is resignation. Our research describes the common attitudes to legitimacy in the job market and points to a deep discontent in some of its key agents. (shrink)

Following a series of national protests in support of an increase in the federal minimum wage, many fast food workers faced retaliation by their employers when they returned to work; schedules were changed, wages and hours were reduced, and some employees were terminated. These retaliatory actions resulted in a number of complaints being filed with the National Labor Relations Board alleging violations of the National Labor Relations Act. Several of the complaints were found to have merit and, additionally, in several (...) instances both the immediate employer, the franchisee, and the corporate organization of which it was a part, the franchisor, were named as co‐defendants. This ruling—that franchisors like McDonald’s USA—could be held jointly responsible for the labor violations of independent franchisees reversed a long‐standing precedent, whereby franchisees were regarded as independent contractors solely responsible for day‐to‐day labor practices, including compliance with federal and state labor statutes. Critics of the ruling argue that it will open the door to unionization and may well spell the end of the service‐sponsor franchising format. Supporters of the NLRB argue that the ruling is just and reflects new “industrial realities” in retail labor markets. Further, a case can be made that the NLRB’s position represents a step in the direction of the restoration of more equitable balance of power between labor and management. (shrink)
