Behavioral paternalism raises deep concerns that do not arise in traditional welfare economics. These concerns stem from behavioral paternalism’s acceptance of the defining axioms of neoclassical rationality for normative purposes, despite having rejected them as positive descriptions of reality. We argue that behavioral paternalists have indeed accepted neoclassical rationality axioms as a welfare standard; that economists historically adopted these axioms not for their normative plausibility, but for their usefulness in formal and theoretical modeling; that broadly rational individuals might fail to (...) satisfy the axioms for various reasons, making them unpersuasive as normative criteria; and that even if their violation did constitute irrationality, that would not justify paternalists’ choosing among inconsistent preferences to define an individual’s “true” preferences. I provide a case-by-case definition of essential truths based on the notions of metaphysical necessity and ontological dependence. Relying on suggestions in the literature, I adopt a definition of the latter notion in terms of the notion of ground. The resulting account is adequate in the sense that it is not subject to Kit Fine’s famous counterexamples to the purely modal account of essence. In Metaphysics of States of Affairs, Bo Meinertsen reviews and works out several underdeveloped points in the existing scholarly debate on states of affairs, and presents his own original account in detail. In this paper, we raise three problems for Meinertsen’s account and draw attention to an alternative view that, though not discussed in the book, is not beset by these problems.

Institutional review board delays may hinder the successful completion of federally funded research in the U.S. military. When this happens, time-sensitive, mission-relevant questions go unanswered. Research participants face unnecessary burdens and risks if delays squeeze recruitment timelines, resulting in inadequate sample sizes for definitive analyses. More broadly, military members are exposed to untested or undertested interventions, implemented by well-intentioned leaders who bypass the research process altogether. To illustrate, we offer two case examples. We posit that IRB delays often appear in (...) the service of managing institutional risk, rather than protecting research participants. Regulators may see more risk associated with moving quickly than risk related to delay, choosing to err on the side of bureaucracy. P. van Inwagen famously offered three precise versions of the so-called Consequence Argument for incompatibilism. The third of these essentially employs the notion of an agent’s having a choice with respect to a proposition. In this paper, I offer two intuitively attractive accounts of this notion in terms of the explanatory connective ‘because’ and explore the prospects of the third argument once they are in play. Under either account, the argument fails.

Neuromodulatory effects of non-invasive brain stimulation (NIBS) have been extensively studied in chronic pain. A hypothetic mechanism of action would be to prevent or revert the ongoing maladaptive plasticity within the pain matrix. In this review, the authors discuss the mechanisms underlying the development of an abnormal plasticity in patients with chronic pain and the putative mechanisms of NIBS in modulating synaptic plasticity in neuropathic pain conditions.

This paper is a response to McKenzie (2017). I argue that the case she presents is not a genuine counterexample to the thesis she labels Brute Fundamentalism. My response consists of two main points. First, that the support she presents for considering her case a metaphysical explanation is misguided. Second, that there are principled reasons for doubting that partial explanations in Hempel’s sense, of which her case is an instance, are genuinely explanatory in the first place. This study, drawing upon contemporary theories in the field of migration, postcolonialism, and translation, offers an analysis of literary works by Monica Ali and Jhumpa Lahiri. Ali and Lahiri epitomize second-generation immigrant literature, play with the linguistic concept of translating and interpreting as forms of hybrid connections, and are significant examples of how a text may become a space where multi-faceted identities co-habit in a process of deconstructing and reconstructing their own sense of emplacement in non-native places. Each immigrant text (...) becomes a hybrid site, where second- and third generations of immigrant subjects move as mobile, fluctuating and impermanent identities, caught up in the act of transmitting their bicultural and bilingual experience through the use of the English language as their instrument of communication in a universe which tends to marginalize them. This investigation seeks to demonstrate how Ali and Lahiri represent two different migrant experiences, Muslim and Indian, each of which functioning within a multicultural Anglo-American context. Each text is transformed into the lieu where identities become both identities-intranslation and translated identities and each text itself may be looked at as the site of preservation of native identities but also of the assimilation of identity. Second-generation immigrant women writers become the interpreters of the old and new cultures, the translators of their own local cultures in a space of transition. (shrink)

Older and newer forms of vulnerability are manifesting themselves today, denouncing a suffering which is both material and existential, individual and societal. It is particularly evident within urban contexts and amplified by the crumbling of collective belonging and the increasing scarcity of places of participation where responsibility and the commitment to building one’s own personal biography are increasingly delegated to each individual, both materially and symbolically. Two separate pedagogical studies will explore some processes of signification of the experiences connected to (...) new poverty, emphasizing the risks of simplification and normativity identified in some of the current interpretations in the common sense, such as the problematic proximity which these are in danger of sharing with the interpretative premises that shape the same local educational services dedicated to new poverty itself. In an age of rapid advances inlife-prolonging treatment, patients and caregivers areincreasingly facing tensions in making end-of-lifedecisions. An examination of the history of healthcare in the United States reveals technological,economic, and medical factors that have contributed tothe problems of terminal care and consequently to themovement of assisted suicide. The movement has itsroots in at least two fundamental perceptions andexpectations. In the age of technological medicineenergized by the profit motive, dying comes at a highprice in suffering and in personal economic loss. (...) Thefailure to provide affordable resources for terminalcare is the result of the marketplace in health care. The medical profession has been painfully slow inresponding to the challenges of terminal care, mainlybecause of the pressures of the marketplace and lackof adequate training. This has occurred at a time ofrapid advances in life-sustaining treatment and ofexpanding public awareness of personal rights underthe law. Overly aggressive treatment in the finalstages of terminal illness has enhanced anxieties overa painfully prolonged and expensive dying. Thesefactors have promoted the movement to assistedsuicide. In the U.S. debate of the issues, ethiciststend to argue abstractly without examiningadequately the context of terminal care that is thehealth care system. Augustine’s analysis of time in Book XI of Confessions represents for Ludwig Wittgenstein a good example of a philosophical question. In dealing with such theme, his thought undergoes relevant changes. In the Philosophical Remarks, written more than 10 years after the drafting of the Tractatus, the Austrian philosopher holds that the essence of the world can be expressed in the grammar of language. Philosophy as “custodian” of grammar can grasp the essence of the world by excluding nonsensical combinations of signs. (...) Philosopher, however, are often “tempted” to straightly describe the nature of the world, producing logical-grammatical paradoxes. An example of such a temptation is offered by the attempt to take hold of the essence of time using propositions like “only the present experience has reality.” The logical mistake hidden in this proposition lies in the bad use of the adjectival word “present” that would lose its everyday use and functional role in the language. Only comparing the term “present” with the background of other words referring to time experiences like “past,” “future,” and so on, we are able to understand the true sense of it. Engaging in a grammatical investigation into the notion of time helps us to dispel the different uses of it staving off logical muddles. Wittgenstein makes, in his lecture held at Cambridge in 1932–1933, a relevant distinction between what he calls “memory-time” and “information-time.” If the first can be understood as a now-centered system mostly expressed by indexical sentences or as an arrangement relied on memory, and therefore inadequate to give any external physical criteria for time measurements, the second clearly refers to a public chronology, implemented by clocks, calendars, diaries, and so on. Grammatical misconceptions, however occur when we are “tyrannized” by a metaphor and not able to “move outside of” it. The Austrian philosopher makes no secret of preferring a characterization of time that rejects a truth-functional interpretation. As for the notion of “game” in the Philosophical Investigations, it is impossible to have something like a common denominator shared by every sentence involving time. (shrink)

Vaesen argues that functional knowledge differentiates humans from non-human primates. However, the rationale he provides for this position is open to question – with respect to both the underlying theoretical assumptions and inferences drawn from certain empirical studies. Indeed, there is some recent empirical work that suggests that functional fixedness is not necessarily uniquely human. I also question the central role of stable function representations in Vaesen's account of tool production and use.

Hayek selon laquelle l’ordre du droit coutumier est un ordre d’action, une coordination des plans individuels dans un système d’échange régi par ce droit. Cette conception s’oppose à l’idée suivant laquelle l’ordre légal doit être avant tout fondé sur la cohérence logique des concepts et doctrines de ce droit. L’article montre que la cohérence logique n’est ni nécessaire ni suffisante pour un ordre de plans ou pour une “cohérence praxéologique”. Nous défendons la position du droit coutumier classique suivant laquelle le droit se développe en accord avec les anticipations marginales des parties en présence. Dans la mesure où le droit se développe dans ce sens, il est possible d’approcher des objectifs jumelés du droit coutumier : la certitude relative et l’adaptation aux circonstances particulières.This article is a development of the idea, proposed by F.A. Hayek, that the order of common law is an order of actions, that is, a coordination of the plans of individuals in a system of exchanges governed by that law. This is in contrast to the idea that legal order is primarily to be found in the logical coherence of the law’s doctrines and concepts. The article shows that logical coherence is neither necessary nor sufficient for an order of plans, or “praxeological coherence”. It argues for the classic common law position that the law develops in accordance with the marginal expectations of the relevant parties. To the extent that the law develops in this way, it is possible for the twin goals of the common law to be approximated: relative certainty and adaptation to novel circumstances. (shrink)

However, since the 1970s, progress has been made onmany fronts, particularly in regard to advancedirectives dealing with end-of-life decisions. Thedebate over physician-assisted suicide has spawned arepetition of moral and legal arguments. Thoseagainst legalization have failed to make (...) a realisticappraisal of the dilemmas facing patients and theirfamilies in an age of technological medicine deliveredin the context of the marketplace. The underlyingproblem is a system in dire need of reform that willno longer treat health care as a commodity of themarketplace and provide universal health care. Terminal care as an integral part of health care willsubstantially benefit from such reforms because amajor obstacle to comprehensive palliative care is thecondition of the present system. (shrink)

In recent years, a new factor for work stress has been studied along with stress as an offense to self-theory. Illegitimate tasks refer to assignments that are unnecessary or are not related to the employee’s role. Because of this, the Bern Illegitimate Tasks Scale was developed, which measures illegitimate tasks in terms of unreasonable tasks and unnecessary tasks. There are no studies in Latin America on illegitimate tasks, so the purpose of this research is to translate and validate the Bern (...) Illegitimate Tasks Scale. The study was performed with a sample of nursing staff from a hospital in Guayaquil, Ecuador. Written informed consent was obtained from each of the participants. The reliability of the questionnaire was evaluated and its structural validity was verified by exploratory factor analysis and confirmatory factor analysis. The internal consistency of the whole scale, measured by Cronbach’s alpha, was 0.857. Moreover, the unnecessary and unreasonable subscales measure were 0.846 and 0.841, respectively. The exploratory factor analysis supported a two-factor model that explained 73.96% of the variance. Additionally, the confirmatory factor analysis showed good indexes of fit. The Spanish version of the Bern Illegitimate Tasks Scale presents good psychometric properties and can be applied to nurses in the Ecuadorian population. (shrink)

Paul Davidson's critique of O'Driscoll and Rizzo is based on an “official” philosophical position that turns on an opposition between knowledge and ignorance and a corresponding opposition between ergodic and nonergodic processes. But Davidson's substantive analysis reveals a very different “unofficial” position, based on “sensible expectations” and a realist ontology of enduring social structures. While O'Driscoll and Rizzo have the edge on Davidson in terms of their characterization of agents’ beliefs, their ontology of event regularities is ultimately the (...) same, and suffers from the same drawbacks, as Davidson's official ontology. The solution to some of these problems may lie in adopting an ontology similar to the one Davidson invokes in his unofficial capacity. (shrink)

Most economists—old and new classical, old and new Keynesian, and Austrian postulate an immutable reality unchangeable by any human action. They differ only over the amount of information decisionmakers have, in the short run, about this unchanging reality. Keynes and the Post Keynesians provide an axiomatic alternative model that presumes a transmutable economic reality. Runde, Torr, Prychitko, and Boehm and Farmer fail to adequately address this dichotomous analysis of reality in responding to my review of O'Driscoll and Rizzo's book.

Our response to Davidson is two?pronged. First, we dispute the basis for his dismissal of Austrian economics as presented by O'Driscoll and Rizzo. In particular, we reject his claim, dictated entirely by his Post Keynesian perspective, concerning an ?identical axiomatic foundation? of Austrian and neoclassical economics. Second, we seek to show that Davidson's criticism of neoclassicism (and by implication of Austrianism) is based on a superficial, incorrect, and outmoded reading of neoclassical economics.

Richard Janko's acclaimed translation of Aristotle's _Poetics_ is accompanied by the most comprehensive commentary available in English that does not presume knowledge of the original Greek. Two other unique features are Janko's translations with notes of both the _Tractatus Coislinianus_, which is argued to be a summary of the lost second book of the Poetics, and fragments of Aristotle’s dialogue On Poets, including recently discovered texts about catharsis, which appear in English for the first time.

The article discusses two bioart projects that bring the symbolically core human substances of blood, sweat and tears into technologically mediated relationships with plants and fungi to explore human kinship with other species: Tarah Rhoda’s BS&T (short for ‘blood, sweat and tears’) and OurGlass, and Saša Spačal’s MycoMythologies: Patterning. The article analyses the art projects through the lens of the molecular gaze and different perspectives on kinning, bringing anthropological conceptualizations of kinship together with Haraway’s pathways to connect with other species. (...) How can bioart use technologies to explore interspecies kinship through a molecular gaze? And may such artworks contribute to the toning down of human exceptionality in the face of a precarious future? We find that artworks providing a molecular gaze on interspecies biological processes may risk a decontextualized approach to complex relational processes but may also create new visions of filiation even with biological organisms imagined to be genetically distant from humans, thus spurring awareness of the fragile interrelationships among species. Introduction:To meet and take care of people with dementia implicate professional and moral challenges for caregivers. Using force happens daily. However, staff also encounter challenges with the management in the units. Managing the caretaking function is also significant in how caretakers experience working in dementia care.Purpose:The purpose of this study is to explore the caregiver’s experiences with ethical challenges in dementia care settings and the significance of professional leadership in this context.Method:The design is qualitative, and data appear through narrative interviews. (...) A total of 23 caretakers participated in the study. The transcribed interviews were subjected to a phenomenological-hermeneutical interpretation.Ethical considerations:The respondents signed an informed consent for participation prior to the interviews. They were assured anonymity and confidentiality in the publication of the data. Ricoeur’s method for interpretation ensures anonymity as the researcher relates to the data as one collective text. The study is part of a larger research project in ethics, in its entirety approved in line with the Helsinki Convention.Results:The findings show that the caretakers experienced inadequacy. Some of them described a negative work atmosphere where they experienced that their leaders did not take them seriously. Because of this, informal negative sub-groups functioned as an exclusive debriefing arena. Some of the informants described the opposite experience where the leaders actively supported them.Discussion:The analyses of the findings are discussed in light of the concepts of trust and mistrust in leadership.Conclusion:There is a correlation between the leadership and the caregivers’ experience of being in difficult situations. These principles were argued to be mid-level principles mediating between high-level moral theory and low-level common morality, and they immediately became very popular in writings about medical ethics. Theologians are split into two groups: those who embrace prosperity theology and those who oppose it; both sides on scriptural grounds. Those criticising it embrace cessationism in its diversity, while its supporters are mainly found among Pentecostals and Charismatics, who are continuationists. Continuationists believe and teach that all gifts of the Spirit are still available to the church today, therefore should be practised by the church just as they were operative during the apostolic era. Therefore, it is clear that prosperity (...) preachers are continuationists. They believe and practice healing and miracle gifts today. A review of the literature, biblical texts, historical teachings, and Pentecostal and Neo-Pentecostal (also referred to as charismatic and neo-charismatic) form the basis of this article. It addresses the positive features of prosperity teachers’ beliefs and methods as well as how they exploit the dreams, fears, and aspirations of people living in poverty. The theology of sharing, as articulated by Nicholas B.H. Bhengu, is proposed as a solution to creating parity between the rich and the poor.Contribution: This article seeks to balance opposing theological approaches with the prosperity gospel. It does this by introducing a theology of sharing as taught by Nicholas Bhengu based on the philosophy of Ubuntu, a way of life among African people. Cette réflexion veut en éclairer certaines thèses, les comparer aux catégories de la philosophie occidentale et déterminer si Fûdo peut se comprendre comme une pensée de la finitude.

Without seeking to diminish its authority as the Word of God, this article acknowledges the Fourth Gospel as a brilliant piece of literary artistry by the implied author. The aim of this article is to substantiate this assertion by conducting a study on focalisation and illustrating how it invites the implied reader’s participation in the narrative. This contribution acknowledges the existence of insightful contributions on the topic, particularly in relation to the Fourth Gospel. However, it asserts that the study of (...) the performative nature of focalisation in this particular Gospel has not received the attention it deserves. The main contribution of this article is its analysis of a selected narrative of the Fourth Gospel using focalisation as an analytical tool, with the objective of demonstrating that the Fourth Gospel is performative in nature, crafted and formulated to consistently engage the implied reader in considering its purpose, as stated in 20:30–31.Contribution: The article showcases that focalisation, when used as an analytical tool, can unlock, and enable the interpreter of the Fourth Gospel to recognise its performative nature to the implied reader of the text. This is critical, given that the text is crafted to encourage the reader to participate in it by making decisions regarding their faith in Jesus Christ. (shrink)
