I entered the room where one of the residents was seeing a patient that we will call Patty, a 32-year-old long-standing epilepsy patient. Patty was sitting in the chair with her husband by her side. She started screaming at me, complaining that she was tired of feeling sick and unable to do (...) anything. She had been in and out of emergency rooms with a variety of complaints, from passing out to dizziness with nausea and vomiting. She was visibly angry and started cursing me with direct expletives and blaming me for all her ailments.Her husband was quiet and, at times, would cover his face as if he was embarrassed. I felt an initial burst of anger. I felt my face getting red. I made a great effort to stay quiet, leaned on the exam table facing them, lowered my voice, and braced to take the barrage of insults that were coming my way. I had to make a strong conscious effort to control my emotions and let her vent. I felt that if I responded in kind, I would inflame the situation. Moreover, a resident and a student working with me that day were also present in the room, and I felt it was my duty to behave professionally, so I sat and tried to do active listening with the idea of offering solutions to her complaints. I am not sure how long the event lasted, but it seemed like an eternity. As she slowed down, I apologized for making her feel not cared for, repeated some of her complaints, and tried to offer solutions to them, but she would not have it and did not accept anything I said. She wanted to get her prescriptions and leave the clinic. I offered to have one of my colleagues do the follow-up as she really did not want to see me anymore.Patty is one of those patients that when you see the name in the schedule, you cringe and tell yourself, it is going to be a long clinic day. She could be in the group of patients who are considered very difficult. Before me, she had been seen by several other neurologists. They likely also preferred not to see her on the schedule because she is one of the 20–30% of patients that have a type of functional psychogenic disorder that becomes more complicated because of the coexistence of epileptic seizures along with non-epileptic psychogenic events. The latter is a more problematic event because it does not respond to pharmacological treatment and causes a lot of disability. The best way to establish whether an event is a true epileptic event or a non-epileptic psychogenic event is to do continuous electroencephalographic monitoring to capture as many events as possible on video. I tried different combinations of medications to no avail and with significant side effects. I tried to set her up for electroencephalogram home monitoring to tease the epileptic and psychogenic events apart. In truth, her social circumstances, insurance coverage, and economic situation made it impossible to do so. Every time she came to the clinic, she had a multitude of complaints, and she would ask for a medication to treat the problem. Any mention of the potential psychogenic nature of her problems would result in a defensive attitude "so you are saying I am crazy." We discussed multiple times the need to be careful with the medications and the potential bad side effects. I wanted to help her, but with every visit, there seemed to be a barrier, and the visit would end on bad terms. At least, that is how I felt. I was left every time, with a feeling of frustration. I believe that she left the clinic feeling the same. That day, I left the clinic upset and depressed. I tried to convince myself I had done all I could to help her. I just could not understand why this was the result.Several years have passed since I have seen Patty in the clinic. She certainly has not... (shrink)

In a framework of absence of fees to be paid by the borrower, the interest rate of the exponential discount function is, moreover, the true interest rate of the operation. Nevertheless, there exist a set of circumstances which make this identity false. Among others, these characteristics are: the use of linear discount as the underlying discount function, (...) splitting time when using a nominal interest rate, and the existence of fees in a loan at 0% interest rate. BackgroundDisorders in different levels of body representation are present in hemiplegic cerebral palsy. However, it remains unclear whether the body image develops from aspects of body schema and body structural description, and how this occurs in children with HCP.Objective and methodsIn a cross-sectional study, we investigated 53 children with HCP and 204 typically developing control children to qualitatively evaluate whether and how body schema and body structural description affect the development of children’s body image and whether this development is delayed (...) through HCP. Graph analysis was used to create a lexical-semantic map of body representation from data of a semantic word fluency task.ResultsResults indicated a similar qualitative pattern of influences of sensorimotor and visuospatial experiences on lexical-semantic knowledge of body parts, with a delayed developmental course in children with HCP compared to TD children.ConclusionThese findings suggest that children’s body image seemed to be influenced by body schema and body structural descriptions as indicated by poorer lexical-semantic knowledge of body parts in children with HCP due to missing physical experiences of the affected body parts. This might imply that “body talk” may beneficially complement physical therapy for children with HCP to promote body image development. (shrink)

KrausIntroductionThe personal stories submitted by physicians and researchers for this symposium add much–needed dimension to conversations on conflicts of interest in medicine and research. Narratives from individuals living with conflicts of interest can serve as a unique lens through which to consider psychological and economic theories and survey data on physician (...) and patient views. In our reading of these personal narratives, we identified four primary themes that will serve as springboards for our commentary. We aim to triangulate clusters of meaning drawn from the narratives with relevant data from published empirical studies and identify gaps in knowledge where more research is needed. These themes are: the unique environments of medicine and research; weighing the potential benefits of conflicts of interest against the risks; conflict of interest management; and the roles and responsibilities of diverse stakeholder groups.The Unique Challenges of the Medical and Research EnvironmentsThe reflections of the narrative authors draw attention to many of the unique environmental aspects of medicine and medical research that make physicians and researchers especially vulnerable to conflicts of interest. Conflicts of interest may be more ubiquitous in medicine than in any other industry (Kassirer, 2006). As the narratives demonstrate, conflicts of interest emerge across a range of health care delivery and research activities. Surveys have shown that 94 percent of physicians have some kind of relationship with industry (Campbell, Gruen, Mountford, et al., 2007). There is also evidence that physician interactions with medical industry begin early and are a regular part of a physician’s professional practice along the career continuum (Wazana, 2000).Medicine as a profession is distinct from banking or law. It is often said that medicine is an art; in treating patients, creative individualized solutions and gut instinct are as (if not more) important than the application of scientific knowledge. Uncertainty surrounds medical decision making. There is limited precision with respect to diagnoses and prognoses, limited data regarding the effectiveness of many treatments, and a range of patient values and preferences. Because of this uncertainty, rules about practice standards, especially with respect to avoidance and management of conflicts of interest, cannot be as explicit as they are in law or business. As demonstrated by the story presented by Sal Cruz–Flores, research and practice often intersect. And, there is no system in greater need of reform—and no system about which there are more divergent opinions as to what shape that reform should take—than the United States health care [End Page 91] system. The narratives of Tony Mikulec, Govind Nagaldinne, and David M. Zientek demonstrate how various aspects of the structure of healthcare service provision and third–party payer arrangements have the potential to harm patients. Conflicts of interest comprise more than relationships with pharmaceutical and medical device manufacturers.The narratives of Laura Jean Bierut and David M. Zientek also discuss examples of conflicts of interest that arise from factors beyond relationships with industry or the direct potential for financial gain. This may be somewhat unique to the medical milieu. Non-financial conflicts such as a desire for the prestige bestowed upon scientists who make key discoveries, a requirement to publish for tenure and promotion, the need to maintain one’s license or other privileges, or simply the pressure of a competitive environment can influence physician and researcher behavior. As noted by Bierut, more research on how to identify and manage non-financial conflicts is needed.The Potential Benefits and Harms of Conflicts of InterestConflicts of interest are usually presented in a negative light, particularly those that involve physician relationships with the pharmaceutical industry. To “have a conflict of interest” is to be in a situation or role where there is potential for personal interests to be prioritized over professional responsibilities. However, in terms of public perception, it seems that conflicts of interest have become almost synonymous with wrongdoing. Wynia and Bette–Jane Crigger*This fascinating collection of essays about individual experiences of conflict of interest leaves little doubt that physicians remain divided about the importance, impact and meaning of conflicts of interest in their work. These essays offer differing views about what conflicts of interest look and feel like “on the ground” and about whether specific conflicts of interest are bad, (...) just a fact of life, or maybe even good.Conflict, Conflict EverywhereThese essays situate conflict of interest in a variety of contexts: the treatment recommendations a physician makes for an individual patient; the relationship between teaching physician and medical student or practicing physician and health care organization; the interaction between academic researchers and industry collaborators or professional bodies and industry supporters. In this, the narratives taken together reflect the scope of concern about conflict of interest in medicine familiar in the literature. In his classic 1993 essay, Dennis Thompson noted that concerns about conflict of interest encompass issues of physician self–referral, risk sharing between physicians and health care institutions, gifts from industry, hospital purchasing practices, as well as sponsored research and research with patients (Thompson 1993). To that list have subsequently been added relationships with industry in medical education at all levels, physicians’ service as consultants to industry or members of industry speakers bureau, and development of clinical practice guidelines (Lo & Fields 2009).That almost none of these essays draw attention to some widely publicized situations of conflict of interest—for example, gifts to physicians or the provision of drug samples—should, we think, be seen more as an artifact of the authors’ varied individual experiences than as a failure by the authors to engage key concerns in the ongoing professional and public debate. It could also be that the authors, asked to submit personal stories, assumed that yet another essay about the ‘traditional’ issues in the conflicts of interest literature would be seen as redundant, routine or even boring. Or, there is the tantalizing possibility that the absence of some of the more familiar conflicts from these narratives is the early fruit of efforts to address these traditional issues through policies governing interactions between physicians and industry promulgated by academic medical centers and health systems, medical specialty societies, and industry.One significant area of concern that has emerged in recent years is conflict of interest in the development of clinical practice guidelines. E.g., Choudry et al. 2002; Sniderrman & Furberg 2009; Guyatt et al. 2010. Although none of the essays in this [End Page 101] collection address it head on, Perlmutter touches on several key issues. His depiction of how an FDA committee process limited the input he was able to provide as an expert, undermined his potential to contribute to the professional dialogue, and raised concerns about the objectivity of the drug approval process echoes concerns about objectivity, the role of expert opinion, and the presence on guideline development panels of individuals with financial interests in the recommendations to be developed that have been explored at some length in the literature, most recently by the Institute of Medicine in reports on evidentiary standards (Eden et al 2011) and principles for guideline development (Graham et al. 2011).Conflict of Interest or Dual Agency?Several essays set out physicians’ experience in navigating situations of diverging expectations. Bierut, for example, reflects on the disjunction between the goals and products of academic researchers and commercial sponsors. She saw herself advancing basic knowledge and was forced to grapple with the reality of sponsors’ goals to advance commercial ends as well. Nagldinne and Mikulec each recall struggles to reconcile their obligation to exercise professional judgment on behalf of patients with the demands of health care organizations focussed also on the bottom line. For many, the study of literature is still an aesthetic beauty pageant in which “great books” like Laurence Sterne’s Tristram Shandy (1767) or Marie de la Vergne de La Fayette’s La princesse de Clèves (1678) are paraded across the stage in a contest to seduce the Western intelligentsia. 1 The postmodern student of literature may not have much concern for this age-old territorial contest, but she might be interested to learn that the fallout from Hispanism’s quest for the “first modern novel” has involved so much attention to, indeed complication of, Don Quixote, that the book now resembles more a postmodern text than an early modern one. At the turn of the century, we have been left with what Jorge Luis Borges would recognize as an “aleph”: an infinite ideological labyrinth that reflects and/or cannibalizes all forms, thereby escaping all attempts [End Page 68] to describe it. 2 Whatever we currently mean by “Cervantes” (an author, a collection of texts, an ideological construction, and so forth) carries with it an impressive range of critical responses. Cervantes has been labeled converso (Castro, Canavaggio), Christian humanist (Castro, Bataillon, Forcione, Herrero, Vilanova), disillusioned secularist (Lukács, Cascardi), precapitalist (Johnson), anti-essentialist (Wilson), anti-Eusebian (Presberg), Menippean (Bakhtin), feminist (El Saffar, Rabin, Cruz), sadist (Nabokov), ethnocentric imperialist (Mariscal), medieval (Gorfkle), homophobic (Martín), non-organicist Aristotelian (Read), and either discursively or actually homosexual (Combet, Rossi, Smith, Arrabal). This list is nowhere near complete, but the reader will grasp the robust effects of the plurality of perspectives on Cervantes.Each of these interpretations is valid to varying degrees within various contexts, but at present I am interested in reading Cervantes as the author of a multicultural manifesto on behalf of the Moriscos of Southern Spain. 3 Within the contexts of French Marxist philosopher Louis Althusser and Palestinian postcolonial literary critic Edward Said, materialist, postcolonial, and multicultural critiques of various forms of power and their ideologies can be seen as the fundamental propositions of Cervantes’s Don Quixote. 4 Cervantes’s ultimate orientation may perhaps be inescapably Eurocentric, but his responses to the European experience of the rise and expansion of an ethnocentric militaristic nation state are relatively centrifugal when compared to the attitudes of many of his contemporaries.In surveying some of the antihegemonic details of Cervantes’s novel, I am also interested in dispelling the popular myth of Don Quixote. The subject of free will has suffered something of a renascence in recent popularized American philosophy. The issue is, of course, a Gordian knot of underlying metaphysical and ontological presupposition, in both the analytic and continental traditions. In this paper, I attempt a bit of an untangling, and in doing so, I find that the fundamental position of the contemporary champion of “no freedom” (Galen Strawson) is not only compatible with a radical Sartrean freedom, but that the two philosophers’ deeper (...) ontology is much the same, supports the same metaphysics and the same outline of an existentialist ethics. My approach is a combination of analytic and continental method and background: I continue to believe that there is no necessary separation between the analytic and continental camps, and that there is much to be gained from the reabsorption of analytic style into the broader philosophic tradition. The objective of this work is to establish a relationship between the cutting time in rocks, determining a speed and the point load strength index test, Is, to characterize the rock in terms of resistance and avoid sending samples to laboratories. As a first stage, on andesite samples, 5 x 5 x 10 cm test tubes were made. After the elaboration they were subjected to cutting, using an electric floor cutter and the time was evaluated. This cut was made in (...) a transversal way and two parts were obtained, one of them with dimensions 5 x 5 x 5 cm, approximately. In a third stage, the point load strength test was carried out in a press built for this purpose. Finally, the cutting speeds were correlated with the point load test values and only when rock samples do not pigeonhole on the proposed relationship, send them to the laboratory. In this paper we defend structural representations, more specifically neural structural representation. We are not alone in this, many are currently engaged in this endeavor. The direction we take, however, diverges from the main road, a road paved by the mathematical theory of measure that, in the 1970s, established homomorphism as the way to map empirical domains of things in the world to the codomain of numbers. By adopting the mind as codomain, this mapping became a boon for all those (...) convinced that a representation system should bear similarities with what was being represented, but struggled to find a precise account of what such similarities mean. The euforia was brief, however, and soon homomorphism revealed itself to be affected by serious weaknesses, the primary one being that it included systems embarrassingly alien to representations. We find that the defense attempts that have followed, adopt strategies that share a common format: valid structural representations come as “homomorphism plus X”, with various “X”, provided in descriptive format only. Our alternative direction stems from the observation of the overlooked departure from homomorphism as used in the theory of measure and its later use in mental representations. In the former case, the codomain or the realm of numbers, is the most suited for developing theorems detailing the existence and uniqueness of homomorphism for a wide range of empirical domains. In the latter case, the codomain is the realm of the mind, possibly more vague and more ill-defined than the empirical domain itself. The time is ripe for articulating the mapping between represented domains and the mind in formal terms, by exploiting what is currently known about coding mechanisms in the brain. We provide a sketch of a possible development in this direction, one that adopts the theory of neural population coding as codomain. We will show that our framework is not only not in disagreement with the “plus X” proposals, but can lead to natural derivation of several of the “X”. (shrink)

ABSTRACT The current debate on scientific realism is an entire universe. A general thesis can be put like follows: scientific activity attains a world that is independent of science itself. This “reaching out” can be thought of in terms of theoretical practices, such as the formulation of true theories, and/or experimental practices, such as the construction of suficiently accurate methods to (re)formulate and test what is said by the theories. By this latter route, the debate about scientific realism in the (...) philosophy of science meets the discussions in the philosophy of measurement, an autonomous research area that investigates measurement practices, their concepts, applications and assumptions. As the “realism” in the philosophy of science in general, there are multiple postures that can be characterized as “realistic” through their theorizations about scientific measurements. Stating which are the criteria and reasons why these positions claim to be realistic and in what they are distinct is a complex task. This article is an attempt to do that, without exhausting the discussion or the field. (shrink)

A disturbing economic reality confronts consumers today: thousands of farm workers are enslaved in U.S. agricultural fields, forced to work without pay amid deplorable conditions and under the constant threat of violence. If structural economic injustices perpetuate modern‐day agricultural slavery, then it is necessary to promote consumer practices that resist these abusive dynamics. But a consumption‐oriented strategy does not necessarily restore either personal agency or communal relations damaged by agricultural trafficking. Este estudio pretende demostrar el origen metodológico común del concepto de soberanía popular de Rousseau y Carl Schmitt, entendido como aquella autoridad política cuya legitimidad descansa en un principio democrático verdaderamente sustantivo. En primer lugar, se intentará probar cómo ambas obras serían la expresión de una común reacción al formalismo de una dogmática liberal que identifica metodológicamente la legalidad formal con la legitimidad política. Así, Rousseau critica un enunciado de la ley natural procedente de Locke que legitima la desigualdad social (...) y política y justifica el gobierno burgués de los propietarios y Schmitt cuestiona un positivismo jurídico cuyo normativismo habría ocultado el auténtico valor sociológico del poder y la soberanía. En segundo lugar, una vez avanzada una crítica de las representaciones políticas que niegan el carácter sustantivo del pueblo soberano, se estudia el modo en que ambos formulan una propuesta metodológica alternativa. Aquí se prestará especial atención al modo en que la elaboración schmittiana incorpora, en un contexto de crisis de las formas liberales, una reelaboración de la crítica de Rousseau. (shrink)

This paper examines explanations for human artistic behavior in two reductionist research programs, cognitive neuroscience and evolutionary psychology. Despite their different methodological outlooks, both approaches converge on an explanation of art production and appreciation as byproducts of normal perceptual and motivational cognitive skills that evolved in response to problems originally not related to art, such as the discrimination of salient visual stimuli and speech sounds. The explanatory power of this reductionist framework does not obviate the need for higher-level accounts of (...) art from the humanities, such as aesthetics, art history or anthropology of art. Humans have cognitive mechanisms that allow them to keep track of time, represent past events, and simulate the future, but these capacities have intrinsic constraints. Here, we explore the role of material culture as an extension of internal time representations through anthropological and archeological case studies, focusing on Upper Paleolithic material culture. We argue that calendars complement and extend internal time representations, because they enable humans to project past events into the future more accurately than is possible with episodic memory (...) alone, making them one of the factors that significantly improved foraging success during the Upper Paleolithic. We discuss the implications of the epistemic use of material culture for our understanding of the causes of shifts in human behavior during the Upper Paleolithic. (shrink)

The COVID-19 pandemic and its related policies (e.g., stay at home and social distancing orders) have increased people’s use of digital technology, such as social media. Researchers have, in turn, utilized artificial intelligence to analyze social media data for public health surveillance. For example, through machine learning and natural language processing, they have monitored social media data to examine public knowledge and behavior. This paper explores the ethical considerations of using artificial intelligence to monitor social media to understand the public’s (...) perspectives and behaviors surrounding COVID-19, including potential risks and benefits of an AI-driven approach. Importantly, investigators and ethics committees have a role in ensuring that researchers adhere to ethical principles of respect for persons, beneficence, and justice in a way that moves science forward while ensuring public safety and confidence in the process. Birth cohort studies can be used not only to generate population-level quantitative data, but also to recompose persons. The crux is how we understand data and persons. Recomposition entails scavenging for various (including unrecognised) data. It foregrounds the perspective and subjectivity of survey participants, but without forgetting the partiality and incompleteness of the accounts that it may generate. Although interested in the singularity of individuals, it attends to the historical and relational embeddedness of personhood. It examines the multiple and complex (...) temporalities that suffuse people’s lives, hence departing from linear notions of the life course. It implies involvement, as well as reflexivity, on the part of researchers. It embraces the heterogeneity and transformations over time of scientific archives and the interpretive possibilities, as well as incompleteness, of birth cohort studies data. Interested in the unfolding of lives over time, it also shines light on meaningful biographical moments. (shrink)

Current philosophical accounts of causation suggest that the same causal assertion can have different meanings. Yet, in actual social-scientific practice, the possible meanings of some causal generalisations intended to support policy prescriptions are not always spelled out. In line with a standard referentialist approach to semantics, we propose and elaborate on four questions to systematically elucidate the meaning of causal generalisations. The analysis can be useful to a host of agents, including social scientists, policy-makers, and philosophers aiming at being socially (...) relevant. To illustrate our proposal, we analyse the complexities related to the meaning of causal generalisations in the context of a concrete case of economic research which is explicitly intended to guide public policy, namely, the OECD research on the causes of unemployment. The use of the journal impact factor (JIF) as a measure for the quality of individual manuscripts and the merits of scientists has faced significant criticism in recent years. We add to the current criticism in arguing that such an application of the JIF in policy and decision making in academia is based on false beliefs and unwarranted inferences. To approach the problem, we use principles of deductive and inductive reasoning to illustrate the fallacies that are inherent to using journal (...) based metrics for evaluating the work of scientists. In doing so, we elaborate that if we judge scientific quality based on the JIF or other journal based metrics we are either guided by invalid or weak arguments or in fact consider our uncertainty about the quality of the work and not the quality itself. Interpretations of Einstein’s equation differ primarily concerning whether E = mc2 entails that mass and energy are the same property of physical systems, and hence whether there is any sense in which mass is ever ‘converted’ into energy. In this paper, I examine six interpretations of Einstein’s equation and argue that all but one fail to satisfy a minimal set of conditions that all interpretations of physical theories ought to satisfy. I argue that we should prefer the interpretation of Einstein’s (...) equation that holds that mass and energy are distinct properties of physical systems. This interpretation also carries along the view that while most cases of ‘conversion’ are not genuine examples of mass being ‘converted’ into energy, it is possible that the there are such ‘conversions’ in the sense that a certain amount of energy ‘appears’ and an equivalent of mass ‘disappears’. Finally, I suggest that the interpretation I defend is the only one that does not blur the distinction between what Einstein called ‘principle’ and ‘constructive’ theories. This is philosophically significant because it emphasizes that explanations of Einstein’s equation and the ‘conversion’ of mass and energy must be top‐down explanations. (shrink)

Following Darwin, many comparative psychologists assume that the human mind is a kind of ape mind, differing only in degree from the extant apes – we call this the mental continuity assumption. However, the continuity principle in evolutionary theory does not posit continuity between extant closely related species, but between extant species and their extinct ancestors. Thus, it is possible that some human cognitive capacities have no parallels in extant apes, but that they emerged in extinct hominid species after the (...) human-chimpanzee divergence. Our examination of the case of social cognition from an archaeological and comparative psychological perspective suggests that the human brain is not simply an enlarged chimpanzee brain. Instead, natural selection seems to have favoured a different social cognition in both species. (shrink)

El presente trabajo busca establecer una relación entre el marcado carácter masculino que durante siglos ha tenido la actividad política y el veto a la mujer en el acceso a los estudios de Derecho. Partiendo de la explicación de la regla prohibitiva y el recuerdo de las juristas parlamentarias pioneras de principios del siglo xx, el estudio se centra en las juristas parlamentarias de la Transición, en concreto, en las que formaron parte de las Cortes Constituyentes de 1977-1979. El objetivo (...) último es reconocer el valor de las aportaciones de todas aquellas mujeres que, en unos años difíciles en España, se enfrentaron no solo al reto de realizar unos estudios con limitadas salidas profesionales para ellas, sino que participaron en aquella legislatura con la esperanza de recuperar y consolidar la democracia.
