One of the prevalent inference methods the mutakallimūn uses is qiyās al-ghaib ‘ala al-shahid (analogy from the visible world to the invisible world). Mu‘tazila, who accepts this method as an absolute criterion in the divine attributes, rejects the possibility of difference between shahid and ghaib about the reality of attributes. By rejecting the concept of kalām nafsī adopted by Ahl al-Sunnah, they mention the divine speech in the category of actual attributes and claim that kalāmullāh (God’s speech), like (...) human speech, is an accident consisting of words and sounds. Mu‘tazila, who defines mutakallim as the agent of kalām, claims that God is also the agent of the word. In this regard, Mu‘tazila, who defends the origin of the kalāmullāh and the createdness of the Qur’ān, focuses on the explanation of the nature of the kalām at the beginning of these theological subjects. As an extension of the issue of whether the ḥikāyah and maḥkī are the same or not, which is the subject of discussion in the context of the possibility of creating something similar to the Qur’ān, Mu‘tazila, who disagree on whether kalām (word) is a kind of sound (ṣawt) or not, examine the problem of the nature of the word by expanding it to include sounds. Although they agree that sounds are accidents created by humans through tawlīd, they propound different theories about the physical formation of sound and kalām. These theories are differentiated according to discussions about the essential factors for the formation of sounds. Some scholars claim that i‘timād generates sounds, and the substrate (maḥall) is enough to form the sounds. In contrast, others claim the necessity of a specific structure (binya), movement (ḥaraka), and air added to the substrate. In this regard, this study will deal with the effect of these factors mentioned above to the formation of the sounds and the physical examples which every group mentioned to prove its opinions rightfulness. The most detailed explanations about this topic are seen in the works of Baṣrian Mu‘tazila. Therefore, this study will examine the opinions about the production of sounds, which argued around metaphysical issues in the context of the createdness of the Qur’ān and the attribute of kalām, which are submitted by Abū ‘Alī al-Jubbā'ī (d. 303/916), Abū Hāshim al-Jubbā'ī (d. 321/933), and their followers Qāḍī ‘Abd al-Jabbār (d. 415/1025), Abū Rashīd al-Nīsābūrī (d. first half of the 5./11. century), and Ibn Mattawayh (d. first half of the 5./11. century), the representatives of Baṣrian Mu‘tazila, who adopt atomic universe understanding. The study aimed to form an opinion about the theologians’ way of discussing a particular physical phenomenon to constitute a basis for solving metaphysical problems. To clarify the problem, first, it will deal with the essence of sounds in the Baṣrian Mu‘tazilites tradition, and then it will tackle the discussions about the formation of the sounds. (shrink)

Despite periods of resurgence over the last decades, it is safe to say that transcendental arguments no longer enjoy a prominent presence in the philosophical landscape. One reason for their declining prominence is the sustained suspicion that despite their self‐proclaimed metaphysical neutrality, transcendental arguments are, in fact, metaphysically committed. This paper aims to revive the discussion of transcendental considerations by offering a metaphysically neutral account of transcendental arguments. I argue that a metaphysically neutral conception of transcendental arguments requires a revision (...) of two concepts constitutive of transcendental claims, namely, transcendental necessity and the a priori. I propose a transcendental reading of Wittgenstein's On Certainty, which, I maintain, provides us with an alternative, metaphysically neutral understanding of these concepts. Thus revised, transcendental claims are suitable for what Mark Sacks once described as the “post‐metaphysical” orientation of contemporary philosophy. (shrink)

This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

Despite the significant amount of debate that Merleau-Ponty’s work has seen over the years, it remains an unresolved issue whether his phenomenology offers what he announces as a ‘new definition of the a priori’. In this paper, I make a case in favor of his claim by clarifying his commitments to the a priori against two dominant lines of interpretation, naturalist and Kantian. I argue that Merleau-Ponty’s view that the sciences themselves rely on the a priori method of Wesensschau establishes (...) his basic commitment to apriority. At the same time, Merleau-Ponty’s treatment of the a priori differs in important respects from the Kantian a priori and its transcendental idealist ramifications because, on his view, the subject is not the unique ground of constitution. Having tackled these obstacles to understanding Merleau-Ponty’s commitments to the a priori, I argue in light of his conception of ‘radical reflection’ that rather than being a static element of experience, the a priori stands in a dynamic relation with the a posteriori as a distinctive way of articulating structures of lived experience. Contemporary accounts of evil attempt to identify features or properties that transform an act of wrongdoing into an act of evil. What is missing from the discussion, however, is a phenomenology of evil that engages with the standpoint of the subject that undergoes evil. This paper discusses basic themes for a phenomenology of evil through a critical comparison between Hannah Arendt and Jean Améry’s respective conceptions of evil. Central for this discussion is a claim Arendt and Améry share: evil destroys (...) subjectivity and undermines trust in the world. Furthermore, both argue that the perpetrators of evil inhabit a distorted moral framework. They differ, however, insofar as Améry foregrounds the subject that undergoes evil, a standpoint that remains tacit in Arendt’s account. Recounting his torture by the Gestapo, Améry reveals how embodied subjects experiences evil and how it is in light of these experiences that perpetrators of evil should be understood. (shrink)

The present study on al-Dīn Suhrawardī's Ḥikmat al-Ishrāq, develops some preliminary explorations on his logic under the background of his remarkable epistemology of pis some witness of d resence. The paper paves the way for responding to the challenges of Tony Street on the compatibility of Suhrawardī's critique of Ibn Sīnā with the development of a temporal and modal syllogism that at first sight seems quite close to that of Ibn Sīnā. In fact, Suhrawardī's modalities are to be understood as (...) the different ways a predicate relates to its subject rather than as propositional operators. Accordingly, necessarily necessary modality relates actual instances (presences) of the Subject-Term with actual (presences) of the Predicate-Term; in contrast, necessarily contingent modality relates these terms conditionally, notably involving states of the Subject-Term within time intervals. Suhrawardī's main innovation, so we claim, is the explicit dialectical role presences or actual instances have in his modal-temporal logic, and particularly so in shaping his notion of contingency that admits both a generic and an individual or de re form of plenitude. In its origins Dialogical logic constituted the logical foundations of an overall new movement called the Erlangen School or Erlangen Constructivism that should provide a new start to a general theory of language and of science. In relation to the theory of language, according to the Erlangen-School, language is not just a fact that we discover, but a human cultural accomplishment whose construction reason can and should control. The constructive development of a scientific language was called the Orthosprache-project. Unfortunately, the (...) Orthosprache-project was not further developed and somehow seemed to fade away. Perhaps, one could say that one of the reasons is that the semantic links between dialogical logic, that was restricted to logical constants, and the more general linguistic aspirations of the Orthosprache were not sufficiently developed and then the new theory of meaning of dialogical logic seemed to be cut off from the project of setting the basis for a general theory of meaning.In the present paper we would like to contribute to precise one possible way in which a general dialogical theory of meaning could be linked to dialogical logic. More precisely, the main aim of the article is to set the basis for the meaning of elementary sentences in the context of dialogical interaction. (shrink)

Recent work on the development of a dialogical approach to the logic of fiction stresses the notion of existence as choice. Moreover, this approach to existence has been combined with the notion of ontolog-ical dependence as deployed by A. Thomasson’s artifactual theory of fiction. In order to implement such a combination within the dialogical frame several predicates of ontological dependence have been de-fined. However, the definition of such predicates seems to lean on a model-theoretic semantics for mod-al logic after all. (...) The main aim of the present paper is to set a dialogical frame for the study of fictions in the context of the dialogical approach of CTT recently developed by S. Rahman and N. Clerbout where a fully-interpreted language is unfolded. We will herewith develop the idea that in such a setting fiction-al entities are understood as hypothetical objects, that is, objects (functions) the existence of which is dependent upon one or more hypotheses that restrict the scope of choices available. We will finish the paper by suggesting that this provides both a natural and genuinely dialogical way to understand R. Frigg’s take on scientific models as fictions and a new perspective on Thomasson’s notion of generic ontological dependence. The main aim of the present paper is to show that the recently developed dialogical approach to Martin-Löf’s Constructive Type Theory, called Immanent Reasoning, provides the means for distinguishing François Recanati’s process of free enrichment and saturation, meets his own objections against perspectives based on unarticulated constituents and opens a new venue to pragmatic modulation, where the speaker-receiver interaction is integrated into the notion of enrichment. In such a setting enrichment operates on proof-objects that make fully articulated event-propositions true. The (...) point is that distinguishing what makes a proposition true from the proposition made true offers a simple and clean way to avoid conflating the contextual elements that enrich a proposition with the proposition itself. Such a framework abounds in means for expressing reference structures such as anaphora, including time and/or location reference. Furthermore, the notion of dependent types of CTT and the associated formation rules allow for a straightforward analysis of composition of meaning at work in Recanati’s cases concerning occasion meaning as determined by context. The brand of dialogical contextualism, grounded on the play-level, advocated herewith is not a form of propositional syncretism. The framework offers a straightforward response to the failure of third excluded in some instances of faultless disagreement without giving up the notion of propositional content. More generally, this suggests an alternative way to tackle the interface pragmatics semantics underlying the notion of pragmatic modulation by integrating into the interface the dialogical game of asking and giving reasons. Protecting women and children is one of the core values of the Islamic legal tradition. In Muslim countries religious, constitutional, and legal frameworks obligate the state to take special measures to provide protection to women and children within families and in society. However, despite such provisions, post-divorce maintenance rights are not granted to women in Pakistan and Iran. Family law enacted in Pakistan and Iran still differs in form and substance from what has been mentioned in the primary sources of (...) Islamic law and from the previous articulations of early Islamic law scholars. Moreover, patriarchal notions of male authority are still sustained through law and judicial interpretations when it comes to the question of giving post-divorce maintenance to women. As a result in the absence of a welfare system divorced women are left in a vulnerable situation. Although in Iran, some financial compensation under the concept of Ujrat ul Misl is given to divorced women, but it remains unclear whether the right to Mata’at-ul-Talaq has been recognised under the family law. In Pakistan the law does not include any provision for giving women Ujrat ul Misl and Mata’at- ul -Talaq. Moreover in the absence of a welfare system, divorced Muslim women in both countries are left in a vulnerable situation. This article engages with plural normative sources and contemporary notions of human rights to make the case for family law reform and for awarding post-divorce maintenance rights to Muslim women in Pakistan and Iran. In this paper we introduce dialogical games with the help of a new connexive If-Then (), the structural rules of which allow the Proponent to develop winning strategies not only for the above-mentioned connexive theses but also for ¬ and ¬. Further on, we developthe corresponding tableau systems and conclude with some remarks on possibleperspectives and consequences of the dialogical approach to connexivity including the loss of uniform substitution leading to a new concept of logical form. The difference between both is that a belief-proposition can be true if it is " factually " false: in our case the proposition can be true in relation to Gildas's belief, that is, despite the fact that there is no witch in his village. Furthermore, assuming that there is not witch in his village, the following proposition is false • Gildas knows that there is a witch in his village. Physically and intellectually, man is not the same as a million years ago. This “improvement” in humans has occurred over a period of time and not as a result of any outside biotechnical intervention. So, the question is what is the need now? The fine line between what can be done technically and what should be done morally is the reason for biomedical ethics. What is the nature of man, and what is his relationship with his creator and his environment? (...) Whose interest are we as scientists and physicians to guard? What are the rights of the unborn, and who protects those rights? While seeking medical treatment for infertility and reconstructive surgery for a malformation or genetic manipulation for a genetic disease might perhaps be appropriate and recommended, is it also appropriate to create a super healthy, super human with genetic manipulation? If so, then are we embarking on the path of ethnic cleansing of humans of lesser ability, and is it appropriate to discriminate? In this paper, such questions and concerns are discussed from an Islamic perspective. (shrink)

The failure of logical omniscience is perfectly compatible with deductive closure if we link the latter with the strategy level and the failure of logical omniscience with the play level.

Around the 1960's, C. Perelman / L. Olbrechts–Tyteca and S. Toulmin endorsed the separation between argumentation and logic. In fact, both assumed a gap between everyday reasoning, closer to legal reasoning, and scientific reasoning based on mathematics. The main claim was that both paradigms are incommensurable, since the legal paradigm makes use of the notion of formality, that has a procedural nature with roots on a conversational and dialectical practice, and logic is based on the notion of form, that involves (...) static (and syntactic) features. I will contest the incommensurability of both paradigms, as J. van Benthem (2009) did already, and plea that what we need is more rather than less logic. There are no juridical solutions to logical problems, if the problem is related to reasoning, then the solution relates to inferences drawn on the basis of juridical knowledge. (shrink)

This study aims to examine the underlying mechanism of the relationship between perceived green human resource management and perceived employee green behavior. By drawing on attitude and social exchange theories, we examined green commitment as a mediator and green knowledge sharing as a moderator of the GHRM–EGB relationship. The study employs partial least square structural equation modeling to analyze 329 responses. Data were collected in two time lags. The empirical results confirmed that GC mediates the relationship between GHRM and EGB. (...) However, the study results found that GKS moderated the indirect influence of GHRM on green behavior via GC. This research signifies the effect of GHRM, GKS, GC, and green behavior on organizations’ sustainability and environmental management. Despite the emerging literature on the significance of green practices in organizations for environmental management, no study has examined the moderating role of GKS on the indirect effect of GHRM on green behavior via mediating role of GC. This study offers valuable insight into environmental management in organizations through green practices and green behavior. (shrink)
