The experience of having to suffer debilitating pain is far too common in the United States, and many patients continue to be inadequately treated by their doctors. Although many physicians freely admit that their pain management practices may have been somewhat lacking, many more express concern that the prescribing of heightened levels of opioid analgesics may result in closer regulatory scrutiny, criminal investigation, or even criminal prosecution.Although several researchers have examined the regulatory environment and the threat of sanction or harm (...) it poses to physicians and patients, few have examined the likelihood of investigation or prosecution stemming from the aggressive use of opioids in physician-directed pain management. Accordingly, in an effort to assess whether the fear of prosecution is realistic and, if so, what factors contribute to its likelihood, we surveyed chief prosecutors in four states about their knowledge, opinions, and attitudes concerning opioids and the prosecution of physicians stemming from the treatment of patients who were either terminally ill or suffering from chronic noncancer pain. I. The Conscious Mind is a hugely likable book. Perceptive, candid, and instructive page by page, the work as a whole sets out a large and uplifting vision with cheeringly un-Dover-Beach-ish implications for “our place in the universe.” A book that you can’t helping wanting to believe as much as you can’t help wanting to believe this one doesn’t come along every day. It is with real regret that I proceed to the story of why belief would not come.

Knowledge is closed under implication, according to standard theories. Orthodoxy can allow, though, that apparent counterexamples to closure exist, much as Kripkeans recognize the existence of illusions of possibility which they seek to explain away. Should not everyone, orthodox or not, want to make sense of “intimations of openness”? This paper compares two styles of explanation: evidence that boosts P’s probability need not boost that of its consequence Q; evidence bearing on P’s subject matter may not bear on the subject (...) matter of Q. Part/whole is said in many ways: the leg is part of the table, the subset is part of the set, rectangularity is part of squareness, and so on. Do the various flavors of part/whole have anything in common? They may be partial orders, but so are lots of non-mereological relations. I propose an “upward difference transmission” principle: x is part of y if and only if x cannot change in specified respects while y stays the same in those respects.

This paper explains how the notion of justification transmission can be used to ground a notion of knowledge transmission. It then explains how transmission theories can characterise schoolteacher cases, which have prominently been presented as counterexamples to transmission theories.

Jonathan Edwards identified the central act of faith as ‘the cordial consent of beings to Being in general’, which is to say to God (see Holbrook, 1973, pp. 102ff). That equation, of Being, Truth and God, is rarely taken seriously in analytical circles. My argument will be that this is to neglect the real context of a great deal of past philosophy, particularly the very Cartesian arguments from which so many undergraduate courses begin. All too many students issue from such (...) courses immunized against enthusiasm, in the conceit that they have answers to all the old conundrums, which were in any case no more than verbal trickery. ‘By uttering the right words but failing to use themin propria persona, philosophy induces a kind of soporific amnesia bewitching us into forgetting our God-given task. That task is, of course, to do what Socrates did and to live as he lived' (Burrell, 1972, p. 4). Burrell's words are not wholly fair to academic philosophers, nor to the Lady Philosophy. Plenty of philosophers really mind about the truth, and want to be Socratic in pursuit of it. But the danger is a real one. If all that matters is debunking past philosophers, how does that differ from the repeated refutation of the Chaldaean Oracles or the Prophecies of Nostradamus? A pretty enough pastime for the young, but hardly serious business for adults (as Callicles remarks: Plato,Gorgias484 c 5ff). ‘If the history of philosophy is a process of ‘salvaging’ what you yourself have already thought, then why bother?’ (MacDonald Ross, 1985, p. 502). Life, the universe, and everything -- Thinking robots and mysterious minds -- The good, the bad, and the ugly -- Is seeing believing?

This article examines the development of the concept of the value chain from the linear to the virtual conception of the chain, through the evolution of the literature from Michael Porter’s writings of the mid 1990s to the theorists of e-business and e-commerce in the later 1990s I argue that Porter’s account employs white metaphors and that writings on the virtual value chain both extend the white metaphors of Porter’s linear chain, and suggest a pronouncedly metaphysical system of thought — (...) one which has correlates in areas of thought, including Renaissance Neo-Platonism, cybernetics and the discourse of cyberspace. I suggest that this offers a model of the advance of metaphor — of its usure, as described by Derrida in his White Mythology — and that this model can be synthesised with the views of Ricoeur about the evolution of metaphor towards symbolism. When we apply these ideas of Derrida and Ricoeur to the development of the White Metaphor of the linear chain towards a progressive symbolism, we can see a correlation between the complex causality inferred as a feature of the virtual chain and the cosmological affinities of Renaissance notions of causation. In light of many recent critiques of Western modernity and its conceptual foundations, the problem of adequately justifying our most basic moral and political values looms large. Without recourse to traditional ontological or metaphysical foundations, how can one affirm — or sustain — a commitment to fundamentals? The answer, according to Stephen White, lies in a turn to “weak” ontology, an approach that allows for ultimate commitments but at the same time acknowledges their historical, contestable character. According to some theories of testimonial knowledge, testimony can allow you, as a knowing speaker, to transmit your knowledge to me. A question in the epistemology of testimony concerns whether or not the acquisition of testimonial knowledge depends on the speaker's testimony being sincere. In this paper, I outline two notions of sincerity and argue that, construed in a certain way, transmission theorists should endorse the claim that the acquisition of testimonial knowledge requires sincerity.

Ernest Sosa has recently argued that the knowledge we get from instruments and the knowledge we get from testimony is similar in important ways. Most importantly, the justification that supports it is similar in kind – both instrumental justification and justification from testimony is to be understood in terms of reliability. I argue that Sosa’s theory is problematic. Specifically, I argue that we can take certain attitudes towards people that we cannot coherently take towards instruments. This, I argue, grounds a (...) distinction between the kind of justification that testimony can make available and the kind of justification that instruments can make available. The result is that reliability cannot provide a complete explanation of the justification that testimony makes available. (shrink)

S contains T iff T is implied by S, and T’s ways of being true are implied by (...) ways for S to be true ; this kind of way-implication is the same as subject matter inclusion. In a recent issue of this journal, Berit Brogaard and Joe Salerno presented a counterfactual theory of essence, designed to get around Kit Fine’s influential objections to the standard modal account of essence. I argue that Brogaard and Salerno’s theory does not avoid Fine’s objections. Then I propose a sequence of variations on their theory, and argue that none of them succeed either.

The concept of "practices"—whether of representation, of political or scientific traditions, or of organizational culture—is central to social theory. In this book, Stephen Turner presents the first analysis and critique of the idea of practice as it has developed in the various theoretical traditions of the social sciences and the humanities. Understood broadly as a tacit understanding "shared" by a group, the concept of a practice has a fatal difficulty, Turner argues: there is no plausible mechanism by which a (...) "practice" is transmitted or reproduced. The historical uses of the concept, from Durkheim to Kripke's version of Wittgenstein, provide examples of the contortions that thinkers have been forced into by this problem, and show the ultimate implausibility of the idea. Turner's conclusion sketches a picture of what happens when we do without the notion of a shared practice, and how this bears on social theory and philosophy. It explains why social theory cannot get beyond the stage of constructing fuzzy analogies, and why the standard constructions of the contemporary philosophical problem of relativism depend upon this defective notion. Yarbrough Department of English The University of North Carolina at Greensboro What are the conditions of discursive competence? In "A Nice Derangement of Epitaphs" Donald Davidson explains how it is possible that in practice we can, with little effort, understand and appropriately (...) respond to linguistic anomalies such as the malapropism—anomalies because, by definition, the "language" cannot account for how we understand them. Such anomalies, Davidson concludes, are the exceptions that do not prove but refute the traditional rule that antecedent linguistic systems govern discursive meaning. If that is so, then meanings are not a property of a linguistic system and are not "governed by learned conventions or regularities" (1986, 436); therefore, learning and sharing such conventions, what we traditionally call "language," is not a necessary condition of successful communication. He shows this by arguing that two conditions must be met for successful interlocution and that meeting these sufficiently allows successful interlocution to take place. A third condition—that the interlocutors share a language, an organized set of learned conventions or regularities "learned in advance of occasions of interpretation" (436) for which phenomena such as malapropisms would be anomalous—is neither a necessary nor sufficient condition of discursive competence.What I hope to show in this paper is that the two conditions Davidson argues interlocution must meet in order to succeed both involve the interlocutor's implicit knowledge of what since Aristotle the rhetorical tradition has called topical heuristics. [End Page 72] Inferential method Davidson argues that the first condition necessary for successful interlocution is that "the interpreter can learn the semantic role of each of a finite number of words or phrases and can learn the semantic consequences of a finite number of modes of expression" (1986, 437). "For this to be possible," says Davidson, "there must be systematic relations between the meanings of utterances" (436). Here he is not talking about grammatical systems but about systematic relations between and among the interlocutors' discursive actions and the world with its objects to which their actions refer. As I'll explain more fully shortly, these are topical relations. What makes these relations possible, Davidson argues, is that the interlocutors share, not a set of learned conventions, but a "recursive characterization of the truth conditions of all possible utterances of the speaker" (437).Such a theory of truth can be something like a Tarski truth definition, the explanation of which can be extremely convoluted (see Davidson 1984), but it boils down to saying that an utterance is true if the anticipations raised by a belief in an interpreted utterance are met by the consequences of believing the utterance; or, to put it another way, if the utterance is an answer to the question that solicited it or a solution to the problem to which it responds. His one-time follower William Whiston attributed his policy of silence to simple, human fear and there must be some truth in this. Every day as a public figure and as the figurehead of British natural philosophy, Newton must have felt the tension of outwardly conforming to the Anglican Church, while inwardly denying much of its faith and practice. He was restricted by heresy laws, religious tests and the formidable opposition of public opinion. Heretics were seen as religiously subversive, socially dangerous and even morally debased. Moreover, the positions he enjoyed were dependent on public manifestations of religious and social orderliness. Sir Isaac had a lot to lose.
