Moral distress has received much attention in the international nursing literature in recent years. In this article, we describe the evolution of the concept of moral distress among nursing theorists from its initial delineation by the philosopher Jameton to its subsequent deployment as an umbrella concept describing the impact of moral constraints on health professionals and the patients for whom they care. The article raises worries about the way in which the concept of moral distress has been portrayed in some (...) nursing research and expresses concern about the fact that research, so far, has been largely confined to determining the prevalence of experiences of moral distress among nurses. We conclude by proposing a reconsideration, possible reconstruction and multidisciplinary approach to understanding the experiences of all health professionals who have to make difficult moral judgements and decisions in complex situations. The themes of the conscious and nonconscious aspects of the mind and their interplay in healthy and psychopathological human functioning are highlighted, with the development and maintenance of self-esteem as the centerpiece of this schema. ABSTRACT:Corporate social responsibility has been hailed as a new means to address gender inequality, particularly by facilitating women’s empowerment. Women are frequently and forcefully positioned as saviours of economies or communities and proponents of sustainability. Using vignettes drawn from a CSR women’s empowerment programme in Ghana, this conceptual article explores unexpected programme outcomes enacted by women managers and farmers. It is argued that a feminist Foucauldian reading of power as relational and productive can help explain this since those involved are (...) engaged in ongoing processes of resistance and self-making. This raises questions about the assumptions made about women and what is it that such CSR programmes aim to empower them ‘from’ or ‘to.’ Empowerment, when viewed as an ethic of care for the self, is better understood as a self-directed process, rather than a corporate-led strategy. This has implications for how we can imagine the achievement of gender equality through CSR. (shrink)

This article offers a series of criticisms of each of these claims, and use them to construct an alternative theory of liability in which the nature of X's having imposed a risk of harm on Y is central to the question of when X is liable to Y, and for how (...) much. This article investigates the use of favors by managers of BRIC firms to accomplish business goals, the ethicality of which should be determined by the moral reasoning in these countries rather than from a developed country perspective. We define a favor as an exchange of outcomes between individuals, typically utilizing one's connections, that is based on a commonly understood cultural tradition, with reciprocity by the receiver typically not being immediate, and its value being less than what would constitute bribery within (...) that cultural context. This exchange normally takes place between and among members of networks, and may involve a network outsider contacted by a network insider on behalf of another insider. We see the giver and receiver of the favor, as well as network insiders and outsiders, as stakeholders. Additionally, society could also be considered to be a stakeholder since the practice of using favors generally inhibits the development of legitimate, strong formal institutions, since the use of favors in emerging economies is rooted in cultural traditions that we view as informal institutions. Furthermore, we assert that the practice of using favors can lead to bribery which harms society as a stakeholder both morally and economically. We posit that BRIC-country managers' behaviors stem from informal, culturally based practices—jeito in Brazil, blat/sviazi in Russia, jaan-pehchaan in India, and guanxi in China. We utilize institutional theory to explain why favors are relied upon, and ISCT to support the argument that the use of favors in environments like the BRICs is generally considered ethical. We focus on the literature about UBI and the experiments developed all around the world to test it in order to address how UBI implementation could affect entrepreneurship. Building on these findings and various strands of entrepreneurial theory, we develop a theoretical framework to explain how the implementation of UBI would dramatically change the environment of entrepreneurial activity, shaping entrepreneurial action at three levels: (i) the desirability of becoming an entrepreneur; (ii) the perceived feasibility of becoming an entrepreneur; (iii) the (...) propensity to act. Consequently, UBI implementation would arguably facilitate the decision to become an entrepreneur. The contribution of the paper is threefold. It firstly provides a theoretical framework that opens new directions for further research on the relationship between UBI and entrepreneurship. Secondly, it offers new insights for policy makers by shedding light on potential effects of UBI implementation. Finally, it raises further questions that remains unsolved related to the role of non-pecuniary motivations and financial constraints. (shrink)

Let us sum up. We began with the question, “What is the interest of a model-theoretic definition of validity?” Model theoretic validity consists in truth under all reinterpretations of non-logical constants. In this paper, we have described for each necessity concept a corresponding modal invariance property. Exemplification of that property by the logical constants of a language leads to an explanation of the necessity, in the corresponding sense, of its valid sentences. I have fixed upon the epistemic modalities in characterizing (...) the logical constants: to be a logical constant in the language of a population is to be invariant over a modality describing complete possible epistemic states of that population (or an idealized analogue thereof). The grounds for this characterization are these: (1) It leads, I believe, to an extensionally reasonable demarcation of the logical constants, including clear cases and excluding clear non-cases. It gives a principled criterion for deciding unclear cases. (2) It provides an analysis of the topic-neutrality of logic. (3) It leads to an explanation of the epistemic necessity of the logical truths in terms of the topic-neutrality of the logical constants.All the same, it is reasonable to ask, even if the suggested demarcation of logic is extensionally correct, whether it can reasonably be expected to be fundamental. The epistemic invariance of an expression is a rather striking property, one which we should want to explain. What is missing, then, is an explanation of the distinguishing epistemic properties of the constants in terms of more fundamental properties involving their understanding and use. It would be these that properly define the nature, not just the extent, of logic. (shrink)

The axis of this epistemological rupture is the disarticulation of the sex/gender and nature/culture binary structures, which dislocate the alignment of body-gender-desire and the classic bios/zoé opposition, fundamental bases of the political and symbolic orders of the West. The changes brought about in Poland and elsewhere in Europe by the fall of Communism have given rise to hopes for the establishment of a political system differing from the one which had been the fate of these countries. In place of totalitarianism, a new political system is to be created based on the democratic principles of a state under the rule of law. The transformation from totalitarianism to democracy is a process which has not yet been completed in Poland (...) and still requires many efforts to be made before this goal may be achieved. One may also enumerate various pitfalls jeopardising this process even now. The dangers cannot be avoided if their sources and nature are not identified. Attempts to pervert the law and the political system may only be counteracted by legal means if the system based on the abuse of the law has not yet succeeded in establishing itself. Resistance by means of the law only has any real chance of success provided it is directed against attempts to set up a totalitarian system. Once the powers which are hostile to the state bound by the rule of law take over the institutions of the state, such resistance is doomed to failure. (shrink)

Here's the article which was a 1964 Stanford AI Memo. After the original memo, several people offered different proofs of the theorem including Shmuel Winograd, Marvin Minsky and Dimitri Stefanyuk - none published, to my knowledge. Winograd claimed that his proof was non-creative, because it didn't use an extraneous idea like the colors of the squares. This set off a contest to see who could produce the most non-creative proof. Minsky's idea was to start with the diagonal next to an (...) excluded corner ssquare, note that 2 dominoes had to project from it to the diagonal with three squares, and from there 1 domino to the four square diagonal, etc. Coming from the other end also leaves only six of the eight squares in the long diagonal covered. Minsky's proof gets high points for non-creativity, because it is specific to the 8 by 8 board. (Using the colors it is easy to show that a Minsky style proof will work for any even sized board.). Nel Noddings claims that there is an important normative element in happiness. For support, she points to the Aristotelian idea of the eudaimonic life, a concept that is often translated into English as ‘the happy life’. However, in light of the wide divergence between the Aristotelian view of eudaimonia as a life of virtuous activity and most contemporary psychologists’ and lay people’s view of happiness as subjective wellbeing, the authors of this article believe that Noddings’s merging of the two has (...) several shortcomings. Aside from ambiguity and confusion, it encourages us to deny that, given the human condition, we must sometimes choose between happiness as pursuit of positive emotion and personal satisfaction and happiness as pursuit of the common good and the virtuous life. Dewey's theory of happiness goes against the grain of much contemporary psychologic and popular thought by identifying the highest form of human happiness with moral behavior. Such happiness, according to Dewey, avoids being at the mercy of circumstances because it is independent of the pleasures and successes we take from experience and, instead, is dependent upon the disposition we bring to experience. It accompanies a disposition characterized by an abiding interest in objects in which all can share, one founded upon (...) a dynamic inner harmony and evolving adjustment to the world. The marks of such an expansive disposition are "stability of character, braveness of soul, and equanimity of soul," and the key to the development of these traits is what Dewey calls "ethical love." In decision theoretic terms, it satisfies the central expected utility axiom of strong independence. We consider when a mixture preorder has a multi-representation that consists of real-valued, mixture-preserving functions. If it does, it must satisfy the mixture continuity axiom of Herstein and Milnor (1953). Mixture continuity is sufficient for a mixture-preserving multi-representation when the dimension of the mixture space (...) is countable, but not when it is uncountable. Our strongest positive result is that mixture continuity is sufficient in conjunction with a novel axiom we call countable domination, which constrains the order complexity of the mixture preorder in terms of its Archimedean structure. We also consider what happens when the mixture space is given its natural weak topology. Continuity (having closed upper and lower sets) and closedness (having a closed graph) are stronger than mixture continuity. We show that continuity is necessary but not sufficient for a mixture preorder to have a mixture-preserving multi-representation. Closedness is also necessary; we leave it as an open question whether it is sufficient. We end with results concerning the existence of mixture-preserving multi-representations that consist entirely of strictly increasing functions, and a uniqueness result. (shrink)

The Republic of Ireland has some of the most restrictive abortion legislation in the world which grants to the ‘unborn’ an equal right to life to that of the pregnant woman. This article outlines recent developments in the public discourse on abortion in Ireland and explains the particular cultural and religious context that informs the ethical case for access to abortion services. Our perspective rests on respect for two very familiar moral principles – autonomy and justice – which are at (...) the centre of social and democratic societies around the world. This article explains the context for the deployment of these concepts in order to support the claim that the current legislation and its operationalisation in clinical practice poses serious risks to the health, lives and well-being of pregnant women, tramples on their autonomy rights and requires of them a self-sacrifice that is unreasonable and unjust. The relation of theory to practice has been a persistent concern of Marxist thought, so much so, in fact, that this type of acute self-consciousness might be regarded as one of its constitutive features. Thus in his introduction to the 1971 edition of Theory and Practice, Jürgen Habermas offers the following characterization of critical theory:The theory specifies the conditions under which a self-reflection of the species has become objectively possible. This essay dwells in the interstitial space between human and nonhuman species attributions to consider the dense political and theoretical activity that the domain capacitates. It begins by discussing the bifurcated funding work of the Arcus Foundation – LGBT rights and great ape conservation – as a means of examining how currently prevailing species divisions that putatively work through expansive notions of embodiment in actuality deploy the same logics present in colonial schemes of bodily division. It then relatedly considers an (...) intimate transspecies relationship between a human, Sandra Herold, and a chimpanzee, Travis, which ended tragically. The essay then puts the concepts of trans* and animacy into productive tension to explore how life and liveness become contingently associated with certain bodies through shifting processes of racial and sexual division. Building from these conceptual framings, it preliminarily introduces a new analytic tool, trans*plant, to facilitate more comprehensive analyses of how bodies move across media, and what those movements facilitate in terms of reproducing or disrupting embodiment categories that rely on naturalized understandings of bodily difference.
