In this article I intend to show that the inference problem, one of the main objections raised against the anti-Humean theory of natural laws defended by Dretske, Tooley and Armstrong (?DTA theory? for short), can be successfully answered. First, I argue that a proper solution should meet two essential requirements that the proposals made by the DTA theorists do not satisfy. Then I state a solution to the inference problem that assumes a local immanentistic view of universals, a partial definition (...) of the nomic necessitation relation as a relation of existential dependence, and a principle constraining multiple occupancy. I also argue that my solution meets the two requirements. Finally, I deal with non-standard laws such as exclusion laws, causal laws and laws involving spatiotemporal parameters. (shrink)

There are many commonalities between the goals of transitional justice and domestic redress movements. We look at the movement for reparations for enslavement and Jim Crow in the United States as an example of a domestic reparations movement, and argue for the usefulness of the concept of transitional justice. We are particularly interested in showing that a future democratic transition – the end of mass incarceration – could animate a renewed push for reparations and a formal investigation into America’s legacy (...) of racial injustice. I provide an argument from consciousness for God’s existence. I first consider a version of the argument which is ultimately difficult to evaluate. I then consider a stronger argument, on which consciousness, given our worldly laws of nature, is rather substantial evidence for God’s existence. It is this latter argument the paper largely focuses on, both in setting it out and defending it from various objections.

Probabilities in quantum theory are traditionally given by Born’s rule as the expectation values of projection operators. Here it is shown that Born’s rule is insufficient in universes so large that they contain identical multiple copies of observers, because one does not have definite projection operators to apply. Possible replacements for Born’s rule include using the expectation value of various operators that are not projection operators, or using vari-.

Exploro una lectura diferente que evita una dicotomía tajante entre las razones prudenciales y las razones morales y subraya en cambio la discontinuidad entre la normatividad subjetiva de la ley natural y la normatividad objetiva de la ley positiva. Sostengo que el contrato de sujeción política establece obligaciones objetivas recién cuando el soberano exige el cumplimiento de los contratos. La obligación política es entonces (...) una forma de obligación jurídica. Además, enfatizo que la comunidad moral de Hobbes solo es posible dentro del Estado. In this paper, I criticize Luciano Venezia's moralized interpretation of the Hobbesian concept of political obligation. I explore a different reading that avoids a clear-cut dichotomy between prudential and moral reasons and underscores instead the discontinuity between natural law's subjective normativity and civil law's objective normativity. I contend that the pact of political subjection establishes objective obligations only when the sovereign requires the fulfillment of contracts. Political obligation is then a form of legal obligation. In addition, I emphasize that Hobbes's moral community is only possible within the State. (shrink)

Alasia Nuti’s important recent book, Injustice and the Reproduction of History: Structural Inequalities, Gender and Redress, makes many persuasive interventions. Nuti shows how structural injustice theory is enriched by being explicitly historical; in theorizing historical-structural injustice, she lays bare the mechanisms of how the injustices of history reproduce themselves. For Nuti, historical-structural patterns are not only shaped by habitual behaviors that are or appear to be morally permissible, but also by individual wrongdoing and wrongdoing by powerful group agents like states. (...) In this article, I extend Nuti’s rich analysis, focusing on two questions that arise from her theory of historical-structural injustice: Beyond being blameworthy for wrongful acts themselves, are culpable wrongdoers blameworthy for contributing to structural injustice? Does historical moral ignorance mitigate moral responsibility for past injustice? Regarding, I distinguish between the local and societal structural effects of wrongdoing. Though I think this distinction is well-founded, it ultimately leads to tensions with structural injustice theory’s idea of ordinary individuals being blameless for reproducing unjust structures. Regarding, I argue that even though it is natural for the question of historical moral ignorance to arise in considering past wrongdoing, at least in the case of powerful group agents, we should not overlook forms of cruelty which present-day moral concepts are not needed to condemn. My students sometimes worry that if eternalism is true then they can’t have libertarian freedom. They aren’t alone, as this sentiment is also expressed, albeit typically briefly, by various philosophers. However, somewhat surprisingly, those working within the free will literature have largely had nothing to say about libertarianism’s relationship to time, with this also being similar in the case of those working in the philosophy of time, apart from some work which has mainly focused on nonlibertarian views of freedom. In (...) this short paper I note why I’m currently unconvinced that there’s an incompatibility between eternalism and libertarianism, and in doing so one will see why I think they are compatible. This paper provides an account of how virtue epistemology can accommodate knowledge acquired through testimony and extended cognition. Section 1 articulates the characteristic claim of virtue epistemology, and introduces the issues discussed in the paper. Section 2 details a related pair of objections to VE: that it is unable to accommodate cases of knowledge through testimony and extended cognition. Section 3 reviews two different virtue epistemologies and their responses to these objections presented in Greco :1–26, 2012). Considerations are presented for (...) why both of these accounts and responses are inadequate. Because of this, I suggest that it is unlikely that an analysis of the attribution relation will provide an adequate response to the objections. Section 4 advocates for a revised VE and a different way of dealing with the objections, which accommodates how agents are sometimes epistemically dependent on external sources. The central claim, for which a novel argument is presented, is that in some cases of knowledge the success is attributable to the abilities of an information system of which the knower is a part. This requires an important revision to traditional VE, but the characteristic claim of VE still holds true–every instance of knowledge is an instance of success attributable to ability. Thus, VE’s solutions to problems concerning the nature and value of knowledge are secured. (shrink)

BackgroundPersonal health information and biospecimens are valuable research resources essential for the advancement of medicine and protected by national standards and provincial statutes. Research ethics and privacy standards attempt to balance individual interests with societal interests. However these standards may not reflect public opinion or preferences. The purpose of this study was to assess the opinions and preferences of patients with kidney disease about the use of their health information and biospecimens for medical research.MethodsA 45-item survey was distributed to a (...) convenience sample of patients at an outpatient clinic in a large urban centre. The survey briefly addressed sociodemographic and illness characteristics. Opinions were sought on the research use of health information and biospecimens including consent preferences.ResultsTwo hundred eleven of 400 distributed surveys were completed. Respondents were generally supportive of medical research and trusting of researchers. Many respondents supported the use of their information and biospecimens for health research and also preferred consent be sought for use of health information and biospecimens. Some supported the use of their information and biospecimens for research without consent. There were significant differences in the opinions people offered regarding the research use of biospecimens compared to health information. Some respondent perspectives about consent were at odds with current regulatory and legal standards.ConclusionsClinical health data and biospecimens are valuable research resources, critical to the advancement of medicine. Use of these data for research requires balancing respect for individual autonomy, privacy and the societal interest in the greater good. Incongruence between some respondent perspectives and the regulatory standards suggest both a need for public education and review of legislation to increase understanding and ensure the public’s trust is maintained. There is an objection to divine timelessness which claims that timelessness shouldn’t be adopted since on this view evil is never “destroyed,” “vanquished,” “eradicated” or defeated. By contrast, some divine temporalists think that presentism is the key that allows evil to be destroyed/vanquished/eradicated/defeated. However, since presentism is often considered to be inconsistent with timelessness, it is thought that the presentist solution is not available for defenders of timelessness. In this paper I first show how divine timelessness is consistent with a (...) presentist view of time and then how defenders of Presentist-Timelessness can adopt the presentist solution to the removal of evil. After this, I conclude the paper by showing that it’s far from clear that the presentist solution is successful and that unless one weakens what is meant by the destruction/vanquishing/eradication/defeat of evil, one can only make the presentist solution work by adopting a number of additional assumptions that many will find unattractive. Brian Leftow has argued in significant detail for a timeless conception of God. However, his work has been interacted with less than one might expect, especially given that some have contended that divine timelessness should be put to death and buried. Further, the work that has critically interacted with Leftow does a very poor job at discrediting it, or so I will contend. As we shall see, the main reason for this is either because what is central to Leftow’s view (...) is not affected by the objection, or because Leftow provides another way of getting his theory off the ground. Why, then, do so many objections miss the mark? I suspect it’s because many struggle to understand Leftow’s view and what is central to it. As such, one of the main goals of this paper will be to make Leftow’s account more accessible and to elucidate the main elements of the theory, whilst also providing responses to the main objections raised against his view. The overall result of this, I hope, will be a more fruitful examination of Leftow’s view in the future. (shrink)

Drawing on the work of Charles W. Mills and considering the case of reparations to Black Americans, this article defends the “structural turn” in the philosophical reparations scholarship. In the Black American context, the structural turn highlights the structural and institutional operations of a White supremacist political system and a long chronology of state-sponsored injustice, as opposed to enslavement as a standalone historical episode. Here, the question whether distributive justice is more appropriate than reparative justice is particularly pressing, since structural (...) racial inequalities form part of the basis for reparations. Derrick Darby’s pragmatic argument for non-race-specific redistributive policies and Tommie Shelby’s principled defense of distributive justice are both considered, as well as the challenge to the structural turn that comes from Carlton Waterhouse’s argument for reparations for enslavement rather than “legacy of slavery” reparations. A simple proof is given that the probabilities of observations in a large universe are not given directly by Born’s rule as the expectation values of projection operators in a global quantum state of the entire universe. An alternative procedure is proposed for constructing an averaged density matrix for a random small region of the universe and then calculating observational probabilities indirectly by Born’s rule as conditional probabilities, conditioned upon the existence of an observation.

I will consider Armstrong's problems in trying to account for structural universals, i.e., a kind of complex universal whose instantiation by particulars involves different parts of those particulars instantiating several basic properties and relations, such as the property of being a molecule of methane. I present and criticise Armstrong's most recent attempt to explain structural properties by means of the identification of universals with types of states of affairs and I state my own solution to the problem by appealing to (...) formal relations holding between particulars. Jc Beall offers a novel resolution to worries about Christ’s contradictory nature by introducing an account of logical consequence that allows for true contradictions. However, to prevent his view from exploding into heresy, Beall must deny that conditionals detach. But without detachment, the language fails to capture other true entailments which must be included in a complete account of Christ. Beall faces a dilemma, then, between heresy and inadequacy.

ON A GENERAL READING of the Metaphysics and the treatises of the so-called Organon, the types of assertion which Aristotle would allow as genuine predications seem relatively straightforward. According to the Categories, for instance, a species is characteristically predicated of the individuals falling under it, while genera and differentiae are predicated both of the relevant species and their associated individuals. The predicates are, in these instances, universals in a familiar Aristotelian sense. Furthermore, these intra-categorial predications, such as "Socrates is a (...) man" and "white is a color," are not the only instances of categorial acts. Aristotle also admits certain cross-categorial predications as logically well-formed; for example, "Socrates is white" and "Socrates is in the marketplace". These latter predications are at first glance also intelligible enough, though there are in both cases questions yet to be faced about the logical structure and ontological commitments of such ways of speaking. For Aristotle, one metaphysical theme presented even on the face of these linguistic appearances is the possibility that being a substrate for predication counts as a criterion for ontological primacy or, more generally, that being an ultimate substrate for meaningful discourse is grounds for being primarily real. An obvious corollary to this line of thought is the thesis that whatever might be said of or predicated of such primary substrata is ontologically dependent upon them. Just such a criterion seems to be at work in disqualifying universals from their claim to be substance in a significant sense. Therefore, it would be somewhat surprising to find primary substance appearing anywhere as a predicate. (shrink)

The Euthyphro objection is often perceived, rightly or wrongly, as the king objection to theistic meta-ethics. This paper proposes a response that hasn’t been much explored within the contemporary literature, based on the metaphysics of dispositions and natural law theory. The paper will first contend that there is a parallel between ways theists conceptualise God’s role in creating laws of nature and the ways God creates goods. Drawing upon these parallels I propose a possible response to the dilemma, where this (...) response parallels the dispositionalist response as to how God creates laws of nature. I do this by first explicating a natural law theory of goodness, then suggesting how the ontology of dispositions can be used in a novel way to account for goods, and finally by explaining how all this relates to the dilemma. I conclude the paper by posing some objections to myself and providing some replies. (shrink)

A person can appropriately manifest respect toward a world heritage ruin by developing a sensitive understanding of the ruin’s cultural and historical context and significance. In this paper, we link such respectful understanding to the question of the aesthetic appreciation of world heritage ruins. Our claim is that an aesthetic appreciation of a world heritage ruin qua world heritage ruin typically involves two things: first, the responsibility not to neglect the individuality of the object, and, second, a commitment to the (...) idea that it is the object—respectfully conceived—which must be the focus of our appreciation. Seunghyun Song’s recent article on epistemic repair for Japan’s military sex slavery lays out the case for considering acknowledgment as a form of reparative justice particularly suited to redressing epistemic wrongs. I agree with Song, but press her on the relationship between epistemic repair and reparative justice more generally. I also outline other forms that backward-looking epistemic responsibility might take. Distinguishing between revisionism and denialism, I ask: Should individual agents who’ve publicly made denialist statements about Japan’s military sex slavery be (...) criminally liable? Should their revisionist counterparts be subject to the kind of social sanctions that are associated with present-day cancel culture? (shrink)
