Diego, is one of the many productive seventeenth-century Franciscan authors whose works are not habitually discussed within the world of Franciscan scholarship. According to the existing bibliographical guides, Sinistrari authored under his own name (...) and under various pseudonyms (such as Panfilo, Clodoveo Farvamondi, Nicolò Turris, Lazaro Socio, and Lazaro Agostino Cotta) about 34 works, more or less half of which reached the printing press during his lifetime. These works cover a wide range of genres and topics, including comedies, religious and secular dramas, astrological, astronomical and scientific works (including polemics against works of other scholars, medical and embryological papers), defenses of the religious orders, sermons and funerary orations, treatises of sacramental theology, some atypical hagiographical texts, and works of religious disciplinary law. This production was linked to his acknowledged expertise in a variety of disciplines, which apparently made him a celebrated lecturer in Pavia within the order and in public schools, teaching the liberal arts, geometry, military architecture and theology. Some of his works are connected with his activities as a preacher, advisor, and later censor for the Holy Office, practicing exorcist, consultant for the Franciscan Minister General, and personal theologian of Alessandro Montecatini (Archbishop of Avignon) and Federico Caccia (Cardinal and Archbishop of Milan).1Within the order itself, his most enduring legacy might have been his three volume Practica criminalis illustrata, a work that is both a commentary on penal law within the Franciscan order, and a more wide-ranging manual for dealing with penitential and religious-criminal issues, written [End Page 191] to supplant older handbooks of such kind. He was initially tasked to compile such materials at the Franciscan general chapter celebrated at Rome in 1688. The first two volumes of the Practica criminalis illustrata appeared in print in 1693. They were again published posthumously in 1702.2 In between he finished another volume of the Practica with a somewhat different focus, also known under the title De delictis et poenis tractatus absolutissimus, and which was proposed as a useful guidebook for judges, lawyers, and prelates in ecclesiastical courts, as well as for confessors, exorcists, and lay practitioners of law. This work was issued for the first time in 1700.3Although a wished-for early eighteenth-century re-issue of this multi-volume Practica criminalis illustrata was put on hold when it was placed on the index of forbidden books in March 1709 donec corrigatur for suspicion of laxist tendencies,4 all three volumes did appear again with some modifications in a 1753-1754 opera omnia edition. The Venezuelan poet and philosopher Ludovico Silva argues that much of the confusion around Marx's work results from a failure to understand his mode of expression. Through meticulous readings of key passages in Marx's oeuvre, Silva isolates the central elements of his style: the search for an architectonic unity at the level of the text, his capacity to express himself dialectically at the level of the sentence, and, above all, his great gift for metaphor.

How and to what extent do people take into account the intentions of others? Alessandro Duranti sets out to answer this question, showing that the role of intentions in human interaction is variable across cultures and contexts. Through careful analysis of data collected over three decades in US and Pacific societies, Duranti demonstrates that, in some communities, social actors avoid intentional discourse, focusing on the consequences of actions rather than on their alleged original goals. In other cases, he argues, (...) people do speculate about their own intentions or guess the intentions of others, including in some societies where it was previously assumed they avoid doing so. To account for such variation, Duranti proposes an 'intentional continuum', a concept that draws from phenomenology and the detailed analysis of face-to-face interaction. A combination of new essays and classic re-evaluations, the book draws together findings from anthropology, linguistics and philosophy to offer a penetrating account of the role of intentions in defining human action. The recent proliferation of AI scandals led private and public organisations to implement new ethics guidelines, introduce AI ethics boards, and list ethical principles. Nevertheless, some of these efforts remained a façade not backed by any substantive action. Such behaviour made the public question the legitimacy of the AI industry and prompted scholars to accuse the sector of ethicswashing, machinewashing, and ethics trivialisation—criticisms that spilt over to institutional AI ethics boards. To counter this widespread issue, contributions in the literature have (...) proposed fixes that do not consider its systemic character and are based on a top-down, expert-centric governance. To fill this gap, we propose to make use of qualified informed lotteries: a two-step model that transposes the documented benefits of the ancient practice of sortition into the selection of AI ethics boards’ members and combines them with the advantages of a stakeholder-driven, participative, and deliberative bottom-up process typical of Citizens’ Assemblies. The model permits increasing the public’s legitimacy and participation in the decision-making process and its deliverables, curbing the industry’s over-influence and lobbying, and diminishing the instrumentalisation of ethics boards. We suggest that this sortition-based approach may provide a sound base for both public and private organisations in smart societies for constructing a decentralised, bottom-up, participative digital democracy. Elaborating on the notions that humans possess different modalities of decision-making and that these are often influenced by moral considerations, we conducted an experimental investigation of the Trolley Problem. We presented the participants with two standard scenarios (‹lever’ and ‹stranger’) either in the usual or in reversed order. We observe that responses to the lever scenario, which result from (moral) reasoning, are affected by our manipulation; whereas responses to the stranger scenario, triggered by moral emotions, are unaffected. Furthermore, when asked (...) to express general moral opinions on the themes of the Trolley Problem, about half of the participants reveal some inconsistency with the responses they had previously given. The SARS‐CoV‐2 virus is responsible for the COVID‐19 pandemic the world experience since 2019. The protein responsible for the first steps of cell invasion, the spike protein, has probably received the most attention in light of its central role during infection. Computational approaches are among the tools employed by the scientific community in the enormous effort to study this new affliction. One of these methods, namely molecular dynamics (MD), has been used to characterize the function of the spike protein at (...) the atomic level and unveil its structural features from a dynamic perspective. In this review, we focus on these main findings, including spike protein flexibility, rare S protein conformational changes, cryptic epitopes, the role of glycans, drug repurposing, and the effect of spike protein variants. This article argues that the discovery of Pythagorean volumes in Numa's tomb in 181 b.c. may have played a significant role in the conception of the meeting between Numa and Pythagoras in the last book of Ovid's Metamorphoses, since several features of this event integrate very well into the discourse at the heart of Book 15 on the Greek origins of Roman culture and literature, on the immortality of poetry, and on the relationship between poetry and power. The article further (...) argues that Ennius’ Annals Book 15 may have covered the events up to 179, if that really was the year of Nobilior's dedication of the Aedes Herculis Musarum, and included the discovery of Numa's books in 181; and hence that Ovid may have used the Ennian account of this discovery as a model for the Numa–Pythagoras episode, appropriating the poetic and political meaning that it already had in Annals Book 15. Keenan (1987) observed that trivial determiners built from basic existential determiners (e.g.,either zero or else more than zero) are allowed inthere-insertion contexts, and that trivial determiners built from basic non-existential determiners (e.g.,either all or else not all) are not. This result is unexpected under the analyses ofthere-sentences proposed in Barwise and Cooper (1981), Higginbotham (1987), and Keenan (1987). I argue that the class of NPs barred from the postverbal position ofthere-sentences (strong NPs) is correctly characterized in presuppositional terms, as suggested (...) in de Jong and Verkuyl (1985) and Lumsden (1988). According to this characterization, strong NPs share one of the defining components of definiteness proposed in Heim (1982), namely the Descriptive Content Condition (DCC). How to derive the prohibition against strong NPs inthere-insertion contexts (definiteness effect) from the fact that strong NPs meet the DCC is not obvious, however. I argue that accounting for this prohibition involves regarding the XP-coda in [there be NP XP] as providing the contextual domain for the interpretation of the postverbal NP. (shrink)

Dedicata a interrogare le categorie di metafora, mito e modernità, la riflessione di Hans Blumenberg (1920-1996) è senz'altro una delle più inquiete, profonde e decisive del secondo Novecento. Il presente volume ne offre una serrata ricostruzione evolutiva, partendo da un'analisi della prima, inedita fase del suo pensiero, e descrivendone la trasformazione nel corso del primo ventennio (1946-1966). Mostrando come la sua indagine si sia sistematicamente nutrita di un confronto "corpo a corpo" con la storia del pensiero cristiano - Agostino, Pascal, (...) Kierkegaard -, vengono allora esplorate le radici teoriche profonde della tesi della legittimità dell'età moderna, quale contraccolpo conseguente all'entrata in crisi dell'assolutismo teologico di matrice agostiniana. Ne emerge così un'immagine nuova della proposta filosofica e antropologica di Blumenberg, in costante debito critico nei confronti della memoria cristiana della cultura occidentale, seppure ritrattata in prospettiva nietzschiana. This article addresses the issue of how to develop a theory of interpretation of social action that takes into consideration culture-specific claims about intentions while simultaneously allowing for a pan-human, universal dimension of intentionality. It is argued that to achieve such a goal, it is necessary to agree on a basic definition of intentionality and on the conditions that allow for its investigation. After briefly discussing the limitations of applying an ‘narrow’ notion of intention to the analysis of other languages (...) and cultures, a more general and basic analytic notion of intentionality is proposed, that is, as aboutness. By applying this more general notion of intentionality, we can then examine both the content of intentional acts and the conditions that allow for their study across cultural contexts through ‘bracketing’. This is made possible by the social ontology of intentions, which is what enables the analysis of human conduct and its interpretation. Our methods and hypotheses must be evaluated over and against such an existential premise. (shrink)

A number of companies allocate ownership rights to stakeholders different from shareholders, despite the fact that the law attributes these rights to the equity holders. This article contributes to an understanding of this evidence by developing a contingency model for the allocation of ownership rights. The model sheds light on why companies, despite pressures from the law, vary in their allocation of ownership rights. The model is based on the assumption that corporations increase their chance to survive and prosper if (...) the stakeholders supplying “critical contributions” receive the ownership rights. According to the model, “critical” contributions involve (1) contractual problems due to specific investments, long-term relationships, and low measurability; (2) the assumption of the uncertainty resting on the company; and (3) the supply of scarce and valuable resources. The model is dynamic because it also provides a basis for understanding why the allocation of ownership rights changes with time. Finally, the article presents the strategies companies can use to realize an efficient distribution of ownership rights among their stakeholders. (shrink)

An influential theory has it that metaphysical indeterminacy occurs just when reality can be made completely precise in multiple ways. That characterization is formulated by employing the modal apparatus of ersatz possible worlds. As quantum physics taught us, reality cannot be made completely precise. I meet the challenge by providing an alternative theory which preserves the use of ersatz worlds but rejects the precisificational view of metaphysical indeterminacy. The upshot of the proposed theory is that it is metaphysically indeterminate whether (...) p just in case it is neither true nor false that p, and no terms in ‘p’ are semantically defective. In other words, metaphysical indeterminacy arises when the world cannot be adequately described by a complete set of sentences defined in a semantically nondefective language. Moreover, the present theory provides a reductive analysis of metaphysical indeterminacy, unlike its influential predecessor. Finally, I argue that any adequate logic of a language with an indeterminate subject matter is neither compositional nor bivalent. (shrink)

Three theories about evolution are presently under discussion: the genocentric theory, the organismocentric theory, and the biospherocentric theory. A brief discussion of the three theories is presented. These theories have different implications for theology. The genocentric theory is related to the Darwinian interpretation and, for theology, means the end of an apologetic vision of natural science and for this reason the end of natural theology. The organismo‐centric theory is mainly related to events of autoorganization and follows the path of the (...) geometrical harmony of nature. But it is far different from the apologetic interpretation of natural theology which cannot be restored. The biospherocentric theory, on the contrary, contains many fruitful perspectives. This theory, which counts Teilhard de Chardin among its founders, allows the development of a new approach to the theology of nature. In this approach, it is actually the biosphere herself that is doing theology thanks to her thinking sphere: the noosphere. (shrink)

Resumo: O pensamento de Walter Benjamin ocupa uma posição particular e, pode-se até dizer, especial na história do pensamento crítico moderno. Sua obra, fragmentada, inacabada, hermética, atual, anacrônica e complexa, possibilita um passeio sobre uma diversidade de temáticas que vão desde a literatura, passando pela sociologia, filosofia, arte, história, entre outras. O objetivo principal deste artigo consiste, assim, em estabelecer mais um olhar em direção a esse pensador. Trata-se, sobretudo, de compreender como as temáticas do fetichismo da mercadoria e da (...) fantasmagoria podem ser vistas em uma de suas principais obras semificcionais (“Infânc[1]ia Berlinense: 1900”). Foram selecionados, para fins deste trabalho, oito excertos. São eles: “O telefone” “Rua de Steglitz, esquina com a rua de Genthin”, “Mercado”, “Krumme Straβe”, “Um fantasma”, “O anãozinho corcunda”, “Blumeshof 12” e “Desgraças e Crimes”. Após a análise dos excertos, pôde-se observar que o conceito de fetichismo da mercadoria, cunhado por Marx no Capital e ampliado por Benjamin como um elemento de interpretação da realidade burguesa alemã da época de sua infância (fantasmagoria), pode ser visualizado na maioria dos excertos escritos pelo autor na obra “Infância Berlinense: 1900”. Fetishism and Phantasmagoria in the Work “Berliner Childhood: 1900”, by Walter Benjamin Abstract: Walter Benjamin's thought occupies a particular and, one might even say, special position in the history of modern critical thought. His work, fragmented, unfinished, hermetic, current, anachronistic and complex, allows a tour of a diversity of themes ranging from literature, through sociology, philosophy, art, history, among others. The main objective of this article is, therefore, to establish another look towards this thinker. It is, above all, to understand how the themes of commodity fetishism and phantasmagoria can be seen in one of his main semi-fictional works (“Berlin Childhood: 1900”). Eight excerpts were selected for the purposes of this work. They are: “The Telephone”, “Steglitz Street, Corner with Genthin Street”, “Market”, “Krumme Straβe”, “A Ghost”, “The Humpbacked Little Dwarf”, “Blumeshof 12” and “Misfortunes and Crimes”. After analyzing the excerpts, it was possible to observe that the concept of commodity fetishism, coined by Marx in Capital and expanded by Benjamin as an element of interpretation of the German bourgeois reality of his childhood (phantasmagoria), can be visualized in most excerpts written by the author in the work “Berlin Childhood: 1900”. The way we represent the world in thought and language is shot through with indeterminacy: we speak of red apples and yellow apples without thereby committing to any sharp cutoff between the application of the predicate ‘red’ and of the predicate ‘yellow’. But can reality itself be indeterminate? In other words, can indeterminacy originate in the mind-independent world, and not only in our representations? If so, can the phenomenon also arise at the microscopic scale of fundamental physics? Section 1 of (...) this Element provides a brief overview of the question of indeterminacy. Section 2 discusses the thesis that the world is comprised of indeterminate objects, whereas Section 3 focuses on the thesis that there are indeterminate states of affairs. Finally, Section 4 is devoted to the case study of indeterminacy in quantum physics. (shrink)

Joshua Knobe found that people are more likely to describe an action as intentional if it has had a bad outcome than a good outcome, and to blame a bad outcome than to praise a good one. These asymmetries raised numerous questions about lay moral judgement. Frank Hindriks recently proposed that one acts intentionally if one fails to comply with a normative reason against performing the action, that moral praise requires appropriate motivation, whereas moral blame does not, and that these (...) asymmetries are normal features of a theory of intentional action, not anomalies. I present two empirical studies revealing asymmetries in lay judgements of intentionality and moral blameworthiness; these cannot be explained by Hindriks' theory of intentional action. (shrink)

Fiery Cushman and Alfred Mele recently proposed a ‘two-and-a-half rules’ theory of folk intentionality. They suggested that laypersons attribute intentionality employing: one rule based on desire, one based on belief, and another principle based on moral judgment, which may either reflect a folk concept (and so count as a third rule) or a bias (and so not count as a rule proper) and which they provisionally count as ‘half a rule’. In this article, I discuss some cases in which an (...) agent is judged as having neither belief nor desire to bring about an action, and yet laypersons find the agent’s action to be intentional. Many lay responses apparently follow a rule, but many other seem biased. The contribution of this study is two-fold: by addressing actions performed without desire or belief, it expands Mele and Cushman’s account; it also helps discriminate between a two-rules and a three-rules theory. As a conclusion, I argue in favor of a three-and-a-half concepts theory. (shrink)

Philosophers have rightly condemned lookism—that is, discrimination in favor of attractive people or against unattractive people—in education, the justice system, the workplace and elsewhere. Surprisingly, however, the almost universal preference for attractive romantic and sexual partners has rarely received serious ethical scrutiny. On its face, it’s unclear whether this is a form of discrimination we should reject or tolerate. I consider arguments for both views. On the one hand, a strong case can be made that preferring attractive partners is bad. (...) The idea is that choosing partners based on looks seems essentially similar to other objectionable forms of discrimination. (In particular, the preference for attractive partners is arguably both unfair and harmful to a significant degree.) One can try to resist this conclusion in several ways. I consider three possible replies. The first has to do with the possibility of controlling our partner preferences. The second pertains to attractiveness and “good genes”. The last attempts to link certain aspects of attractiveness to a prospective partner’s personality and values. I argue that the first two replies fail conclusively, while the third only amounts to a limited defense of a particular kind of attractiveness preference. So the idea that we should often avoid preferring attractive partners is compelling. (shrink)

The purpose of this qualitative study was to analyse nurses’ professional dignity in their everyday working lives. We explored the factors that affect nursing professional dignity in practice that emerge in relationships with health professionals, among clinical nurses working in hospitals and in community settings in central Italy. The main themes identified were: (i) nursing professional dignity perceived as an achievement; (ii) recognition of dignity beyond professional roles. These two concepts are interconnected. This study provides insights into professional dignity in (...) nursing being perceived as an achievement linked to the intrinsic dignity of every human being. The ‘nursing professional dignity perceived as an achievement’ was perceived as having declined in different social factors. Some factors of nursing professional dignity perceived as an achievement were attained more easily in community settings. ‘Recognition of dignity beyond professional roles’ underpins the intrinsic dignity as an expression of humanity, embedded in persons regardless of any profession, and values, such as: respect, moral integrity, humility, working conscientiously and kindness.
