O artigo pretende expor uma visão crítica sobre a teoria da secularização defendida por Carl Schmitt e sobre a reflexão de Martin Heidegger a respeito da metafísica do sujeito. Mais precisamente, nosso foco recai criticamente sobre a equivalência entre niilismo e autolegislação humana presente na obra de ambos os autores. Nosso objetivo é apreender tais formulações em duas dimensões imbricadas: uma delas, teórico-filosófica, e a outra, histórica. Em seguida, buscamos colocá-las em perspectiva crítica tendo em vista especialmente a reflexão (...) desenvolvida por Hans Blumenberg e alguns de seus comentaristas. Pretendemos proceder a contraposição entre (i) a noção de autolegislação humana como niilismo e (ii) a legitimidade do espaço do simbólico. Sem negar a crítica ao racionalismo limitante, que inclui a superação do sujeito cartesiano, a abordagem que defendemos legitima a dimensão de mediação entre o tempo da vida e tempo do mundo, mediação que pode se dar tanto pela elaboração científica quanto pelo pensamento filosófico ou religioso. Por fim, buscamos apontar a relação entre o espaço simbólico e a superação da noção de mímesis como imitação ou simples adequação. Palavras-chave: Autolegislação humana. Niilismo. Simbólico. Mímesis .The article aims to expose a critical view about the theory of secularization advocated by Carl Schmitt and also about Martin Heidegger's reflection on metaphysics of the subject. More precisely, our focus rests critically upon the equivalence between nihilism and human self-legislation present in the work of both authors. Our goal is to apprehend such formulations in two imbricated dimensions: one, theoretical and philosophical, and the other historical. Then, we seek to put both in a critical perspective, in special the reflection developed by Hans Blumenberg and some of his commentators. We intend to make the counterposition between (i) the notion of human self-legislation as nihilism and (ii) the legitimacy of the symbolic space. Without denying the critique of the limiting rationalism, which includes the overcoming the Cartesian subject, the approach we advocate legitimates the dimension of mediation between life-time and world-time, mediation that can occur either by scientific elaboration or by philosophical or religious thought. Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. Longtermists have argued that humanity should significantly increase its efforts to prevent catastrophes like nuclear wars, pandemics, and AI disasters. But one prominent longtermist argument overshoots this conclusion: the argument also implies that humanity should reduce the risk of existential catastrophe even at extreme cost to the present generation. This overshoot means that democratic governments cannot use the longtermist argument to guide their catastrophe policy. In this paper, we show that the case for preventing catastrophe does not depend on longtermism. (...) Standard cost-benefit analysis implies that governments should spend much more on reducing catastrophic risk. We argue that a government catastrophe policy guided by cost-benefit analysis should be the goal of longtermists in the political sphere. This policy would be democratically acceptable, and it would reduce existential risk by almost as much as a strong longtermist policy. (shrink)

Jung has never pursued the "psychology of religion" apart from general psychology. The unique importance of his work lies rather in his discovery and treatment of religious, or potentially religious, factors in his investigation into the unconscious as a whole and in his general therapeutic practice. In Answer to Job , first published in Zurich in 1952, Jung employs the familiar language of theological discourse. Such terms as "God," "wisdom," and "evil" are the touchstones of his argument. The concept of indiscernibility in a structure is analysed with the aim of emphasizing that in asserting that two objects are indiscernible, it is useful to consider these objects as members of (the domain of) a structure. A case for this usefulness is presented by examining the consequences of this view to the philosophical discussion on identity and indiscernibility in quantum theory.

Cognitive representations are typically analysed in terms of content, vehicle and format. While current work on formats appeals to intuitions about external representations, such as words and maps, in this paper we develop a computational view of formats that does not rely on intuitions. In our view, formats are individuated by the computational profiles of vehicles, i.e., the set of constraints that fix the computational transformations vehicles can undergo. The resulting picture is strongly pluralistic, it makes space for a variety (...) of different formats, and is intimately tied to the computational approach to cognition in cognitive science and artificial intelligence. Carl F. Craver investigates what we are doing when we use neuroscience to explain what's going on in the brain. When does an explanation succeed and when does it fail? Craver offers explicit standards for successful explanation of the workings of the brain, on the basis of a systematic view about what neuroscientific explanations are.

Discrimination, understood as differential treatment of individuals on the basis of their respective group memberships, is widely considered to be morally wrong. This moral judgment is backed in many jurisdictions with the passage of equality of opportunity legislation, which aims to ensure that racial, ethnic, religious, sexual, sexual-orientation, disability and other groups are not subjected to discrimination. This chapter explores the conceptual underpinnings of discrimination and equality of opportunity using the tools of analytical moral and political philosophy.

An influential view in cognitive science is that computation in cognitive systems is semantic, conceptually depending on representation: to compute is to manipulate representations. I argue that accepting the non-semantic teleomechanistic view of computation lays the ground for a promising alternative strategy, in which computation helps to explain and naturalise representation, rather than the other way around. I show that this computation-based approach to representation presents six decisive advantages over the semantic view. I claim that it can improve the two (...) most influential current theories of representation, teleosemantics and structural representation, by providing them with precious tools to tackle some of their main shortcomings. In addition, the computation-based approach opens up interesting new theoretical paths for the project of naturalising representation, in which teleology plays a role in individuating computations, but not representations. In this systematic introduction to the philosophy of Charles S. Peirce, the author focuses on four of Peirce's fundamental conceptions: pragmatism and Peirce's development of it into what he called 'pragmaticism'; his theory of signs; his phenomenology; and his theory that continuity is of prime importance for philosophy. He argues that at the centre of Peirce's philosophical project is a unique form of metaphysical realism, whereby continuity and evolutionary change are both necessary for our understanding of experience. In his final (...) chapter Professor Hausman applies this version of realism to contemporary controversies between anti-realists and anti-idealists. Peirce's views are compared to those of such contemporary figures as Davidson, Putnam, and Rorty. Under what conditions are people responsible for their choices and the outcomes of those choices? How could such conditions be fostered by liberal societies? Should what people are due as a matter of justice depend on what they are responsible for? For example, how far should healthcare provision depend on patients' past choices? What values would be realized and which hampered by making justice sensitive to responsibility? Would it give people what they deserve? Would it advance or hinder equality? The (...) explosion of philosophical interest in such questions has been fuelled by increased focus on individual responsibility in political debates. Political philosophers, especially egalitarians, have responded to such developments by attempting to map out the proper place for responsibility in theories of justice. I analyze a tension at the core of the mechanistic view of computation generated by its joint commitment to the medium independence of computational vehicles and to computational systems possessing teleological functions to compute. While computation is individuated in medium-independent terms, teleology is sensitive to the constitutive physical properties of vehicles. This tension spells trouble for the mechanistic view, suggesting that there can be no teleological functions to compute. I argue that, once considerations about the relevant function-bestowing factors for computational (...) systems are brought to bear, the tension dissolves: physical systems can have the teleological function to compute. Philosophers have disagreed on the composition of force for decades. The main divergence concerns the fundamental question: given a certain motion that is observable, which force or forces are present in it, component or resultant forces? The present paper focuses on the conditions for dealing with this problem. I will argue that we are not able to infer force from the observation of a motion, as required by the problem. I will further argue that the validity of the Newtonian algorithm (...) is not a sufficient condition for that inference because the Gaussian algorithm, which is equally valid, differs from the former with regard to the forces present in motions. Under these circumstances, I will make recourse to an experiment available in physics in which the force present in a motion is measured. Thus, we obtain a numerical value for this force. This result, playing the role of a counterexample, clarifies the composition of force issue significantly. (shrink)

The principle of conservation of energy tells us that ‘energy can neither be created nor destroyed but only transformed’. The validity of the principle is without question. The problem is the concept. Contemporary physicists have asserted that we do not know what energy is. We find, however, 19th century physicists, contemporary physicists and historians of science who converge on the point: Mayer and Joule discovered energy. Therefore, we do not know what energy is, but we know these authors discovered it. (...) What did they then discover? What can we learn from this with regard to the energy concept problem? To deal with this issue, I will distinguish between what the authors did experimentally and what they said about the phenomena. This method of analysis makes the difference in relation to historical works on the subject. In a second step, I will consider the introduction of the energy concept, which is from 1850s, and the reification of the energy in 1880s. Finally, I will address the energy conservation principle and the concept of energy conveyed by this principle in contemporary textbooks. As we shall see, the conservation of a magnitude that we call energy nowadays was discovered by Mayer and Joule; an indestructible and transformable entity was not. Adopting the original conservation principle would be enough to avoid the energy concept problem. (shrink)

This introductory chapter provides an overview of the recent debate about responsibility and distributive justice. It traces the recent philosophical focus on distributive justice to John Rawls and examines two arguments in his work which might be taken to contain the seeds of the focus on responsibility in later theories of distributive justice. It examines Ronald Dworkin's ‘equality of resources’, the ‘luck egalitarianism’ of Richard Arneson and G. A. Cohen, as well as the criticisms of their work put forward by (...) Elizabeth Anderson, Marc Fleurbaey, Susan Hurley, and Jonathan Wolff. Key concepts such as responsibility (individual and collective), luck (thin and thick; brute and option), control, desert, and equality of opportunity are delineated, and the implementation of responsibility-sensitive accounts of justice is considered. This chapter identifies three contrasts between responsibility-sensitive justice and desert-sensitive justice. First, while responsibility may be appraised on prudential or moral grounds, it is argued that desert is necessarily moral. As moral appraisal is much more plausible, responsibility-sensitive justice is only attractive in one of its two formulations. Second, strict responsibility sensitivity does not compensate for all forms of bad brute luck, and forms of responsibility-sensitive justice like luck egalitarianism that provide such compensation do so by appealing to independent moral (...) concerns such as equality. Desert-sensitive justice can deliver the appropriate compensation without relying on external moral resources. Finally, while responsibility-sensitive justice harshly refuses to provide for those whose basic needs are unsatisfied due to their own negligent actions, this result can be averted by desert-sensitive justice as it can take into account responsibility-independent considerations. In sum, desert-sensitive justice appears to offer a tighter fit with considered judgments about justice. (shrink)

In this paper I argue against one variety of contextualism about aesthetic predicates such as “beautiful.” Contextualist analyses of these and other predicates have been subject to several challenges surrounding disagreement. Focusing on one kind of contextualism— individualized indexical contextualism —I unpack these various challenges and consider the responses available to the contextualist. The three responses I consider are as follows: giving an alternative analysis of the concept of disagreement ; claiming that speakers suffer from semantic blindness; and claiming that (...) attributions of beauty carry presuppositions of commonality. I will argue that none of the available strategies gives a response which both satisfactorily explains all of the disagreement -data and is plausible independent of significant evidence in favor of contextualism. I conclude that individualized indexical contextualism about the aesthetic is untenable, although this does not rule out alternative contextualist approaches to the aesthetic. (shrink)

My concern is with the minimal suggestion that an adequate philosophical theory of scientific explanation can limit its attention to the format or structure with which theories are represented. The representational subsumption view is a plausible hypothesis about the psychology of understanding. It is also a plausible claim about how scientists present their knowledge to the world. However, one cannot address the central questions for a philosophical theory of scientific explanation without turning one’s attention from the structure of representations to the basic commitments about the worldly structures that plausibly count as explanatory. A philosophical theory of scientific explanation should achieve two goals. The first is explanatory demarcation. It should show how explanation relates with other scientific achievements, such as control, description, measurement, prediction, and taxonomy. The second is explanatory normativity. It should say when putative explanations succeed and fail. One cannot achieve these goals without undertaking commitments about the kinds of ontic structures that plausibly count as explanatory. Walter Benjamin e um setor da Teologia da Libertação, em especial aquele que se articula em torno à Escola do DEI, tem diversas convergências na crítica do capitalismo como religião. Esta proposição desafia pressupostos modernos das teorias da religião exigindo uma revisão conceitual que permita compreender melhor o poder de legitimação/fascínio ou questionamento da economia política capitalista. Neste artigo procuramos refletir sobre esta revisão da teoria da religião e propor uma abordagem que relaciona Benjamin e a teologia da libertação. Para (...) isso, propomos exemplificar os desafios teórico-práticos desta relação e percorrer alguns estudos que re-situam os conflitos epistemológicos e políticos da religião com a modernidade. Em seguida, buscamos elementos de Benjamin e da Escola do DEI que fornecem instrumental analítico potente para a crítica do fetichismo capitalista como religião cotidiana. Por fim, sintetizamos a tarefa fundante de pensar, a partir da vida das vítimas, um necessário discernimento de deuses que permitem des-ocultar a razão mítico-teológica que caracteriza o espírito do fetiche. A core, constitutive norm of science is to remove or remedy the artefacts in one’s data. Here, we consider examples of artefacts from many fields of science (for example, astronomy, economics, electrophysiology, psychology, and systems neuroscience) and discuss their contribution to a more general evidential selection problem at the heart of the epistemology of evidence. Synthesizing and building on previously disparate discussions in many areas of the philosophy of science, we provide a novel, causal–pragmatic account that fits the examples and (...) clarifies the practices by which artefacts are discovered and remedied.
