‘Marx on tax’ as an effective antidote to inequality is an overlooked theme within his own output, but also for our own time. Marx theorising on tax is seen even by pre-eminent Marxists as an empty box, but Marx and Engels in fact had plenty to say about tax. Their coverage embraces progressive taxes, both on capital and income, a strong preference for direct over indirect taxation, inheritance tax, land-value tax, taxes on financial transactions, and state finances around the world. (...) Tax also provides the battleground for a rare sight of Marx as campaigning activist, in 1848, matched in the same period by close ally Wilhelm Wolff. The tax policies of Marx and Engels have been neglected because they are primarily to be found in their journalism and letters. Prior works in institutional theory are characterized by an assumption that the legal basis for authority of regulatory agencies is sufficient to ensure compliance by business organizations. From a business ethics standpoint, this would imply that regulatory oversight can hinder organizations’ pursuit of questionable business practices. However, the evidence for regulatory efficacy is far from clear as questionable business practices tend to persist despite regulatory monitoring. Drawing on the case of the regulatory failure to trigger a shift away from aggressive (...) banking practices in Ireland, which had serious social and economic costs, we highlight three barriers to deinstitutionalization: insufficient advocacy for change coupled with an inability to problematize the risks of extant business practices, unwillingness to impose change through the use of threats, power, or sanctions, and contradictions in the institutional environment that can obfuscate the regulators’ message. Thus, our study proposes that regulator-led change might not be as straightforward as previously theorized. In doing so, it advances prior theory through an explicit focus on the importance of three types of institutional work that are necessary for regulator-led deinstitutionalization. (shrink)

This paper aims to perform a multi-level analysis of the Irish public discourse on Covid-19. Despite widespread agreement that Ireland’s response was rapid and effective, the country’s journey through the pandemic has been no easy ride. In order to contain the virus, the Government’s emergency legislation imposed draconian measures including the detention and isolation of people deemed to be even “a potential source of infection” and a significant extension of An Garda Síochána’s power of arrest. In April 2020, journalists (...) John Waters and Gemma O’Doherty initiated judicial review proceedings before the High Court to challenge such legislation, which they defined as unconstitutional, “disproportionate” and based on “fraudulent science”. The proceedings attracted widespread media coverage in what soon became a debate on the legitimacy of emergency legislation and the notion of ‘fake news’ itself. After a brief survey of the legislative background to Ireland’s Covid response, the argumentative strategy is analysed through which the High Court eventually dismissed Mr Waters and Ms O’Doherty’s challenge. Focusing on the process of justification of the judicial decision, the paper provides a descriptive account of the argument structure of the Court’s decision. This sheds light on the pattern of multiple argumentation through which the Court interpreted relevant norms in the Constitution and at once re-established the primacy of “facts” informing political decision-making at a time of national emergency. The Asher’s Bakery case raises questions around discrimination against political causes and freedom of religious conscience. Using the Asher’s case, this essay builds on Kasper Lippert-Rasmussen’s work to develop a theory of discrimination which accounts for discrimination of political causes. The essay explores the normative implications of this account including the rights members of salient political causes, and discusses various objections; in particular, how discrimination claims should be balanced against freedom of religious conscience in a liberal society and how religion’s (...) ‘specialness’ can be defended. By offering a critique of the Asher’s case, the essay aims to provide a framework for dealing with similar cases where claims of discrimination from political groups meet claims of religious discrimination. Within any organization (e.g. a hospital or clinic) the perception of the way things operate may vary dramatically as a function of one’s location in the organizational hierarchy as well as one’s professional discipline. Interorganizational variability depends on organizational coherence, safety, and stability. In this four-nation (Canada, Ireland, Australia, and Korea) qualitative study of 42 nurses, we explored their perception of how ethical decisions are made, the nurses’ hospital role, and the extent to which their voices were heard. These (...) nurses suggested that their voices were silenced (often voluntarily) or were not expressed in terms of ethical decision making. An awareness of the significance of location in the production and dissemination of scientific knowledge has brought a new dimension to recent work on the sociology of science. But the importance of speech in scientific enterprises has been less well developed. This article explores the idea of `spaces of speech' by underscoring the connections between location and locution. It develops a case study of how Darwinian evolution was talked about in different sites using examples from Ireland and the American (...) South during the latter part of the 19th century. These reveal how sites enable and constrain what may be said, and heard, about particular scientific claims, and how they are crucial to understanding the circulation of scientific claims in public arenas. Its publication in 2021 coincided with the fiftieth anniversary of the first publication of David Ireland’s The Unknown Industrial (...) Prisoner (1971). This experimental novel, centered on a “kaleidoscopic vision” of its characters and their lives, tells the story of a group of workers at the Puroil refinery in a fictionalized part of Sydney. In Heino’s own words, this project emerged from a desire to write about industrialization and representation in Australian fiction. Working primarily as a legal scholar and historian, this work represents his first foray into literary geography.At the heart of Heino’s argument is a question: What does literature know about space? In his pursuit of a spatially-directed reading of The Unknown Industrial Prisoner, Heino eschews work in literary geography that cultural geographers might recognize— particularly the writings of Sheila Hones, the doyenne of an emerging interdiscipline of literary geography, whose practitioners work at the interstices between literary studies and geography. Heino criticizes this interdisciplinary literary geography as being too focused on establishing the “sovereignty” or “imperialism” of fictional space at the expense of recognizing the [End Page 132] role of literature in the world. Arguably, such a stance is a misreading of the thinking within literary geography that “reading literature is essentially an experimental process in which the categorical distinction between the frames of ‘fact’ and ‘fiction’ become blurred,”1 and where the “ontological distinction between literary and non- literary spaces” is undermined.2 Neither of these statements supposes that reading literature is a practice by which the world falls away and nothing remains but the book. Instead, following Doreen Massey’s idea that space is a complicated process of events and happenings, literary geographers in this mold argue that fiction is a part of life as it happens, and reading is a constitutive practice in the co- production of space.In its place, Heino emphasizes a form of literary geographical thinking that understands literature’s role as being separate from, but intimately connected to, the actual world. His theoretical framework is multi-layered, borrowing from Marxist literary scholars, including Terry Eagleton and Fredric Jameson, and Marxist geographers, including Henri Lefebvre. In essence, however, it can be expressed neatly in the following quotation from geocritic Bertrand Westphal:Fiction does not reproduce the real, but actualises new virtualities that had remained unformulated, and then goes on to interact with the real according to the hypertextual logic of interfaces... fiction detects possibilities buried in the folds of the real, knowing that these folds have not been temporised.3I think that Heino’s rejection of what he characterizes as poststructural literary geography, of the kind represented in his analysis of Sheila Hones’s work, misses some opportunities. First, there are similarities between his conception of literary geography and those he leaves aside— not least, their shared acceptance of the productive tension that sits between literature as text and world as practical, non- representational, and exceeding narrative. Secondly, the shared aim of both approaches is to understand how “representation ‘takes place’ and precisely how texts are part of what happens.”4 This is particularly powerful in the light of Heino’s aim to understand the development and contents of literary texts in materialist terms. For centuries Andean civilization and ecology has afforded a special fascination for European travellers and officials. Assessing national levels of happiness has become an important research and policy issue in recent years. We examined happiness and satisfaction in Ireland using phone text messaging to collect large-scale longitudinal data from 3,093 members of the general Irish population. For six consecutive weeks participants’ happiness and satisfaction levels were assessed. For four consecutive weeks (weeks 2 to 5) a different random third of the sample got feedback on the previous week's mean happiness and satisfaction ratings. Text messaging proved (...) a feasible means of assessing happiness and satisfaction, with almost three quarters (73%) of participants completing all assessments. Those who received feedback on the previous week’s mean ratings were eight times more likely to complete the subsequent assessments than those not receiving feedback. Providing such feedback data on mean levels of happiness and satisfaction did not systematically bias subsequent ratings either towards or away from these normative anchors. Texting is a simple and effective means to collect population level happiness and satisfaction data. (shrink)

Commentators in both the French and foreign press were quick to criticize Sarkozy’s vow to “flush (...) out [the thugs of La Corneuve] with a Kärcher [pressure washer]” (il faut [les] nettoyer au Kärcher).1 It was pointed out by Azouz Begag, as the newly appointed minister of equal opportunities, that such “warlike” language indiscriminately victimizes young people in the banlieue, while journalist Doug Ireland argued that Sarkozy’s comments conveyed hints of ethnic cleansing by equating urban youth, largely of Maghrebi origin, with dirt that needed to be violently removed from the otherwise smooth and clean civic spaces of the French Republic.2 The populist rage that Sarkozy articulated by using the term racaille (rabble, scum) received most of the attention, including an essay in Le Monde that explored the word’s etymology (intended as a lesson in the politics of language for the French interior minister).3It is the Kärcher reference, however, that most interests me here. Kärcher, a company based in Germany, whose own website touts it as “the most recognized and trusted name in high-pressure cleaning equipment,” manufactures machines used to clean city walls and public latrines. By proclaiming that he wanted to “kärcherize” the “racaille,” Sarkozy evoked a specific technology of urban cleansing that vividly illustrates the increasingly brutal approach to the banlieue that marks French urban policy since the 1980s. The Kärcher water blaster is not a mere metaphor, but an actual machine used to scour graffiti from a variety of hard-to-clean surfaces. Sarkozy’s comments thus equate banlieue youth (la racaille) with their signs of passage through urban space (le graff, as graffiti is often called). The young banlieusards themselves become illegible signs on the new smooth spaces of the HLM housing estates. The rhetorical dehumanization of young people from “troubled neighborhoods,” combined with hostility to graffiti, reveals the neo-logocentrism operative in the penal republican state that reiterates colonialism’s pseudo-scientific rationale for depriving supposedly illiterate peoples of history, reason, and even the very capacity for thought, a rationale that ultimately justifies their exclusion from the entire chain of civilizational benefits and rights attendant upon literacy and reason. One piece of anti-Sarkozy graffiti in Brest near the port de commerce, depicting Sarkozy as the national cop wielding a billy club, displays an explicit awareness of this interpretation of what nettoyer au Kärcher means (fig. 1). Text accompanying the cartoonish caricature reads, “Article 1: Nettoyage des graffitis au Kärcher” (Article 1: Cleaning graffiti with a Kärcher).4It would be an error, however, to suggest that the category, “banlieue youth,” exists independent of the statements that construct it as an identifiable group. Mustafa Dikeç’s recent demonstration of the way that French urban policy “produces” the banlieue as a space to be policed and contained also extends to the way that specific groups within these spaces are produced through the media, statistics, law, and other techniques.5 The [End Page 73] act of naming the racaille effectively produces them as a social category precisely at the same moment that the necessity of cleansing their living inscription from the cité is asserted. I am calling this nettoyage or erasure of these groups “neo-logocentric” because part of its target is graffiti, which, as I hope to demonstrate, represents an important emerging global practice of inscription that produces multiple transnational connections among ghettoized spaces around the world. Graffiti functions as a kind of alternative literacy that operates within a plane that connects with literacy in the narrow sense of the term, but remains independent from it. The strong reactions that graffiti elicits, as adduced by Sarkozy’s remarks (and one could cite dozens of other examples), suggest that the new technologies of thought, mobility, and inscription that graffiti engineers are what make it... Background Since the UK Abortion Act (1967), women have travelled from Ireland to the UK for legal abortion. In 2011 >4000 women did so. Knowledge and attitudes of medical students towards abortion have been published, however, this is the first such report from Ireland. Objective To investigate medical students’ attitudes towards abortion in Ireland. Methods All medical students at the University of Limerick, and physicians who graduated from the university within the previous 12 months, were invited via (...) email to complete an anonymous online survey. The questionnaire comprised 17 questions. Quantitative and qualitative analyses were performed. Results Response rate was 45% (n=169; 55% women; 88.2% <30 years of age; 66.7% Irish; 29.2% North American). Outcomes were: abortion should not be legally available (7.1%), abortion should be allowed in limited circumstances only (35.5%), abortion should be legally available upon request (55%). 72.8% of respondents were moderately/strongly prochoice (74% of women/71% of men/72% and 76% of Irish and North American respondents, respectively). Students aged >30 years were less likely to be prochoice (55%). While 95.2% believed that education on abortion should be offered within medical school curricula, 28.8% stated that they would decline to terminate pregnancies even if legally permitted. While 58.8% indicated that they might perform legal abortions once qualified, 25.7% would do so under limited circumstances only. Conclusions The majority of participants wanted education regarding abortion. Despite being predominantly prochoice, considerably fewer students, irrespective of nationality, indicated that they would perform abortions. (shrink)

In this book, which thoroughly revises and greatly expands his classic work Sameness and Substance, David Wiggins retrieves and refurbishes in the light of twentieth-century logic and logical theory certain conceptions of identity, of substance and of persistence through change that philosophy inherits from its past. In this new version, he vindicates the absoluteness, necessity, determinateness and all or nothing character of identity against rival conceptions. He defends a form of essentialism that he calls individuative essentialism, and then a (...) form of realism that he calls conceptualist realism. In a final chapter he advocates a human being-based conception of the identity and individuation of persons, arguing that any satisfactory account of personal memory must make reference to the life of the rememberer himself. Lipsey and Lancaster's "general theory of second best" is widely thought to have significant implications for applied theorizing about the institutions and policies that most effectively implement abstract normative principles. It is also widely thought to have little significance for theorizing about which abstract normative principles we ought to implement. Contrary to this conventional wisdom, I show how the second-best theorem can be extended to myriad domains beyond applied normative theorizing, and in particular to more abstract theorizing about the normative (...) principles we should aim to implement. I start by separating the mathematical model used to prove the second-best theorem from its familiar economic interpretation. I then develop an alternative normative-theoretic interpretation of the model, which yields a novel second best theorem for idealistic normative theory. My method for developing this interpretation provides a template for developing additional interpretations that can extend the reach of the second-best theorem beyond normative theoretical domains. I also show how, within any domain, the implications of the second-best theorem are more specific than is typically thought. I conclude with some brief remarks on the value of mathematical models for conceptual exploration. (shrink)

Artificial intelligence has historically been conceptualized in anthropomorphic terms. Some algorithms deploy biomimetic designs in a deliberate attempt to effect a sort of digital isomorphism of the human brain. Others leverage more general learning strategies that happen to coincide with popular theories of cognitive science and social epistemology. In this paper, I challenge the anthropomorphic credentials of the neural network algorithm, whose similarities to human cognition I argue are vastly overstated and narrowly construed. I submit that three alternative supervised learning (...) methods—namely lasso penalties, bagging, and boosting—offer subtler, more interesting analogies to human reasoning as both an individual and a social phenomenon. Despite the temptation to fall back on anthropomorphic tropes when discussing AI, however, I conclude that such rhetoric is at best misleading and at worst downright dangerous. The impulse to humanize algorithms is an obstacle to properly conceptualizing the ethical challenges posed by emerging technologies. (shrink)

According to dispositionalism about modality, a proposition <p> is possible just in case something has, or some things have, a power or disposition for its truth; and <p> is necessary just in case nothing has a power for its falsity. But are there enough powers to go around? In Yates (2015) I argued that in the case of mathematical truths such as <2+2=4>, nothing has the power to bring about their falsity or their truth, which means they come out both (...) necessary and not possible. Combining this with axiom (T), it is easy to derive a contradiction. I suggested that dispositionalists ought to retreat a little and say that <p> is possible just in case either p, or there is a power to bring it about that p, grounding the possibility of mathematical propositions in their truth rather than in powers. Vetter’s (2015) has the resources to provide a response to my argument, and in her (2018) she explicitly addresses it by arguing for a plenitude of powers, based on the idea that dispositions come in degrees, with necessary properties a limiting case of dispositionality. On this view there is a power for <2+2=4>, without there being a power to bring about its truth. In this paper I argue that Vetter’s case for plenitude does not work. However, I suggest, if we are prepared to accept metaphysical causation, a case can be made that there is indeed a power for <2+2=4>. (shrink)

Why study notations, diagrams, or more broadly the variety of nonverbal “representations” or “signs” that are used in mathematical practice? This chapter maps out recent work on the topic by distinguishing three main philosophical motivations for doing so. First, some work (like that on diagrammatic reasoning) studies signs to recover norms of informal or historical mathematical practices that would get lost if the particular signs that these practices rely on were translated away; work in this vein has the potential to (...) broaden our view of the specific normativity of mathematics beyond logical proof. Second, some work focuses on signs to highlight the open-ended and “nonrigorous” aspects of mathematical practice, and the role of these aspects in the historical development of mathematics. The third motivation is based on the following observation: the reason differences in signs matter in mathematics is that humans are finite agents, with cognitive and computational limitations. Accordingly, studying signs can be a way to study how human computational constraints shape the mathematics that we do, and to tackle the topic of mathematical understanding. (shrink)

The typical kind of color realism is reductive: the color properties are identified with properties specified in other terms (as ways of altering light, for instance). If no reductive analysis is available — if the colors are primitive sui generis properties — this is often taken to be a convincing argument for eliminativism. That is, realist primitivism is usually thought to be untenable. The realist preference for reductive theories of color over the last few decades is particularly striking in light (...) of the generally anti-reductionist mood of recent philosophy of mind. The parallels between the mind—body problem and the case of color are substantial enough that the difference in trajectory is surprising. While dualism and non-reductive physicalism are staples, realist primitivism is by and large a recent addition to the color literature. We propose a formal framework for interpretable machine learning. Combining elements from statistical learning, causal interventionism, and decision theory, we design an idealised explanation game in which players collaborate to find the best explanation for a given algorithmic prediction. Through an iterative procedure of questions and answers, the players establish a three-dimensional Pareto frontier that describes the optimal trade-offs between explanatory accuracy, simplicity, and relevance. Multiple rounds are played at different levels of abstraction, allowing the players to explore overlapping causal (...) patterns of variable granularity and scope. We characterise the conditions under which such a game is almost surely guaranteed to converge on a optimal explanation surface in polynomial time, and highlight obstacles that will tend to prevent the players from advancing beyond certain explanatory thresholds. The game serves a descriptive and a normative function, establishing a conceptual space in which to analyse and compare existing proposals, as well as design new and improved solutions. (shrink)

This is an in-depth study of J.G. Fichte’s philosophy of mathematics and theory of geometry. It investigates both the external formal and internal cognitive parallels between the axioms, intuitions and constructions of geometry and the scientific methodology of the Fichtean system of philosophy. In contrast to “ordinary” Euclidean geometry, in his Erlanger Logik of 1805 Fichte posits a model of an “ursprüngliche” or original geometry – that is to say, a synthetic and constructivistic conception grounded in ideal archetypal elements that (...) are grasped through geometrical or intelligible intuition. -/- Accordingly, this study classifies Fichte’s philosophy of mathematics as a whole as a species of mathematical Platonism or neo-Platonism, and concludes that the Wissenschaftslehre itself may be read as an attempt at a new philosophical mathesis, or “mathesis of the mind.” -/- “This work testifies to the author's exact and extensive knowledge of the Fichtean texts, as well as of the philosophical, scientific and historical contexts.
