Burt (bio)In May 1949, a French Court of Appeals reversed an 1857 decision condemning six poems from Les fleurs du mal for obscenity, in a signal case of a public lifting of a ban against some lyric poems. 1 Among the several interesting features of this case not the least is the decision to proceed against (...) the work in the first place. For lyric poetry does not appear an attractive target for censorship. Its subject matter and formalism remove it far enough from the experience of most readers that Gustave Flaubert, fresh from his troubles with the court over Madame Bovary, could express his surprise at the government’s attack: “This is new,” he wrote to Baudelaire, “this pursuit of a volume of verse.” While Flaubert’s comment was in point of fact inaccurate, he puts his finger on a problem worth considering. 2 Here we have a work that must seem naturally exempt from state intervention, by virtue of a deliberate retreat from risky political subjects, and it nonetheless did get censored by the state. Can anything be learned about “normal” state censorship from this exceptional case? [End Page 19]A key factor in the government’s decision to pursue the book, according to the prosecutor Pinard, was that these poems would prove accessible to a large audience: 3 “An immoral book that had no chance of being read or understood would not be pursued” [1208], he states. In his argument, as in the judgment by the court that the condemned poems “lead necessarily to the exciting of the senses by a coarse realism offensive to modesty” [1182], the assumption is that the work is extraordinarily available, its pictures immediately referable to ordinary experience. In the six condemned poems, language is judged to be not a veil but a tool, and a sex tool at that. “Despite an effort of style” [1182], the poetic situation—in most of the poems that of the boudoir—is painted in a language insufficiently flowery. 4A further interesting feature in the case is that when it comes up again, under DeGaulle’s Fourth Republic, the court summarily dismisses the 1857 judgment of coarse realism as just one possible interpretation, and a forced one at that. Instead, the 1949 court finds that the poems are self-referential, symbolic entities that do not represent ordinary experience:If some pictures, on account of their originality, were able to alarm some minds upon first publication and appeared to the first judges as offensive to morality, such an appraisal, attaching itself only to a realistic interpretation of the poems and neglecting their symbolic meaning, has proved to be of an arbitrary character, unratified by public opinion or by the judgment of the literary world.[St. John-Stevas 249]The shocking representations of 1857, outraging morality, are now understood to deliver the Wordsworthian “shock of mild surprise” by which we recognize the original work of art. In 1949, the poems are precious artifacts; their language is not realistic but symbolical; its sensuous forms reveal an inner, spiritual meaning.A crucial resemblance can be discerned between the actions taken by the two courts: both make their judgments in terms of a “reading pact,” a set of “artificial rules” [1206] that are presumed to govern reading and to have currency in the context. Les fleurs gets policed in the name of this generic purity, with the prosecutor Pinard calling “the judge... a sentinel who must not let the border be crossed” [1206] and the 1949 decision confirming the opinion of the literary world that the supposed transgression against public morality was in point of fact a transformation in the rules regulating the narrow confines of lyric poetry. 5This concern that texts be framed by a reading pact aimed at constraining their interpretation is worth considering in any discussion of censorship that wants to move from the level of pragmatics to that of theory. The nature of intelligence and how it can be measured has occupied psychologists, educationalists, biologists and philosophers for hundreds of years. However, there has been little investigation into the rise of the traditional dominant educational ideology that intelligence and IQ have innate limits and are unchanging and unchangeable. This book traces the roots of this mind set back to early puritan communities on both sides of the Atlantic, drawing parallels between puritan dogma and the development of the traditional curricula and (...) selection processes that are still firmly embedded in school practice today. Drawing on the work of Galton, Pearson, Burt, Goddard, Terman and others in his search for the truth about intelligence testing, John White looks at the personal histories and socialised religious backgrounds of these key psychologists and casts an entirely new light on schooling in Britain and the USA in modern times. Burt formulates her critique at a general level of abstraction that highlights the methodological deficiencies of sociogenomics without also calling attention to precisely the same deficiencies in the social science model she seeks to defend against its encroachments. What might have been a methodological bulwark against the excesses of sociogenomics is instead a one-sided critique that merely renews its charter.

My aim in this study is not to praise Fischer's fine theory of moral responsibility, but to (try to) bury the “semi” in “semicompatibilism”. I think Fischer gives the Consequence Argument (CA) too much credit, and gives himself too little credit. In his book, The Metaphysics of Free Will, Fischer gave the CA as good a statement as it will ever get, and put his finger on what is wrong with it. Then he declared stalemate rather than victory. In my (...) view, Fischer’s view amounts to sophisticated compatibilism. It would be nice to be able to call it by its right name. In The Metaphysics of Free Will, Fischer develops his own version of Consequence Argument, which turns on two principles, one of which is the fixity of the past. FP: For any action Y, agent S and time t, if it is true that is S were to do Y at t, some fact about that past relative to t would not have been a fact, then S cannot at t do Y at t. I argue that the equipment needed to reject FP (and thereby defend the most plausible version of compatibilism) is needed to deal with the problem of fatalism. In addition, I argue that the rejection of FP is compatible with Fischer’s approach to Frankfurt cases and with his account of transfer principles. (shrink)

Postcolonial theory has yielded productive methodologies with which to examine an institution such as the John Rylands Library. This paper reinterprets aspects of the Library‘s history, especially its collecting practices, using Bhabha‘s concept of hybridity. The Library‘s founder, Enriqueta Rylands, embodied hybridity and colonial talking back in her remarkable trajectory from a Catholic upbringing in Cuba, via her conversion to Nonconformity and her marriage to Manchester‘s most successful cotton manufacturer, to her usurpation of the cultural hegemony in purchasing spectacular (...) aristocratic collections for her foundation. Hybridity was embedded in many other aspects of the Library‘s development: it was established as a public library with a board of governors but its collections were largely shaped by Enriqueta‘s tastes and interests; it was independent until 1972, while maintaining very close links to the University of Manchester; it has always fulfilled a dual remit of addressing the research needs of scholars and attracting wider audiences; and it is simultaneously a library of printed books and manuscripts, an archive repository, and a gallery of visual materials. Free Will’s Value: Criminal Justice, Pride, and Love. New York: Routledge, 2023. 284 pp. Cloth, $160.00It is a pleasure to read John Lemos’s latest work on moral free will, understood as the control needed for us to be morally responsible in “the just deserts sense.” Lemos is a clear writer who carefully (...) lays out the positions that he reviews and critiques. This book would be wonderful as a main text in a graduate seminar: The first six chapters critically address most of the main theories and moves in this wide field during the last twenty to twenty-five years, providing a very helpful overview while setting up Lemos’s own position. He advances an “indeterministic weightings” version of leeway-libertarianism about moral freedom that builds on both Robert Kane’s event-causal account and Robert Nozick’s older account of fixing the weight of practical considerations in the moment of choice. Lemos’s new account significantly refines the position that he defended against hard incompatiblism in his 2018 book. [End Page 721]Free Will’s Value also discusses responsibility in applied contexts, such as criminal justice and loving relationships. There are two chapters arguing that hard incompatibilists cannot save the “just deserts” aspect of criminal punishment or explain all the wrongness of taking the liberty of innocent persons mistakenly convicted. Their “public health quarantine” account of criminal justice will be utilitarian, and thus have a hard time justifying the beyond-reasonable-doubt standard for conviction. And, building on the critiques of compatibilism that he develops partly from Derk Pereboom and Bruce Waller, Lemos includes three chapters arguing that “axiological/pragmatist reasons” provide more evidence for libertarian free will than psychological evidence alone can.The final chapter in particular offers a novel argument that valuable sorts of interhuman loves need to involve self- or character-forming initiatives that are not primarily determined by factors beyond our control. The intrinsic value of some types of love, such as deep friendships—including romantic friendships—involve their being autonomous (my term), which in turn requires a kind of leeway-control. This involves arguing that “our will, effort, or a decision to love” is important to values achieved in sustaining loving relationships.Lemos’s own theory contends that Kane’s account of “self-forming actions” (SFAs) and “willings” (SFWs) in terms of dual “tryings” (or decisions) to do A or B in a fraught situation suffers from the “phenomenological problem” stated by Laura Ekstrom and Marc Balaguer, namely, that we do not normally experience fraught choices as involving such opposed tryings. This is even more evident, I believe, if we consider choices involving three or more salient options. Lemos is not convinced by Kane’s reply that the dual or multiple simultaneous efforts are usually unconscious, because he thinks responsibility for unconscious mental processes will (normally) trace to patterns of conscious choices made earlier in life. In fact, unconscious efforts, Lemos says, cannot meet even “plausible minimal compatibilist standards of responsibility” for elements of agency.I’m not convinced by this last claim, because it seems that an unconscious choice, C, could be responsive to (or counterfactually guided by) reasons relevant to C that the agent has considered in the past. Perhaps the problem is that “trying” is normally associated with attempting to act on an intention, but Kane uses it to describe the more elusive processes of agency involved in forming an intention via decision in the face of competing relevant options, which thereby incorporates motives into the intention. This sheds light on the further problem that it appears irrational to try to do multiple incompatible things at once. Pace Lemos, I think that Kane is right that “will-settling” is a special context in which it is not irrational for a single person’s agency to be engaged along dual pathways. Even if we do not call this “trying,” the agent’s interactions with the salient options are not like those of a detached spectator; they are volitional as well as evaluative. But fewer still have been subject to as much criticism for perceived ambiguities and inconsistencies. In Completely Free, John Peter DiIulio offers an ambitious and comprehensive new reading that explains how Mill’s ethical, moral, and political ideas are all part of (...) a unified, coherent, and powerful philosophy. ABSTRACT Historicist approaches to the reading of sacred texts, rapidly attain a point where further research produces diminishing returns, resulting in more historical speculation rather than less. This is the opposite of the desired result. The cause of this impasse lies in a failure to discern the rhetorical techniques of the author as a basic reading strategy. Similarly, it is necessary to discern that the author has already made key determinations as to historicity. What is now required of the reader (...) is a deepened appreciation of the intentional theological, ontological and existential implications of the narrative. This paper examines how a literary/rhetorical approach may yield positive results in the case of the call of Nathanael, a narrative fragment that poses intriguing critical questions, both theological and Christological. The results suggest a dominical encounter that supplies the reader with pre-emptive eschatological intensity through deliberate juxtaposition of Nathanael’s disbelief and Jesus’ selfawareness held together in a matrix of scriptural fulfilment. Winnipeg's North End has informed the Canadian mythology and influenced the national psyche. The North End also divides and defines the city of Winnipeg, shaping its politics and sense of identity. In these photographs, taken between the mid-1970s and the mid-1990s, John Paskievich set out to explore the North End he knew in his youth. What he found were traces of it, captured in the stillness in which the past still lingers and in the dignity and singularity of its (...) inhabitants. (shrink)

The monk Rodulfus Glaber is best known for his Five Books of Histories, a major source for events in the first half of the eleventh century, and valuable above all for revealing the mental furniture of an eleventh-century monk - for his account of the millennium, of relics genuine and false, of church-building, and visions of saints and demons. This edition, the first since 1866, presents the only critical text of the Histories, accompanied by a complete translation and a full (...) historical commentary. Glaber also wrote a Life of his mentor, St William of Dijon, the renowned monastic reformer. The Life is reprinted after the Histories, again with translation and notes. In recent years there has been a tendency in some quarters to see an affinity between the views of Kierkegaard and Wittgenstein on the subject of religious belief. It seems to me that this is a mistake, that Kierkegaard's views were fundamentally at odds with Wittgenstein's. That this fact is not generally recognized is, I suspect, owing to the obscurity of Kierkegaard's most fundamental assumptions. My aim here is to make those assumptions explicit and to show how they differ from (...) Wittgenstein's. (shrink)

Few contemporary philosophers have made as wide-ranging and insightful a contribution to philosophical debate as John Cottingham. This collection brings together friends, colleagues and former students of Cottingham, to discuss major themes of his work on moral philosophy.
