This article deals with the problems of abortion as a political issue, in the form represented in the two reports of the Belgian «National Commission for Ethical Problems». Both the «translation» of the political problem into a question to be handled by an «apolitical» commission on the level of scientific expertness, and the delivery of two mutually dissenting reports, are studied as a typical stage of the development of the political decision-making process in this matter and compared with similar evolutions (...) in the neighbour countries. From a view point of political theory the main problem is the following : how a parliamentary democracy solves such a deap-seated confiict concerning the «basic values» of ethical order of society? Elements of an answer can be gathered from a comparative analysis of the different positions and arguments in the two reports of the Ethical Commission. (shrink)

«Without a theory of corruption there cannot be a remedy for corruption unless by happy accident». There are empirical theories, such as the functional approach of the political process, but how useful they may be, they essentially fall short. One needs a normative, i.e. an ethical theory of political action.After having evaluated the idea, that politicians and rulers have the right to make use of violence, lies and ruses in order to combat violence and ruse within the community, the article (...) draws some important conclusions from the general democratic principle «no power without control and possibility of sanction by those being subject to that power».Applied to the problem of corruption, this principle can be used as a guideline for a systematic exploration of the structural sources of corruption, defined in a general way as abuse of power. The main thesis reads as follows. The sources of corruption are to be found in those «deficiencies of the system» that create chances for a particular pressure of power to exert an overweight - without possibilities of control and sanction - in the processes of actual definition of the «public interest» or the «common good».An elaboration of the thesis is made by means of an analysis of this kind of «deficiencies» in the Belgian political-administrative system, most of them however not specific for the Belgian situation in particular.Finally, some suggestions for «remedies » against corruption are made, especially in the field of legislative measures. Penser la guerre, c'est se placer dans l'effort philosophique qui se conçoit comme élucidation et affirmation rationnelles des différentes manières dont l'option humaine pour la raison et contre la violence se réalise dans l'histoire. Cette thèse fournit le point de vue à partir duquel l'auteur épouse la pensée de Kant, von Clausewitz et Hegel, en essayant ensuite d'en tirer des leçons possibles en vue des discussions actuelles dans la philosophie politique en tant que réflexion sur la guerre et la paix. Von Clausewitz, penseur de la guerre après la « révolution » militaire depuis Napoléon, n'est pas seulement le « militariste » s'appliquant à la rationalité qui se déploie dans la violence guerrière elle-même, mais a surtout montré comment la guerre doit emprunter sa rationalité spécifique à la rationalité supérieure et englobante qui est celle de la politique , selon sa célèbre formule: la guerre est la continuation de la politique avec d'autres moyens. Mais il s'agit de bien comprenre cette formule. Dans la philosophie politique hégélienne, qui veut «saisir en pensée» le système d'une pluralité d'États indépendants et également souverains, la guerre a le caractère d'une «nécessité» rationnelle. Dans la philosophie du droit de Kant, la paix stable est l'objet d'un devoir impératif de la pure raison pratique, mais la guerre semble, de fait, inévitable, et ceci encore pour longtemps. C'est dans son projet philosophique intitulé Vers la paix perpétuelle que Kant essaie de penser les conditions politiques nécessaires pour établir une paix durable et juste entre les nations. L'auteur montre que ce projet est moins irréaliste qu'on ne le pense le plus souvent, si on veut l'interpréter à la lumière de la philosophie de l'histoire de Kant. On peut se demander néanmoins si Hegel ne continue pas à avoir raison contre Kant. Mais pour Hegel aussi l'histoire est un apprentissage. Au philosophe qui la comprend elle prouve, dit-il, la perfectibilité de l'éducation du genre humain. Il est possible de trouver, de ce point de vue, une convergence de la philosophie de l'histoire de Hegel avec celle de Kant. Une importance spécifique est donnée ici à l'interprétation du dictum de Hegel, que dans la guerre elle-même la guerre est déterminée comme devant être passagère . S'il est vrai que l'histoire de la dialectique de guerre et de paix peut nous rendre plus „sages”, qu'est-ce qu'elle nous a appris ? L'auteur souligne plus spécialement deux éléments: nous comprenons peut-être mieux la signification de la liberté et de ce qu'implique „libération”; nous voyons plus clairement l'importance à donner aux droits de l'homme comme expression de la justice. Il conclut que la philosophie comme „pensée de guerre” peut éclairer la politique dans son effort tendant à définir la justice qui peut établir la paix, afin de rendre superflue la guerre qui doit établir la justice. As a contribution to the commemorations of Spinoza's death, this article describes in a few pages the significance of Spinoza in the evolution of Western political thought. Especially in his Political Treatise, Spinoza attempted to elaborate a «scientific» theory of political life, i.e. a closing deductive theory based upon a «true knowledge of the causes and natural bases» of human actions and passions. In his view it can be proved with a rational necessity that democracy - defined as Spinoza defines (...) it - is the best political regime. He strongly emphasizes that democracy and, consequently, a well organized and efficiently functioning life in common, is impossible without real freedom of opinion and speech and a political «neutralization» of religion. Ethical approval must be obtained before medical research can start. We describe the differences in EA for an pseudonymous, non-interventional, observational European study. Sixteen European national coordinators of the international study on very old intensive care patients answered an online questionnaire concerning their experience getting EA. N = 8/16 of the NCs could apply at one single national ethical committee, while the others had to apply to various regional ECs and/or individual hospital institutional research boards. The time between applying for (...) EA and the first decision varied between 7 days and 300 days. In 9/16 informed consent from the patient was not deemed necessary; in 7/16 informed consent was required from the patient or relatives. The upload of coded data to a central database required additional information in 14/16. In 4/16 the NCs had to ask separate approval to keep a subject identification code list to de-pseudonymize the patients if questions would occur. Only 2/16 of the NCs agreed that informed consent was necessary for this observational study. Overall, 6/16 of the NCs were satisfied with the entire process and 8/16 were unsatisfied. 11/16 would welcome a European central EC that would judge observational studies for all European countries. Variations in the process and prolonged time needed to get EA for observational studies hampers inclusion of patients in some European countries. This might have a negative influence on the external validity. Further harmonization of ethical approval process across Europe is welcomed for low-risk observational studies. Getting ethical approval for low-risk, non-interventional, observational studies varies enormously across European countries. (shrink)

Enfin, j’indiquerai en quoi le premier argument fournit des pistes pour penser le statut légal des animaux de compagnie. | : Because of the injustices domestic animals suffer today, some animal rights theorists claim that the relationship between humans and domestic animals is intrinsically unjust, and that therefore we should not allow domestic animals to breed. I try to show in this paper that, provided that some specific conditions are respected, it is possible to allow the perpetuation of domestic animals—especially pets—while being consistent with an “abolitionist” animal rights theory. Thus, I will try to show that if, all other things being equal, it is morally acceptable to have a child based on a selfish desire, then it is morally acceptable to have a pet for the same reason. Having a child does not lead to the same ethical issues as having a pet. I will show that, despite some constraints, a pet’s life can be perfectly enjoyable. Finally, I will show how the first argument can help us to think about the legal status of pets. (shrink)

Whitehead verfaßte Werk "Principia Mathematica" (1910-1913). Die "Einführung in die mathematische Philosophie" faßt die Ergebnisse dieser Untersuchungen zusammen, ohne Kenntnisse der mathematischen Symbolik vorauszusetzen. Sie ist zuweilen und mit Recht "eine bewundernswerte Exposition des Monumentalwerks Principia Mathematica" genannt worden; und sie ist zugleich etwas anderes, insofern sie eine relativ eigenständige Einführung in die Grundlagen der Mathematik (...) und der Erkenntnistheorie darstellt. Das Buch entstand 1918 im Gefängnis von Brixton, wo Russell eine sechsmonatige Haftstrafe für seine pazifistische Tätigkeit während des 1. Weltkrieges absaß. Es ist sehr anregend zu lesen, wie beinahe alles, was Bertrand Russell geschrieben hat, und es ist ein Buch von der Art, wie es nur jemand wie Russell schreiben kann, wenn er im Gefängnis sitzt und keine Hilfsmittel hat und sich daher entschließt, allen technischen Ballast abzustreifen. Alberto Coffa ON SEVERAL OCCASIONS Russell pointed out that the discovery of his celebrated paradox concerning the class of all classes not belonging to themselves was intimately related to Cantor's proof that there is no greatest cardinal. lOne of the earliest remarks to that effect occurs in The Principles ofMathematics where, referring to the universal class, the class of all classes (...) and the class of all propositions, he notes that when we apply the reasoning of his [Cantor's] proofto the cases in question we find ourselves met by definite contradictions, of which the one discussed in Chapter x is an example. (P. 362) And in a footnote he adds: "It was in this way that I discovered this contradiction". Throughout his writings Russell left a number ofhints concerning the sort of connection he had drawn between Cantor's proof and his own discovery. In Sovereignty he turned his attention to the relationship between the distribution of power and the creation of an ethical society. More specifically, he was concerned with the potential confusion of the body politic resulting from the development of increasingly dynamic and nebulous social conditions. The text is written in an exploratory fashion, reflecting the authorial perception of an ambiguity in modern political structures. This translated Cambridge edition, which (...) was first published in 1957, was derived from a 1955 French original. It constitutes an important contribution to post-war political theory that will remain of value to anyone with an interest in questions relating to political structures and the nature of authority. Presentism is the view that only present entities exist. Recently, several authors have asked the question whether presentism is able to account for cross-time relations, i.e., roughly, relations between entities existing at different times. In this paper I claim that this question is to be answered in the affirmative. To make this claim plausible, I consider four types of cross-time relation and show how each can be accommodated without difficulty within the metaphysical framework of presentism.

Problems arise when applying the current procedural conceptualization of decision-making capacity to paediatric healthcare: Its emphasis on content-neutrality and rational cognition as well as its implicit assumption that capacity is an ability that resides within a person jeopardizes children’s position in decision-making. The purpose of the paper is to challenge this dominant account of capacity and provide an alternative for how capacity should be understood in paediatric care. First, the influence of developmental psychologist Jean Piaget upon the notion of capacity (...) is discussed, followed by an examination of Vygostky’s contextualist view on children’s development, which emphasizes social interactions and learning for decision-making capacity. In drawing parallels between autonomy and capacity, substantive approaches to relational autonomy are presented that underline the importance of the content of a decision. The authors then provide a relational reconceptualization of capacity that leads the focus away from the individual to include important social others such as parents and physicians. Within this new approach, the outcome of adults’ decision-making processes is accepted as a guiding factor for a good decision for the child. If the child makes a choice that is not approved by adults, the new conceptualization emphasizes mutual exchange and engagement by both parties. (shrink)

Bertrand Russell says of Leibniz that "the best parts of his philosophy are the most abstract and the worst those which most nearly concern human life". Many have agreed with Russell's comments and the treatment of Leibniz by most Anglo-American philosophers in particular during this century is a testimony to his sentiments. Even sympathetic commentators have been dismissive or apologetic of those aspects of Leibniz's thought that "concern human life". My purpose here is not to dear Leibniz of any (...) and all animadversions - personal or philosophical - but to attempt to understand the dissimulation and equivocality that even his admirers ascribe to his non-logical writings. It is my position that such qualities were intrinsic to his thought, and not simply personal quirks or flaws that have to be tolerated or dismissed in any sustained examination of his philosophy. Either they misrepresent what aesthetic ineffability consists in, or they leave important aspects of it unexplained. I then show how a more satisfying account might be developed, once a distinction is made between two kinds of awareness. -/- .

Background: This article describes the overall attitudes of children, their parents, and attending physicians toward including or excluding pediatric patients in medical communication and health care decision-making processes. Methods: Fifty-two interviews were carried out with pediatric patients (n = 17), their parents (n = 19), and attending oncologists (n = 16) in eight Swiss pediatric oncology centers. The interviews were analyzed using thematic coding. Results: Parenting styles, the child's personality, and maturity are factors that have a great impact upon the (...) inclusion of children in their health care processes. Children reported the desire to be heard and involved, but they did not want to dominate the decision-making process. Ensuring trust in the parent–child and physician–patient relationships and respecting the child as the affected person were important values determining children's involvement. These two considerations were closely connected with the concern that fantasies are often worse than reality. Seeking children's compliance with treatment was a practical but critical reason for informing them about their health care. The urge to protect them from upsetting news sometimes resulted in their (partial) exclusion. Conclusions: The ethical imperative for inclusion of children in their health care choices was not so much determined by the right for self-determination, but by the need to include them. If children are excluded, they imagine things, become more isolated, and are left alone with their fears. Nevertheless, the urge to protect children is innate, as adults often underestimate children's coping capacities. (shrink)

It has been argued (for example, by Nelson Goodman and John Hyman) that ‘depicts’ and similar terms such as ‘is a picture of’ and ‘represents’ are semantically ambiguous: sometimes they are two-place predicates expressing a relation, and sometimes they are not. A number of philosophers attribute the underrepresentation of women in philosophy largely to bias against women or some kind of wrongful discrimination. They cite six sources of evidence to support their contention: (1) gender disparities that increase along the path from undergraduate student to full time faculty member; (2) anecdotal accounts of discrimination in philosophy; (3) research on gender bias in the evaluation of manuscripts, grants, and curricula vitae in other academic disciplines; (4) psychological research on implicit bias; (5) psychological (...) research on stereotype threat; and (6) the relatively small number of articles written from a feminist perspective in leading philosophy journals. In each case, we find that proponents of the discrimination hypothesis have tended to present evidence selectively. Occasionally they have even presented as evidence what appears to be something more dubious. (shrink)

Entrepreneurs with social goals face various challenges; insights into how these entrepreneurs experience and appreciate their work remain a black box though. Drawing on identity, conservation of resources, and person–organization fit theories, this study examines how entrepreneurs’ social value creation beliefs relate to their work-related well-being (job satisfaction, work engagement, and lack of work burnout), as well as how this process might be influenced by social concerns with respect to the common good. Using data from the German Public Value Atlas (...) 2015 and 2019 and the Swiss Public Value Atlas 2017, a three-study design analyzes three samples of entrepreneurs in Germany and Switzerland. Study 1 reveals that entrepreneurs report higher job satisfaction when they believe their organization creates social value. Study 2 indicates that these beliefs relate negatively to work burnout; entrepreneurs’ perceptions of having meaningful work mediate this relationship. Study 3 affirms and extends these results by showing that a sense of work meaningfulness mediates the relationship between social value creation beliefs and work engagement and that this mediating role is more prominent among entrepreneurs with strong social concerns. This investigation thus identifies a critical pathway—the extent to which entrepreneurs experience their work activities as important and personally meaningful—that connects social value creation beliefs with enhanced work-related well-being, as well as how this process might vary with a personal orientation that embraces the common good. One of the oldest platitudes about beauty is that it is pleasant to perceive or experience. In this article, I take this platitude at face value and try to explain why experiences of beauty are seemingly always accompanied by pleasure. Unlike explanations that have been offered in the past, the explanation proposed is designed to suit a “realist” view on which beauty is an irreducibly evaluative property, that is, a value. In a nutshell, the explanation is that experiences of beauty (...) are experiences in which it appears that something is beautiful, and that such experiences are identical to experiences of aesthetic pleasure. We consider the very weak paracomplete and paraconsistent logics that are obtained by a straightforward weakening of Classical Logic, as well as some of their maximal extensions that are a fragment of Classical Logic. We prove that these logics may be faithfully embedded in Classical Logic, and that the interpolation theorem obtains for them.

This article examines the relationship between women entrepreneurs’ job autonomy and work–life balance, with a particular focus on how this relationship might be augmented by environments that discriminate against women, whether socio-economically, institutionally, or culturally. Multisource data pertaining to 5334 women entrepreneurs from 37 countries indicate that their sense of job autonomy increases the likelihood that they feel satisfied with their ability to balance the needs of their work with those of their personal life. This process is particularly prominent when (...) they operate in countries characterized by discriminatory socio-economic and institutional conditions, though a mitigating instead of invigorating effect arises in culturally discriminatory settings. For business ethics scholars and practitioners, these findings indicate how the extent to which women entrepreneurs, seeking to combine professional and private responsibilities, derive benefits from initiatives aimed at enhancing their job-related freedom critically depends on whether they operate in adverse external environments. Machine Learning (ML) is on the rise in medicine, promising improved diagnostic, therapeutic and prognostic clinical tools. While these technological innovations are bound to transform health care, they also bring new ethical concerns to the forefront. One particularly elusive challenge regards discriminatory algorithmic judgements based on biases inherent in the training data. A common line of reasoning distinguishes between justified differential treatments that mirror true disparities between socially salient groups, and unjustified biases which do not, leading to misdiagnosis and erroneous (...) treatment. In the curation of training data this strategy runs into severe problems though, since distinguishing between the two can be next to impossible. We thus plead for a pragmatist dealing with algorithmic bias in healthcare environments. By recurring to a recent reformulation of William James’s pragmatist understanding of truth, we recommend that, instead of aiming at a supposedly objective truth, outcome-based therapeutic usefulness should serve as the guiding principle for assessing ML applications in medicine.
