I argue that there are such things as nomological probabilities—probabilities that play a certain explanatory role with respect to stable, long-run relative frequencies. Indeed, I argue, we should be willing to accept nomological probabilities even if they turn out to be metaphysically weird or even wholly sui generis entities. I then give an example of one way in which this argument should shape future work on the metaphysics of chance by describing a challenge to a common group of analyses of (...) objective probability—Humean analyses— understood as analyses of nomological probability. Global warming, like many other environmental controversies, mixes pervasive uncertainty with the certainties of expert (but contradictory) opinion. How can we know who is right about global warming, if the only things we have to work with are the scientists’ competing scenarios, the truth‐value of which has yet to be established? One approach is to rely on narrative policy analysis to identify the non‐scientific, but policy‐relevant role played by the global warming controversy. This approach shows that the controversy signals a (...) wider “analytic tip” taking place in the examination of major public policy problems, a tip toward the notion that issues which can still be effectively dealt with locally, regionally or nationally must now first be addressed globally. The policy implications of analytic tip and the narrative features of the global warming scenario are profound for both environmentalists and their ideological opponents. (shrink)

Enjoyment of negative emotions in music is seen by many as a paradox. This paper argues that the paradox exists because it is difficult to view the process that generates enjoyment as being part of the the same system that also generates the subjective negative feeling. Compensation theories explain the paradox as the compensation of a negative emotion by the concomitant presence of one or more positive emotions. But compensation brings us no closer to explaining the paradox because it does (...) not explain how experiencing sadness itself is enjoyed. The solution proposed is that an emotion is determined by two critical processes—labelled motivational action tendency (MAT) and subjective feeling (SF). For many emotions the two processes are coupled in valence. For example, happiness has positive MAT and positive SF, annoyance has negative MAT and negative SF. However, in an aesthetic context, such as listening to music, emotion processes can become decoupled. Sadness retains its negative SF but the aversive, negative MAT is inhibited, leaving sadness to still be experienced as a negative valanced emotion, while contributing to the overall positive MAT. Individual differences, mood and previous experiences mediate the degree to which the aversive aspects of MAT are inhibited. The reason for hesitancy in considering or testing this parallel processes hypothesis, as well as the preponderance of research on sadness at the exclusion of other negative emotions, are discussed. As with any proposal for institutional reform, and especially one that has gained so much ground in such a short amount of time, this paper asks whether diversity, equity, and inclusion (DEI) movement is good for corporations. Are businesses stronger with DEI practices and ideas or weaker? We believe that the DEI movement is asking the right questions: How do we create more just and equitable institutions? The challenge, however, is whether this movement is giving the right answers to such (...) questions. The main premise of our paper is that without deeper principles than DEI itself, these qualities of corporate life will be misunderstood, misused, and disordered in our increasingly fragmented and politicized culture. We propose in this essay that “subsidiarity” serves as one of those deeper principles that can order and enrich our understanding of DEI. It serves as a gift principle that begins to reveal the deepest nature of our work, namely, that our work allows us to exercise our gifts in serving others. (shrink)

A plateau has been reached in how to analyze people's use of their common property resources. We require fresh ways of thinking about the issue. Four new and very different approaches are sketched in the article.

Jon Elster's notion of 'local justice systems' helps recon ceive sustainable development in several fresh ways. Keeping options open for the future use of resources turns out to be a justice/injustice cycle: the more sustainable development becomes a global phenom enon, the more locally unjust its uniform application would necess arily be. The more uniform the application, the greater the local pressure for suitably varied alternatives. But the more varied the applications, the greater the chance of global injustice arising from (...) the decentralization and lack of coordination on the ground. In this way, sustainable development must be seen as not ending when unjust global systems become more just, but rather as continuing through a set of iterations whose moments include a rejection of an overly globalized sustainable development. Histone acetylation is an important regulatory mechanism that controls transcription and diverse nuclear processes. While great progress has been made in understanding how localized acetylation and deacetylation control promoter activity, virtually nothing is known about the consequences of acetylation throughout entire chromosomal regions. An increasing number of genes have been found to reside in large chromatin domains that are controlled by regulatory elements many kilobases away. Recent studies have shown that broad histone acetylation patterns are hallmarks of chromatin domains. This paper describes a model of how musicians make decisions about performing notated music. The model builds on psychological theories of decision-making and was developed from empirical studies of Western art music performance that aimed to identify intuitive and deliberate processes of decision-making, a distinction consistent with dual-process theories of cognition. The model proposes that the proportion of intuitive (Type 1) and deliberate (Type 2) decision-making processes changes with increasing expertise and conceptualizes this change as movement along a continually narrowing (...) upward spiral where the primary axis signifies principal decision-making type and the vertical axis marks level of expertise. The model is intended to have implications for the development of expertise as described in two main phases. The first is movement from a primarily intuitive approach in the early stages of learning toward greater deliberation as analytical techniques are applied during practice. The second phase occurs as deliberate decisions gradually become automatic (procedural), increasing the role of intuitive processes. As a performer examines more issues or reconsiders decisions, the spiral motion toward the deliberate side and back to the intuitive is repeated indefinitely. With increasing expertise, the spiral tightens to signify greater control over decision type selection. The model draws on existing theories, particularly Evans’ (2011) Intervention Model of dual-process theories, Cognitive Continuum Theory Hammond et al. (1987), Hammond (2007), Baylor’s (2001) U-shaped model for the development of intuition by level of expertise. By theorizing how musical decision-making operates over time and with increasing expertise, this model could be used as a framework for future research in music performance studies and performance science more generally. Given the prevalence of debilitating anxiety associated with music performance, there is a need for rapid, pinpointed assessment of the extent to which an individual experiences music performance anxiety. A short, five item scale, the Mazzarolo Music Performance Anxiety Scale, was developed to capture retrospective self-reported estimates of the frequency, intensity and aversion tendency associated with performing music. 102 musicians completed the scale, as well as an established MPA inventory. The M-MPAS was found to be internally reliable with all items (...) being statistically relevant to the overall scale. Furthermore, the M-MPAS was correlated with the relevant factors of an established MPA measure, suggesting that the new scale exhibited good construct validity. M-MPAS is easy to score, with a scale range of 0–30. A score of 11 or above is suggested as the range in which a diagnosis of potential high MPA can be made, but more research into this and the psychometric robustness of the scale is called for. Nevertheless, the reliability and validity demonstrated in the present study, along with the brevity of the M-MPAS suggest that the newly proposed scale may offer considerable triaging benefits for pinpointed assessment of the extent to which an individual experiences MPA. Animal rights and experimentation have become the focus of a major controversy in the United States, with acute implications for animal-related research in the laboratories and veterinary schools of many American universities. To date, efforts to reduce fundamental disagreements between animal researchers and animal welfare groups or to redefine their differences in ways that satisfy all concerned have by and large not been successful. In such situations where it is not possible to identify a middle ground between conflicting positions, the (...) best a policy analyst may be able to do is to accentuate the issue's manifest topsy-turviness and uncertainties. No one can afford or risk having an issue of such high uncertainty, inconsistency, and stakes defined in terms so stark that they feel compelled to choose between those who say they know that the future shall hold us accountable for our wholesale slaughter of animals and those who would blame us for the human deaths they say will surely follow when we do not allow that slaughter. This paper discusses historical-critical thought to address the problems of restoration and preservation of tape music, proposing viable solutions to the matter of digitizing the historically valuable data that exists on and is represented by magnetic tapes. A detailed program of research and restoration and some software for helping in creation of critical editions of the musical works are proposed. We also present some of the issues and controversies that must be considered and approaches we have applied in the preservation (...) of tape music, highlighting how these interpretations can impact later performances of these tape documents. Fundamentally, we argue that the act of tape music restoration has a parallel with the interpretation of the “Urtext score” in the performance of music from the Common Practice Era. (shrink)

This book addresses a critically important question regarding human capital learning in our present neo-liberal schooling context: How can contemporary career education programs be integrated into public school curricula without impacting negatively on the liberal learning, intellectual autonomy, and democratic citizenship of students? Using Aristotelian and Deweyan approaches to career education, this new work argues for a new approach to vocational education that is both liberal and democratic in nature.

Placing the Philosophical Fragments in the context of Kierkegaard's others works, Mercer's commentary shows how literary style and character are used to reveal the nature of history and time.

As corporate managers interact with nonshareholder stakeholders, potential tradeoffs emerge and questions arise as to how these interactions impact shareholder value. We argue that this shareholder—stakeholder debate is an important issue within the overall corporate governance and corporate policy domain and examine one such stakeholder group - employees - by studying labor-friendly corporate practices. We find that announcements of labor-friendly policies are associated with positive abnormal stock returns. Labor-friendly firms also outperform otherwise similar firms, both in terms of long-run stock (...) market returns and operating results. In addition, we find that the probability and benefits of labor-friendliness increase with the demand for highly skilled labor. Our analysis of excess executive compensation suggests that top management derives no pecuniary benefits from labor-friendly practices. We interpret our results as consistent with a genuine concern for employees translating into higher productivity and profitability, which in turn facilitate value creation. It appears that the benefits of labor-friendly practices significantly outweigh the costs and that what is good for employees is good for shareholders. (shrink)
