Existing theoretical literature on justice, law, and community typically treats them as ideas studying them through an analytical and rational approach. In this article, I propose to investigate these concepts through aesthetic experience as an attempt to both sharpen our imagination of such concepts and demonstrate they are inseparable. I do this by painstakingly examining the movies Shoplifters by Kore-eda and The House That Jack Built by Von Trier. Rather than focusing on thematic analysis, I claim and show that film (...) form is crucial for aesthetic and affective experience. Furthermore, and against the conventional view, I argue that both movies articulate a spatialized vision of justice defined by its materiality. Together these aspects help us to keep (re)imagining law, justice, and community, and grasp better their worldmaking properties and powers. (shrink)

This article argues that to disrupt legal education in a radical sense, students need to become acquainted with the art of worldmaking and the view that law is a “way of worldmaking”. First, I show that law is a cultural semiotic practice that requires decoding and, for that reason, demands a creative intervention by those that want to know, understand, and do things with law. Altogether this amounts to recognizing the different modes in which law creates, and is part of, (...) worlds. Second, I propose that due to different features of their aesthetic form, comics are a particularly effective medium to place students before the myriad ways in which law and lawyers make and reproduce worlds. Third, I illustrate the argument by exploring how the Saga comic series, through its formal multimodality and narrative and cultural complexity, can make good on that challenge. (shrink)

It is common in the cognitive and computational sciences to regard virtual reality (VR) as composed of illusory experiences, given its immersive character. In this paper, we adopt an ecological-enactive perspective on cognition (Sect. 3) to evaluate the nature of VR and one’s engagement with it. Based on a post-cognitivist conception of illusion, we reject the commonly held assumption that virtual reality experiences (VREs) are illusory (Sect. 4). Our positive take on this issue is that VR devices, like other technological (...) devices, can be embodied during use, which is why they can be the source of experiences (Sect. 5). We then propose a new concept to interpret VREs, namely, _allusion_, which means that the subject acts _as if_ the virtual experiences are real (Sect. 6). This kind of engagement has a volitional aspect, which is evident in the onboarding of VR devices and which allows us to distinguish VREs from other experiences. We conclude that, even though we have experiences that afford certain interactions in VR, the strong continuity between cognitive and biological processes is not sustained therein. This characterizes a difference of kind—given the current state of technology—between VREs and fully fledged cognitive states, which nevertheless allows for constrained experimentation in cognitive science. There has been a shift from teaching to learning, the so-called process of ‘learnification’, which promotes the idea that teaching should be primarily concerned with the creation of rich learning environments and scaffolding student learning. In doing so, this process of ‘learnification’ has also attacked the idea that teachers have something to teach and that students have something to learn from their teachers. The influence of constructivism, and thinkers like Piaget, Vygotsky, and Bruner in this paradigm shift is quite evident; (...) however, this gives rise to a tension in what a teacher is and what teaching entails, because the teacher, by definition, is someone who has something to teach students, and not merely a facilitator of the learning process. Moreover, because of constructivism and ‘learnification’, current educational practices and policies seem to pay little attention to the importance of ‘relations’ and ‘the encounter with the Other’, which become merely desirable by-products. In this article I criticise constructivism and ‘learnification’ by proposing that the teacher is a community ‘builder’ and teaching a ‘situational revelation’, while also emphasising the importance of ‘relations’ in the educational process. The starting point for my discussion is a much neglected passage of I and Thou where Martin Buber discusses the importance of the ‘living centre’ [lebendigen Mitte] for ‘true community’ [Die wahre Gemeinde] formation. No artigo, abordo a ideia de melhoramento humano (MH), visando a contestar três frustrantes tendências dos seus críticos, a saber, as ideias de: (1) que a natureza humana será artificializada, sugerindo que estaremos diante de algo novo e incomparavelmente perigoso, bem como que ainda seja possível preservar uma separação radical entre natureza e técnica; (2) que é possível abordar e criticar o MH a partir de uma singularidade semântica; e, diretamente relacionada à anterior, (3) que há univocidade entre os defensores (...) do MH acerca de como os indivíduos devem lidar com os meios biotecnocientíficos disponibilizados, a saber, como uma ingênua e acrítica obrigação de melhorar. In this paper, I discuss the idea of human enhancement (HE). My goal is to refute three frustrating trends in the HE criticism, namely the ideas that: (1) human nature will become artificial, suggesting that we will be facing something new and uniquely dangerous, and that it is still possible to preserve a radical separation between nature and technique; (2) it is possible to address and criticize HE from a semantic uniqueness, which is directly related to the previous item; and (3) there is an univocity among the HE's defenders on how individuals should handle the available bio-techno-scientific tools made available, namely, as a naive and uncritical obligation to become enhanced. The Jewish philosopher and educator Martin Buber (1878–1965) is considered one of the twentieth century’s greatest contributors to the philosophy of religion and is also recognized as the pre-eminent scholar of Hasidism. He has also attracted considerable attention as a philosopher of education. However, most commentaries on this aspect of his work have focussed on the implications of his philosophy for formal education and for the education of the child. Given that much of Buber’s philosophy is based on dialogue, on (...) community and on mutuality, it is puzzling that relatively little has been written on the implications of Buber’s thought for the theory and practice of non-formal adult education. The article provides a discussion of the philosophy underpinning this aspect of Martin Buber’s life and work, and its implications for adult non-formal education. (shrink)

Culture plays an important role in defining ethics standards because dissimilar cultures socialize their people differently, according to what is acceptable behaviour. The potential significance of ethnic groups for marketing justifies inquiry into the moral judgments, standards, and rules of conduct exercised in marketing decisions and situations arising from decisions whether or not to focus on individual ethnic groups within an economy. Identifying and targeting ethnic groups for marketing purposes are tasks fraught with many ethical difficulties. In a multicultural society (...) consisting of a dominant group and many diverse, minority groups defined by ethnicity, these problems can be expected to increase substantially. Consequently, marketers may include minority ethnic consumers in their mainstream marketing programs. In itself, this has ethical consequences. Alternatively, if marketers seek to target individual minority ethnic groups within the same economy a further set of ethical consequences needs to be considered. This paper reviews the concepts of ethnicity and ethnic groups and their relevance for marketing strategy within an economy where there is a dominant group and also significant minority ethnic groups. The ethical consequences for minority communities arising from the use of non-ethnic, mainstream marketing programs are examined. An alternative approach, ethnic marketing, is also examined and its ethical consequences in terms of other groups within the one country appraised. The ethical dilemma and tradeoffs facing marketers within advanced, culturally diverse countries are then considered. (shrink)

Nos propomos nesse artigo a contribuir à apreciação da assimilação de Schopenhauer da teoria das Ideias de Platão, por meio da comparação da interpretação schopenhaueriana dessa doutrina com sua exposição platônica. Para tanto, partiremos do roteiro de leitura da teoria das Ideias de Platão recomendado por Schopenhauer em suas preleções na Universidade de Berlim, e que destaca trechos de Filebo, A República e O Banquete. Após sua análise, defenderemos que Schopenhauer assume e ressignifica a distinção platônica entre o mundo como (...) protótipo e cópia, associando o primeiro às forças naturais fundamentais, e o segundo, aos fenômenos do princípio de razão suficiente. Mostraremos também que Schopenhauer espera “corrigir” [1] a “psicologia racional” de Platão, com o argumento de que “o conhecimento sem a intuição, que é intermediada pelo corpo, não possui estofo algum” [2], seguido da radicalização da teoria platônica de que o belo intuitivo facilita o conhecimento das Ideias. Propomos comparar as respostas de Schopenhauer e Freud à questão do significado do prazer e desprazer, dadas por eles, respectivamente, em A ordem da salvação (W II) e Além do princípio do prazer. Ambos lhe respondem concordantemente, pois assinalam que a conduta humana ou os processos psíquicos se dilatam entre a busca do prazer e a fuga da dor (em Schopenhauer, a partir da afirmação da Vontade, e em Freud, conforme o princípio de prazer), e a busca da dor e (...) fuga do prazer (em Schopenhauer, no ascetismo ou graças ao “destino”, conduzido pela Vontade inconsciente, e em Freud, a partir da compulsão à repetição). Mesmo que na contradição schopenhaueriana se expresse mais uma polaridade entre o intelecto e a Vontade, e na freudiana, duas tendências subordinadas ao instinto de morte, defenderemos que ambos os autores estão mais afinados nesse tema do que no do dualismo entre Morte e Eros. Fichte is the first great Post-Kantian Idealist and his debt to Spinozism has been acknowledged by virtually all of his commentators. However, the extent of Spinoza’s influence on Fichte has not been spelled out in much detail. In response to this I propose to do two things. Firstly, I propose to provide a typology of interpretations of Fichte’s Absolute I, as some commentators seem to get entangled in these different interpretations, which can be very confusing to their readership. This paper discusses Gilbert Ryle’s image of philosophy as cartography in an attempt to explore the idea of a cartography of the phenomenon, confronting it with the sense it takes in Edmund Husserl’s transcendental phenomenology. Ryle tries to grasp the particularity of philosophical tasks as being about specific sorts of problems, not about specific sorts of objects. What is required both of a cartographer and of a philosopher is, according to him, to look at familiar spaces in wholly unusual terms. (...) Husserlian phenomenology then, with its rediscovery of consciousness as an absolute, unbounded field, meets quite well this demand. The uncovered field of the phenomena is not a new region, opposing that of the objects as faced in the natural attitude. It is rather a completely different attitude, just as a map is not a share of the world, but a distinct orientation towards it. The phenomenon, therefore, would not be something that is there to be cartographed as much as a kind of cartography itself. A phenomenological cartography, however, is one that has its specific marks, different from those of the Rylean conception. (shrink)

Este artigo mostra que não há uma tese de subdeterminação de teorias científicas pelos indícios observacionais, mas várias. Identificamos quatro, com significados, plausibilidades e implicações distintos. Mostra-se que as mais fortes não passam de conjeturas, e que as mais fracas são mais plausíveis, mas não possuem implicações filosóficas robustas – em particular, não implicam o antirrealismo científico –, embora forneçam indícios de alternativas teóricas sistematicamente ignoradas na ciência, bem como do emprego de critérios em parte valorativos de escolha de teorias.

Introduction:Despite being considered as a contravention under some countries’ legislation, the therapeutic use of Cannabis sativa has been growing in Brazil, due to the promising results observed in many pathologies. Such a scenario has fostered the need to deepen discussions on the subject and possibly revise legislation governing the substance use and access.Objectives:Identify the types of stigma related to the therapeutic use of Cannabis and describe the strategies people use to overcome stigma.Methods:This integrative review was carried out in the databases (...) PubMed, Scopus, CINAHL, MEDLINE, PsycINFO, Web of Science, and Cochrane Library, with 565 articles being retrieved. Triads’ cross-check were done, first maintaining the “cannabis” and “therapeutic use” pair, added by “stigma,” “bioethics,” “ethics,” “social consequences,” and “legal consequences.” The final selection resulted in six articles.Ethical Consideration:However, the ethical issues that pervade and regulate decisions on this subject must be considered.Results:Different dimensions and types of stigma related to the therapeutic use of Cannabis have been identified. The bioethical principle of autonomy was an expression of citizenship and human rights, mitigating internal conflicts related to self-stigma and the effects of external stigma on the person’s life.Conclusion:It was possible to identify the types of stigma related to the therapeutic use of Cannabis is an internal dimension represented and an external dimension, represented and to identify strategies adopted to face this stigma: skills training group for users, elaboration of laws and specific programs to clarify the therapeutic use of Cannabis with a greater social scope, and support for family members. Thus, contributing to the building of people’s autonomy in a broader context of decision-making autonomy and executive autonomy will provide the development of people’s capacity to perform complex tasks of self-management and, consequently, to continue promoting and preserving their decision-making process and their capacity to plan and perform tasks associated with managing their lives and their treatments. The generic idea that the human should enhance seems uncontroversial. However, there is a great controversy about the meaning of enhance and the means that should be used. The possibilities of enhance humans through the use of biotechnology are a central theme of the current bioethical debate. Human Enhancement is the concept used to translate the idea that a biotransformation would generate a bioenhancement. In this article, we present a proposal for a factual-elementary framework of the generic concept of human (...) enhancement, in order to highlight the differences between a normative terminology and a descriptive terminology. Then, we contest the radical polarization that creates a harmful bias in the debate, arguing that what is at issue is a decision making based on non-universal value judgments. (shrink)

Este artigo apresenta a concepção de democracia adotada pela Teoria dos Sistemas Sociais na versão de Niklas Luhmann. Embora seja um tema pouco frequente na obra do sociólogo, ela foi exposta com clareza no artigo The Future of Democracy, publicado em 1990. Neste artigo, a concepção é apresentada como uma hipótese histórica que foi capaz de prever e explicar algumas características da democracia ocidental após a queda do bloco soviético. O artigo avança um desenvolvimento dessa concepção democrática para entender melhor (...) o ressurgimento dos movimentos políticos de extrema-direita na última década e, por outro lado, mostrar como tais movimentos são incompatíveis com o princípio democrático proposto pela teoria luhmanniana. The problem of addiction to psychoactive substances, such as alcohol and other drugs, has been addressed in psychiatry traditionally from the perspective of a mechanistic-reductionist epistemological model, whose main focus in clinical care is to avoid or suppress the use of these substances, rather than understanding the meaning of a treatment and the meaning of the alterations of consciousness produced by these addictive substances. This paper attempts to contribute towards overcoming this epistemological perspective from the perspective of phenomenological psychopathology. In (...) the first part of the article, the main characteristics of phenomenology and its incorporation into the field of mental health will be presented. Then the issue of addiction will be analysed from two ways of understanding it: the mechanistic-reductionist model and the phenomenological dialectical model. Finally, the pragmatic consequences of the dialectical perspective of phenomenology, called Dialectical Phenomenology (DPh), which seeks to enrich the diagnostic process in the mental health clinic, allowing scientific diagnoses to approach the complexities of clinical reality, will be presented. Human extinction is something generally deemed as undesirable, although some scholars view it as a potential solution to the problems of the Earth since it would reduce the moral evil and the suffering that are brought about by humans. We contend that humans collectively have absolute intrinsic value as sentient, conscious and rational entities, and we should preserve them from extinction. However, severe threats, such as climate change and incurable viruses, might push humanity to the brink of extinction. Should that (...) occur, it might be useful to envision a successor to humans able to preserve and hand down its value. One option would be to resort to humanoid robots that reproduce our salient characteristics by imitation, thanks to AI powered by machine learning. However, the question would arise of how to select the characteristics needed for our successors to thrive. This could prove to be particularly challenging. A way out might come from an algorithm entrusted with this choice. In fact, an algorithmic selection both at the social and at the individual level could be a preferred choice than other traditional ways of making decisions. In this sense, reflecting on human extinction helps us to identify solutions that are also suitable for the problems we face today. (shrink)

Este artigo visa a mostrar que é possível bloquear o regresso sem lançar mão de recursos argumentativos ad hoc. Algumas considerações sobre a forma lógica de frases relacionais contendo termos que se referem a propriedades e relações mostram como substituir a forma viciosa de regresso por uma menos problemática.

Este artigo aborda a mudança de paradigma para a noção de trabalho na sociedade impactada pela transformação digital. Reformulando o conceito de trabalho como transformação conservadora de energia, de acordo com a primeira lei da termodinâmica, para o entendimento do trabalho como redução da entropia, conforme a segunda lei, é possível compatibilizá-lo com os conceitos de informação e de comunicação. O artigo sugere que esta reformulação já estava implícita na teoria marxista e a diferencia do modelo ricardiano clássico. A transformação (...) digital é pensada como corte epistemológico no modo de produção, que traz consequências para o sistema funcional da economia. Neste, o modo dominante da economia capitalista (o capitalismo de plataforma) é confrontado com modos alternativos como o da Economia Solidária. Alonso de Veracruz é o autor do mais antigo estudo realizado na América colonial sobre o comportamento lógico das proposições compostas pelos verbos 'começa' e 'cessa'. De modo geral, sua abordagem coincide com a análise híbrida dos lógicos terministas medievais, que conjugavam princípios semânticos e metafísicos para investigar os limites temporais da mudança. Apesar disso, o uso que ele faz de doutrinas pouco estudadas ou mesmo ignoradas pelos historiadores da lógica com o propósito de determinar a natureza dos instantes de (...) transição, a distinção entre itens sujeitos a mudança, a exposição das proposições formadas por 'começa' ou 'cessa', as relações de oposição entre elas e a suposição de seus termos categoremáticos, evidencia a importância histórica e doutrinária da lógica alonsina da mudança. No De grammatico, Anselmo distingue e articula algumas noções linguísticas a fim de esclarecer uma suposta inconsistência na semântica dos termos denominativos. O presente estudo sustenta que a apelação é por ele concebida como uma noção básica a partir da qual a significação de um termo denominativo pode ser estabelecida. Essencialmente, Anselmo define a apelação em termos pragmático-referenciais e dela se vale para realizar três procedimentos consecutivos, cujo propósito é determinar a significação de um termo denominativo. De início, ele indica (...) o que o termo denominativo apela. Em seguida, ele explicita a significação da sentença que contém tal termo, substituindo-o por sua definição. Finalmente, ele identifica o que o termo abstrato dessa definição apela. Segundo Anselmo, dado que um termo denominativo significa per se o que na significação da sentença correspondente se predica do que ele apela e significa per aliud aquilo que ele apela, basta especificar ambas as apelações para, com base nelas, obter a significação de um termo denominativo. A tradução a seguir tem como pretensão demonstrar o modo como Gaston Berger (1896-1960) em seu texto Husserl et Hume, promove uma articulação entre a fenomenologia de Edmund Husserl e o empirismo de David Hume. No texto, o autor apresenta a maneira como a fenomenologia ao valorizar a experiência (tendo-a como imprescindível) se aproxima da filosofia de Hume, e ao tratá-la como insuficiente por si mesma, acaba por estabelecer uma estreita relação com o idealismo transcendental kantiano. O fato é que (...) por mais que Husserl acredite ter superado a imediaticidade dos fatos empíricos vindo a construir um novo sistema de idealismo transcendental, a sua fenomenologia jamais deixou de clara fazer referência a Hume. Following a trend in bioethical/applied ethics approaches, one of the frustrating features of studies on technological human enhancement is their dichotomous tendency. Often, benefits and risks of technological human enhancement are stated in theoretically and empirically vague, polarized, unweighted ways. This has blocked the debate in the problematic ‘pros vs. cons’ stage, leading to the adoption of extremist positions. In this paper, we will address one side of the problem: the focus on risks and the imprecise approach to them. What (...) motivates our approach is the identification of the weaknesses of the anti-enhancement criticism, which stem from its use of the concept of risk, as well as the heuristic of fear and the precautionary principle. Thus, ‘taking a step back’ to move forward in the debate, our purpose is to establish some theoretical foundations concerning the concept of risk, recognizing, at the same time, its complexity and importance for the debate. Besides the concept of risk, we emphasize the concept of existential risk, and we make some considerations about epistemic challenges. O texto analisa a Constituição Federal de 1988 traduzida em norma e em fato no que concerne à solidariedade ambiental frente às mudanças climáticas que provocam a desigualdade. Desta forma, defende-se sua função dentro do âmbito jurídico e social da solidariedade em face da desigualdade social provocada por este fenômeno ambiental. Pressupõe-se que a solidariedade ambiental é um instrumento relevante a ser observado e aplicado na contenção das desigualdades provocadas pelas mudanças climáticas, que promovem a pobreza, a degradação ambiental e (...) a não realização dos direitos fundamentais/humanos. This article develops a phenomenological contribution to biological psychiatry. Grounded in the principles of transformation, heterogeneity, proportionality and particularity, a paradigm of phenomenological orientation allocates to biology a role different from that assumed by official Cartesian psychiatry. First, no clear definition of what is biological may be established a priori—as a general application, and useful to each and every studied phenomenon. Biology may be understood only as the experience of ununderstandable elements within consciousness, and as belonging necessarily to a whole (...) unity of conscious experience. Second, the research agenda in biological psychiatry necessarily intersects with the investigation of the particularities of each individual clinical case with its unique characteristics. Without this, the very notion of biological psychiatry becomes merely a theoretical abstraction. Finally, the continuity of the biological agenda needs to resume the construction and investigation of psychopathological categories that cohere with the reality of the mental universe. (shrink)

Em primeiro lugar, cabe à fundação assegurar a distinção entre os princípios enumerados na figura A da Ars generalis ultima, seus correlativos e Deus, que, apesar de serem necessariamente coextensionais, não se confundem hiperintensionamente por não compartilharem a mesma fundação. Paralelamente, compete à fundação assegurar que os constituintes da realidade possam se arranjar hierarquicamente (...) segundo a variação dos seus graus de semelhança, encadeando-se fundacionalmente conforme a intensidade com a qual os princípios neles se contraem. De fato, a responsável direta por tal organização hierárquica da realidade é justamente essa capacidade de contração que os princípios têm de assumir uma condição contraída nas coisas que os manifestam e que a eles confere o seu caráter fundacional. O presente artigo pretende explorar a máxima contida em Os irmãos Karamázov (se não há Deus, tudo é permitido?) à luz do pensamento de Immanuel Kant. Para tanto, se vale do pensamento de Dostoiévski apenas na medida em que ele serve como auxílio na apresentação da ideia de Deus e de sua relação com a posição do ateu. Tendo em vista a filosofia kantiana, buscamos não apenas a apresentação dessa ideia, mas também sua relação com o ato moral e com (...) a própria condição desse ato. Isso, portanto, resultará em Kant, uma resposta duplamente negativa à pergunta que reflete a posição ateísta de Ivan Karamazov. Pois Kant ao distinguir o ato moral por dever e conforme o dever, defende que recorrer a algo externo à razão (Deus) constituiria uma vontade meramente heterônoma. Portanto, o ato moral por excelência ocorre quando a ação é realizada de um modo unicamente guiado pela razão, com base num interesse puro, e isso conduz, por sua vez, à reprovação por parte de Kant da referida máxima presente na obra de Dostoiévski. O presente artigo almeja demonstrar que em Einleitung in die Logik und Erkenntnistheorie, de 1906/07, por meio de uma crítica ao ceticismo, Husserl promove uma mudança que será significativa no desenvolvimento posterior de sua filosofia: a introdução da εποχή. Ao contrário do ceticismo grego, tal conceito em Husserl, ao suspender o juízo, busca um dado indubitável: o ego. Isso proporciona com que Husserl supere o ceticismo, tanto em sua face dogmática (negação de possibilidade de todo o conhecimento), quanto crítica (suspensão (...) do juízo perante o alcance do conhecimento). Com isso, pode-se perceber que ao retomar um conceito cético da filosofia antiga, e opor-se ao relativismo, Husserl inaugura o seu primeiro esboço de uma filosofia pura, que adiante será concretizada, em sua última fase, como idealismo fenomenológico-transcendental.
