The effective collection and management of personal data of rapidly migrating populations is important for ensuring adequate healthcare and monitoring of a displaced peoples’ health status. With developments in ICT data sharing capabilities, electronic personal health records (ePHRs) are increasingly replacing less transportable paper records. ePHRs offer further advantages of improving accuracy and completeness of information and seem tailored for rapidly displaced and mobile populations. Various emerging initiatives in Europe are seeking to develop migrant‐centric ePHR responses. This paper highlights their (...) importance and benefits, but also identifies a number of significant ethical, legal and social issues (ELSI) and challenges to their design and implementation, regarding (1) the kind of information that should be stored, (2) who should have access to information, and (3) potential misuse of information. These challenges need to be urgently addressed to make possible the beneficial use of ePHRs for vulnerable migrants in Europe. (shrink)

The texts of Walid Daka, a Palestinian political prisoner incarcerated since 1986, challenge the notion that colonial power ends with decolonization and expose the shortcomings of examining colonial prisons solely through the eliminatory prism of death and deprivation. Studying Daka’s texts, the article presents how the Israeli carceral system has managed to utilize prisoners’ hopes and longings – in their relations with one another, their political actions such as hunger strikes or their building of internal leadership hierarchies, and their affective (...) worlds – to further its own goals. Rather than a pessimistic account, this article critically analyzes Daka’s writings to demonstrate how a first-person study of carceral subjectification can unfold within an activist framework. Daka uses these observations to develop an alternative articulation of decolonization that I term ‘abolitionist decolonization’ as a collective and continued insistence on setting the terms of getting free. By ‘abolitionist decolonization,’ I conjure a difficult conversation between a Fanonian project of never-ending decolonization and a Foucauldian project of never-ending abolition. As such, this critical attitude aims to counter settler-colonial carcerality in ways that will foil the administration’s attempts to reproduce the dangers that the prisoners seek to elude, through the very means they deploy to elude them. Moral Entanglements: Conserving Birds in Britain and Germany, by Stefan Bargheer, claims that work and play orientations have respectively organized German and British wild bird conservation efforts. The book argues that work and play are nonmoral categories, and—more broadly—that moral justifications for action should be understood as mere post-hoc surface phenomena that contribute little to social action. The new French pragmatic sociology provides conceptual tools to examine how categories like work and play intertwine with logics of moral evaluation that define (...) what activities rightly qualify as each category, what public goods might each yield, and what value ought to be attached to them. With this approach in mind, this review examines Moral Entanglements’ claims, and identifies ways in which moral logics did indeed play a role in establishing different bird conservation styles in each country. The review highlights the broader importance for comparative-historical sociologists to take moral repertoires into account as they reconstruct historical institutional emergence. (shrink)

This study evaluated the potential contribution of extrageniculate visual pathways to oculomotor orienting reflexes in hemianopic patients. It tested whether extrageniculate pathways mediate inhibition of return —a phenomenon characterized by slowed target detections at recently stimulated locations . Because hemianopic subjects cannot overtly respond to stimuli presented within their hemianopic field, we utilized a spatial cueing paradigm that capitalized on the fact that IOR operates in spatiotopic coordinates. Subjects moved their eyes so that a cue and a target presented at (...) the same spatial location were imaged successively onto blind and seeing portions of their retinas. One hemianopic patient showed a similar IOR effect from cues presented within both the seeing and the hemianopic fields. With a second hemianopic patient, only presentations of the cue to the subject's seeing field produced IOR. The explanation for this discrepancy is not evident. These observations highlight both the potential value and the pitfalls inherent in using “blindsight” as a window into human consciousness. (shrink)

Thomas Jefferson’s famous proposal; whereby a state’s constitution should be re-enacted every 19 years by a majority vote; purports to solve the intergenerational problem caused by perpetual constitutions: namely that laws which were enacted by people who are already dead bind living citizens without their consent. I argue that the model fails to fulfil its own normative consent-based aspirations. This is because it produces two groups of people who will end up living under laws to which they did not give (...) their consent: citizens who reach the voting age after the re-enactment process; citizens who did not assent to being obliged by the majority vote’s results. I reject possible responses to my argument by showing that they result in making the model either impractical or redundant. The remainder of the paper discusses whether implementing the model would enhance the consent-based legitimacy of the modern state. (shrink)

The adversarial legal system is traditionally praised for its normative appeal: it protects individual rights; ensures an equal, impartial, and consistent application of the law; and, most importantly, its competitive structure facilitates the discovery of truth – both in terms of the facts, and in terms of the correct interpretation of the law. At the same time, legal representation is allocated as a commodity, bought and sold in the market: the more one pays, the better legal representation one gets. In (...) this article, I argue that the integration of a market in legal representation with the adversarial system undercuts the very normative justifications on which the system is based. Furthermore, I argue that there are two implicit conditions, which are currently unmet, but are required for the standard justifications to hold: that there is (equal opportunity for) equality of legal representation between parties, and that each party has (equal opportunity for) a sufficient level of legal representation. I, therefore, outline an ideal proposal for reform that would satisfy these conditions. (shrink)

Recent years have seen numerous sociological disagreements devolve into heated debates, with scholars openly accusing their peers of being both empirically wrong and morally misguided. While social scientists routinely reflect on the ethical implications of certain research assumptions and data collection methods, the sociology of knowledge production has said little about how moral debates over scholarship shape subsequent research trajectories. Drawing on the new French pragmatic sociology, this article examines how sociologists respond to criticisms of the moral worth of their (...) research. The article outlines three typical responses: (1) accepting the criticism and changing direction completely; (2) accepting the criticism but changing discursive framing to incorporate existing research without being subject to critique; and (3) navigating through the debate by devising new research directions that do not trigger such criticism. To demonstrate, the article looks at how sociologists of religion responded, in their published scholarship, to criticisms of secularization theory as depreciating religious people and spiritual experience. Across the responses, we show that sociologists have included moral considerations in their empirical investigations, and have switched among several diverse moral justifications to address—and also avoid—criticism. We conclude by demonstrating that this model can be extended to other domains of sociological inquiry, including the study of gender-based wage inequality and methodological nationalism. The article highlights the importance of mapping the moral frameworks sociologists use for the sociology of knowledge and the sociology of morality. (shrink)

Abstract. Darwinism has attracted proportionately less attention from Jewish thinkers than from Christian thinkers. One significant reason for the disparity is that the theodicies created by Jews to contend with the catastrophes which punctuated Jewish history are equally suited to address the massive extinctions which characterize natural history. Theologies of divine hiddenness, restraint, and radical immanence, coming together in the sixteenth-century mystical cosmogony of Isaac Luria, have been rehabilitated and reworked by modern Jewish thinkers in the post-Darwin era.

International courts strive to enhance their legitimacy, that is, they would like the members of the international community to perceive their judgments as just, correct and unbiased even if they do not agree with their specific content. This Article argues that international courts take into account the actors they interact with, the norms they apply, and the conditions they operate under as they try to enhance their legitimacy. It demonstrates strategic behavior towards that end in the judgments of two prominent (...) international courts - the International Court of Justice and the European Court of Human Rights. International courts interact with states under their jurisdiction and with their national courts. International courts try to preserve their legitimacy vis-à-vis states; at the same time, they want to signal that states will comply with them even if they issue judgments states disagree with. International courts can cooperate with national courts and gain legitimacy from interacting with legitimate national courts. The norms that international courts apply constrain their ability to maneuver their judgments in ways that can help their legitimacy, but at the same time help legitimize their judgments. International courts use various tactics to shape their reasoning in order to improve their legitimacy. The behavior of international courts is scrutinized by the domestic public within each state. That public has certain agendas, priorities and preferences. The domestic public’s agenda is a condition that the court must respond to, but sometimes courts can also shape that agenda to their benefit. (shrink)

Chaim Perelman invokes the idea of “universal audience” for explaining the nature of philosophical argumentation as rational rhetoric. As opposed to this view, centuries before Perelman, Socrates argues that philosophy should be conducted as a dialogue between concrete individuals with very specific qualities. The paper presents these different views in order to claim that the philosopher addresses neither a universal audience nor a particular other, but mainly and essentially the philosopher herself/himself. This brings to light the problem of self-deception as (...) a central problem of philosophical thinking. In posing this view the paper uses Nietzsche’s definition of “the will to truth” as the will not to deceive, not even myself. (shrink)

Jürgen Habermas's theories have received enormous attention in the public sphere as well as in political science. It is therefore surprising that his method, rational reconstruction, is not more debated. In political science the method is of particular interest because of its ambition to bridge the gap between empirical and normative approaches. In this article the author traces Habermas's interest in rational reconstruction by going back to his writings on theory and practice and subsequently shows what the method's main principles (...) are. He then specifies how this methodological conception is used in Habermas's political theory. Finally, the introduction of an empirical design allows the author to discuss one of the fundamental tensions in Habermas's approach: the hypotheses arrived at through rational reconstruction are empirical hypotheses but cannot be tested by empirical means. Wolfhart Pannenberg's innovative account of the Trinity, in which the mutual self-distinction of the divine persons is also constitutive for the divinity of each, is an important corrective to one-sided views of Trinitarian relations which reductively account only for relations of origin. However, his account ties relationality to death and self-emptying in such a way that it becomes impossible to escape a hierarchical account of Trinitarian relations in which the differences between the persons collapse into an ordered relation that repeats (...) the pattern of the relations of origin. As a result, the most significant potential contribution of Trinitarian theology, its responsiveness to a reality that is internally differentiated yet non-competitive, is lost. This problem is the result of tying the inner-Trinitarian relations too closely to the cross, such that there has to be something in the divine life that can make the cross possible, a move that has become increasingly popular in recent Trinitarian theology. The inner-Trinitarian relations are then reduced to a single taxis which is not sufficiently flexible to respond to the various ways in which God interacts with the world as narrated in the Bible. One of the most popular facets of Schmitt's philosophy is his theory of sovereignty and decisionism, as developed in his early essay Political Theology (1922). There, Schmitt offers an original outlook on the political implications of the secularization of modern Europe and philosophy's purported turn away from theology. The “death of God,” along with the gradual disappearance of the political institution of monarchy, are only symbols of the decline of sovereignty in general. I offer a novel distinction between two concepts of competition. The first, parallel competition, is designed to create separate pathways for each competitor wherein they can maximize their performance. The second, friction competition, is designed to facilitate a clash between competitors. Each concept is utilized as an institutional mechanism to generate social benefits. In parallel competition, the social benefit is the result of the aggregation of the independent efforts of each competitor. In friction competition, it emerges from the clash between (...) competitors. I argue that this distinction carries significant normative implications concerning debates over equality, freedom, and democratic institutional design. (shrink)

A well-known objection to prioritarianism, famously levelled by Mike Otsuka and Alex Voorhoeve, is that it wrongly ignores the unity of the individual in treating intra-personal cases like inter-personal cases. In this paper we accept that there should be a moral shift between these cases, but argue that this is because autonomy is a relevant consideration in intra-personal but not inter-personal cases, and one to which pluralist prioritarians ought to attend. To avoid this response, Otsuka and Voorhoeve must assume we (...) know nothing about the subjective information of the person being chosen for. But we show that this commits them to two controversial assumptions: that welfare consists in an objective list of goods, and – if one accepts an unorthodox but plausible account of the relationship between risk aversion and rationality – that there is only a narrow range of rational risk aversions. Only prioritarians who accept both these assumptions are on the hook of Otsuka and Voorhoeve’s objection; for all others, the examples have insufficient information, and so lose their sting. This study explores how therapists deal with ethical dilemmas in psychotherapy with older adults. Semi-structured interviews were conducted with 14 therapists and analyzed using grounded theory methodology. Findings clustered around three themes: (i) respecting autonomy when interacting with family of vulnerable and dependent older patients; (ii) prioritizing respecting autonomy in risk situations and in suspected financial abuse without impaired judgment; and (iii) prioritizing protecting the patient in risk situations of patients with dementia and of suspected physical abuse or neglect. This book explores dialogue as a transformative form of philosophical practice by unveiling the method behind the unique dialogue developed by mystic and thinker Jiddu Krishnamurti (1895–1986). While Krishnamurti himself generally rejected the cultivation of systems and techniques, Shai Tubali argues that there are easily identifiable patterns through which Krishnamurti strove to realize his dialogical aims. For this reason, he refers to this method, whose existence has evaded Krishnamurti’s followers and scholars alike, as the Krishnamurti dialogue. He suggests that (...) these discursive patterns serve to broaden our understanding of the possibilities of philosophical and religious dialogues and further illuminate established forms of dynamic discourse, such as the Socratic method. Inspired by Pierre Hadot’s revolutionary reading of the classical Greco-Roman texts, the author centers his attention on Plato’s Socratic dialogues and the guru–disciple conversations in the Hindu Upanishads, which fall within the scope of what may be termed ‘the transformative dialogue’: dialogues that have been written with the intention of bringing about a transformation in the mind of the interlocutor and reader and reorienting their way of life. This text appeals to students as well as researchers and suggests that the Krishnamurti dialogue is not only a continuation and development of the transformative dialogue, but that it also amalgamates ingredients of classical Western philosophy and South Asian mysticism. Moreover, this type of dialogue encourages readers to revisit the lost practice of transformative philosophy, in that it reveals new pathways of philosophical and religious inquiry that bear thought-provoking practical implications. Throughout the 3-year war in Lebanon (1982-1985) and throughout the 7 years of the first Intifada (1987-1994), about 170 objecting reservists chose to adopt an unconventional mode of moral resolution for their dilemma about service in the conflict: they disobeyed the order to serve in the war zone when their unit was called up. They argued that such service would contradict the dictates of their conscience. At the outset, the intention of most of these reservists was to comply with orders (...) for general military service. They asked to serve within the Green Line. When their request was overruled and they continued to disregard their call-up, they were charged with a disciplinary offense (Israel has no legal provision for selective conscientious objection). They subsequently were tried by court-martial and were sentenced to 14-35 days in military prison, some of them more than once when they refused additional drafts. Their major conscientious claims revolve around two major constraints: resisting the unfair physical load of military reserve service and resisting the obligation to face morally no-win situations. I would further argue that even though most of the public and the senior army echelons were familiar with these two types of moral voices, they preferred to remove the conscientious soldiers from their posts, or to ignore the claims themselves. Biomedicine is typically defined as the branch of medicine that is based on the principles of biology and biochemistry. A central tenet for biomedicine is the notion of disease and therapeutic specificity, i.e. the idea of tailored treatments for discrete disorders underpinned by specific pathologies. The present paper is concerned with how notions of disease and therapeutic specificity guide biomedical reasoning. To that end, the author proposes a model – the specificity triad – that draws on late philosopher and physician (...) Ludwik Fleck’s concept of “style of thought” to offer a frame for investigating the intricate process through which links between disorders, mechanisms, and therapeutics are established by biomedicine. Next by applying the specificity triad model to scrutinize research efforts in two discrete areas of medicine—psychiatry and regenerative medicine—this paper seeks to stimulate pertinent discussions in and about biomedicine. These include discussions on the ambiguous epistemic status of psychiatry within contemporary biomedicine, as well as the relationship between developmental biology — historically relatively disjointed from biomedical enterprise — and the burgeoning field of regenerative medicine. A large body of evidence on the activity of regulatory T (Treg) cells was gathered during the last decade, and a similar number of reviews and opinion papers attempted to integrate the experimental findings. The abundant literature clearly delineates an exciting area of research but also underlines some major controversies. A linear cause–result interpretation of experimental maneuvers often ignores the fact that the activity of Treg cells is orchestrated with the effector T (Teff) cells within an intricate network of physiological (...) immune homeostasis. Every modulation of the activity of the effector (cytotoxic) immune system revolves to affect the activity of regulatory (suppressive) cells through elaborate feedback loops of negative and positive regulation. The lack of IL‐2 production by innate Treg cells makes this cytokine a prime coupler of the effector and suppressive mechanisms. Although a great deal of literature has looked at how individuals respond to stigma, far less has been written about how professional groups address challenges to their self-perception as abiding by clear moral standards. In this paper, we ask how professional group members maintain a positive self-perception in the face of moral stigma. Drawing on pragmatic and cultural sociology, we claim that professional communities hold narratives that link various aspects of the work their members perform with specific understanding of the (...) common good. These narratives allow professionals to maintain a shared view of their work as benefitting society and to perceive themselves as moral individuals. As a case study, we focus on the advertising industry, which has long been stigmatized as complicit in exploitative capitalist mechanisms and cultural degradation. We draw on nine total months of fieldwork and seventy-four interviews across three US advertising agencies. We find that advertising practitioners use narratives to present their work as contributing to the common good, depicting themselves as moral individuals who care about others in the process. We analyze three prevalent narratives: the account-driven narrative, which links moral virtue to caring for clients; the creative-driven narrative, which ties caring to the production of meaningful advertisements; and the strategic-driven narrative, which sees caring in finding meaningful relationships for consumers and brands. What makes modern law and politics modern? What makes the question of "modernity" so central to our understanding of contemporary law and politics? To offer one possible answer to these questions this study examines the changing relationship between animals and humans and, more specifically, the new regulation of the slaughterhouse in turn of the century Germany. If humans and animals meet in the modern agora it is neither because animals are now perceived as more human-like, as champions of progress would (...) have it, nor because humans are perceived as more animal-like, as critics of modernity would suggest. Rather, both animals and humans have undergone a radical transformation, which has put them on the same plane. If life is that which humans and animals share in common, and politics is that which sets them apart, the history of animal laws suggests that modernity entails the radical transformation of both life and politics. This Article strives to understand this change through the transformation of both politics and life into processes, i.e., into that which can be scientifically known and thus manipulated. The different strategies of reformers of slaughtering as well as their opponents are analyzed in light of this fundamental transformation. (shrink)

The stereotype content model defines warmth and competence as basic dimensions of social judgment, with warmth often dominating perceptions; it also states that many group-related stereotypes are ambivalent, featuring high levels on one dimension and low levels on the other. Persuasion theories feature both direct and indirect source effects. Combining both the approaches, we studied the persuasiveness of ambivalently stereotyped sources. Participants read persuasive arguments attributed to groups stereotyped as either low in competence but high in warmth or vice versa. (...) In Study 1, high competence/low warmth sources were more persuasive than low competence/high warmth sources. In Study 2, this pattern replicated when an accuracy motive had been induced, whereas it reversed when a connectedness motive had been induced. These source effects were direct, that is, independent of message processing. We discuss our findings in terms of the persuasiveness of warmth vs. competence of the source as being dependent on recipient motivation; we also consider theoretical implications and perspectives for future research. During the course of the nineteenth century, a dramatic change took place in the way Americans die. The deathbed, formerly governed predominantly by religious tradition, gradually was being shaped by medical ethics and state law. By the end of the nineteenth century, not only had the physician replaced the priest as master of ceremonies at the deathbed, but the state, in the form of positive law, had begun to express an interest in regulating the treatment of the dying patient. This (...) interest first emerged in the context of the late nineteenth-century public debate over the legitimacy of medical euthanasia, an issue passionately disputed to this day in America and other Western societies. The history of the deathbed in nineteenth-century America suggests that the intervention of the state in the regulation of dying is a relatively new phenomenon. This paper examines this history, thereby enabling us to explore a world in which the legal regulation of dying was still unthinkable and inviting us to contemplate the historical significance of this development. The paper traces the changes that occurred during the nineteenth century in deathbed ethics, concluding with proposals for regulating dying legally through euthanasia. It focuses on the most significant moments in the history of the nineteenth-century deathbed, outlining a three-stage transformation in deathbed ethics--from the realm of religion, to the jurisdiction of medical ethics, to positive law regulation--a movement that reflects a change not only in specific rules of deathbed conduct, but also a more decisive alteration of the entire normative system governing the deathbed and the entire experience of dying. The insight to the modus operandi of regulatory law that emerges in the paper can lead to a deeper understanding of the conditions of its possibility. Regulation is only possible if the phenomenon to be regulated undergoes a transformation through which it severs its connections with anything that cannot be regulated. Thus, the paper shows how a radical transformation in the way people die was necessary for regulation by state law to emerge. (shrink)

The question of the use of force and its relation to political power has resurfaced in an era of terror attacks and wars against terror. The liberal conceptualization of this relation is limited by the bipolar understanding of force as either legitimate or illegitimate. Turning to the history of the Irgun, a Jewish underground movement, and its struggle against the British Empire in 1947 Palestine, this article seeks to expand the understanding of force beyond the liberal paradigm. The article offers (...) a new model for understanding the use of force by the liberal nation-state and distinguishes between four different modes of force: violence, legality, terror, and empire. Whereas the liberal paradigm is limited to a conception of force as either justified and, hence, just, or unjustified and, hence, unjust, one may think of two additional forms of force, which, at first, may seem paradoxical: the unjust but justified force of terror and the force of empire, which is just but not in need of justification. Rather than using these forms as stable categories, the article seeks to understand the ways in which the uses of force became destabilized in times of political contestation. The article concludes by pointing out the broader implications of this model for the political analysis of the liberal nation-state and its use of force. (shrink)

A unique Middle English text on the seven liberal arts survives in Cambridge, Trinity College, MS R. 14.52, a manuscript of ca. 1458–85. Latin texts on the seven liberal arts were certainly in circulation in medieval England, but this text is, to my knowledge, the earliest one written in English. It thereby offers evidence of the vernacular English reader's knowledge of the arts that were the foundation of medieval university education. This text is also unique in that it includes in (...) its chapter on grammar an attempt to describe the phonetic production of the letters of the alphabet, providing the only surviving contemporary approximation of the pronunciation of medieval English, and in that it adds a chapter on the mechanical sciences, relating them as no other medieval author to the English craft guilds. Given the growing importance of issue competition and the growing use of social media during elections, this study seeks to create a better understanding of how issue dynamics relating to political parties play out on social media. It tests whether issue ownership theory can explain how parties and issues are being discussed on Twitter and to what extent a mediated form of issue ownership aligns with citizens’ perceptions of issue ownership. The results indicate that perceptions of issue ownership as measured (...) in representative surveys correlate with variations of what issues parties are linked with on Twitter. Some deviations also emerged, which possibly reflect short-term changes in parties’ issue competition.
