Femmes et filles de marchands restent seules pendant de longues périodes dans leur maison à Aššur, partent fonder un foyer à Kaniš (en Anatolie centrale), ou suivent leurs maris dans toutes leurs pérégrinations en Asie Mineure. Les nombreuses archives cunéiformes – correspondance privée et documents (...) juridiques – découvertes dans le quartier commerçant de Kaniš illustrent les différents voyages accomplis par les femmes avec ou sans leurs époux. En partant de la notion d’« accommodement raisonnable » telle que comprise dans le contexte légal du Québec et du Canada, nous parvenons à une interprétation des fondements normatifs de la distinction entre droits fondamentaux et accommodements qui repose sur la raison publique. Technology is even more than our world, our form of life, our civilization. Technology interacts with the world to change it. Philosophers need to seriously address the fluidity of a smartphone interface, the efficiency of a Dyson vacuum cleaner, or the familiar noise of an antique vacuum cleaner. Beyond their phenomenological description, the emotional experience acquires moral significance and in some cases even supplies ethical resources for the self. If we leave this dimension of modern experience unaddressed, we may miss (...) something of value in contemporary life. Combining European humanism, Anglophone pragmatism, and Asian traditions, Michel Puech pleads for an "ethical turn" in the way we understand and address technological issues in modern day society. Puech argues that the question of "power" is what needs to be reconsidered today. The relationship between Albert Einstein’s special theory of relativity and Hendrik A. Lorentz’s ether theory is best understood in terms of competing interpretations of Lorentz invariance. In the 1890s, Lorentz proved and exploited the Lorentz invariance of Maxwell’s equations, the laws governing electromagnetic fields in the ether, with what he called the theorem of corresponding states. To account for the negative results of attempts to detect the earth’s motion through the ether, Lorentz, in effect, had to assume that the laws (...) governing the matter interacting with the fields are Lorentz invariant as well. This additional assumption can be seen as a generalization of the well-known contraction hypothesis. In Lorentz’s theory, it remained an unexplained coincidence that both the laws governing fields and the laws governing matter should be Lorentz invariant. In special relativity, by contrast, the Lorentz invariance of all physical laws directly reflects the Minkowski space-time structure posited by the theory. One can use this observation to produce a common-cause argument to show that the relativistic interpretation of Lorentz invariance is preferable to Lorentz’s interpretation. (shrink)

Il faut donc concevoir l’éducation comme problématisation. Ce qui implique de doter les jeunes de nouveaux types de repères : boussole et cartes avec lesquels ils pourront s’orienter eux-mêmes sur le fond d’un héritage, d’une expérience transmise. Une philosophie de l’éducation inspirée de la problématologie de John Dewey et de Michel Meyer, permet un autre regard sur l’évolution des normes éducatives, sur les schèmes qui les sous-tendent, sur le savoir et la culture scolaire, sur l’émancipation. Readers of this volume will notice that it contains only a few papers on general relativity. This is because most papers documenting the genesis and early development of general relativity were not published in Annalen der Physik . After Einstein took up his new prestigious position at the Prussian Academy of Sciences in the spring of 1914, the Sitzungsberichte of the Berlin academy almost by default became the main outlet for his scientific production. Two of the more important papers on (...) general relativity, however, did find their way into the pages of the Annalen [35,41]. Although I shall discuss both papers in this essay, the main focus will be on [35], the first systematic exposition of general relativity, submitted in March 1916 and published in May of that year. Biogea is a mixture of poetry, philosophy, science, and biography exemplary of the style that has made Michel Serres one of the most extraordinary thinkers of his age. His philosophical and poetic inquiry sings in praise of earth and life, what he names singularly as Biogea. In these times when species are disappearing, when catastrophic events such as earthquakes and tsunamis impale the earth, Serres wonders if anyone “worries about the death pangs of the rivers.” And for Serres, one (...) can ask the same question of philosophy as the humanities increasingly find themselves in need of defenders. Today, all living organisms discover themselves part of this Biogea. “Today we have other neighbors, constituents of the Biogea: the sea, my lover; our mother, the Earth, becomes our daughter; this beautiful breeze which inspires the spirit, a spiritual mistress; our light friends, the fresh and flowing waters.”. In publications in 1914 and 1918, Einstein claimed that his new theory of gravity in some sense relativizes the rotation of a body with respect to the distant stars and the acceleration of the traveler with respect to the stay-at-home in the twin paradox. What he showed was that phenomena seen as inertial effects in a space-time coordinate system in which the non-accelerating body is at rest can be seen as a combination of inertial and gravitational effects in a space-time (...) coordinate system in which the accelerating body is at rest. Two different relativity principles play a role in these accounts: the relativity of non-uniform motion, in the weak sense that the laws of physics are the same in the two space-time coordinate systems involved; what Einstein in 1920 called the relativity of the gravitational field, the notion that there is a unified inertio-gravitational field that splits differently into inertial and gravitational components in different coordinate systems. I provide a detailed reconstruction of Einstein's rather sketchy accounts of the twins and the bucket and examine the role of these two relativity principles. Droit et morale Sous la direction de Dominique Bureau, France Drummond et Dominique Fenouillet Véritable « pont aux ânes de la pédagogie juridique », la question des relations qu'entretiennent Droit et Morale appelle une réponse doctrinale presque invariable: la séparation de principe n'exclurait pas l'influence réciproque. Le droit contemporain semble pourtant traversé par deux courants a priori antinomiques: ici, la référence morale est invoquée comme une sorte de « tabou » qui justifierait le retrait du droit, alors que, là, elle (...) est appelée en renfort pour justifier telle solution ou fonder telle réforme. C'est de cette étrange coexistence du « retour offensif » et du « tabou » qu'est née l'idée d'organiser un colloque sur le thème « Droit et Morale. C’est à travers un ensemble de données (entretiens et données documentaires) que l’article décrit ce qu’ils en disent eux-mêmes. Analyser cette sexualité à partir du concept de « scripts sexuels » permet de comprendre comment l’impossibilité de coller aux normes leur permet de s’en détacher pour construire un répertoire personnel de scripts adaptés à leurs possibilités corporelles et à celles de leurs partenaires. (...) Leur sexualité récréative emprunte à des répertoires variés, dont ceux d’autres groupes minorisés. Elle est marquée par la négociation entre les partenaires de la symbolique des parties du corps ou des pratiques, la souplesse des rôles masculins et féminins, la réciprocité. L’objectif du rapport est souvent la « connexion » entre les partenaires dans un plaisir qui se nourrit du plaisir de l’autre. Non prise en compte dans les recherches habituelles, la sexualité récréative des hommes handicapés moteurs ébranle les normes et montre un potentiel subversif. (shrink)

BackgroundMoral distress is a phenomenon that can lead to an imbalance of the mind and body. There are many coping strategies to overcome the obstacles that lead the subject to this condition. Some coping strategies are capable of being achieved through the cultivation of moral resilience.AimThe aim is to identify the strategies of moral resilience in the nursing management of University Hospitals in Brazil.Research designThe research design is the qualitative study with discursive textual analysis.Participants and research context: 44 nurse managers (...) and nurses in leadership positions participated in a total of 30 University Hospitals in Brazil. Data were collected online, using a questionnaire with open questions.Ethical considerationsThe Ethics Committee approved the study. Participants received information about the research, agreed to respond to the questionnaire, and were guaranteed anonymity.FindingsPersonal adaptive strategies (intrapersonal and interpersonal) and organizational collaborative strategies (intrinsic and transformational management) emerged from this process. The intrapersonal strategies involved elements of rationality, flexibility, rebalancing practices, moral courage, and detachment. The interpersonal strategies addressed support networks, team involvement, and dialog. Organizational strategies dealt with actions which reorient ethical infrastructure, ethical education, and psychological protection, as well as fostering dialogical relationships, empowerment, and cooperation.ConclusionFrom the perspective of social historical construction, it is understood that developing personal and organizational strategies is essential to cultivating moral resilience. “Special relativity killed the classical dream of using the energy-momentumvelocity relations as a means of probing the dynamical origins of [the mass of the electron]. The relations are purely kinematical” (Pais, 1982, 159). This perceptive comment comes from a section on the pre-relativistic notion of electromagnetic mass in ‘Subtle is the Lord . . . ’, Abraham Pais’ highly acclaimed biography of Albert Einstein. ‘Kinematical’ in this context means ‘independent of the details of the dynamics’. There is a striking difference between the methodology of the young Einstein and that of the old. I argue that Einstein’s switch in the late 1910s from a moderate empiricism to an extreme rationalism should at least in part be understood against the background of his crushing personal and political experiences during the war years in Berlin. As a result of these experiences, Einstein started to put into practice what, drawing on Schopenhauer, he had preached for years, namely to use (...) science as his means of escaping from “the merely personal.” Whatever the exact sources of Einstein’s about-face, the older man has left us with a highly misleading picture of how the younger man achieved the successes that we still celebrate today. This has had a harmful influence on theoretical physics. If the young Einstein’s successes are any guide as to how successful theoretical physics is done, close adherence to general features of the empirical data is much more and mathematical elegance is much less important than the old Einstein wanted us to believe. In this critical notice we argue against William Craig’s recent attempt to reconcile presentism (roughly, the view that only the present is real) with relativity theory. Craig’s defense of his position boils down to endorsing a ‘neo-Lorentzian interpretation’ of special relativity. We contend that his reconstruction of Lorentz’s theory and its historical development is fatally flawed and that his arguments for reviving this theory fail on many counts.

Qualitative research should strive for knowledge translation toward the goal of closing the gap between knowledge and practice. However, it is often a challenge in nursing to identify knowledge translation strategies able to illustrate the usefulness of qualitative results in any given context. This article defines storytelling and uses pragmatism to examine storytelling as a strategy to promote the knowledge translation of qualitative results. Pragmatism posits that usefulness is defined by the people affected by the problem and that usefulness is (...) promoted by modalities, like storytelling, that increase sensitivity to an experience. Indeed, stories have the power to give meaning to human behaviors and to trigger emotions, and in doing so bring many advantages. For example, by contextualizing research results and appealing to both the reason and the emotions of audiences, storytelling can help us grasp the usefulness of these research results. Various strategies exist to create stories that will produce an emotional experience capable of influencing readers’ or listeners’ actions. To illustrate the potential of storytelling as a knowledge translation strategy in health care, we will use our story of discovering this strategy during a qualitative study in a nursing home as an example. Nous voudrions montrer, à partir d’une relecture du (...) 2e Discours (362) de Grégoire de Nazianze (329-390), dont Foucault tire le concept d’une « économie des âmes », que cette idée ne présuppose nullement la référence au schéma trinitaire et renvoie bien davantage au modèle du « patronage » romain, couplé à la figure sacerdotale du bon berger. Cette analyse conduira, en outre, à rappeler le lien de la « direction des âmes » avec le paradigme médical. (shrink)

Les Leçons d'histoire de la philosophie du droit sont un jalon fondamental de la philosophie du droit de Michel Villey. Elles ambitionnent de construire une synthèse des apports nécessaires et successifs de l'histoire de la philosophie : " Il ne suffit plus de s'installer dans le sillage du seul Thomas, celui de Kant ou celui de Comte ; mais toutes ces doctrines ensemble sont les données de notre problème.
