The rapid dynamics of COVID-19 calls for quick and effective tracking of virus transmission chains and early detection of outbreaks, especially in the “phase 2” of the pandemic, when lockdown and other restriction measures are progressively withdrawn, in order to avoid or minimize contagion resurgence. For this purpose, contact-tracing apps are being proposed for large scale adoption by many countries. A centralized approach, where data sensed by the app are all sent to a nation-wide server, raises concerns about citizens’ privacy (...) and needlessly strong digital surveillance, thus alerting us to the need to minimize personal data collection and avoiding location tracking. We advocate the conceptual advantage of a decentralized approach, where both contact and location data are collected exclusively in individual citizens’ “personal data stores”, to be shared separately and selectively, voluntarily, only when the citizen has tested positive for COVID-19, and with a privacy preserving level of granularity. This approach better protects the personal sphere of citizens and affords multiple benefits: it allows for detailed information gathering for infected people in a privacy-preserving fashion; and, in turn this enables both contact tracing, and, the early detection of outbreak hotspots on more finely-granulated geographic scale. The decentralized approach is also scalable to large populations, in that only the data of positive patients need be handled at a central level. Our recommendation is two-fold. First to extend existing decentralized architectures with a light touch, in order to manage the collection of location data locally on the device, and allow the user to share spatio-temporal aggregates—if and when they want and for specific aims—with health authorities, for instance. Second, we favour a longer-term pursuit of realizing a Personal Data Store vision, giving users the opportunity to contribute to collective good in the measure they want, enhancing self-awareness, and cultivating collective efforts for rebuilding society. The present contribution proposes a reflection on the meanings of the actions of educational professionals when trying to prevent mental distress in their students and promote their well-being. This focus derives from the suggestion — indicated by Basaglia’s work in linking mental health to the existential, educational, social and cultural elements of everyone’s life conditions — that education can offer an important contribution to the development of, and support for, mental wellbeing. It would thus follow that educational professionals play a (...) potentially pivotal role in promoting mental health and in preventing possible disease, if they are aware of the possibilities and are appropriately trained. This paper, based on a phenomenological approach, refers to the words of schoolteachers and other educators collected in a qualitative educational research project and presents and explores possible ways of giving meaning to educational work in these areas. This article explores the change in meaning of the term `utopia' between 1968 and today. It proposes an interpretation of 1968 based on the connection between utopia and desire; the emergence of subjectivity in history meant a new way of becoming subjects of one's own history, and a new understanding of socio-political change, as including daily life and personal emotions.

Legislation usually lacks a systematic organization which makes the management and the access to norms a hard problem to face. A more analytic semantic unit of reference (provision) for legislative texts was identified. A model of provisions (provisions types and their arguments) allows to describe the semantics of rules in legislative texts. It can be used to develop advanced semantic-based applications and services on legislation. In this paper an automatic bottom-up strategy to qualify existing legislative texts in terms of provision (...) types is described. (shrink)

We almost every day direct our actions with reference to social, moral or legal norms and oughts. However, oughts and norms cannot be perceived through the senses: how can we “grasp” them, then? Adolf Reinach distinguishes enacted norms and oughts created through a social act of enactment, from moral norms and oughts existing in themselves independently of any act, knowledge or experience. I argue that this distinction is not a distinction between two species of oughts within a common genus: it (...) is rather a deeper ontological distinction between two modes of existence that are quite different, even though both are objective, according to Reinach. This ontological distinction is reflected in the way in which enacted oughts and moral oughts can be grasped, respectively: in the former case, the enacted ought is grasped by going back to the underlying social act from which it springs; in the latter, a “grasping through feeling” of the moral values is implied. A widespread thesis in the analytical theory of law is that norms exist as linguistic entities. Rodolfo Sacco is one of the authors who have most fruitfully insisted, on the contrary, that there is no necessary correlation between norms and language, not even in the specific context of law. He thus extended the conceptualisation of legal normativity well beyond the boundaries of language through the notions of cryptotype and mute law. This paper takes into account two alternative hypotheses to the (...) hypothesis that norms exist as linguistic entities, which are respectively based on the concepts of deontic state-of-affairs and deontic noema. Both hypotheses are tested for their applicability to the phenomena investigated by Sacco under the notion of mute law, notably with reference to cryptotypes. The question is raised then of how the existence of cryptotypes can be inferred from behaviour. The paper emphasizes the role that can be played in this context by nomotrophic behaviour, that is, the behaviour that consists in a reaction to the violation of a norm. (shrink)

Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health rather (...) than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

El kitsch no es solo una categoría que ha definido una de las posibles gramáticas estéticas de la modernidad, sino también una dimensión antropológica que ha tenido diferentes configuraciones en el curso de los procesos históricos. El ensayo ofrece una mirada histórico-crítica sobre las transformaciones que condujeron desde el kitsch de principios del siglo XX hasta el neokitsch contemporáneo: desde la génesis del kitsch hasta su afirmación como una de las manifestaciones más tangibles de la cultura de masas. Integrándose con (...) la estética posmoderna, el kitsch se transforma en neokitsch, una estética que utiliza el kitsch como su propia sintaxis en el complejo escenario de la estética contemporánea. /// -/- Kitsch is not just a category that has defined one of the possible aesthetic grammars of modernity, but also an anthropological dimension that has had different configurations in the course of historical processes. The essay offers a historical-critical look at the transformations that led from the early twentieth century kitsch to the contemporary neokitsch: from the genesis of kitsch to its affirmation as one of the most tangible manifestations of mass culture. Integrating with postmodern aesthetics, kitsch turns into neokitsch, an aesthetic that deliberately uses kitsch as its own syntax in the complex scenario of contemporary aesthetics. (shrink)

Seit 1923 publiziert sie wegweisende Forschungsarbeiten zum frühen Christentum und angrenzenden Themengebieten. Die Reihe ist historisch-kritisch verankert und steht neuen methodischen Ansätzen, die unser Verständnis des Neuen Testaments befördern, gleichfalls offen gegenüber.

In its first part the article examines visions of the family during 1968 and the succeeding years. It concentrates in particular on alternative visions of the family, both at a theoretical level (as with David Cooper's Death of the Family), and at the level of social history, with the rise and fall of the commune movement. It does so with reference to a methodology which concentrates on relationships, principally those between the individual and the family, between family and between the (...) family and the state. In the second part it surveys the widespread changes that have beset family relations and family life in the advanced capitalist societies since 1968: the lowering of fertility rates, the gradual decline of marriage, the significant changes in the position of women in the family, the increase in individualisation, as manifested in the growth of single-member households. The article then seeks to explore the relationship, if any, between the movement of 1968 and these transformations in the family. It examines both conservative and progressive interpretations, and suggests that paradoxically the movement left few sediments in the relationship between family and civil society but rather more in that between the state and the family. Assunzione fondamentale è che i nostri dispositivi rappresentazionali possano essere difettosi. Si configura dunque come l'attività che consiste nell'identificare i difetti in tali dispositivi e mettere in atto strategie di miglioramento. Verranno illustrate le questioni fondamentali a cui una teoria di ingegneria concettuale deve rispondere: in cosa consiste esattamente questa attività? Come possiamo attuarla? Quali meccanismi regolano la formazione dei dispositivi rappresentazionali? Possiamo influire su (...) tali meccanismi? Verrà inoltre presentata un'obiezione all'ingegneria concettuale e varie risposte. -/- Conceptual engineering is a branch of philosophy characterised by a normative approach towards representation. The fundamental assumption of it is that our representational devices can be defective. Conceptual engineering is then the activity consisting of identifying the defects of such devices and putting in place ameliorative strategies. This paper illustrates the fundamental issues for a theory of conceptual engineering: what does this activity consist of? How can we implement it? What mechanisms regulate the formation of representational devices? Can we have an influence over those mechanisms? Moreover, it will be presented an objection to conceptual engineering and various responses to it. (shrink)

Custom is a complex phenomenon, and one that is hardly given a satisfying account, especially if it is assumed, as many legal positivists do, that law is only produced through acts of will. After examining five main reasons for the complexity of custom, I will consider Uberto Scarpelli’s thesis that customary law can be given an account within legal positivism through a reinterpretation of norm-generating facts as the manifestations of a will. But what kind of will is implied here, and (...) how can the underlying norm be inferred? I will first briefly examine Gaetano Carcaterra’s analysis of abduction as a method to infer norms from behaviors, and then distinguish six different forms of will possibly implied in a behavior which is relevant for the formation of a customary norm. I will finally focus on norm-oriented, or nomotropic will, and especially on nomotrophic will, that is, the will –implied and expressed in the reaction to the violation of a norm– that the infringed norm be valid. The case of the Juke family is one of the most notable episodes of the history of eugenics in the USA. The Jukes were initially brought to the fore in the 1870s by a famous investigation that aimed at estimating the interplay of heredity and environment in determining the problems of poverty and crime. This inquiry triggered a harsh confrontation between two polar interpretations of the study, an “environmentalist” one and a “hereditarian” one. It was with the later reassessment of (...) the case made by the Eugenics American Office (ERO) in the 1910s that the controversy was considered closed with the victory of the eugenicists’ hereditarian stance. As a result, the family was made a living proof of the alleged hereditary nature of crime and pauperism and a case study in support of the eugenicists’ plea for the sterilization of people deemed the bearers of hereditary defectiveness. In this article, I explore the role played by pedigrees and other diagrammatic representations in the eugenicists’ appropriation of the meaning of the case of the Juke family and the role played by this appropriation in asserting the superiority of the ERO’s method of work over rival approaches. This article investigates why Humboldtian Science, as a heuristic concept, has gained prominence in the historiography of science and requires clarification. It offers an ideal-type model of comparative research and exact measurements across vast spaces, which Susan F. Cannon and others tied to Alexander von Humboldt (1769–1859). Yet, he himself was less “Humboldtian” than this concept suggests. The article proposes to disentangle Humboldtian Science from Humboldt’s science, which constituted a set of individual research practices that defied the ideal of precision. (...) Humboldt’s science was often impromptu, marked by epistemological and personal insecurities, and embedded in the protagonist’s peripatetic way of living and frequently erratic writing style. Historicizing Humboldt’s science undermines the exceptionalism that elevates the Prussian savant above his contemporaries and casts him as a singular figure. This critical reflection encourages biographical approaches to the history of science, balancing heuristic generalizations and attention to individual research styles. (shrink)

El presente artículo intentará mostrar el punto de transición que se da en el pensamiento merleau-pontyano entre un primado de la percepción y una rehabilitación ontológica de lo sensible. Dicho punto se refiere a una prioridad ontológica del mundo percibido, el cual pone de manifiesto el paso hacia una ontología de lo percibido, hacia la descripción del ser de lo percibido. Con ello podremos dar cuenta de la exposición del propio autor del modo en cómo la percepción puede ser entendida (...) como un verdadero acceso al ser: el primado de la percepción abarcaría una prioridad propiamente ontológica. El objetivo principal de esta investigación se situará en la exposición de una red conceptual que nos permita dar cuenta del fenómeno perceptivo que no sólo nos proporciona el mundo, tal y como se le aparece al sujeto, sino que intenta ir más allá del aspecto visible, intentará dar cuenta del ser de lo percibido. Expresar, en definitiva, este circuito de incorporación donde se hallan inseridos tanto el ser como el sujeto, donde hay una co-pertenencia entre ambos. (shrink)

In der vorliegenden Arbeit geht es um Entscheidungsspielräume und Entscheidungsprozesse von hauptamtlichen Hospizmitarbeiterinnen und -mitarbeitern in ethisch relevanten Situationen. Wie sich diese Prozesse und Spielräume konkret in der Praxis gestalten, erforschten wir mittels einer qualitativen Studie, die wir in drei Hospizen in Nordrhein-Westfalen durchführten. Als ethische Haupthandlungsfelder nannten die befragten Pflegekräfte die Medikation in der präfinalen Phase, den Umgang mit terminaler Sedierung und mit der Flüssigkeitszufuhr und Ernährung am Lebensende. Entscheidungen innerhalb dieser Felder werden i. d. R. kollektiv getroffen. Die (...) individuellen Entscheidungsspielräume der Mitarbeiterinnen und Mitarbeiter betreffen hauptsächlich den Pflegestil und das auf den Gast bezogene Zeitmanagement. Die Gestaltung dieser Entscheidungsspielräume hängt dabei häufig weniger von einem Rahmenkonzept ab, wie es Leitbilder oder Ethikkodizes nahelegen könnten, als vielmehr von einer Anspruchsanpassung der Pflegenden in der Praxis, wie es Modelle eingeschränkter Rationalität nahelegen. Damit übernehmen die Pflegekräfte in einem Hospiz eine sich selbst beratende wie korrigierende Funktion in ethischen Fragen, die angesichts des individuellen Sterbens eines Gastes immer wieder von Neuem ausgehandelt werden.
