For an explicit statement, thirty years before Lexington, of "when it is that colonies may turn independent," one must turn to the work of Francis Hutcheson, a Scottish professor of moral philosophy. That the abuse of power justified resistance was the belief of all Americans who subscribed to the Declaration of 1776. Their situation demanded action. Doctrines, even phrases, which would support and explain their claims, had already been formulated in earlier constitutional crises overseas.

Since its inception some fifty years ago, cognitive science has seen a number of sea changes. Perhaps the best known is the development of connectionist models of cognition as an alternative to classical, symbol-based approaches. A more recent - and increasingly influential - trend is that of dynamical-systems-based, ecologically oriented models of the mind. Researchers suggest that a full understanding of the mind will require systematic study of the dynamics of interaction between mind, body, and world. Some argue that this (...) new orientation calls for a revolutionary new metaphysics of mind, according to which mental states and processes, and even persons, literally extend into the environment. This book is a guide to this movement in cognitive science. Each chapter tackles either a specific area of empirical research or specific sector of the conceptual foundation underlying this research. BackgroundThe phenomenon of ‘moral distress’ has continued to be a popular topic for nursing research. However, much of the scholarship has lacked conceptual clarity, and there is debate about what it means to experience moral distress. Moral distress remains an obscure concept to many clinical nurses, especially those outside of North America, and there is a lack of empirical research regarding its impact on nurses in the United Kingdom and its relevance to clinical practice.Research aimTo explore the concept of moral (...) distress in nursing both empirically and conceptually.MethodologyFeminist interpretive phenomenology was used to explore and analyse the experiences of critical care nurses at two acute care trauma hospitals in the United Kingdom. Empirical data were analysed using Van Manen’s six steps for data analysis.Ethical considerationsThe study was approved locally by the university ethics review committee and nationally by the Health Research Authority in the United Kingdom.FindingsThe empirical findings suggest that psychological distress can occur in response to a variety of moral events. The moral events identified as causing psychological distress in the participants’ narratives were moral tension, moral uncertainty, moral constraint, moral conflict and moral dilemmas.DiscussionWe suggest a new definition of moral distress which captures this broader range of moral events as legitimate causes of distress. We also suggest that moral distress can be sub-categroised according to the source of distress, for example, ‘moral-uncertainty distress’. We argue that this could aid in the development of interventions which attempt to address and mitigate moral distress.ConclusionThe empirical findings support the notion that narrow conceptions of moral distress fail to capture the real-life experiences of this group of critical care nurses. If these experiences resonate with other nurses and healthcare professionals, then it is likely that the definition needs to be broadened to recognise these experiences as ‘moral distress’. (shrink)

It is widely held that our beliefs can be epistemically faultless despite being morally flawed. Theories of moral encroachment challenge this, holding that moral considerations bear on the epistemic status of our attitudes. According to attitude-based theories of moral encroachment, morality encroaches upon the epistemic standing of our attitudes on the grounds that we can morally injure others with our epistemic practices. In this paper, I aim to show that current attitude-based theories have asymmetric mechanisms: moral features only make it (...) harder for attitudes to secure epistemic merits. I argue that, if attitudes can incur moral injury, failure to form attitudes can too. To make sense of this, I contend, attitude-based accounts require symmetric mechanisms, allowing that moral considerations make it both harder and easier for attitudes to attain epistemic merits. I maintain that, once we recognize this, attitude-based encroachment views must soon concede that they sometimes demand we believe against the evidence. (shrink)

We refine the intuitively appealing idea that you are blameworthy for something if it happened because you did not care enough. More formally: you are blameworthy for X (where X may be an action, omission, or outcome) just in case there is the right causal-explanatory relation between your poor quality of will and X. First, we argue that blameworthiness for actions, omissions, and outcomes is concerned with negative differences: you are blameworthy for the fact that X occurred instead of X*, (...) where X is worse than X*. Second, we argue that the way in which your quality of will is poor has to fit what you are blameworthy for. With these refinements, the account already gives intuitively correct verdicts in cases of forgetting, making a negative difference to a nevertheless good result, and doing an action with runaway consequences. We then discuss what the right causal-explanatory relation is and suggest that it is simply causation, understood in the right way. Here, we draw on the account of causation developed in Touborg, The Dual Nature of Causation. According to this account, there are two necessary and jointly sufficient conditions for causation. Roughly, C causes E rather than E* iff (a) C is process-connected to E, and (b) C makes E more secure and E* less secure. With this account of causation, our account of blameworthiness now also gives correct verdicts in omission, pre-emption, and switching cases, Frankfurt-style cases, and collective harm cases. The aim of this paper is to explain why, while Charles Darwin was well recognized as a scientific leader of his time, Claude Bernard never really regarded Darwinism as a scientific theory. The lukewarm reception of Darwin at the Académie des Sciences of Paris and his nomination to a chair only after 8 years contrasts with his prominence, and Bernard’s attitude towards Darwin’s theory of species evolution belongs to this French context. Yet we argue that Bernard rejects the scientific value (...) of Darwinian principles mainly for epistemological reasons. Like Darwin, Bernard was interested in hereditary processes, and planned to conduct experiments on these processes that could lead to species transformation. But the potential creation of new forms of life would not vindicate Darwinism since biologists can only explain the origin of morphotypes and morphological laws by the means of untestable analogies. Because it can be the object neither of experiments nor of any empirical observation, phylogeny remains out of science’s scope. Around 1878 Bernard foresaw a new general physiology based on the study of protoplasm, which he saw as the agent of all basic living phenomena. We will analyze why Bernard regarded Darwinism as part of metaphysics, yet still referred to Darwinians in his latter works in 1878. Basically, the absence of a scientific reception of Darwinism in Bernard's work should not obscure its philosophical reception, which highlights the main principles of Bernard’s epistemology. This piece criticizes Fodor's argument (in The Elm and the Expert, 1994) for the claim that Frege cases should be treated as exceptions to (broad) psychological generalizations rather than as counterexamples.

In this article, we present evidence of a bidirectional coupling between moral concern and the attribution of properties and states that are associated with experience (e.g., conscious awareness, feelings). This coupling is also shown to be stronger with experience than for the attribution of properties and states more closely associated with agency (e.g., free will, thoughts). We report the results of four studies. In the first two studies, we vary the description of the mental capacities of a creature, and assess (...) the effects of these manipulations on moral concern. The third and fourth studies examine the effects of variations in moral concern on attributions of mindedness. Results from the first two studies indicate that moral concern depends primarily on the attribution of experience, rather than the attribution of agency. The results of the latter two studies demonstrate that moral concern increases attributions of mindedness, and that this effect is stronger for attributions of experience than for attributions of agency. The research aims to investigate the characteristics and risks associated with the handling of sensitive data in the implementation of public policies within the digital government model. To achieve this, a hypothetical-deductive method and bibliographic and documentary procedures are employed, proposing an interdisciplinary discussion on technological advancement, data protection, transparency, and public policies. The justification revolves around the importance of a comprehensive, cohesive system that genuinely protects sensitive personal data, considering the need to keep pace with technological developments and maintain (...) a minimum level of security in the digital age at both national and international levels. There is no doubt that the judicious and strategic use of data has the potential to drive substantial improvements in policy evaluation, decision-making, and the relationship between government and citizens. However, dealing with personal data also means addressing risks with responsibility, transparency, and respect for individual rights. (shrink)

Seminal work in moral neuroscience by Joshua Greene and colleagues employed variants of the well-known trolley problems to identify two brain networks which compete with each other to determine moral judgments. Greene interprets the tension between these brain networks using a dual process account which pits deliberative reason against automatic emotion-driven intuitions: reason versus passion. Recent neuroscientific evidence suggests, however, that the critical tension that Greene identifies as playing a role in moral judgment is not so much a tension between (...) reason and passion, but a tension between distinct forms of deliberative reasoning: analytic versus empathetic. It is widely held that individuals who are unable to provide informed consent should be enrolled in clinical research only when the risks are low, or the research offers them the prospect of direct benefit. There is now a rich literature on when the risks of clinical research are low enough to enroll individuals who cannot consent. Much less attention has focused on which benefits of research participation count as ‘direct’, and the few existing accounts disagree over how this crucial (...) concept should be defined. This disagreement raises concern over whether those who cannot consent, including children and adults with severe dementia, are being adequately protected. The present paper attempts to address this concern by considering first what additional protections are needed for these vulnerable individuals. This analysis suggests that the extant definitions of direct benefits either provide insufficient protection for research subjects or pose excessive obstacles to appropriate research. This analysis also points to a modified definition of direct benefits with the potential to avoid these two extremes, protecting individuals who cannot consent without blocking appropriate research. In this paper, we present a new account of teleological reasons, i.e. reasons to perform a particular action because of the outcomes it promotes. Our account gives the desired verdict in a number of difficult cases, including cases of overdetermination and non-threshold cases like Parfit’s famous _Drops of water._ The key to our account is to look more closely at the metaphysics of causation. According to Touborg (_The dual nature of causation_, 2018), it is a necessary condition for causation that (...) a cause increases the security of its effect. Building on this idea, we suggest, roughly, that you have a teleological reason to act in a certain way when doing so increases the security of some good outcome. This represents a middle way between the proposal that you have a reason to act in a certain way just in case this _would_ cause a good outcome and the proposal that you have a reason to act in a certain way just in case this _could_ cause a good outcome. The use of drones in public healthcare is suggested as a means to improve efficiency under constrained resources and personnel. This paper begins by framing drones in healthcare as a social experiment where ethical guidelines are needed to protect those impacted while fully realizing the benefits the technology offers. Then we propose an ethical framework to facilitate the design, development, implementation, and assessment of drones used in public healthcare. Given the healthcare context, we structure the framework according to the four (...) bioethics principles: beneficence, non-maleficence, autonomy, and justice, plus a fifth principle from artificial intelligence ethics: explicability. These principles are abstract which makes operationalization a challenge; therefore, we suggest an approach of translation according to a values hierarchy whereby the top-level ethical principles are translated into relevant human values within the domain. The resulting framework is an applied ethics tool that facilitates awareness of relevant ethical issues during the design, development, implementation, and assessment of drones in public healthcare. We present experimental results that support the claim that the folk concept of knowledge how is an epistemological hybrid, encompassing both intellectualist and praxist elements.

This study aimed to outline the profile of retractions of scientific articles on COVID-19 published in journals indexed in the Scopus database between 2020 and 2021. To analyze the data, we used a bibliometric technique, with the Bibliometrix package in the R-Studio software, and descriptive statistics. Twenty-nine retractions were analyzed, and we found that the most common reasons for retraction were related to ethical issues and that 68.97% of authors have previously retracted articles. We concluded that there appears to have (...) been a change in the publication policies of journals, which resulted in an increase in scientific retractions related to COVID-19 during the study period. It has been well documented that children perceive robots as social, mental, and moral others. Studies on child-robot interaction may encourage this perception of robots, first, by using a Wizard of Oz set-up and, second, by having robots engage in self-description. However, much remains unknown about the effects of transparent teleoperation and self-description on children’s perception of, and relationship formation with a robot. To address this research gap initially, we conducted an experimental study with a 2 × 2 between-subject design (...) in which 168 children aged 7–10 interacted with a Nao robot once. Transparency about the teleoperation procedure decreased children’s perceptions of the robot’s autonomy and anthropomorphism. Self-description reduced the degree to which children perceived the robot as being similar to themselves. Transparent teleoperation and self-description affected neither children’s perceptions of the robot’s animacy and social presence nor their closeness to and trust in the robot. (shrink)

Este artigo aborda as motivações para a docência e os desafios enfrentados por licenciandos em psicologia. A metodologia utilizada foi a abordagem qualitativa, e o instrumento de coleta de dados questionário online com questões abertas e fechadas. Participaram do estudo, onze estudantes de cursos de licenciatura em psicologia de quatro instituições universitárias das regiões sul e sudeste do Brasil. Os resultados demonstraram que a escolha pela licenciatura se deu, sobretudo, pelo interesse e curiosidade na área da educação, apropriação dos saberes (...) pedagógicos, ampliação do mercado de trabalho, bem como as possibilidades de atuação profissional. As dificuldades apontadas revelaram: a falta de informações sobre as especificidades do curso de licenciatura e da atuação do professor de psicologia e a ausência de docentes com saberes pedagógicos para atuar na licenciatura em psicologia. Embora seja considerada formação complementar entre os estudantes, observou-se possibilidades de um ensino-aprendizagem de psicologia engajada e inventiva. (shrink)

The practice of law has changed greatly since the days when judges based decisions on the maxim salus populi suprema lex, and Oliver Wendell Holmes disagreed, noting that “experience” has been the “life of the law.” In the intervening years, the profession has followed Holmes and the legal realists in recognizing that the law does not exist in a vacuum. It is a human endeavor, molded by experiences and filled with human consequences. Today, lawyers, jurists, and legal scholars everywhere on (...) the political spectrum recognize the importance of social context, history, and a variety of non-legal disciplines, and non-legal insights to the intelligent practice of the law Unfortunately, in rejecting the old maxims, the legal profession also lost sight of the fundamental truth of salus populi suprema lex, Latin for “the health of the people is the highest law” - namely, it has lost sight of the truth that a population’s health is a critical part of law’s social context. One of the consequences of this is that the profession has failed to include public health - the study of the causes and prevention of disease, disability, and death in populations - among the non-legal disciplines regularly incorporated into legal analysis and routinely taught to all would-be lawyers. This research focuses on a profession, that of pedagogical consultant (PC) in mathematics, which has been little explored. Interviews were conducted with eight PCs in mathematics at the elementary school level, based on two professional situations related to problem solving and professional development of teachers. An emerging analysis brought to light, within their professional practice, common elements, characterizing what we can call “a PC’s professional genre”. Singular forms of this profession are also highlighted, reflecting the way in which these PCs (...) engage personally in this profession and develop styles according to circumstances. (shrink)

Soil balancing is widely used in organic farming, but little is known about the practice because technical knowledge and goals for the practice are produced and negotiated within an alternative community of practice (CoP). We used a review of the private soil balancing literature and semi-structured interviews with farmers and consultants to document the knowledge, shared meanings, and goals of key actors within the soil balancing CoP. Our findings suggest this CoP is dominated by discourse between private consultants and farmers, (...) with few contributions to or from scientists or the peer reviewed literature. The idea of soil balancing is centered around improving soil quality through adjustments in Base Cation Saturation Ratios (BCSR), and practitioners report a wide range of positive agronomic outcomes. For most soil balancers, however, BCSR is only one part of a broader approach to soil health management that also utilizes traditional soil fertility recommendations and soil health-building cultural management practices. Meanwhile, a survey of land grant university soil fertility specialists and the peer-reviewed literature documented a high degree of skepticism and a lack of scientific evidence that BCSR can boost crop yields. We conclude that this scientific discourse reflects a disconnect from the practices and meanings used in the soil balancing CoP. While tensions between the dominant and niche agricultural knowledge systems are not unique, we believe a better appreciation for the nuanced meanings and goals within the soil balancing CoP present an opening for expanded collaborations with scientists doing research on soil health. Circadian rhythm abnormalities in bipolar disorder have led to a search for genetic abnormalities in circadian "clock genes" associated with BD. However, no significant clock gene findings have emerged from genome-wide association studies. At least three factors could account for this discrepancy: complex traits are polygenic, the organization of the clock is more complex than previously recognized, and/or genetic risk for BD may be shared across multiple illnesses. To investigate these issues, we considered the clock gene network at three levels: (...) essential "core" clock genes, upstream circadian clock modulators, and downstream clock controlled genes. Using relaxed thresholds for GWAS statistical significance, we determined the rates of clock vs. control genetic associations with BD, and four additional illnesses that share clinical features and/or genetic risk with BD. Then we compared the results to a set of lithium-responsive genes. Associations with BD-spectrum illnesses and lithium-responsiveness were both enriched among core clock genes but not among upstream clock modulators. Associations with BD-spectrum illnesses and lithium-responsiveness were also enriched among pervasively rhythmic clock-controlled genes but not among genes that were less pervasively rhythmic or non-rhythmic. Our analysis reveals previously unrecognized associations between clock genes and BD-spectrum illnesses, partly reconciling previously discordant results from past GWAS and candidate gene studies. We discuss two readings of Wegner's thesis and find that neither can motivate his larger conclusion. Wegner thinks science requires us to dismiss our experiences. Its real promise is to help us to make better sense of them.

This volume maps the areas of ethical concern in the debate regarding the governance of genetic information, and suggests alternative ethical frameworks and models of regulation in order to inform its restructuring. Genetic governance is at the heart of medical and scientific developments, and is connected to global exploitation, issues of commodification, commercialisation and ownership, the concepts of property and intellectual property and concerns about individual and communal identity. Thus the decisions that are made in the next few years about (...) appropriate models of genetic governance will have knock-on effects for other areas of governance. In short the final answer to 'Who Decides?' in the context of genetic governance will fundamentally shape the ethical constructs of individuals and their networks and relationships in the public sphere. Fix an integer $r \ge 3$. We consider metric spaces on n points such that the distance between any two points lies in $\left\{ {1, \ldots,r} \right\}$. Our main result describes their approximate structure for large n. As a consequence, we show that the number of these metric spaces is $\left\lceil {{{r + 1} \over 2}} \right\rceil ^{\left + o\left}.$Related results in the continuous setting have recently been proved by Kozma, Meyerovitch, Peled, and Samotij [34]. When r is even, our (...) structural characterization is more precise and implies that almost all such metric spaces have all distances at least $r/2$. As an easy consequence, when r is even, we improve the error term above from $o\left$ to $o\left$, and also show a labeled first-order 0-1 law in the language ${\cal L}_r $, consisting of r binary relations, one for each element of $[r]$. In particular, we show the almost sure theory T is the theory of the Fraïssé limit of the class of all finite simple complete edge-colored graphs with edge colors in $\left\{ {r/2, \ldots,r} \right\}$.Our work can be viewed as an extension of a long line of research in extremal combinatorics to the colored setting, as well as an addition to the collection of known structures that admit logical 0-1 laws. In this paper we bring together the results of our research into agreement in copular clauses in 4 four different Germanic languages—Dutch, German, Faroese, Icelandic—in order to provide an 5 overview of the results. These cases present a particularly interesting window into how verbal 6 agreement operates, since there are two potential controllers of agreement, which may disagree 7 in person and/or number (The source of the rumour BE the neighbours / you-SG / you-PL). We 8 will show that there (...) is variation at all levels in which nominal controls agreement: cross-linguistic, 9 inter-speaker within a single language, and intra-speaker. We argue that our data support the 10 following claims: (1) “Downward” agreement for person, as well as number, with a nominal that is 11 not in the canonical subject position is possible and in some cases preferred; (2) The agreement 12 patterns observed in Icelandic and Faroese support the hypothesis that in these languages there 13 are distinct Number and Person heads; (3) “Downward” agreement from a high position in the 14 left-periphery is a grammatically distinct phenomenon from agreement when the verb remains 15 in a lower position in the clause; (4) In some languages and some configurations, speakers 16 show a significant degree of indeterminacy in their judgments and production suggesting that 17 speakers use more than one grammar. We relate our findings to current discussions in the 18 generative literature on subject agreement and in particular differences between number and 19 person agreement, and possible connections to restrictions on object clitics, and we also discuss 20 questions that remain open, and invite new, cross-disciplinary research. Those who are optimistic about the prospects of a science of consciousness, and those who believe that it lies beyond the reach of standard scientific methods, have something in common: both groups view consciousness as posing a special challenge for science. In this paper, we take a close look at the nature of this challenge. We show that popular conceptions of the problem of consciousness, epitomized by David Chalmers’ formulation of the ‘hard problem’, can be best explained as a cognitive (...) illusion, which arises as a by-product of our cognitive architecture. We present evidence from numerous sources to support our claim that we have a specialized system for thinking about phenomenal states, and that an inhibitory relationship exists between this system and the system we use to think about physical mechanisms. Even though the ‘hard problem’ is an illusion, unfortunately it appears that our cognitive architecture forces a closely related problem upon us. The ‘genuine problem’ of consciousness shares many features with the hard problem, and it also represents a special challenge for psychology. Nonetheless, researchers should be careful not to mistake the hard problem for the genuine problem, since the strategies appropriate for dealing with these problems differ in important respects. Beyond the eras a dialogue seems to have been established between Bruegel the Elder (1525-1569) and Antonin Artaud (1896-1948). The poet’s wonder at the « painting of the North », both realistic and emblematic, reveals his deepest ideal as an artist : painting, a « magical » operation, deploys a power of expression based on signs and no longer on words, which the theatre is also called upon to seize. The juxtaposition of Bruegel’s Triumph of Death and a famous drawing (...) by Artaud, Le Théâtre de la cruauté [The Theatre of Cruelty], highlights the striking convergences between the two artists. Through their pictorial works, both of them renew over the centuries the funerary and mythical symbolism of death, inherited from the macabre scenes of medieval paintings, but also from ancient times. Studying the references to theatrical iconography in Bruegel’s painting, where carnival and crudity of death reinforce each other, allows us to deepen the meaning of these resonances. For the two artists, form and poetic momentum meet so that representation, as a structure common to painting and theatre, fixes a moment of the world, while animating that moment to infinity, thanks to signs conceived as « true hieroglyphs » (Artaud), a problem that Michel Foucault associated with the strongest truth that the experience of madness carries. Robbins, Francis, and Rutledge documented the personality profile of Church of England clergymen and clergywomen prior to the ordination of the first women to the priesthood in 1994, drawing on Eysenck's three-dimensional model of personality. They found that the personality profiles of clergymen and clergywomen were indistinguishable. The present paper reports a comparable study conducted in 2004 among 182 clergywomen and 540 clergymen serving in similar parochial posts in order to examine whether the ordination of women to the priesthood (...) had impacted the overall personality profile of Anglican clergy. The data suggest that little change had taken place between the two cohorts of clergy studied. Once again clergywomen and clergymen appeared to be formed in the same image. (shrink)
