O presente artigo busca fazer uma análise do papel das questões metodológicas no primeiro escrito publicado por Kant. Iniciamos com a apresentação dos preceitos práticos de pesquisa do jovem Kant e da problemática das forças vivas; depois, analisamos o método propagado por Kant enquanto o principal recurso para a solução da polêmica e a sua origem no método de Mairan. Na sequência, expomos os pressupostos metodológicos sobre os quais Kant construiu a sua solução para os problemas das forças vivas; por (...) fim, fazemos um paralelo do método de 1747 em relação ao do _Preisschrift_ de 1764, considerado o principal escrito pré-crítico de Kant sobre o método. A presença, ainda que parcial, do procedimento categorial no direito privado em Metaphysische Anfangsgründe der Rechtslehre é inegável, assim como a sua importância para a construçáo da teoria da posse. Uma prova adicional aos próprios fragmentos da primeira parte do direito natural (cf. MS R, AB 59, 79, 82, 90, 93, 119-121) sáo os esboços categoriais contidos nos Manuscritos da Rechtslehre (particularmente, em Vorarbeiten zum Privatrecht e em Zusammenhängender, signierter Entwurf in Kant's handschriflicher Nachlaß ). Os objetivos desse artigo sáo: (...) 1) expor a coerência interna entre os esboços categoriais do direito privado presentes em Vorarbeiten zur Rechtslehre , e 2) apresentar a correspondência entre esses esboços e o texto jurídico de 1797. In this article we assume that the kantian a priori juridical-political theory can be reconstructed according to the a priori synthetic satisfiability proof theory, initially declared in Kritik der reinen Vernunft and extended to practical domain in Kritik der praktischen Vernunft. In particular, it is assumed that the aim to prove that synthetic judgments, such as “this object of external usage is mine”, can a priori invigorate in private law and public law in general – from the determination of their (...) possibility conditions in the executable actions domain by the free human agent – was carried out in Metaphysische Anfangsgründe der Rechtslehre. In what concerns the demonstration of the effectiveness of the law a priori synthetic judgments Kantian theory, i.e., to decide which juridical proposals actually invigorate or not, accepted that this work was not treated on a systematic way by the philosopher Königsberg. There are fragments, spread through many works. Therefore, the task to be developed in this article, aiming to present a field of effectiveness to the law doctrine, is to organize (synthetically) Kant´s statements about politics as a law doctrine exercise, according to the proof theory problems from the a priori synthetic proposals in general. Neste artigo interpreta-se a Rechtslehre kantiana enquanto uma doutrina jurídica crítica, compreensível à luz do projeto crítico – iniciado em Kritik der reinen Vernunft e adaptado ao campo prático em Kritik der praktischen Vernunft . Em particular, objetiva-se destacar, além da aprioridade, do caráter sistemático e da busca pela completude dos princípios jurídicos, o emprego da teoria de solubilidade de problemas da razáo em geral nos "prolegômenos" da Rechtslehre . O estudo desta parte introdutória se justifica por apresentar a divisáo (...) suprema do sistema segundo princípios, donde se deriva uma divisáo da doutrina do direito, que determina o objeto ( Gegenstand ) e, por conseguinte, o campo dessa ciência particular e a discussáo do procedimento de pesquisa. Tal moldura a priori da doutrina do direito é o fundamento da sequente teoria kantiana do direito privado e do direito público. Num quadro maior, esse artigo pode ser compreendido enquanto uma renúncia à leitura de que a Rechtslehr e kantiana náo cumpre com as exigências da filosofia crítica – formulada por Hermann Cohen ( Ethik des reinen Willens , 1904) e detalhada por Christian Ritter ( Der Rechtsgedanke Kants nach den frühen Quellen , 1971). Implicações da noção de consciência histórica nas ciências humanas e sociais: um modo de projeção para o futuro e de posição em relação ao passado Resumo: O presente texto, de caráter bibliográfico, discute o problema da consciência histórica com o objetivo de pensar o sentido dessa expressão na atualidade e as variações que esse conceito adquiriu ao longo da história das Ciências Humanas e Sociais, com ênfase no século XX. A hipótese é que a discussão a respeito da consciência histórica (...) passou a se ocupar, na modernidade, com uma múltipla relatividade de pontos de vista, o que é destacado por Gadamer em sua análise sobre os preceitos implicados na definição do que significa “ter senso histórico”. É defendida a tese, portanto, de que a noção de consciência histórica não se limita ao conhecimento das experiências vivenciadas no passado, mas se apresenta como condição de possibilidade de projetar o futuro e se posicionar em relação ao passado, especialmente no que diz respeito às ciências humanas e sociais. A defesa desta ideia central é realizada por meio de dois gestos reflexivos, com apresentação, primeiramente, do marco teórico da consciência histórica e, posteriormente, de suas implicações na constituição das Ciências Humanas e Sociais. Implications of the notion of historical consciousness in human and social sciences: a mode of projection for the future and position in relation to the past: This bibliographic text discusses the problem of historical consciousness with the purpose of thinking about the meaning of this expression in the present time and the variations that this concept has acquired throughout the history of the Humanities and Social Sciences, with emphasis on the twentieth century. The hypothesis is that the discussion about historical consciousness has come to concern itself, in modernity, with a multiple relativity of points of view, which is highlighted by Gadamer in his analysis of the precepts involved in defining what “having a historical sense” means. Therefore, the thesis that the notion of historical consciousness is not limited to the knowledge of past experiences is defended, but is presented as a condition of possibility of projecting the future and positioning itself in relation to the past, especially with regard to humanities and social sciences. The defense of this central idea is made through two reflexive gestures, presenting, first, the theoretical framework of historical consciousness and, later, its implications in the constitution of the Human and Social Sciences. A sociobiologia e a psicologia evolucionista elucidaram muitos aspectos do comportamento social de diversas espécies animais, a partir de mecanismos como a seleção de parentesco e o altruísmo recíproco que, contudo, são insuficientes para explicar a cooperação no caso humano. Como alternativa, a teoria da dupla herança busca explicar o comportamento humano considerando tanto (...) a biologia quanto as ciências sociais. Segundo esta abordagem, a psicologia social humana é caracterizada por instintos sociais tribais e marcadores simbólicos, que resultam em uma mente que pressupõe princípios morais inatos e universais, selecionados para a vida em grupos orientados por normas sociais, mas que são plasticamente moldados à realidade cultural de cada sociedade. Neste artigo, pretendo explicitar o papel da lógica formal no projeto crítico kantiano. No tratamento dessa questão, abordarei a relação entre a lógica formal, frequentemente chamada por Kant de lógica geral, e a lógica transcendental. Assumirei a tese de que a lógica formal e a lógica transcendental são duas ciências racionais puras, distintas, independentes, porém, com conexões entre si, a despeito das leituras que sugerem que a lógica transcendental substitua a lógica formal ou que a lógica formal mantenha a sua (...) existência, devendo, no entanto, ser subordinada à lógica transcendental. Na caracterização da lógica formal, utilizarei, sobretudo, a Jäsche-Logik. Quanto à lógica transcendental, exposta na Kritik der reinen Vernunft, irei me servir da leitura semântica de Loparic para tratar do conhecimento metafísico da natureza. Inicio o artigo apontando a proximidade de Kant com a lógica formal e o seu emprego na elaboração do projeto crítico. (shrink)

This article explores the social representation of Information Technology and Network Society from Barthes' semiology, using his ideas about myth creation and the connotation of ideological discourses through naturalization. Supplemented with some concepts from Peirce and Santaella, we try to identify and understand these mystification mechanisms and how they affect the creation of an information order; in this case, a digital order. We conclude that we are before an evangelizing discursive alignment based on mythical elements arisen from our aversion to (...) uncertainty, the energy-saving principle, and an engineering discourse guided by the urgency of profit and power. We highlight the presence of a reckless narrative that permanently repeats the urgent need for information technology and digitalization without considering side effects or costs. (shrink)

Modern society is challenged by a loss of efficiency in national governance systems values, and lifestyles. Corporate social responsibility (CSR) discourse builds upon a conception of organizational legitimacy that does not appropriately reflect these changes. The problems arise from the a-political role of the corporation in the concepts of cognitive and pragmatic legitimacy, which are based on compliance to national law and on relatively homogeneous and stable societal expectations on the one hand and widely accepted rhetoric assuming that all members (...) of society benefit from capitalist production on the other. We therefore propose a fundamental shift to moral legitimacy, from an output and power oriented approach to an input related and discursive concept of legitimacy. This shift creates a new basis of legitimacy and involves organizations in processes of active justification vis-à-vis society rather than simply responding to the demands of powerful groups. We consider this a step towards the politicization of the corporation and attempt to re-embed the debate on corporate legitimacy into its broader context of political theory, while reflecting the recent turn from a liberal to a deliberative concept of democracy. A definition of emotion common to the affective sciences is an urgent desideratum. Lack of such a definition is a constant source of numerous misunderstandings and a series of mostly fruitless debates. There is little hope that there ever will be agreement on a common definition of emotion, given the sacred traditions of the disciplines involved and the egos of the scholars working in these disciplines. Our aim here is more modest. We propose a list of elements for a working (...) definition of emotion and discuss the justification for the inclusion of elements from our respective perspectives (philosophy and psychology). This working partial definition may at least serve as a litmus test to examine theories of emotion, old and new, across disciplinary boundaries. (shrink)

In a recent paper, Pruss proves the validity of the rule beta-2 relative to Lewis’s semantics for counterfactuals, which is a significant step forward in the debate about the consequence argument. Yet, we believe there remain intuitive counter-examples to beta-2 formulated with the actuality operator and rigidified descriptions. We offer a novel and two-dimensional formulation of the Lewisian semantics for counterfactuals and prove the validity of a new transfer rule according to which a new version of the consequence argument can (...) be formulated. This new transfer rule is immune to the counter-examples involving the actuality operator and rigidified descriptions. However, we show that counter-examples to this new rule can also be generated, demanding that the Lewisian semantics be generalized for higher dimensions where counter-examples can always be generated. Earth’s life-support system is facing megaproblems of sustainability. One important way of how these problems can be addressed is through innovation. This paper argues that responsible innovation that contributes to sustainable development consists of three dimensions: innovations avoid harming people and the planet, innovations ‘do good’ by offering new products, services, or technologies that foster SD, and global governance schemes are in place that facilitate innovations that avoid harm and ‘do good.’ The paper discusses global governance schemes based on deliberation (...) as a means to foster such responsible innovation. These schemes can provide voluntary soft-law regulations that complement and extend national and international hard-law regulations and facilitate collective innovation that contributes to SD goals. The article addresses the facilitative role of governments and international organizations in overcoming problems of deliberation and offers illustrative examples of such governance schemes. It is a widely held principle that no one is able to do something that would require the past to have been different from how it actually is. This principle of the fixity of the past has been presented in numerous ways, playing a crucial role in arguments for logical and theological fatalism, and for the incompatibility of causal determinism and the ability to do otherwise. I will argue that, assuming bivalence, this principle is in conflict with standard views about (...) knowledge and the semantics for ‘actually’. Considerable research has demonstrated that teachers’ self-efficacy plays a major role in implementing instructional practices in classroom lessons. Only few studies, however, have examined the interplay between how teachers’ self-efficacy and the challenges that lie outside their influence are related to their implementation of cognitive-activation strategies (CAS), especially in science classrooms. Using the Trends in Mathematics and Science Study (TIMSS) 2015 data from Grades 4, 5, 8, and 9, we explored the extent to which teachers’ self-efficacy in teaching science and (...) the perceived time constraints explained variation in the enactment of general and inquiry-based CAS. Overall, the findings revealed that highly self-efficacious teachers reported more frequent implementation of both general and inquiry-based CAS, whereas those who perceived strong time constraints reported a less frequent use of inquiry-based CAS. We further found that these relations differed significantly between primary- and secondary-school teachers and discuss these findings in light of teachers’ professional competences and the resources for science activities in primary and secondary education. We point to the theoretical implications of this study for enhancing the conceptual understanding of generic and specific aspects of CAS and the practical implications for teacher education, professional development, and educational policy. In recent times, representation theory has become one of the most productive and interesting sub-fields in democratic theory. Arguably, the most important theoretical innovation are the so-called ‘constructivist’ approaches to political representation. These approaches play a central role in Creating Political Presence: The New Politics of Democratic Representation and The Constructivist Turn in Political Representation, two impressive volumes that take stock of the state of the art in representation theory. Nosso objetivo, no presente artigo, é propor uma articulação entre a teoria da individuação de Gilbert Simondon e a teoria da investigação de John Dewey. Em relação à primeira, serão enfatizados os aspectos “biológico” e “psíquico” de individuação; quanto à segunda, ressaltaremos seus principais elementos naturalistas e epistemológicos, assim como os conceitos mais gerais de “experiência” e de “natureza” de Dewey. Defenderemos que o processo de individuação tem estreita relação com a capacidade, possuída por todo indivíduo vivo, de solucionar problemas (...) ou situações de conflito resultantes de sua constante interação com o ambiente. Proporemos, mais precisamente, uma conexão teórica entre o princípio ou conceito de individuação e a ideia de que existe no organismo vivente uma aptidão investigativa que não apenas restaura seu equilíbrio “metaestável”, como também, e ao mesmo tempo, lhe proporciona sempre uma nova individualidade, tanto biológica como psíquica. Esperamos obter, como resultado deste processo de síntese envolvendo as ideias de Simondon e de Dewey, uma compreensão ampliada das respectivas teorias da individuação e da investigação. (shrink)

Resumen Este artículo estudia la transformación de las bases del escepticismo antiguo en el pensamiento agustiniano; para presentar el proceso se parte de la crisis que supuso la ruptura con experiencia maniquea, se distingue su preocupación y consideración sobre el modo y los límites del conocimiento y se analiza la función de la imagen mítica de Proteo en Contra Académicos; esta imagen permite ponderar la capacidad de la representación mítica como contrafuerte del carácter discursivo del saber humano. Mediante este recurso, (...) san Agustín afirma que la razón no puede quedar aislada de otros modos complementarios de comprensión, hace propio el núcleo de la actitud escéptica y amplía la noción de racionalidad para la filosofía cristiana.This paper studies the transformation of the foundations of ancient skepticism in Augustinian thought; to present the process we start from the crisis that led to the break with Manichaean experience, we distinguished their concern and consideration about the mode and limits of knowledge and analyzed the function of Proteo's mythical image in Contra academicos; this image allows us to weigh the capacity of mythical representation as a buttress of the discursive character of human knowledge. Through this resource, St. Augustine affirms that reason cannot be isolated from other complementary modes of understanding, appropriates the core of the skeptical attitude and broadens the notion of rationality for Christian philosophy. Falsity of the judicial decision. Implicit statements, legal truth and technical judgments. In response to the hypothesis of extending the category of "evaluative" falsehood to the motivations of a judicial decision, the paper attempts a critical reconstruction of the progressive evolution of these crimes in matter of acts of will and technical judgments, highlighting some aporias and proposing some corrections. Both the theory of psychic facts, as well as the theory of implicit attestations and the legal truth, in their joint action, can violate the prohibition of analogical interpretation in criminal matters. The controversial case from which the analysis starts concerns a public competition for a university professorship and the T.A.R.’s judgment that decides on a candidate's appeal. (shrink)

The United Nations Global Compact is one of the largest transnational governance schemes. Its success or failure, however, is a matter of debate. Drawing on research in cognitive linguistics, we argue that when evaluators discuss the UNGC, they apply the metaphorical concept of the family: the UNGC corresponds to the “family,” the UNGC headquarter to the “parent” and the business participants of the UNGC to the “children” of the family. As a corollary, evaluators’ implicit understanding of how a family is (...) best organized sets different benchmarks against which the governance structure of the UNGC is assessed. We describe two ideal models of “educating” UNGC business participants. Critics of the UNGC adopt a “strict father” model of transnational governance based on the idea that the proper education of inherently “bad” business firms necessitates obedience, discipline and punishment in case firms are non-compliant. In contrast, the UNGC’s advocates follow a “nurturant parent” model, which prioritizes empathy, learning and nurturance to support the moral development of “good” business firms. We develop the “UNGC-as-family” metaphor, explore its implications for transnational governance and discuss under what conditions these idealized models can serve as appropriate guidelines for TGSs. Specifically, we posit that following the behavioral prescriptions of the “strict father” model may, under certain conditions, jeopardize the organizational embedding and institutionalization of UNGC principles, and explain when and why it may be in the best interest of the UNGC and civil society to embrace the instructions of the “nurturant parent” model of transnational governance. An experiment aimed at detecting a DC voltage across a conductor induced by the steady magnetic field of a coil, carried out in 1998, provided a positive (although preliminary) evidence for such an effect, which might be interpreted as a breakdown of local Lorentz invariance. We repeated in 1999 the same experiment with a different experimental apparatus and a sensitivity improved by two orders of magnitude. The results obtained are discussed here in detail. They confirm the findings of the previous (...) experiment, and show, among the others, that the effect is independent of the direction of the current. A possible interpretation of the results is given in terms of a geometric description of the gravitational and the electromagnetic interactions by means of phenomenological, energy-dependent metrics. O caráter comunitário da filosofia de Aristóteles resulta das diversas formas de análise da política que o filósofo apresenta na articulação dos seguintes aspectos: a tese de que o ser humano é um animal político; o modo como esta é realizada na comunidade política, na qual o logos se manifesta como atividade discursiva compartilhada; o cultivo de determinadas virtudes ético-políticas presentes na convivência humana, sobretudo, a amizade; a autossuficiência do cidadão e o seu vínculo com a autarquia da comunidade política. A retomada de um moderno conceito de comunidade, na tentativa de reatualizar os princípios gerais do comunitarismo aristotélico, pode ser compatível com determinadas teses liberais, sobretudo a questão da liberdade (autonomia) individual e o fato do pluralismo ético e político nas sociedades modernas. The communal nature of Aristotle's philosophy results from the various forms of analysis of the politics the philosopher shows in the articulation of the following features: the thesis that man is a political animal; the way the political community is accomplished through this thesis, in which the logos itself manifests as a shared discoursive activity; the cultivation of certain ethical and political virtues present in the human companionship, above all, friendship; citizen self-sufficiency and its relationship with the autarchy of the political community. In an attempt to bring up to date the general principles of Aristotelian communitarianism, the resumption of a modern concept of community can be compatible with certain liberal theses, especially the issue of individual freedom (autonomy) and the fact of the ethical and political pluralism in the modern societies. The aim of this paper is to clarify the extent to which relationships between Human Agents (HAs) and Artificial Agents (AAs) can be adequately defined in terms of trust. Since such relationships consist mostly in the allocation of tasks to technological products, particular attention is paid to the notion of delegation. In short, I argue that it would be more accurate to describe direct relationships between HAs and AAs in terms of reliance, rather than in terms of trust. However, as (...) mediums of human actions to which tasks are delegated, AAs indirectly mediate trust between users and other social actors involved in their design, manufacture, commercialisation and deployment. In this sense, AAs mediate social trust. My conclusion is that relationships between HAs and AAs are thus to be understood directly in terms of reliance and indirectly in terms of social trust mediation. (shrink)

In scientific communications, journal articles, and philosophical aesthetic debates the words “art”, “creativity”, and “machine” are put together more and more frequently. Since some machines are designed to, or happens to, imitate human artistic creativity, it seems natural to use the same words to talk about human artists and machines which imitate them. However, the evolution of language in light of technology may conceal specific features of the phenomena it is supposed to describe. This makes it difficult to understand what (...) machine creativity actually is and how it is connected to human creativity. The aim of the paper is to investigate why, and in what sense, the functioning of some machines may be described in terms of artistic creativity and what is the relation between machine creativity and its human archetype. I start (§1) by introducing some general ideas concerning how language evolves alongside new technologies and focusing on the case of machine creativity. In §2 I review how some creative machines have been presented to the public, thus showing that a linguistic habit which connects machines to artistic creativity has already formed. In §3 I survey the debate on machine aesthetics and I highlight the main traits of the issue. In §4 I submit a primary scheme of machine creativity which draws on the concept of functional autonomy. Finally (§5), I argue that machine creativity cannot be mistaken for a substitute of the human kind, despite the fact that the word is the same. Creative machines are technological mediums by which new forms of human aesthetic experience can be explored. The kind of creativity machines enjoy displays a functional nature. (shrink)

El presente trabajo tiene como objetivo fundamental analizar una disciplina reciente denominada teoría de la organización. Para tal efecto se muestran diversos hechos históricos, los cuales al inicio eran tan sólo una pretensión teórico-metodológica univoca y simplificada para el estudio de las organizaciones, como ocurrió con las ciencias naturales. Sin embargo, en la actualidad han eclosionado en una amplia gama de perspectivas fenomenológicas en torno a las organizaciones. Por lo anterior se propone como explicación el anarquismo epistemológico acuñado por Paul (...) K. Feyerabend, por considerarlo una herramienta poderosa para entender a las teorías de la organización. También se sostiene como hipótesis la presencia de un robustecimiento de esta teoría al abrevar de distintas fuentes para la explicación de sus fenómenos.The fundamental aim of this paper is to analyze a recent discipline called organization theory. For this purpose, diverse historic events are shown. These facts initiated a theoretical-methodological univocal and simplified pretension for the study of the organizations, like the one occurred with the natural sciences. Nevertheless, currently they have emerged in an extensive range of phenomenological perspectives around organizations. Therefore, it is proposed as an explanation the “anarchism epistemology” minted by Paul K. Feyerabend by considering it a powerful tool to understand the theories of the organization. Also it maintains as hypothesis that the study of several sources to find out a possible explanation for its phenomena, strengthens the organization theory or theories. (shrink)

In this paper, we introduce the concept of N-dimensional generalized Minkowski space, i.e., a space endowed with a metric tensor, whose coefficients do depend on a set of non-metrical coordinates. This is the first of a series of papers devoted to the investigation of the Killing symmetries of generalized Minkowski spaces. In particular, we discuss here the infinitesimal-algebraic structure of the space-time rotations in such spaces. It is shown that the maximal Killing group of these spaces is the direct product (...) of a generalized Lorentz group and a generalized translation group. We derive the explicit form of the generators of the generalized Lorentz group in the self-representation and their related, generalized Lorentz algebra. The results obtained are specialized to the case of a 4-dimensional, “deformed” Minkowski space \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document} $${\widetilde M}$$ \end{document}4, i.e., a pseudoeuclidean space with metric coefficients depending on energy. In particular, the results obtained are specialized to the case of a “deformed” Minkowski space M_4, for which we derive the explicit general form of the (...) finite rotations and boosts in different parametric bases.
