In this exploratory, correlational study, several psychophysiological measures were assessed and the relation between these measures and an experimental self-report questionnaire to measure the seven implicit beliefs of sexual offenders ) was established in a sample of Dutch participants recruited from the healthy population using correlational analyses. After analyzing task performance, electroencephalogram data and electrocardiogram data, the psychophysiological variables were correlated with the experimental QITSO subscales. The subscale “children as sexual beings” correlated positively with the P300 amplitude at electrode Pz. (...) The subscale “women are unknowable” correlated positively with resting-state beta activity during eyes closed and eyes open, and with alpha activity during eyes open. Additionally, the subscale “entitlement’ correlated positively with low frequency heart rate variability power during eyes closed and eyes open, and with high frequency power during eyes closed. This study is a first exploratory step towards establishing a psychophysiological profile underlying the self-report questionnaire QITSO. (shrink)

This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. The collection of essays (...) is rather more philosophical and reflective as opposed to doctrinal. Each contribution focuses on the nature and operation of justice, the independence of the judiciary, and on judicial style primarily from the perspective of the judges themselves. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. In this thesis, I investigate realist, anti-realist and pluralist views in the philosophy of science and the philosophy of complexity. The philosophy of science can inform the philosophy of complexity and vice versa because we can consider scientific inquiry to largely involve the study of complex systems. I however find that the relevant realist, anti-realist and pluralist views are problematic in various ways, and that a version of pragmatism suggests a promising alternative. This version of pragmatism incorporates elements of pluralism, (...) but maintains a commitment to epistemic hierarchy, convergence and progress. The way to develop such a version of pragmatism is, I argue, by rebooting William Whewell’s 19th century philosophy of science. Whewell however held to the following two transcendental claims: 1. Empirical inquiry undertaken in science properly practiced can reveal necessary truths. 2. The revelation of such necessary truths grants us a glimpse of the mind of God. Such transcendental claims are obviously at odds with pragmatism. There are however core features of Whewell’s view that are notably pragmatist in nature, features that explicitly inspired Charles Sanders Piece’s convergent pragmatism. These are as follows: 3. Subject and object (or mind and world) are inextricably entwined during scientific inquiry; they are not separated by anything like a correspondence relationship. 4. Science progresses via what Whewell calls the consilience of inductions (an ongoing merging of scientific theories, a merging that increases our understanding of the world over time). I modify Whewell’s view by stripping away its transcendental elements while maintaining its pragmatist elements. What remains is, I argue, a robust and novel kind of pragmatism suitable for being introduced into the contemporary philosophy of science. Whewell suitably-pragmatised can offer new insights into ongoing debates, particularly those around the nature of scientific progress, scientific truth and scientific understanding. (shrink)

Dans sa violente charge contre la Révolution française, Edmund Burke avait élevé le débat politique à un niveau philosophique. Son argument le plus profond consistait à reprocher aux révolutionnaires de pécher par apriorisme, en cherchant à déduire, comme des géomètres, une nouvelle constitution à partir des principes abstraits énoncés dans la Déclaration des droits de l’homme. Reprise par les disciples allemands de Burke, cette critique de la méthode adoptée par la Constituante tirait des postulats empiristes des Lumières anglo-écossaises toutes les (...) implications conservatrices que recelaient déjà les textes politiques et historiques de Hume. Or c’est d’emblée sur ce terrain spéculatif que se joue, chez Fichte, la défense du droit de révolution. Reprochant à l’empirisme de réduire l’esprit au « mécanisme aveugle de l’association des idées », passivement déterminé par une extériorité en soi, Fichte entend au contraire fonder l’expérience elle-même sur l’activité d’un « Moi-en-soi », absolument indépendant. Conçu comme causalité libre, pouvant donc s’affranchir des « conjonctions coutumières » humiennes pour commencer une nouvelle série dans l’ordre des phénomènes, l’homme, pour Fichte, n’a pas seulement la « faculté de se perfectionner », mais la loi de sa liberté lui en fait même un devoir. Au regard de cet impératif catégorique de perfectionnement, il n’y a pas de Common Law qui tienne. Aussi Fichte ne recule-t-il pas devant la révolution, si les institutions du passé font obstacle à la destination de l’homme. (shrink)

How can a realistic ethical imagination about the future of a technology take shape? This article contains a reflection which is based on the experiences of an embedded ethicist in the context of biophysical research conducive to the development of photoacoustic mammography, which is intended for the non-invasive detection of breast cancer. Imagination in this context already informs the activities of the biophysical researchers, but its role is limited: biophysical future scenarios concentrate on the technological advances that photoacoustics could bring (...) about. In this article it is argued that it is advisable to also consider the medical practice and the ways in which this practice is likely to change as an effect of the introduction of photoacoustic mammography into it. On the basis of this more encompassing imaginative endeavor it is possible to get a clearer idea about how new technologies are able to contribute to human well being, which is informative for the setting of research-goals/priorities and a responsible implementation of new technologies into the world. This article provides an affirmative feminist reading of the philosophy of Henri Bergson by reading it through the work of Karen Barad. Adopting such a diffractive reading strategy enables feminist philosophy to move beyond discarding Bergson for his apparent phallocentrism. Feminist philosophy finds itself double bound when it critiques a philosophy for being phallocentric, because the setup of a master narrative comes into being with the critique. By negating a gender-blind or sexist philosophy, feminist philosophy only reaffirms its parameters, and (...) setting up a master narrative costs feminist philosophy its feminism. I thus propose and practice a different methodological starting point, one that capitalizes on "diffraction." This article experiments with the affirmative phase in feminist philosophy prophesied by Elizabeth Grosz, among others. Working along the lines of the diffractive method, the article at the same time proposes a new reading of Bergson (as well as of Barad), a new, different metaphysics indeed, which can be specified as onto-epistemological or "new materialist.". During the past decennium, one of the main issues discussed in research ethics has been focused on the care that should be provided to the control group in a clinical trial. This discussion is also called the standard of care debate . Current international research ethics guidelines contain a wide variety of standards for the standard of care—including the provision of the highest attainable, the best available, the best current, a proven , and an established effective treatment. In this article, (...) we systematically review the currently used standards and argue that none of the current standards is adequate to serve as a universal standard for the standard of care. Alex London has made a substantial proposal for a universal standard, but universally adopting his standard is problematic. In this article, we propose a revised version of London's standard. This article reports on a survey of the moral problems that Dutch nurses experience during their everyday practice. A questionnaire was developed, based on published literature, panel discussions, in-depth interviews and participation observations. The instrument was tested in a pilot study and proved to be useful. A total of 2122 questionnaires were sent to 91 institutions in seven different health care settings. The results showed that nurses were not experiencing important societal issues such as abortion and euthanasia as morally the (...) most problematic, but rather situations such as verbally aggressive behaviour of colleagues towards patients, keeping silent about errors, and medical treatment given against the wishes of patients. Moral problems occurred especially when nurses experienced feelings of powerlessness with regard to the well-being of patients. Moreover, these moral problems proved to be related to institutional organization, leadership, and collaboration with colleagues and other disciplines. Nurses appeared to have a limited awareness of the moral dimensions of their practice. (shrink)

Contextualist moral philosophers criticise hands-off liberal theories of justice for abstracting from the cultural context in which people make choices. Will Kymlicka and Joseph Carens, for example, demonstrate that these theories are disadvantageous to cultural minorities who want to pursue their own way of life. I argue that Pierre Bourdieu's critique of moral reason radicalises contextualist moral philosophy by giving it a sociological turn. In Bourdieu's view it is not enough to provide marginalised groups or subgroups with equal access to (...) public institutions and specific cultural rights—in some cases this may in fact be detrimental. He contends that scientists, politicians and other intellectuals have a duty to take seriously the social presuppositions of free deliberate choice and public opinion and to support cultural minorities with instruments to liberate themselves from their often precarious situation.
