There is a well-worn image and phrase for libertarianism: "atomized individualism." This hobgoblin has spread so thoroughly that even some libertarians think their philosophy unreservedly supports private persons, whatever the situation, whatever their behavior. Leonard EMERSON, WHITMAN, AND CONCEPTUAL ART The widespread abandoning of the art object at the end of the 1960s was taken as something radically, even frighteningly, new, by critics and artists alike. Objects, concept artist Joseph Kosuth was asserting by 1969, are "irrelevant" to art. Though an artist might choose, as in the past, to "employ" objects, "all art is finally conceptual." In fact it was (...) now time that the object, nothing more than the "physical residue" of the artist's mental activity, was dispensed with.1 "We / open our eyes and ears seeing life / each day excellent as it is," John Cage chanted: "This / realization no longer needs art...."2 Aestheticians as disparate as Murray Krieger and Harold Rosenberg reacted to this "transfiguration of the commonplace," as Arthur Danto has called it. Danto has gained a wide scholarly audience for his ideas about the 1960s as "the end of art," or at least as the beginning of "post-historical art."3 We know from such works as Renato Poggioli's TL· T^ry oftL· Avant-Garde that, in this century, particular movements have routinely declared themselves to be art's climax.4 Critics like Jacques Barzun and artists like Amedee Ozenfant had been saying for years that art was exhausted. Yet conceptualism's attack on the object struck most critics as something both alarming and new: Irving Sandler wrote in a special edition of the College Art Association's Art Journal devoted to the problem that it demolished "every notion of what art should be,"5 and Murray Krieger feared that this "leap beyond Pop Art" would "complete the obliteration of the realm of art, its objects, its museums...."6 But the conceptualist attacks on the art object were, in fact, not new. One can find attacks as scathing in Emerson and Whitman; so scathing, that criticism has rarely taken them seriously. The attacks the concep297 298Philosophy and Literature tualists mounted in the 1960s were only the culmination ofan intellectual tendency which appeared throughout the West one hundred and sixty years before. It has long been a scholarly commonplace that after 1800 an "intellectual tendency"—as M. H. Abrams finallytermed it—extolling the possibilities of this world emerged in all parts of Western culture. When itappears in literature we nowusually call it, withAbrams, Natural Supernaturalism; or, with Harold Bloom, the "visionary company." Man, Wordsworth decreed, can and must learn to find "Paradise" in "the common day."7 Surprisingly litde work has been done on what happened when this intellectual tendency, Natural Supernaturalism, confronted the art object. Emerson and Whitman can stand for many who were necessarily ill at ease with the idea of art objects as elite objects superior to the common things it was their mission to extol. Wordsworth works before these two; Ruskin develops similar ideas into greater complexity; but since Emerson writes clear expository prose and avoids fanciful terminology, he makes a good place to enter this dark wood. Let us begin with some straightfor-ward, overdue interdisciplinary history, reading Emerson on the art object, noticing similar passages in Whitman, and noting where Emerson has reworked Hegel for his own ends. For Emerson objects are but thought's "inert effect," as for the concept artist Kosuth they would be but the "physical residue" of the artist's activity. Emerson and Kosuth, opposite Shakespeare, do not applaud the art process as the giving to an airy nothing a local habitation and a name; rather they disdain the stuff as petrifactions, as dead mud footprints left by living thoughts diat have raced away.8 In his essay "Circles," Emerson derides our admiration for a work of architecture, directing us to the "litde waving hand" that built it, for "that which builds is better than that which is built." By the same logic, the invisible thoughts which truly wrought the object were even better than the hand and "nimbler."9 When such passages are discussed at all, they are usually considered Platonic,10 but, in his essay "Art," Emerson envisions a use for art objects Plato would have blinked at. Philosophy of history before the nineteenth century was based on the classical theory of history. That theory, in justifying the purpose of historical studies, maintained that history was a storehouse of good and bad examples; was of particular use in educating statesmen, since it provided them with vicarious experience; and was a more compelling moral guide than the abstractions of philosophy. The unquestioned authority of Polybius and other ancient historians, as well as. of the definitions of history by Pseudo-Dionysius and (...) Cicero , perpetuated the exemplar theory. The rise of professional, academic historical study rendered it irrelevant; Bolingbroke was its last notable exponent. (shrink)

In Oneself as Another, Ricœur famously writes of the ethical intention as “aiming at the ‘good life’ with and for others, in just institutions.” This article explores the potential meaning of “just institutions,” a theme underdeveloped in Ricœur’s work. While many have argued that institutions necessarily reify and so cannot aim toward just ends, the article draws on Ricœur’s differentiation between objectification and reification to show why this need not be the case. While reification destroys human value and meaning because (...) it reduces human activity to a thing, objectification characterizes the positive externalization of ourselves in objects—in words, deeds, structures, and institutions. Institutions such as the law are structures that can positively objectify our just aspirations, even if we must continually guard against these structures’ reified reduction. Ricœur shows us how objectification, including objectification of values in institutions, can be something not only positive but necessary in order for values to flourish. (shrink)

While it is often argued that U.S. military strategy has gone through substantial changes over the post three decodes, it is not so clear if this is so, or why this should be so. Some changes in the real strategic problem of the west must be considered, including the growth of the Soviet nuclear arsenal. Changes in our perception of the problem may be at least as important, however, amid some possibilities of ‘Finlandisation’. Changes in the West’s opportunities must also (...) be considered, including ‘limited nuclear war’, and a totally conventional defense. Finally to be considered are the bureaucratic motivations of those advocating any such changes in western military postures, all of which suggest that current policies may still be better than the alternatives. Few outstanding questions in the human behavioral sciences are timelier or more urgently debated than the evolutionary source of religious behaviors and beliefs. Byproduct theorists locate the origins of religion in evolved cognitive defaults and transmission biases. Others have argued that cultural evolutionary processes integrated non-adaptive cognitive byproducts into coherent networks of supernatural beliefs and ritual that encouraged in-group cooperativeness, while adaptationist models assert that the cognitive and behavioral foundations of religion have been selected for at more basic levels. Here, (...) we survey these differing approaches, noting their respective strengths and weaknesses. We then advance a novel model that centers on the ability of language to generate alternative worlds independent of immediate empirical facts, and thus highlight the similarities between religious belief and the modes of cognition that underlie institutions in general. The institutional cognition model of religion accounts for some of the shortcomings of extant approaches and draws attention to the human ability to create non-empirical worlds; that is, worlds that are imaginary. Both religious beliefs and institutional facts—such as jurisdictional borders—are non-empirical assertions, yet they are socially accepted as truths and reified through ritual and behavior. One type of non-empirical, linguistically generated belief—supernatural agent belief—is particularly effective for stabilizing systems of arbitrary norms by rooting them in deontic rather than utilitarian reasoning. The evolutionary roots and continued persistence of religion are thus functions of the capacity for humans to generate cognitive alternatives to empirical reality, and the need to stably coordinate those alternative conceptions. Philosophy of mind has made substantial progress on biologically-rooted approaches to understanding the mind and subjectivity through the enactivist perspective, but research on subjectivity within neuroscience has not kept apace. Indeed, we possess no principled means of relating experiential phenomena to neurophysiological processes. Here, we present the Nested States Model as a framework to guide empirical investigation into the relationship between subjectivity and neurobiology. Building on recent work in phenomenology and philosophy of mind, we develop an account of experiential states (...) as layered, or nested. We argue that this nested structure is also apparent in brain activity. The recognition of this structural homology — that both experiential and brain states can be characterized as systems of nested states — brings our views of subjective mental states into broad alignment with our understanding of general principles and properties of brain activity. This alignment enables a more systematic approach to formulating specific hypotheses and predictions about how the two domains relate to one another. (shrink)

It is a common metaphor that the text is a window onto the world that it depicts. I want to explore this metaphor and the insights it may offer us for better understanding legal interpretation. As in the opening epigraph from James Boyd White, I shall develop the metaphor of the text as window in three ways: the text may be transparent, opaque, or translucent. My goal will be to argue that the best way to understand legal interpretation is to (...) conceive of the legal text as translucent, but along the way I will compare the merits also of considering the legal text as either transparent or opaque. This article attempts to show the continuing practical relevance of hermeneutics through the example of legal interpretation. The article begins with the very concrete nature of legal hermeneutics that forms everyday legal practice – the interrelation of meaning and application – and expands at a more theoretical to show how legal hermeneutics, and hermeneutics more generally, offers what Ricoeur calls an interpretive “choice in favor of meaning.” The choice in favour of meaning underscores the restorative character of hermeneutics that legal (...) hermeneutics can epitomize.
