The authors of the preceding articles1 raise legitimate questions about patient and staff rights and the unintended consequences of allowing ABC News to film inside teaching hospitals. We explain why we regard their fears as baseless and not supported by what we heard from individuals portrayed in the filming, our decade-long experience making medical documentaries, and the full un-aired context of the scenes shown in the broadcast. The authors don’t and can’t know what conversations we had, what documents we reviewed, (...) and what protections we put in place in each televised scene. Finally, we hope to correct several misleading examples cited by the authors as well as their offhand mischaracterization of our program as a “reality” show. (shrink)

In this collection, a leading sociologist brings his distinctive method of social criticism to bear on some of the most significant ideas, political and social events, and thinkers of the late twentieth century. Dov Fox’s Birth Rights and Wrongs offers a largely compelling argument for expanding the scope of legal actions and remedies available to those whose reproductive choices are wrongfully frustrated by the actions of others. The dominant focus of the book is individuals who, due to the negligence and/or malice of medical professionals, suffer harms arising from reproduction imposed, denied, or confounded. A serious examination of these kinds of injuries is certainly appropriate given that medical professionals are increasingly involved in individuals’ (...) reproductive plans and that serious harms may arise when desired medical interventions are improperly implemented. I will not take issue with the general framework developed by Fox for addressing these kinds of harms. My focus here will be to show that Fox’s arguments have consequences for two kinds of cases that lie beyond the scope of those he explicitly acknowledges. The first is instances of reproductive wrongs that occur outside the confines of the patient/medical practitioner relationship. The second is claims made by children for harms suffered in virtue of being denied contact with their biological parents and/or access to identifying information about their biological parents. This essay critically explores contemporary Euro-American feminist debate on prostitution. It argues that to develop analyses relevant to the experience of more than just a small minority of “First World” women, those who are concerned with prostitution as a form of work need to look beyond liberal discourse on property and contractual consent for ways of conceptualizing the rights and wrongs of “sex work.”.

Science, in particular physics, is a collective enterprise and is so because it is, itself, a fruit of the exquisitely social nature of human living. So it is inevitable to encounter ethical issues in the natural sciences, since the contest of differing interests and views is perennial in its practice, indeed essential to its momentum. The crucial ethical question always hangs in the air: How is the truth best served? In this paper we describe some ethical aspects of our own (...) discipline of science: their cultural context and the bounds which they delineate for themselves, sometimes in transgression. We argue that the minimalist ethic espoused in science, namely loyalty to truth, is a bellwether for the much wider, more problematic, and more vital consequences of ethics – and its failure – in human relationships at large. An introduction to meta-ethics for non-philosophers.

John Mackie's stimulating book is a complete and clear treatise on moral theory. His writings on normative ethics-the moral principles he recommends-offer a fresh approach on a much neglected subject, and the work as a whole is undoubtedly a major contribution to modern philosophy.The author deals first with the status of ethics, arguing that there are not objective values, that morality cannot be discovered but must be made. He examines next the content of ethics, seeing morality as a functional device, (...) basically the same at all times but changing significantly in response to changes in the human condition. He sketches a practical moral system, criticizing but also borrowing from both utilitarian and absolutist views. Thirdly, the frontiers of ethics, areas of contact with psychology, metaphysics, theology, law and politcs, are explored.Throughout, his aim is to discuss a wide range of questions that are both philosophical and practical, working within a distinctive version of subjectivism-an "error" theory of the apparent objectivity of values. This article examines the idea of mind-reading technology by focusing on an interesting case of applying a large language model (LLM) to brain data. On the face of it, experimental results appear to show that it is possible to reconstruct mental contents directly from brain data by processing via a chatGPT-like LLM. However, the author argues that this apparent conclusion is not warranted. Through examining how LLMs work, it is shown that they are importantly different from natural language. The former (...) operates on the basis of nonrational data transformations based on a large textual corpus. The latter has a rational dimension, being based on reasons. Using this as a basis, it is argued that brain data does not directly reveal mental content, but can be processed to ground predictions indirectly about mental content. The author concludes that this is impressive but different in principle from technology-mediated mind reading. The applications of LLM-based brain data processing are nevertheless promising for speech rehabilitation or novel communication methods. (shrink)

I argue that the strongest form of consequentialism is one which rejects the claim that we are morally obliged to bring about the best available consequences, but which continues to assert that what there is most reason to do is bring about the best available consequences. Such an approach promises to avoid common objections to consequentialism, such as demandingness objections. Nevertheless, the onus is on the defender of this approach either to offer her own account of what moral obligations we (...) do face, or to explain why offering such a theory is ill-advised. I consider, and reject, one attempt at the second sort of strategy, put forward by Alastair Norcross, who defends a 'scalar' consequentialism which eschews the moral concepts of right, wrong and obligation, and limits itself to claims about what is better and worse. I go on to raise some considerations which suggest that no systematic consequentialist theory of our moral obligations will be plausible, and propose instead that consequentialism should have a more informal and indirect role in shaping what we take our moral obligations to be. ABSTRACTThis is a critical discussion and proposed refinement of the inspiring account of the successes and failures of economic modelling sketched in Dani Rodrik’s Economics Rules. The refinements make use of a systematic framework of the structure of scientific modelling. The issues include distinguishing the discipline of economics from the behaviour and attitudes of economists as targets of normative assessment; nature and sources of success and failure in modelling; the key role of model commentary; model transparency; purposes and audiences of (...) modelling; the nature of critical assumptions; negligibility, applicability, and tractability in modelling; the possibility of generally applicable models; and economics fundamentalism. The proposed refinements submit sharper formulations for some of Rodrik’s ideas and supplement others, but they also reveal tensions and relieve some – not yet all – of these. (shrink)

Davidson argued that the fact we can have a reason for acting, and yet not be the reason why we act, requires explanation of action in terms of the agent's reasons to be causal. The present paper agrees with Dickenson (_Pacific Philosophical Quarterly_, 2007) in taking this argument to be an inference to the best explanation. However, its target phenomenon is the very existence of a case in which an agent has more than one reason, but acts exclusively becaue of (...) one reason. Folk psychology appears to allow for this phenomenon. However, appreciation of 'rationalization' as a form of contrastive explanation reveals the existence of the Davidsonian possibility to the problematic. Claims that 'I did it because of R₁, not because of R₂' are entertained in folk psychology, and may be sincere or insincere. But as reports of conscious practical reasoning, even when sincere, they are not authoritative about the mechanism of motivation. (shrink)

One of the most interesting phenomena in the history of the English language is the remarkable rise of the word right, in its many interrelated senses and uses. This article tries to trace the changes in the meaning and use of this word, as well as the rise of new conversational routines based on right, and raises questions about the cultural underpinnings of these semantic and pragmatic developments. It explores the hypothesis that the `discourse of truth' declined in (...) English over the centuries; that the use of `right' and `wrong' as parallel concepts increased; and it notes that the use of right as an adjective increased enormously in relation to the use of true. Originally, right meant `straight', as in a right line. Figuratively, perhaps, this right in the sense `straight' was also used in an evaluative sense: `good', with an additional component building on the geometrical image: `clearly good'. Spoken of somebody else's words, “right” was linked with `true'. But in the course of the 17th and 18th centuries right appears to have begun to be used more and more with reference to thinking rather than speaking. The association of right with thinking seems to have spread in parallel with a contrastive use of right and wrong — a trend apparently encouraged by the influence of the Reformation, especially within its Calvinist wing. Another interesting development is that over the last two centuries or so the discourse of `right' and `wrong' appears to have found a competitor in a discourse of `cooperation' and mutual concessions. Judging by both the frequency and range of its use, the word right flourished in this atmosphere, whereas wrong was increasingly left behind. This article traces the transition from the Shakespearean response “Right.”, described by the OED as `you are right; you speak well', to the present-day “Right.” of non-committal acknowledgement and it links the developments in semantics and discourse patterns with historical phenomena such as Puritanism, British empiricism, the Enlightenment and the growth of democracy. This concise and readable book uses the question of obligation to the law as a stepping-off point to a more general discussion of deciding what's right and wrong.

When an act is right or wrong, there may be an explanation why. Different moral theories recognize different moral facts and offer different explanations of them, but they offer no account of moral explanation itself. What, then, is its nature? This thesis seeks a systematic account of moral explanation within a framework of moral realism. In Chapter 1, I develop a pluralist theory of explanation. I argue that there is a prima facie distinctive normative mode of explanation that (...) is essential to moral theory. In Chapter 2, I characterize normative explanation through its formal properties. I then draw on John Mackie’s claim that moral explanations are queer to develop a powerful form of moral scepticism. In Chapters 3–4, I reject attempts to reduce normative explanation to logical necessity, metaphysical necessity, or conceptual necessity. The failure of these accounts is taken to reinforce Mackie’s scepticism. In Chapter 5, I defend a partial analysis of normative explanation in terms of irreducible normative laws. I argue that irreducible normative laws offer a realist, though non-naturalist, answer to Mackie’s scepticism. The existence of irreducible normative laws then is defended as offering the best realist explanation of why rightness and wrongness supervene on descriptive properties. In Appendix A, I discuss the claim the normative explanation has an essential connection to the motivation of virtuous agents. I defend this claim from certain difficulties posed by Jonathan Dancy’s recent work. (shrink)

Derrick Darby’s book Rights, Race, and Recognition defends the seemingly startling thesis that all rights, moral as well as legal, are dependent upon social recognition. So there are no “natural” rights independent of social practices, and subordinated groups in oppressive societies do not have rights. Darby appeals to intersubjectivist constructivism to make his meta-ethical case, but in this critique, I argue that he conflates, or at least fails to consistently distinguish, two radically different varieties of constructivism: idealized intersubjectivist constructivism, which (...) is objectivist, and non-idealized conventionalist constructivism, which is relativist. In neither case, then, can Darby establish the shocking thesis that white supremacy objectively takes away blacks’ moral standing. (shrink)

This book is the result of a retired judge's curiosity about the meaning of 'moral' and 'ethical,' two ambiguous terms that mean different things to different people. Following ten guidelines, the author concludes that the terms 'right' and 'wrong' provide a more practical standard of conduct.

I offer new arguments for an unorthodox reading of J. L. Mackie’s Ethics: Inventing Right and Wrong, one on which Mackie does not think all substantive moral claims are false, but allows that a proper subset of them are true. Further, those that are true should be understood in terms of a “hybrid theory”. The proposed reading is one on which Mackie is a conceptual pruner, arguing that we should prune away error-ridden moral claims but hold onto those (...) already free of error. This reading is very different from the standard ones found in the literature. I build on recent work by Moberger and argue that this reading is better corroborated by close attention to the way in which Mackie argues at length that terms like “good” and “ought” are systematically context-sensitive, as well as by considerable additional textual evidence. This reading, however, faces an important challenge—to explain in what sense, if any, morality retains its “normativity” on the proposed reading. I argue that this challenge can be met, at least given some of Mackie’s further assumptions about the nature of rationality. (shrink)

Claims for improving migrants’ access to care often draw on universalistic ethical notions, such as the principle of equity as it is specified in human rights law and public health ethics. These claims contrast with political realities across most welfare states. In the underlying public discourses, the frontline arguments against greater inclusion have often focused on practical concerns, such as the costs of healthcare provision. Yet it has also been suggested that ultimately context‐specific moral frameworks play a key role in (...) demarcating legitimate right‐holders from undeserving others. Hence, is this a conflict between ethical principles and practical concerns? Or between different ethical perspectives? And why would that question matter? We propose that awareness of the nature of the arguments involved and respect for different ethical views are critical for coherent and constructive debates. This paper looks at the ways in which ethical concepts are used to justify exclusionary policy decisions. In particular, it examines the rationales that inform health policies towards documented and undocumented labor migrants in two welfare states, Germany and Israel, through the qualitative analysis of policy documents and 71 in‐depth interviews. The study points to the central role of particular concepts of health‐related deservingness. These results lead to the proposition that the fundamental clash in the discussion on migrants’ access to care is one, albeit not solely, between contrasting ethical perspectives. Drawing on process‐oriented approaches to ethical decision‐making, the paper concludes with three suggestions for moving forward with the migrant health rights debate. (shrink)

This is a non-evaluative overview of Justice: Rights and Wrongs covering its three parts: (i) an ‘archaeological’ account of justice and rights in the Christian tradition; (ii) a description of the goods to which we have rights; (iii) an argument grounding natural, inherent, human rights to goods in God’s love.

In its recent review of the US Public Health Service Sexually Transmitted Disease Inoculation Study, conducted in Guatemala from 1946 to 1948, the Presidential Commission for the Study of Bioethical Issues identified a number of egregious ethical violations, but failed to adequately address issues associated with the intentional exposure research design in particular. As a result, a common public misconception that the study was wrong because researchers purposefully infected their subjects has been left standing. In fact, human subjects have (...) been exposed to disease pathogens for experimental purposes for centuries, and this study design remains an important scientific tool today. It shares key features with other types of widely accepted research on human subjects and can be conducted ethically, provided certain safeguards are implemented. That these safeguards were not implemented in Guatemala is what made that study wrong, rather than the fact of intentional exposure itself. To preserve public trust in the clinical research enterprise, this conclusion ought to be stated explicitly and emphasised. (shrink)
