A notion that the theologians consider as a physical explanation model while discussing the movement in accordance with their theological views on the comprehension and interpretation of the universe is i‘timād. In conclusion, this notion, which has various meanings in different contexts, has been used to express “the tendency of object in motion, potential energy, pressure or resistance of an object to another object”. Within this framework, including weight-lightness, ascent-descent, impulse-pull etc., many phenomena related to the unidirectional and compulsory movement (...) of objects have been explained. On the other hand, theologians dealt with i‘timād in the context of their own conceptions of the universe, in relation to their understanding of causality while discussing the movements of bodies in the universe and their changes-transformations, and the causality relationship between them. As a result of their discussions, they asked questions about i‘timād and tried to find answers to these questions in the perspective of their own views of the universe. Furthermore, in relation to the theory of i‘timād, Mu‘tazilite scholar Abû Ishâq Ibrâhîm al-Nazzâm (d. 231/845) discussed the theory of tafra (leaping) and put forward contrary arguments. One of those who sought answers to the questions discussed in this direction and expressed an opinion on i‘timād is the Ash’arî theologian Abû al-Maâlî al-Juwaynî (d. 478/1085). He discussed i'timād in terms of the accidents of spatial generation and used i'timād as a universal explanatory theory for the phenomena of movement, space, weight and lightness, and directional phenomena such as up and down. From this point of view, he also tried to interpret i'timād with examples from natural phenomena and objects. In doing so, he synthesized i'timād within his own system and presented it as an explanatory element by considering the Ash'arite metaphysical principles through the examples he frequently gave. Thus, he put forward views on whether the movements of objects give rise to i'timād or not, and drew attention to the usage of i'timād in the Muʿtazilite and Ashʿarī schools. In this context, he tried to prove with examples whether the Muʿtazilite understanding of iʿtimād overlaps with the Ashʿarī understanding of iʿtimād. On the other hand, al-Juwaynī put forward his proofs in the context of his criticisms of the Muʿtazilites in general and al-Naẓẓām in particular. His criticisms were generally in response to the views of Muʿtazilite scholars on the phenomenon of motion in the context of iʿtimād. In fact, al-Juwaynī criticized the arguments of Abū ʿAlī al-Jubbāʾī (d. 303/916) and Abū Ḥāshim (d. 321/933) in the context of the theory of tawlīd and al-Naẓẓām in the context of the theory of tafra through their arguments. In this direction, the paper concentrates on how Juwaynî stated the examples he put while proving the theory of i‘timād in terms of movement phenomenon and what he comprehended from it. In addition, the paper discusses his criticisms against Nazzâm’s theoretical and experimental arguments he brought in the context of tafra theory while elaborating Juwaynî’s explanation of movement phenomenon. This article discusses Abū Isḥāq al-Naẓẓām’s (d. 231/845) (one of the first Muʽtazilī thinkers); understanding of Allah-world relationship, his theory of nature (tab‘) and his view on miracles. In a proposal form, Muʽtazilī scholars accept that the miracle, which is the actual confirmation, must occur, since it is not possible for Allah to confirm His messenger (prophet) in a way that everyone can hear and in a direct word. Since the Prophet's message can be authenticated only by a miracle, Muʽtazilī (...) thinkers paid great attention to this issue, organized and formed natural theories about the universe in a way that miracles can occur. Naẓẓām explains a kind of miracle that occurs under the power of Allah, by his theory of nature called latency and occurrence (kumūn-ẓuhūr). His view of miracles is rooted in the Muʽtazilī classification of miracles. Naẓẓām argues that in the theory of nature, things are infinitely divided. He also argues that all qualities considered accident (aʽrāḍ) by other Muslim theologians are different objects as only motion and rest are the only accidents. According to him, the universe consists of objects and accidents of motion only. In each object in the universe, an unlimited number of opposing objects (sub-components) that have different effects on each other is located in the same space. Those objects in the same space are intervened (tadākhul) with each other. Kumūn refers to sub-components that are located inside the object in a state of passing into each other, and a state of balancing each other through the push-pull motion (i‘timād). Ẓuhūr is an outward movement of the sub-component from where it is located when an impact imposed outside the object interacts with one of the sub-components contained in it. Naẓẓām says that too many opposing sub-components, such as heaviness-lightness, heat-coldness contained in the object, form an internal dynamic by providing balancing each other through inside the object with the push-pull motion. The state of balance inside the object is disrupted by an external factor affecting one of the sub-components. An external thing approaching the object interacts with one of the sub-components contained in the object. Then, the affected sub-component moves out of the object and thus the state of balance inside the object is disrupted. According to the theory of kumūn-ẓuhūr, change in objects occurs when the balance within the object is disturbed. The change in the balance also occurs not by the direct intervention of Allah and the creation of accidents, but by the disruption in the balance of natures within the object. Naẓẓām, who advocates the intrinsic natures in things, has been criticized for not leaving any room for Allah’s influence on objects at least through miracles. This criticism is not correct. Naẓẓām says that the nature of objects depends on God, and it is possible for God to intervene in them at any time. According to him, Allah can force opposing objects into a union that is not in their natures. In their natures, unification can separate those by applying pull and push. In this way, Naẓẓām sees the intervention of Allah as possible in the occurrence of a situation that is the opposite of what is present in the nature of objects. In Naẓẓām's theory of kumūn-ẓuhūr, there are suppressed natures and sub-components that are in a weak state inside the actual object. Furthermore, they cannot go out in any way from the actual object. One of these suppressed natures found in the object is removed from the nature of the object by the intervention of Allah when a miracle occurs in the hands of theProphet. In this case, the miracle is not something new that Allah has created, but that Allah has disclosed a hidden sub-component that is hidden in that thing that has never appeared before. Naẓẓām’s view of miracle is something occurring under the power of the created, which Muʽtazilī scholars accept in the classification of miracles in relation to, the theory of sarfa. He suggests that the Qur'an, which he accepts under the power of the created, would not be a miracle, if the Arabs could dispute it. However, according to him, the Qur'an is a miracle because Allah prevents them from the dispute. In his understanding of sarfa, the miracles occur directly as an act of God’s divine intervention with human beings. Madden ve Hare argümanlarını altmışlarda, Rowe ise yetmişlerde öne sürmüş olsalar da İslam düşüncesinde gereksiz ve anlamsız kötülük kavramına ışık tutabilecek bir teori bulunmaktadır. Bu çalışma Yeni Platonculuğun kurucu metni olan Enneadlar’ı merkeze alarak Plotinus’un ahlâk, erdemler ve adalet konusundaki düşüncesini ortaya koymayı hedeflemektedir. Bunu gerçekleştirmek için Enneadlar’ın I, 2, 19. bölümü tüm detaylarıyla ele alınacaktır. Elbette modern ve çağdaş dönemde bu konu etrafında gelişen literatür de göz ardı edilmeyecektir. Plotinus’un erdem tasavvurunun Platon ve Aristoteles’ten daha farklı bir yere evirildiği, Plotinus öncesindeki ahlâk anlayışının ve erdemler sistematiğinin daha realist bir yerde konumlandığı, onun görüşünün ise “Tanrı’yla benzeme” ideali etrafında şekillenen yarı mistik bir felsefî (...) ahlâk tasavvuruna dönüştüğü öne sürülecektir. Ayrıca erdemlerin yüce ve bayağı âlemde hikmet, şeceaat, adalet gibi eş adlı isimlerle adlandırılmasına karşın yüce âlemde Ruhun erdemlerle özdeş olduğu, bayağı âlemde bedenle birlikte bulunan nefsin ise erdemleri arınma yoluyla edinerek tanrıya benzemeye çalışması gerektiği sonucuna ulaşılacaktır. Sonuç olarak Plotinus’un, Platon’dan Descartes’e kadarki süreçte neredeyse iki ana metafizik öğretiden birinin sahibi oluşu ve etki gücü bakımından Aristotelesçiliğin karşısına esaslı farklılıklarla birlikte Platonculuk görünümünde konumlanışı sadece metafizik öğretide değil ahlâk felsefenin temel kavramları ve kavrayışında da bir dönüşüm oluşturmuştur. Birey/fert merkezli bu kavrayış, ahlâki dönüşümü başlangıç düzeyinde siyasi erdemlerin de katkısını yadsımadan ama kişinin kendine yönelmesi ve nefsinin bedensel kavrayış biçimleri ve dil başta olmak üzere tüm sınırları geride bırakıp arınma idealine ulaşmayı hedefleyerek kendisinden önceki perspektiflerden farklılaşmış ve kendisinden sonraki pek çok felsefî, dîni ve mistik ekole öncülük etmiş bir insan tasavvuru sunmuştur. Plotinus’un felsefesinin bütünü dikkate alındığında bu içe dönüşün, dış dünyayı yok saymak anlamına gelmediği, dış dünyadaki belirlenmiş ölçülere göre erdem sahibi olmanın yetersiz görüldüğü bu nedenle bu aşamadan sonra içe dönerek arınmak gerektiği fikrinin savunulduğu öne sürülmüştür. Hüküm verilirken temel bakış açısı ve değerlendirme yöntemi genel hatlarıyla fıkıh usûlü ve kavaid kitaplarında mevcut olmakla beraber, bunun karmaşık güncel meselelere uyarlanması her zaman kolay olmamaktadır. Bu makalede konunun işleyişi ortaya konulmaya çalışılarak fıkhî açıdan ilgili konulara değinilecektir. Çalışmada Bitcoin meselesi, garar, bey’ul ma’dûm, kumar, miras ve akit teorisi çerçevesinde değerlendirilerek okuyucuda bir kapının aralanması hedeflenmektedir. Konunun nihai hükmü ise ilgili kurumlar ve fıkıh meclisleri tarafından (...) verilmelidir. Nihayetinde bu çalışma konunun belirli yönleri etrafında şekillenmiş ve sübjektif bakışı açısı potansiyeli taşıyabilmektedir. Bir şey, Tanrı onu emrettiği için mi iyidir ya da kötüdür? sorusunu merkeze alarak oluşturulan ve yakın dönem içerisinde gerek din felsefesi ve gerekse ahlak felsefesi içerisinde tartışılan konulardan biriside “İlahi Buyruk Teorisi”dir. Bu teori kısaca, ahlaki değerlerin kaynağının, Tanrı’nın buyruklarında, yani onun emir ve yasaklarında belirlendiğini açıklamaya çalışmaktadır. Eylemlerimizin iyi ya da kötü olarak nitelendirilmesinin Tanrı’nın buyruklarıyla mı, yoksa onların Tanrı’dan bağımsız, yani, kendi doğalarından mı kaynaklandığı tartışması, ilk olarak ahlak felsefesi içerisinde Platon’un “Euthyphro” diyaloğunda kendisine yer bulmuştur. Bununla beraber Hristiyan teolojisi içerisinde Aziz Augustinus, Duns Scotus ve Thomas Aquinas isimler; İslam düşüncesi içerisinde ise, “Hüsün ve Kubuh” meselesi adı altında Mu’tezile, Eş’ariyye ve Matüridiyye gibi ekoller konuya dair yaklaşımlarını ortaya koymaya çalışmıştır. Tarih boyunca Kur’an’ı anlama ve yorumlama faaliyetinin metodolojik bir zemine oturtulmasına yönelik çabaların semeresi olarak oluşup şekillenen klasik Ulûmu’l-Kur’an bahislerinden biri olan nesh konusu Sünnî gelenekte olduğu kadar Şiî gelenekte de farklı yorumlara konu olmuştur. Şiî müfessirler çoğunlukla bu kavramın anlam ve izahı ile ilgili olarak Sünnî meslektaşlarıyla benzer tutumlar sergilemiş olsalar da belli kırılma noktalarında onların kendilerine özgü yaklaşımlara sahip olduğu da gözlemlenebilmektedir. Özellikle nesh ve bedâ kavramları arasındaki benzerlik ve karşıtlık noktaları ile neshin Kur’an dilindeki isimlerinden biri olan (...) insâ kavramı bu farklı yaklaşımların temerküz ettiği hususlar arasında sayılabilir. Bu yazı söz konusu kavramın Şiî tefsir edebiyatı içerisinde nasıl anlaşılmış olduğunu izlemenin yanı sıra bu geleneğin Sünnî gelenekten ayrıştığı noktalara titizlikle işaret edebilmek için kimi değerlendirmeler yapmayı da amaçlamaktadır. Özellikle bedâ kavramı çerçevesinde Şiî tefsir ve daha genel anlamda Şiî düşünce hakkında ağırlıklı olarak dışarıdan teşekkül etmiş algı, bu düşüncenin ilahî bilgide değişiklik ya da eksiklik gibi illetleri mümkün gördüğü şeklindedir. Ne var ki doğrudan Şiî bilginlerin tefsir metinlerinde böyle bir yargıyı doğrulamak için yeterli veri bulunmamaktadır. İnsâ kavramı ise Şiî müfessirler tarafından, onların peygamberlerin ismeti konusundaki hassas tutumlarının neticesi olarak, farklı yorumlara ve mezhep içi tartışmalara konu olmuştur. Bu tartışmalarda Şiî bilginler imamlardan nakledilen rivayetlerin literal anlamlarına sadık kalmakla teorik tutarlılığı sürdürme arasında farklı konumları benimsemişlerdir. Bu bağlamda bu yazı, tefsir disiplini çerçevesinde benimsenen genel kabullerin metin yorumunda sebep olduğu gerilimlere ve açtığı diyalektik düşünme imkânlarına dair daha kapsamlı çalışmalar için bir tür giriş/başlangıç noktası oluşturmayı da hedeflemektedir. Bu makale Fahreddin el-Râzî’nin metafizik yakîn anlayışını te’vîl teorisi açısından incelerken, onun metafizik yakîne ulaşma hususundaki optimistik tutumunu da ortaya çıkarmaktadır. Kuşkucuların lideri (şeyhü’l-müşekkikîn) olarak da bilinen Râzî’nin, kendisinden önceki felsefe ve kelam geleneklerini etraflıca kritik ederken yeni ve özgün bir anlayış ortaya koyup koymadığı tartışılmış, eleştirel düşüncesi kendisinden sonraki düşünürlerce tenkit edilmiş ve bu vesile ile Râzî hakkında çeşitli okuma biçimleri ortaya çıkmıştır. Bu okuma biçimleri arasında Râzî’yi, aklın kelamî bilgide yakîne ulaşamayacağı şeklinde bir metafizik bilinmezci olarak değerlendirenler (...) de olmuştur. Bu çalışma, Râzî’nin metafizik yakîn anlayışını te’vîl teorisi ile birlikte serimlemeye çalışmaktadır. Makalenin ilk ana bölümü metafizik yakîn ve te’vîl ilişkisi ekseninde -başka bir deyişle kelâmî bilgide akıl-nakil tartışmaları açısından- Râzî öncesi düşünceye dair -ipuçları niteliğinde- tarihsel bağlam vermektedir. İkinci ana kısım ise Râzî’nin metafizik bilgide akıl anlayışındaki ilkelerini istivâ’ kavramının te’vîli üzerinden belirginleştirmektedir. Bu makale, Râzî’nin te’vîl anlayışını bütünüyle ortaya koymayı amaçlamamaktadır. Ancak, te’vîl teorisinin temel bileşenlerinden birisi olan akliyyâtın nasıl metafizik yakîniyyâta dönüştüğünü analiz etmektedir. Muʻtezile, akliyyât üzerinden dönüştürdüğü metafizik yakîniyyâti, dini anlama ve yorumlamada kıstas haline getirmiştir. Öte yandan metafizik yakîniyyât anlayışlarındaki iddiaları, farklı din yorumlarına karşı müsamahasız bir tavra dönüşmüş, siyasi erkle birlikte baskıcı hale gelmiş ve Muʻtezile dışı kelam düşüncelerini akılcılık -daha radikal bir ifade ile rasyonelizm- karşısında eleştirel-tepkisel olmaya sevk etmiştir. Doğal bir sonuç olarak diğer doktrinlerin rasyonel gelişimi Muʻtezilî etki yüzünden yavaşlamıştır. Makalenin birinci kısmı, Râzî öncesi Eşʻarî düşünceyi, metafizik yakîniyyât ve nass yorumu açısından değerlendirirken, yorum ve akliyyât ilişkisine dair anlayışlarındaki dakikleşmeyi Muʻtezile’nin tarihsel varlığına ters orantılı olarak ele almaktadır. Ancak Râzî’ye kadar kararsız bir şekilde gerçekleşen dakikleşme süreci, Râzî ile birlikte nihayi formuna ulaşmaktadır. Râzî’nin te’vîl teorisinin temel prensiplerinden ilki, aklın nakle esas (el-ʿakl aṣlu’l-nakl) teşkil etmesidir. Akıl, naklin yalnız ispatı ve anlaşılması bakımından değil, aynı zamanda yorumlanması (te’vîl) açısından da temel belirleyici bir unsura dönüşmektedir. Bu makale, Râzî’nin ilmi hayatının sonlarına doğru, metafizik yakîniyyâta ulaşma noktasında pesimizme düşerek, metafizik bilinmezciliğe doğru yöneldiği şeklindeki anlama biçimlerine karşı, en son eserleri arasında olan ve tamamlanmamış Tefsîr’i üzerinden cevaplar aramaktadır. Râzî, değişik zamanlarda ele aldığı eserlerinde, “naklin zanniliği” hususundaki ısrarlı duruşunu vurgulamaktadır. Bu makale Râzî’nin naklin zanniliği noktasındaki ısrarlı duruşunun, “aklın asıllığı” ilkesindeki kararlılığı ile zorunlu bir paralellik gösterdiğininin altını çizerken, metafizik yakîniyyât açısından da hala optimistik olduğunu savunmaktadır. İslam geleneği kendi istidlâl teorilerine sahip olsa da modern terminoloji ve teoriler, yorumlayıcı anlayış ve eleştirel analize yardımcı olabilir. Bu makale, Kâdî Abdülcebbâr’ın (ö. 415/1025) Hıristiyanlığa karşı kelâm ve reddiye geleneklerindeki aklî yöntemleri kullandığı Tesbît’ine odaklanmaktadır. Yine, Kâdî Abdülcebbâr’ın Hıristiyanlıktaki “İsa’nın ilahî doğası” iddiasına karşı delillerini örneklerle tahlil etmekte- dir. Makale, tarihî kelâm metinlerinin istidlâlî açıdan incelenmesi gerektiğini; ayrıca delile dayalı kelâmın tarihini ve gelişimini anlamada hem analitik teorilerin hem (...) de argümantasyon teorilerinin ne kadar önemli olduğunu tartışmaktadır. Kategoriler’de, iki tür ontolojik yüklemleme ilişkisi ve karşılık gelen iki temel varlık ayrımı karşımıza çıkar. Aristoteles, bir taşıyıcı içinde olma ifadesiyle tözleri ilineklerden, bir taşıyıcı için söylenir olma ifadesiyle de tümelleri, özleri bakımından aynı olan tikellerinden ayırır. Anılan ayrımlar bize Aristoteles’in varlık görüşündeki iki temel prensibi verirler: Var olan çok anlamlıdır ve her zaman belirli bir şeydir. Bu bakımdan Kategoriler, şeylerin hem özlerini hem de ilineklerini açıklama ve böylece ilgili yüklemleme problemlerini çözme iddiasına sahiptir. Bu doğrultuda, metnin kendisinde doğrudan bir (...) atıf bulunmasa da literatürde Kategoriler’in Platoncu formlara yönelik iki temel eleştiri getirdiği sonucuna varılır: (1) Formlar teorisi var olanları tek anlamlı varsayarak şeylerin ilineksel özelliklerini açıklamakta başarısız olur; (2) formlar teorisi ilişkisel bir yüklemleme modeli kabul ettiğinden şeylerin özlerini açıklamakta başarısız olur. Bu yazı, Kategoriler ve Platoncu formlar arasındaki bu eleştirel ilişkinin Metafizik’in A kitabında yer alan bir pasajda (990b22-991a3) açıkça görülebileceği iddiasını taşır. Bilhassa Afrodisyaslı Aleksandros’un şerhi ışığında ele alındığında, pasajda formlar teorisine yöneltilen karşıt argümanların kategoriler kuramını varsaydığı ve argümanlar ile tam da literatürde konu edilen iki eleştirinin yapıldığı görülür. Bunun devamı olarak pasajdan, Kategoriler’in kaçındığı fakat formlar teorisinin yüzleşmek zorunda olduğu bazı ontolojik zorlukları çıkarsamak da mümkündür. Bu yazı ile, anılan pasaj bir kanıt olarak sunulmakta ve böylece Kategoriler’de formlar teorisinin örtük bir eleştirisi bulunduğu yönündeki literatür okumalarına katkıda bulunulması amaçlanmaktadır. Güvenilirci (reliabilist) bilgi teorisi, çağdaş epistemik gerekçelendirme kuramları içerisinde, dışsalcı (externalist) kuramın bir türü olarak kendisine yer bulmaktadır. Kısaca, bir inancı gerekçelendiren şeyin o inancın oluşturulduğu sürecin güvenilirliği olduğunu öne süren bu yaklaşım, bu bilişsel süreçleri özne dışı unsurlara bağladığı içinde dışsalcı bir pozisyonda yer almaktadır. Bu bilgi teorisinin tam karşı konumunda yer alan içselci (internalist) bilgi teorisi ise, özne merkezli bir yaklaşımla, doğru inancı gerekçelendirecek yöntemin, kişinin kendi zihinsel yapısından yola çıkarak, belli kognitif süreçler sonucunda ulaşılabileceğini öne (...) sürmektedir. Epistemik gerekçelendirme kuramları içerisinde birçok tartışmada kendisine yer bulan bu iki bilgi teorisi, kendi içerisinde de birçok farklı kurama kapı aralamıştır. Burada içselci bilgi teorisinden ortaya çıkan erişim içselciliği, farkındalık içselciliği gibi kuramları ve dışsalcı bilgi teorisinden ortaya çıkan süreç güvenilirciliği, gösterge güvenilirciliği ve erdem güvenilirciliği gibi farklı türden kuramları örnek olarak verebiliriz. Öte yandan çağdaş epistemolojideki bu tartışmalar, dini epistemoloji içerisinde de kendisine yer bulmuştur. Özellikle Alvin Plantinga, kendi dini epistemolojisi içerisinde dışsalcı bir tutum sergilemiş ve son dönem çalışmaları içerisinde de güvenilirci bir anlayışla Tanrı inancının epistemik mahiyetini ortaya koymaya çalışmıştır. Bu makalede öncelikle dışsalclık ve onun bir türü olan güvenilirci bilgi anlayışını ve bu kuramlara getirilen eleştirileri ele almaya çalışacağız, daha sonra A. Plantinga’nın son dönem dini epistemolojisinin de yönünü belirleyen güvence (warrant) kavramını açıklayıp, bu kavramın bütün teist dinlere uygulanabilirliğini sorgulayacağız. (shrink)

Âlemin zaman içinde vücûda gelip gelmediğine dair tartışma düşünce tarihinde kadim bir geçmişe sahiptir. Platon öncesi döneme kadar izleri sürülen söz konusu tartışma İslâm düşünce tarihinde de önemli bir yer işgal eder. Hareket ve zamanı, seyyal varlığın birer boyutu olarak gören Sadrâ’ya göre hareketin bizzat kendisi anlamına gelen yaratmanın olmadığı mevhum bir zamanın varlığı söz konusu olamaz. Bu anlamda âlem, öncesinde yokluk olan muayyen bir zaman diliminde yaratıldığı anlamda hâdis değil, yaratmanın zaman mecrasında gerçekleştiği anlamda hâdistir. Māturīdism is an Ottoman identity and this identity was not limited, as is commonly believed, to the last period of the Empire. It maintained its formal existence throughout the Ottoman history. Nevertheless, the context in which the Māturīdism was located or with which it was associated changed in the course of time. In the early period when the eclectic way of thinking was dominant, Māturīdism as a creed was apparent mainly in the jurists whose ascetic identity was prominent and partly (...) in the mystical currents that were essentially continuations of Yasawiyya. At this point, the Bukhara-centered Ḥanafī legal literature played a distinctive role. At the time of Meḥmed II and in the following period during which the philosophical kalām dominated the scene, the Māturīdism was relatively passive and was in search of a position against the Ash‘arism. The new Rāzian paradigm of thought that began to be felt strongly in the Ottoman lands with Meḥmed II as an attempt of integration into the global circulation of knowledge prevented to a certain extent the visibility of Māturīdism. However, even in this period, Māturīdism was remarkably reflected in the muqaddimāt-i arba‘a literature which was directly sponsored by Meḥmed II. The tradition of philosophical kalām in the Ottoman scholarship, just when it was about to yield significant results, was interrupted due to the struggle against the Ṣafawids. Transformation of this political tension, at the same time, into a fight against Shiism also brought about a constriction in the religious thought of the Ottomans. Shiism and its all other variants were bitterly attacked under the main heading of Rāfiḍa. Unfortunately such a refutational approach proved a boomerang and returned in time striking the Ottoman Ṣūfīs who stood near the line of the Ardabil Shrine before its Shiitization. Ḥanafī fatwā literature was used extensively in the refutation texts against Ṣafawids. This brought to the fore at first the Ḥanafite and then the Māturīdite identity. This paper attempts to analyze this changing emphasis on Māturīdism in the Ottoman period and the political and intellectual factors that supported and nourished it. -/- SUMMARY It can be argued that the debates around Ash‘arism and Māturīdism in the Ottoman period and the resulting meant more than attempts of the members of the two sides to understand each other and that Māturīdism, particularly from the 16th century onwards, was gradually brought fore as the identity of Ottomans. In fact, this identity was not limited, as is commonly believed, to the last period of the Empire; it maintained, in form, its existence throughout the Ottoman history. Nevertheless, the context in which the Māturīdism was located or with which it was associated changed in the course of time. In the early period when the eclectic way of thinking was dominant, Māturīdism as a creed was apparent mainly in the jurists whose ascetic identity was prominent and partly in the mystical currents that were essentially continuations of Yasawiyya. In this period, Ottoman scholars still embraced the Māturīdī-Ḥanafī line in their theological views. Ḫiḍir Beg’s al-Qaṣīda al-Nūniyya, and al-Khayālī’s commentary upon it, and the commentary written by Aḥmad b. Oġuz Dānishmand al-Aḳshahrī on al-I‘timād of Abū al-Barakāt al-Nasafī were the most noticeable Māturīdite texts from that time. Besides, al-Khayālī’s supercommentary (ḥāshiya) upon the commentary of al-Taftāzānī written on al-‘Aqā’id of Najm al-Dīn ‘Umar al-Nasafī was also of central importance. However, the new Rāzian paradigm of thought that began to be felt strongly in the Ottoman lands with Meḥmed II as an attempt of integration into the global circulation of knowledge prevented to a certain extent the visibility of Māturīdism. But, this should not be taken to mean that Māturīdism lost its ground of existence. That the Ash‘arite works produced in this new paradigm were transferred to and fully integrated in the madrasa curriculum was not because they were Ash‘arite texts but because they were the most original and highest achievements of the philosophical theology. These texts that aimed at combining all fields of knowledge on a single platform, despite the Ash‘arism they included, constituted the peak of the Islamic thought of the time. In the preference of these texts, the fact that the Māturīdī tradition generally stood, in course of time, distant to the philosophy and chose to continue the kalām in the classical line also played a role. Māturīdī theologians Muḥammad b. Ashraf al-Samarqandī, partly, but Ṣadr al-Sharī‘a al-Maḥbūbī, to a greater extent, were notable exceptions to this general Māturīdī tendency. These figures were theologically Māturīdite, but their framework of producing discourse was the combination of philosophy and kalām as with their Ash‘arī counterparts. Therefore, Ṣadr al-Sharī‘a’s criticism of Fakhr al-Dīn al-Rāzī, and through him, of against the Ash‘arism in the context of muqaddimāt arba‘a was wholeheartedly supported by the Ottoman ulama. Even it was Meḥmed II who sponsored the debates regarding muqaddimāt arba‘a. The works written by such scholars as Muṣliḥ al-Dīn al-Kastallī, al-Ṣamṣūnī, ‘Alā’ al-Dīn al-‘Arabī, Mollā ‘Arab al-Anṭākī, Khaṭībzāde, Sa‘dī Chalabī during his and his son Bāyazid II’s reigns were the supercommentaries written upon the related chapter of al-Talwīḥ, al-Taftāzānī’s commentary on Ṣadr al-Sharī‘a’s al-Tawḍīḥ where the former responded to the criticism of the latter from an Ash‘arī point of view. The Ottoman ulama, in their workswere forced to choose between the two scholars and they mostly supported Ṣadr al-Sharī‘a and Māturīdism. The tradition of philosophical kalām in the Ottoman scholarship, just when it was about to yield significant results, was interrupted due to the struggle against the Ṣafawids. Transformation of this political tension, at the same time, into a fight against Shiism also brought about a constriction in the religious thought of the Ottomans. The reflex of of identifying oneself through ‘the other’ made, to a certain extent, the theological and philosophical debates regarding faith meaningless, and gradually gave the Ottoman Sunnism a doctrinal and political tone. In such a context, the Ottomans’ paradigm of producing thought in line with the philosophical kalām began to lose its function, and, the focus of scholarhsip shifted; Shiism with its all variants were began to be bitterly attacked under the main heading of Rāfiḍa. When the refutation texts composed from the reign of Bāyazid II onward to criticize the Ṣafawids are chronologically analyzed, it is seen that the contents of the texts evolved from criticism of Rāfiḍa to criticism of Sūfism. Ḥanafī fatwā literature was used extensively in these refutations. So the fatwās issued against Rāfiḍa and Ṣūfīs in malāmatī line in earlier centuries in different contexts for different reasons were employed to criticize the new opponents. This caused two important results: First, such an approach proved a boomerang and returned in time striking the Ottoman Ṣūfīs who stood near the line of the Ardabil Shrine before its Shiitization. Ḫalwatīs, Bayrāmīs, Gulshanīs, Baktāshīs and Mawlawīs were the sufi groups influenced by this situation in varying degrees. Second, Sunnism was exposed to the narrowization and centered around the fiqh, particularly Ḥanafī fiqh, in the context of Ḳāḍīzādelīs who were the main adversaries of above mentioned groups. The culture of catechism (‘ilm-i ḥāl) that came to the fore through the efforts of Ḳāḍīzādelīs was a crystallization and was mainly fuelled from this tension. Such a crystallization led the Ṣūfīs, the opponents of Ḳāḍīzādelīs, to a higher level of discourse deemphasizing the Ḥanafī aspect: They underscored the discourse of Ahl al-Sunna and four madhhabs, and mostly turned towards the Shāfiʿī and Ash‘arī traditions to look for support fortheir views. This process during which the emphasis of sharī‘a and tradition began to come to the fore once again paved the way for the zuhd and fiqh-centered religious thought that was maintained from the time of the Seljukids in Anatolia and was influential until Meḥmed II’ reign. Therefore in the Ottomans, particularly starting with the reign of Suleymān I, an intensive emphasis on Abū Ḥanīfa was witnessed. Abū Ḥanīfa was at the very center of the debates revolving around zuhd and fiqh which came about in the same period and in which the sharī‘a sensitivity was a determining factor. Al-Māturīdī, whose name was overshadowed for a long time by the name of Abū Ḥanīfa, but who became prominent in the tradition with Abū al-Mu‘īn al-Nasafī, had to transfer his gains for a period of time to Abū Ḥanīfa. Emphasis on Abū Ḥanīfa looks like a rope that when pulled, all the tradition comes with it. When the topics began to be discussed in a manner that would also include the theological context, the contribution of the works ascribed to Abū Ḥanīfa, namely al-Fiqh al-Akbar, al-Waṣiyya and al-‘Ālim wa al-Muta‘allim to the discussions would be limited. For this reason, the need to refer to al-Māturīdī or to the theological formation bearing his name was inevitable. So, the literature on the points of disagreements between the Ash‘arism and the Māturīdism developed both vertically and horizontally in the 18th century and, corollary to that, the debates of free will as a corolloary to that, once again brought Māturīdism to the fore. One of the prevalent inference methods the mutakallimūn uses is qiyās al-ghaib ‘ala al-shahid (analogy from the visible world to the invisible world). Mu‘tazila, who accepts this method as an absolute criterion in the divine attributes, rejects the possibility of difference between shahid and ghaib about the reality of attributes. By rejecting the concept of kalām nafsī adopted by Ahl al-Sunnah, they mention the divine speech in the category of actual attributes and claim that kalāmullāh (God’s speech), like human speech, (...) is an accident consisting of words and sounds. Mu‘tazila, who defines mutakallim as the agent of kalām, claims that God is also the agent of the word. In this regard, Mu‘tazila, who defends the origin of the kalāmullāh and the createdness of the Qur’ān, focuses on the explanation of the nature of the kalām at the beginning of these theological subjects. As an extension of the issue of whether the ḥikāyah and maḥkī are the same or not, which is the subject of discussion in the context of the possibility of creating something similar to the Qur’ān, Mu‘tazila, who disagree on whether kalām (word) is a kind of sound (ṣawt) or not, examine the problem of the nature of the word by expanding it to include sounds. Although they agree that sounds are accidents created by humans through tawlīd, they propound different theories about the physical formation of sound and kalām. These theories are differentiated according to discussions about the essential factors for the formation of sounds. Some scholars claim that i‘timād generates sounds, and the substrate (maḥall) is enough to form the sounds. In contrast, others claim the necessity of a specific structure (binya), movement (ḥaraka), and air added to the substrate. In this regard, this study will deal with the effect of these factors mentioned above to the formation of the sounds and the physical examples which every group mentioned to prove its opinions rightfulness. The most detailed explanations about this topic are seen in the works of Baṣrian Mu‘tazila. Therefore, this study will examine the opinions about the production of sounds, which argued around metaphysical issues in the context of the createdness of the Qur’ān and the attribute of kalām, which are submitted by Abū ‘Alī al-Jubbā'ī (d. 303/916), Abū Hāshim al-Jubbā'ī (d. 321/933), and their followers Qāḍī ‘Abd al-Jabbār (d. 415/1025), Abū Rashīd al-Nīsābūrī (d. first half of the 5./11. century), and Ibn Mattawayh (d. first half of the 5./11. century), the representatives of Baṣrian Mu‘tazila, who adopt atomic universe understanding. The study aimed to form an opinion about the theologians’ way of discussing a particular physical phenomenon to constitute a basis for solving metaphysical problems. To clarify the problem, first, it will deal with the essence of sounds in the Baṣrian Mu‘tazilites tradition, and then it will tackle the discussions about the formation of the sounds. (shrink)

Aristotelesçi bilim teorisi her ilmin konu, ilke ve meselelerden oluştuğunu ileri sürmekte, felsefî mukaddime yazma geleneği ise bir eserin konusunu, amacını ve sair belli başlı meselelerini ele alarak giriş yapma tarzını sunmaktaydı. Makale felsefî bilim teorisiyle ilmî eserlere mukaddime yazma geleneğinin, İbnü’l-Hâcib’in (ö. 646/1249) Muhtasarü’l-Müntehâ’sının girişi üzerine (...) yapılan şerh ve haşiyelerde kesiştiklerini göstermektedir. Bu metne onlarca şerh ve haşiye yazılmıştır, fakat makalede bunlar içerisinden on üç ve on dördüncü yüzyıllarda Kâdî el-Beyzâvî (ö. 691/1291-92), Ziyâüddin et-Tûsî (ö. 706/1306-7), Kutbüddin eş-Şîrâzî (ö. 710/1311), Cemâleddin el-Hillî (ö. 726/1325), Bedreddin et-Tüsterî (ö. 732/1332), Adudüddin el-Îcî (ö. 756/1355), Sa‘deddin et-Teftâzânî (ö. 792/1390) ve Seyyid Şerif el-Cürcânî (ö. 816/1413) tarafından yazılanlar incelenmektedir. İbnü’l-Hâcib’in giriş mahiyetindeki iki cümlesi üzerine yapılan yorumlar mebâdî kelimesinin ilkeler ve başlangıçlar şeklindeki -ilki bilim teorisi ikincisi ise bilimlere giriş yazma geleneğiyle ilişkili olan- iki anlamı arasındaki gerilimi göstermektedir. Müslüman bağlamında bilim-din etkileşiminde muhtemelen en can alıcı konu, İslam ve Neo-Darwinci evrim teorisi arasındaki ilişkidir. Müslüman alimler iki ana kampa ayrılır. Bir yandan, daha geleneksel eğilimlere sahip Müslüman düşünürler, İslam'ın evrimle çeliştiğini düşünüyorlar. Diğer tarafta, evrim teorisinin İslam'la tamamen uyumlu olduğunu düşünen daha bilimsel yönelimli Müslüman düşünürlerimiz var. Başta bilim insanları olmak üzere bu düşünürler, genellikle Kuran ayetlerinin bazılarının mecazi bir okumasını sunarlar ya da onları yeniden yorumlarlar. Bu makalede, ben orta yolcu bir yaklaşım tercih edecek ve mecazi (...) okumaya ya da yeniden yorumlamaya başvurmadan, geleneksel Kuran okumasının Neo-Darwinci evrim teorisi ile uyumluluğunu göstermeye çalışacağım. Standart bilimsel anlatıyı da herhangi bir çarpıtmaya maruz bırakmadan kabul edeceğim. İlk olarak, kutsal kitaptaki yaratılış anlatısının evrim teorisiyle bağdaşmadığı iddiasının kötülük sorununa, yani kötülüğün klasik Teizm'in Tanrısı ile bağdaşmadığı iddiasına, benzediğini savunacağım. Bu analojiyi kullanarak hem Kuran anlatısının hem de evrim teorisinin nasıl doğru olabileceğine dair eksiksiz ve makul bir açıklama bulmaya çalışmak yerine, sadece bu iki açıklamanın birbiri ile çelişmediğini göstermeyi amaçlayan daha mütevazı yaklaşımlar aramamız gerektiğini iddia edeceğim—yani kötülük sorunu bağlamındaki savunmalara benzer bir yaklaşım geliştirmeye çalışacağım. Hem bilimsel yaratılış anlatısı hem de Kuran’daki yaratılış anlatısı özetledikten sonra ve olası tek çelişkinin ortak ata tezinde olduğunu savunduktan sonra, Kuran anlatımının evrim teorisiyle uyumluluğunu göstermeyi amaçlayan bu tür iki savunma sunacağım. Birinci savunma, "çifte yaratılış savunması", Adem'in, kutsal kitapların tarif ettiği Cennet'te ve evrim biliminin tarif ettiği Dünya'da olmak üzere iki kez yaratıldığı senaryoları içerir. Bu nedenle, her iki yaratılış anlatısı da aynı anda doğru olabilir ve bu nedenle ikisi bir biri ile tutarlıdır. İkincisi, "çoklu ata savunması", Tanrı'nın Adem'i doğrudan topraktan yaratmış olabileceğini ve onun soyundan gelenlerin evrimleşmiş homo sapiens ile ürediğini öne sürer. Turkish Epistemoloji rasyonel inançların felsefi analizini konu edinmesi nedeniyle gerekçelendirme edimine merkezi bir önem atfeder. Gerekçelendirme kişinin bir önermeye inanmak için gerekçeye sahip olunmasını sağlayan koşul veya koşullar dizisinin tespit edilmesini içerir. İnançlarımızın birçoğunun çıkarımsal olmayan gerekçelerinin bulunduğu şeklindeki ılımlı/yanılırcı temelci perspektifle uyum sağlayan bir gerekçelendirme teorisi olarak Michael Huemer tarafından ortaya konan görüngüsel muhafazakarlık ilkesi, bu türden bir koşulu tanımlar. GM formülasyonuna göre eğer S’ye p olarak görünüyorsa, çürütücü etmenlerin yokluğunda S’nin p’ye inanmak için en azından bir dereceye (...) kadar gerekçesi vardır. Görüngüler ise rasyonel inanç oluşturmanın olanağına referans veren, inanç ve inanma eğilimlerinden farklı, sui generis deneyimlerdir. Bu makalede görüngülerin doğasından hareketle GM’yi tanıttım ve GM’ye yöneltilen eleştirilerin bir bölümünü tartıştım. Yer verdiğim eleştiriler, GM’nin irrasyonel/tehlikeli görüngüler ve bilişsel nüfuzdan kaynaklanan inançları dahi gerekçelendirilmiş kabul ettiği, GM teorisyenlerinin görüngülere gerekçelendirme edimi özelinde biçtiği başat rolün ve inanç ve görüngüler arasında öngörülen farklılıkların abartılı olduğu itirazlarını içerir. Bana göre sözü edilen eleştirilerin hiçbiri, GM’nin reddedilmesini gerektiren argümanlar içermez. Görüngülerin epistemik gerekçelendirmedeki rolünü tesis eden GM veya benzeri bir ilkeyi kabul etmek için temel neden ise bunun şüphecilik haricindeki olası alternatiflerinin belirsizliğidir. Çünkü eğer görüngüler, inanç oluşturmada epistemik faile rehberlik edecek göstergeler ise bu, failin ilgili göstergelerden yoksun olduğunda herhangi bir şeye rasyonel olarak inanmasının olanaksızlaşacağı anlamına gelir. English Because epistemology deals with the philosophical analysis of rational beliefs, it assigns central importance to justification. Justification involves identifying the condition or set of conditions that enables one to have grounds for believing a proposition. The principle of phenomenal conservatism, put forward by Michael Huemer as a justification theory that accords with the moderate/fallibilist foundationalist perspective that many of our beliefs have non- inferential justifications, is a principle that defines such a condition. According to the PC formulation, if it seems to S that p, then, in the absence of defeaters, S thereby has at least some degree of justification for believing that p. Seemings/appearances are sui generis experiences that refer to the possibility of rational belief formation and are different from beliefs and dispositions to believe. In this article, I introduce PC based on the nature of seemings and evaluate some of the criticisms directed at PC. The criticisms I discuss include objections that PC even justifies beliefs stemming from irrational/dangerous seemings and cognitive penetration, and that the dominant role that PC theorists assign to seemings in the act of justification and the differences envisaged between beliefs and seemings are exaggerated. In my opinion, none of these criticisms contain arguments that would lead to the rejection of PC. The main reason to accept PC or a similar principle that establishes the role of seemings in epistemic justification is the vagueness of its possible alternatives other than skepticism. For, if seemings are indicators that guide the epistemic agent in forming beliefs, this means that it is impossible for the agent to believe anything rationally when she lacks the relevant indicators. İslâm’ın ilk dönemlerinden başlayarak âlimler neshin mahiyeti, delilleri ve Kur’an’da geçen emir ve nehiy ifadeleri yanında haber ifadelerinin neshin konusu olup olmayacağı meseleleri üzerinde yoğunlaşarak bir nesh teorisi meydana getirmişlerdir. Bu bağlamda şer’î hüküm içeren haber ifadelerinin emir ve nehiy manasında oldukları için metninin daha sonra gelen şer’î bir delille nesh edilmesi caiz görülmüştür. Haberin ifade ettiği şeye gelince; Allah’ın sıfatları ve kıyametin kopuşu gibi değişmesi mümkün olmayan şeylerden ise, yalana yol açacağı için, bunun nesh edilmesi caiz görülmemiştir. Bu (...) iki konuda âlimler ittifak etmişlerdir. Geçmişte olanları ve gelecekte olacak hâdiseleri bildiren haberin ifade ettiği şeyin neshin konusu olup olmayacağı konusunda ise ihtilafa düşmüşlerdir. Keza vaad ve vaid bildiren haberler ile ebedîlikle kayıtlanan haber ifadelerini neshin caiz olup olmayacağı da tartışma konusu olmuştur. Burada Kur’an’da geçen haber ifadelerinin hangisinin nesh edilmesinin mümkün, hangisinin mümkün olmadığı meselesinin ana hatlarıyla ortaya konulması amaçlanmıştır. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

The Moroccan philosopher Taha Abderrahmane is one of the leading surviving philosophers of the Arab-Islamic world. His fields of study are issues such as logic, philosophy of language, moral philosophy and political theology. He built a holistic and versatile Islamic methodology in his works and formed a world of thought on the axis of trusteeship (divine contract and trust paradigm) and circulation tedavuliyya (pragmatic-word-action theory). Taha Abderrahmane has analyzed, criticized and constructed the Islamic thought tradition, which he handled with a (...) holistic view, with a versatile reference network. In addition, one of his most important contributions is that he put forward a moral philosophy in the Qurʾānic and prophetic axis. Taha Abderrahmane proved to be a prolific thinker with his thirty-five work consisting of ten thousand pages. He proposes a deliberative model of political communication in harmony with his theo-political writings and physical and metaphysical integrity. While this article aim to provide information on the main components of Abderrahmane’s paradigm of divine contract and trusteeship (i’timaniyya), essentially a theory of morality, such as political theology, linguistics, and negotiation ethics, it also tries to identify the Western references of these elements. In this context how the theory of speech acts that seems quite important in the field of modern social sciences and created by theorists such as John Searl and Austin was transformed by Taha Abderrahmane into an Islamic theory of speech is also subject to a comparative assessment. In addition, the possibility of the issue of negotiation ethics, which gained more importance with new communication theories in the West, in the axis of Islamic thought was questioned in the article. The article reviews how views on negotiation ethics are positioned by Taha Abderrahmane within the Islamic paradigm. Therefore, the article is limited in scope to Taha Abderrahmane’s references about the theories in the West. Taha Abderrahmane attempts to construct an Islamic Pragmatic or Islamic Theory of Verbal Action, with reference to Pragmatics or Theory of Speech Acts, which is a sub-branch of linguistics, but in line with principles specific to the Islamic paradigm. Taha Abderrahmane combined the Islamic concept of pragmatic with the concept of negotiation. The terms “praxis” and “praxeology [fiqh al falsafa]”, which define the framework of the Trust Paradigm and the Islamic Pragmatic Model proposed by Taha Abderrahmane, emphasize “deed” or, in other words, “action” and he is linguistically referencing the founding masters of the pragmatics field such as J. L. Austin and J. R. Searle. However, there are two other fields that constitute the main reference to his concept of praxis (action) and praxeology (action science). These are economics and philosophy. Praxeology is a scientific field that deserves to be mentioned especially with the economist Ludwig von Mises (1881-1973). According to Mises, the laws of the field about which physics, biology, and praxeology [mainly economics] provide information, are independent of human will. These are primary ontological facts that strictly limit the human power to act (Mises, 1998, 67). Taha Abderrahmane references western thinkers such as Ludwig von Mises, Jürgen Habermas, Chantal Mouffe and Hannah Arendt, as well as Islamic sources. However, the way he makes use of them takes place within the framework of criticism and analysis. He also refers to other personalities such as Jonas, Freud, Ellul, Putnam, Ricoeur and Rawls. While Taha Abderrahmane explains the process of turning words into action, he also draws on the Action Theory of Hannah Arendt (1906-1975), who was one of the children of Heidegger, such as Karl Löwith, Hans Jonas and Herbert Marcuse, and who was accepted as a real philosopher even though he rejected the title of philosopher during his lifetime. On the other hand, Taha Abderrahmane makes strong references to the basic dimension of Islam, such as “O believers! If you avoid opposing Allah; It gives you an understanding to distinguish good from bad (Al-Anfal, 8/29)” verse. He makes strong references to the supposed dimension of Islam, and in this context, he tries to create a praxis based on nature, especially based on the hadith known as nawāfil hadith. (shrink)

20. yüzyılın ikinci yarısında Platon’un Devlet’te ortaya koyduğu vatandaşlık ve yönetim teorisi totaliter, ırkçı ve eşitlikçilik karşıtı olmakla suçlanmıştır. Özellikle ulus ve yurttaş kimliği yaratmak için yönetici elitler tarafından kurgulanması öngörülen asil yalan hikayesinin vatandaşları doğuştan gelen politik ve ekonomik bir hiyerarşiye inandırmak için bir propaganda aracı gibi kullanılması haklı olarak yoğun eleştirilere maruz kalmıştır. Platon’u yukarıdaki suçlamalar karşısında tamamen aklamayacak olsa bile, asil yalanın epistemik statüsü ve ikna etme gücü hakkında yapılacak dilsel ve mantıksal analizler bize Platon’un felsefi (...) amacına dair kapsamlı bir resim sunabilir. İslâm’ın ilk dönemlerinden itibaren Kur’ân’da Arapça dışında bir kelimenin bulunup bulunma-dığı hususunda farklı görüşler ileri sürülmüştür. Bu görüşler çerçevesinde mesele, Kur’ân’da yabancı dillerden bazı kelimelerin bulunup bulunmadığı merkezinde tartışıldığı gibi, bazı kelimelerin köken itibarıyla Arapça olmakla beraber şer’î terminolojinin ortaya çıkışı sonra-sında Arapların o zamana kadar bilmediği yeni anlamlar kazanmış olmasının Kur’ân’ın arabî olmasına engel teşkil edip etmeyeceği boyutuyla da tartışılmıştır. Şâfiî, Kur’ân’ın arabîliği görüşünün ilk ve en tavizsiz savunucularından biridir. Kur’ân, muhatapları Arap olduğu için Arapça nazil olmuştur. Her dil, (...) o dili konuşan halkın kültürünü ve düşünce yapısını da barındı-rır. Şâfiî nazarında Kur’ân’ın arabî olması Arap dilinin kurallarına, üslubuna uygun olmasının ötesinde Arap kültürünü ve düşünce yapısını da barındırması demektir. Muhataplar açısından bakınca da kendi dillerinde inen vahyin kendileri için olabildiğince açık/mübin olması gerekir. Dolayısyla Şâfiî’nin er-Risâle’de, nasslardan hüküm çıkarırken Arapçanın kural ve üsluplarını dikkate alma üzerine kurmuş olduğu beyân teorisi Kur’an’ın arabî olması ile yakından alakalı-dır. Scientists often diverge widely when choosing between research programs. This can seem to be rooted in disagreements about which of several theories, competing to address shared questions or phenomena, is currently the most epistemically or explanatorily valuable—i.e. most successful. But many such cases are actually more directly rooted in differing judgments of pursuit-worthiness, concerning which theory will be best down the line, or which addresses the most significant data or questions. Using case studies from 16th-century astronomy and 20th-century geology and (...) biology, I argue that divergent theory choice is thus often driven by considerations of scientific process, even where direct epistemic or explanatory evaluation of its final products appears more relevant. Broadly following Kuhn’s analysis of theoretical virtues, I suggest that widely shared criteria for pursuit-worthiness function as imprecise, mutually-conflicting values. However, even Kuhn and others sensitive to pragmatic dimensions of theory ‘acceptance’, including the virtue of fruitfulness, still commonly understate the role of pursuit-worthiness—especially by exaggerating the impact of more present-oriented virtues, or failing to stress how ‘competing’ theories excel at addressing different questions or data. This framework clarifies the nature of the choice and competition involved in theory choice, and the role of alternative theoretical virtues. (shrink)

The divine command meta-ethics (hereafter, DCM) promote non-naturalist realism about the ontological status of moral properties while depending on this ontological status on a such-and-such divine being’s moral roles derived from some relevant divine characteristics. As DCM typically contends, our moral discourse depends on God’s commands and prohibitions to the effect that an action A is morally right if and only if God commands A. Robert M. Adams (1979, 1987a) offers a modification that explicates the dependency relation between a loving (...) God’s commands and moral properties on metaphysical grounds to the effect that some action A is morally right if and only if it is not logically but metaphysically necessary for a loving God to command A. In this paper, I discuss whether Adams’ modification stands for a cogent account of DCM in a few respects. Firstly, Adams fails to provide robust reasons for grounding moral realism so that his commitment to the reality of moral properties merely expresses a theoretically unwarranted assumption hinging on a presumptive case in our moral discourse. Particularly, his assumption on the pervasiveness of strongly held moral beliefs is unwarranted and it inherits a vague notion of certainty. Secondly, Adams' response to the Euthyphro dilemma does not satisfactorily sort out the concerns accompanying this dilemma, mainly because his response relies on a vague notion of divine love that allegedly necessitates God commanding morally permissible acts while this notion cannot be trivially reducible into a moral aspect. In this article, I examine the conceptual and methodological points of convergence and divergence of two intellectual currents frequently referred to as the decolonial and ontological turns in social and anthropological theory. Salient points considered are the ways both theoretical projects unsettle modernity’s dominant ontological and epistemological foundations by seriously engaging the conceptual potential of thinking with alterity (ethical dimension) and from exteriority (geopolitical dimension). I compare their subversive methodological contributions, examining, in particular, Enrique Dussel’s analectical hermeneutic approach and Eduardo (...) Viveiros de Castro’s ethnographic method of controlled equivocation. Lastly, I discuss how both theories and approaches complement each other’s efforts to destabilize Western modernity’s philosophical and anthropological foundations. (shrink)

Some argue that time’s causal arrow is grounded in an underlying thermodynamic asymmetry. Often, this is tied to Humean skepticism that causes produce their effects, in any robust sense of ‘produce’. Conversely, those who advocate stronger notions of natural necessity often reject thermodynamic reductions of time’s causal arrow. Against these traditional pairings, I argue that ‘reduction-plus-production’ is coherent. Reductionists looking to invoke robust production can insist that there are metaphysical constraints on the signs of objects’ velocities in any state, given (...) other—including far later—states’ properties. The Past Hypothesis may thus be a metaphysical condition, not a physical law. (shrink)

Nietzsche values intellectual honesty, but is dubious about what he calls the will to truth. This is puzzling since intellectual honesty is a component of the will to truth. In this paper, I show that this puzzle tells us something important about how Nietzsche conceives of our pursuit of truth. For Nietzsche, those who pursue truth occupy unstable ground, since being honest about the ultimate reasons for that pursuit would mean that truth could no longer satisfy the important human needs (...) it satisfies at present. We can pursue truth, or be honest about what in us is served by such a pursuit, but not both. Nietzsche aims to show that understanding and owning up to this instability is the sort of affirmation of human life to which we ought to aspire, and is the price we pay for being free from otherworldly morality. The notion of reduction continues to play a key role in philosophy of mind and philosophy of cognitive science. Supporters of reductionism claim that psychological properties or explanations reduce to neural properties or explanations, while antireductionists claim that such reductions are not possible. In this book, I apply recent developments in philosophy of science, particularly the mechanistic explanation paradigm and the interventionist theory of causation, to reassess the traditional approaches to reduction in philosophy of mind. I then elaborate and defend (...) a pluralistic framework for philosophy of mind, and show how reductionist ideas can be incorporated into it. This leads to a novel synthesis of pluralism and reductionism that I call pluralistic physicalism. (shrink)

Robert M. Adams (1979, 1987a, 1987b) defends a modified variant of the divine command theory (hereafter MDCT) to the effect that he proposes a moral argument for God’s existence driven in the form of practical reasoning with respect to rational moral agents’ beliefs in the adequacy of MDCT. For Adams, one’s commitment to MDCT as the most adequate theory legitimately provides her a practical reason for why she ought to believe in God’s existence which MDCT implies. In this paper, I (...) criticize the viability of Adams’ moral argument considering its argumentative structure and strategy. Adams’ strategy behind his moral argument, i.e. mediating theistic beliefs with deontic ones, seeks out a non-decisive medium that might be used to ubiquitously generate equally plausible arguments for/against God’s existence based on distinct sorts of allegedly adequate theories of some subject matter. Thus, his argument does not seem to distinctively ground God’s existence in comparison with a myriad of practical arguments which might follow the same argumentative strategy on the same practical grounds. More significantly, there seems to be coherent no way for Adams to disambiguate his argument on theoretical grounds. (shrink)

We present PhrasIS, a benchmark dataset composed of natural occurring Phrase pairs with Inference and Similarity annotations for the evaluation of semantic representations. The described dataset fills the gap between word and sentence-level datasets, allowing to evaluate compositional models at a finer granularity than sentences. Contrary to other datasets, the phrase pairs are extracted from naturally occurring text in image captions and news headlines. All the text fragments have been annotated by experts following a rigorous process also described in the (...) manuscript achieving high inter annotator agreement. In this work we analyse the dataset, showing the relation between inference labels and similarity scores. With 10K phrase pairs split in development and test, the dataset is an excellent benchmark for testing meaning representation systems. (shrink)

Should businesses engage in moral talk when it becomes profitable? Due to their particular position of visibility, it is reasonable to acknowledge that businesses have specific moral duties. Some might argue that companies ought to help abandon morally repugnant norms by providing examples of alternative behaviors through advertisements. However, the moral talk of businesses might unexpectedly reinforce repugnant norms and increase social tensions in a polarized society. Then, the duty of the companies is not fulfilled when they engage in moral (...) talk. In polarized societies, the positional duty of businesses implies decreasing the risk of social conflict. It is not clear how to do that, yet I argue that if businesses use moral talk with mass marketing strategies, they would strive to shape impartial moral messages aiming to find points of moral convergence among polarized moral positions, which might mitigate social polarization. I call this duty the imperative of doux commerce. (shrink)

During the early years of the COVID-19 pandemic, preclinical and clinical research were sped up and scaled up in both the public and private sectors and in partnerships between them. This resulted in some extraordinary advances, but it also raised a range of issues regarding the ethics, rigour, and integrity of scientific research, academic publication, and public communication. Many of the failures of scientific rigour and integrity that occurred during the pandemic were exacerbated by the rush to generate, disseminate, and (...) implement research findings, which not only created opportunities for unscrupulous actors but also compromised the methodological, peer review, and advisory processes that would usually identify sub-standard research and prevent compromised clinical or policy-level decisions. While it would be tempting to attribute these failures of science and its translation solely to the “unprecedented” circumstances of the COVID-19 pandemic, the reality is that they preceded the pandemic and will continue to arise once it is over. Existing strategies for promoting scientific rigour and integrity need to be made more rigorous, better integrated into research training and institutional cultures, and made more sophisticated. They might also need to be modified or supplemented with other strategies that are fit for purpose not only in public health emergencies but in any research that is sped-up and scaled up to address urgent unmet medical needs. This book posits that a sustainable future is possible without abandoning Capitalism. In its present form as Consumer Capitalism, the organization of the global economy is clearly unsustainable. But Capitalism is a malleable concept that has assumed a variety of forms since the 17th Century, and it can be altered as needed. In Part I of this book, Wayne Henry sets out an economic model for a sustainable form of Capitalism, referred to in the literature as Natural Capitalism. In Part (...) II, he abandons exposition in favour of rigorous philosophical analysis and critiques the older but still dominant narrative that underlies Classical Liberalism. The narrative will be reconstructed with great care and analyzed to understand why it has been so powerful and enduring, and, of course, why it is no longer appropriate for our present circumstances. In Part III, he investigates Classical Liberalism and globalized capitalism, the economic system it licenses, from a normative perspective. Finally, in the conclusion, Henry draws the threads of the discussion together in a way that emphasizes the differences between the two narratives, Classical Liberalism on the one hand, and the contemporary version of Progressive Liberalism that nurtures and supports Natural Capitalism on the other. This book will be of interest to a broad range of scholars and curious laypersons interested in a clear and interdisciplinary presentation of the issues arising out of climate change, including corporate governance, social and environmental policy, declining social capital and the capacity of democratic institutions to deal effectively with sustainability. In this article, I focus on intersections between colonial violence, aesthetics, and ecological crises as reflections of a crisis of the political imagination. I engage Namita Goswami’s Subjects That Matter and argue that the ways in which her text pursues forms of questioning racialized and gendered colonial violences provides a context for approaching variations of colonial violence collectively. By engaging Goswami’s text, I propose a postcolonial aesthetics as a way of rethinking our planetary bonds, aesthetically. I further argue that postcolonial (...) aesthetics runs contrary to our contemporary political imagination, and that it makes the crisis of this imaginary apparent. (shrink)

The research analyzes the process of formation of the ethics committee as a new institution in the system of regulation of genetic research. The external factors of this process are the increasing digitalization of medical and research practices, as well as the special situation that is developing in the field of genomic research and the use of genetic technologies, where issues of philosophy, jurisprudence and administration have generated many fundamentally new, and sometimes unexpected contexts. The author shows the similarity and (...) difference of approaches to the inclusion of the ethics committee in the national regulatory systems of different countries and determines the prospects for further integration of the new institution into normative and administrative-regulatory and law enforcement practices. The research applies all the main methods of system analysis and structural and functional analysis, as well as the comparative legal method. At the stage of generalization of empirical material, the author turns to the means and methods of philosophical phenomenology and phenomenological sociology. The study revealed that the ethics committee may have different institutional and regulatory functions in a variety of management and legal systems. Being hybrid in nature, the ethics committee performs various functions, and in various state legal systems and traditions it can combine elements of legislative, executive and judicial power. At times, the ethics committee may go beyond the scope of both a purely administrative and exclusively legal regulator. All this indicates that the integration of this institution into the legal system and into a variety of social practices is far from being completed. (shrink)

Gideon Yaffe argues that children should be treated as less culpable by the criminal justice system because children have little political say over the law. I analyze several elements of Yaffe’s argument and express qualified agreement with his thesis. Though I reject the role he assigns to the notions of desert and legal reasons, I agree that people who lack political power are less accountable to the criminal justice system’s legal authorities.
