Sentience is the capacity to have feelings, such as feelings of pain, pleasure, hunger, thirst, warmth, joy, comfort and excitement. It is not simply the capacity to feel pain, but feelings of pain, distress or harm, broadly understood, have a special significance for animal welfare law. Drawing on over 300 scientific studies, we evaluate the evidence of sentience in two groups of invertebrate animals: the cephalopod molluscs or, for short, cephalopods (including octopods, squid and cuttlefish) and the decapod crustaceans or, (...) for short, decapods (including crabs, lobsters and crayfish). We also evaluate the potential welfare implications of current commercial practices involving these animals. (shrink)

Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. The discipline of knowledge translation (KT) emerged as a way of systematically understanding and addressing the challenges of applying health and medical research in practice. In light of ongoing and emerging critique of KT from the medical humanities and social sciences disciplines, KT researchers have become increasingly aware of the complexity of the translational process, particularly the significance of culture, tradition and values in how scientific evidence is understood and received, and thus increasingly receptive to pluralistic notions of knowledge. Hence, (...) there is now an emerging view of KT as a highly complex, dynamic, and integrated sociological phenomenon, which neither assumes nor creates knowledge hierarchies and neither prescribes nor privileges scientific evidence. Such a view, however, does not guarantee that scientific evidence will be applied in practice and thus poses a significant dilemma for KT regarding its status as a scientific and practice-oriented discipline, particularly within the current sociopolitical climate. Therefore, in response to the ongoing and emerging critique of KT, we argue that KT must provide scope for relevant scientific evidence to occupy an appropriate position of epistemic primacy in public discourse. Such a view is not intended to uphold the privileged status of science nor affirm the “scientific logos” per se. It is proffered as a counterbalance to powerful social, cultural, political and market forces that are able to challenge scientific evidence and promote disinformation to the detriment of democratic outcomes and the public good. Jusqu’à présent, les discussions au sein de la communauté universitaire et dans la littérature scientifique sur la conduite responsable en recherche (CRR), incluant l’intégrité scientifique et l’éthique de la recherche, ont principalement été menées par les chercheurs en sciences de la santé et en sciences fondamentales. Préoccupés, à juste titre, par des problèmes d’inconduite, leurs effets négatifs sur la rigueur scientifique et la confiance du public dans l’entreprise de la recherche, ces débats ont conduit à l’élaboration et à la mise (...) en œuvre de lignes directrices nationales et de politiques institutionnelles. Ces lignes directrices visent entre autres à promouvoir la CRR, notamment dans le but de prévenir ces inconduites. Cependant, pour garantir la pertinence et une application appropriée de ces normes à tous les domaines universitaires, il est nécessaire que les sciences humaines et sociales (SHS) contribuent plus directement à ces discussions. Un tel engagement devrait permettre d’exprimer les particularités disciplinaires et méthodologiques des SHS, dont certaines peuvent être très différentes des sciences appliquées et fondamentales. Cela permettrait également de s’assurer que la littérature sur la CRR ainsi que les politiques et les directives qui en découlent soient à la fois fondées sur des principes universellement généralisables, mais aussi appliquées avec nuance afin de refléter la diversité des pratiques disciplinaires. Dans ce chapitre, nous explorons trois grands domaines dans lesquels les SHS pourraient contribuer à façonner les discussions dans la littérature sur la CRR, tout en informant les chercheurs en SHS des meilleures pratiques en matière de CRR : l’autorat/paternité, la collaboration et l’autorégulation. Institutions receiving federal funding for research from the U.S.Public Health Service need to have policies and procedures to both prevent research misconduct and to adjudicate it when it occurs. The person who is designated to handle research misconduct is typically referred to as the research integrity officer (RIO). In this interview study we report on 79 RIOs who describe how they would handle allegations of research misconduct. Their responses were compared to two expert RIOs. The responses to the allegations in (...) the scenarios demonstrated that RIOs are not uniformly well prepared to handle activities associated with reported allegations of research misconduct. We recommend greater preparation through directed training, use of check lists of possible behaviors necessary to consider when situations arise, being involved in a network of RIOs so one can discuss options, and the possible need to certify RIOs. The concept of transformative experience (TE) has been widely explored by several disciplines from philosophy to neurobiology, and in different domains, from the spiritual to the educational one. This attitude has engendered heterogeneous models to explain this phenomenon. However, a consistent and clear understanding of this construct remains elusive. The aim of this work is to provide an initial comprehensive interdisciplinary, cross-domain, up-to-date, and integrated overview on the concept of TEs. Firstly, all the models and theories on TEs were reviewed (...) to extract and analyze TEs’ main components emerging from different disciplines. Then, this preliminary analysis was integrated with an in-depth examination of redundancies and particularities across domains and disciplines, to provide an integrated theoretical framework of TEs and a preliminary interdisciplinary operational definition of TEs. This examination, in turn, can help organize current research and theories, thus providing suggestions for operationalizing TEs as well as encouraging new interdisciplinary research endeavors. Cet article propose la première publication complète d’un monument consacré par les Thespiens aux Muses dans leur sanctuaire au pied de l’Hélicon, dont les éléments constitutifs sont connus depuis le xixe s., et notamment depuis les fouilles de P. Jamot au Val des Muses. Les statues en bronze de petite taille des neuf Muses se dressaient sur une base en arc de cercle d’une ampleur de ca 10 m, placée dans un écrin architectural largement ouvert sur l’extérieur. Un nouveau lustre (...) est donné à ce groupe statuaire hellénistique exceptionnel à l’époque d’Auguste par la gravure, sous chacune des figures, d’une épigramme descriptive et érudite signée par le poète corinthien Honestos. Est ainsi conservé l’un des rares exemples archéologiques de recueil de poèmes décrivant des œuvres d’art figuré. L’analyse des épigrammes et l’observation détaillée des mortaises de fixation visibles à la face supérieure des blocs de la base permettent d’émettre des hypothèses sur les types utilisés pour la représentation des Muses, mais aussi d’assurer, au‑delà de tout doute, que les statues prenaient place au milieu d’ornements végétaux en bronze qui évoquaient le paysage du Val des Muses. La représentation de la nature comme élément non plus secondaire, mais essentiel d’un groupe sculpté correspond aux recherches nouvelles de la basse époque hellénistique. Faute de fouilles exhaustives du sanctuaire des Muses, l’emplacement du monument ne peut être déterminé avec certitude. Des lettres de remontage nous apprennent en revanche qu’il a été déplacé, peut‑être à l’époque où furent gravés les poèmes d’Honestos. (shrink)

Cognitive test batteries are widely used in diverse research fields, such as cognitive training, cognitive disorder assessment, or brain mechanism understanding. Although they need flexibility according to their usage objectives, most test batteries are not available as open-source software and are not be tuned by researchers in detail. The present study introduces an open-source cognitive test battery to assess attention and memory, using a javascript library, p5.js. Because of the ubiquitous nature of dynamic attention in our daily lives, it is (...) crucial to have tools for its assessment or training. For that purpose, our test battery includes seven cognitive tasks, common in cognitive science literature. By using the test battery, we conducted an online experiment to collect the benchmark data. Results conducted on 2 separate days showed the high cross-day reliability. Specifically, the task performance did not largely change with the different days. Besides, our test battery captures diverse individual differences and can evaluate them based on the cognitive factors extracted from latent factor analysis. Since we share our source code as open-source software, users can expand and manipulate experimental conditions flexibly. Our test battery is also flexible in terms of the experimental environment, i.e., it is possible to experiment either online or in a laboratory environment. (shrink)

We improve on and generalize a 1960 result of Maltsev. For a field F, we denote by $H(F)$ the Heisenberg group with entries in F. Maltsev showed that there is a copy of F defined in $H(F)$, using existential formulas with an arbitrary non-commuting pair of elements as parameters. We show that F is interpreted in $H(F)$ using computable $\Sigma _1$ formulas with no parameters. We give two proofs. The first is an existence proof, relying on a result of Harrison-Trainor, (...) Melnikov, R. Miller, and Montalbán. This proof allows the possibility that the elements of F are represented by tuples in $H(F)$ of no fixed arity. The second proof is direct, giving explicit finitary existential formulas that define the interpretation, with elements of F represented by triples in $H(F)$. Looking at what was used to arrive at this parameter-free interpretation of F in $H(F)$, we give general conditions sufficient to eliminate parameters from interpretations. (shrink)

Recent evidence suggests that probabilistic grammars may be modulated by communication mode and genre. Accordingly, the question arises how complex language users’ lectal competence is, where complexity is proportional to the extent to which choice-making processes depend on the situation of language use. Do probabilistic constraints vary when we talk to a friend compared to when we give a speech? Are differences between spoken and written language larger than those within each mode? In the present study, we aim to approach (...) these questions systematically. Guided by theorizing in cognitive (socio)linguistics and using logistic regression based on corpus materials, we analyzed the dative alternation with give (The government gives farmers money vs. The government gives money to farmers) in four broad registers of English: spoken informal, spoken formal, written informal, and written formal. Corpus analysis was supplemented with a scalar rating experiment. Results suggest that language users’ probabilistic grammars vary as a function of register. (shrink)

Civility is formed by social norms that guide our behavior and allow us to interact appropriately with others. These norms affect everyone and are learned through the socialization process. However, in the same process, people also learn gender norms that dictate how men and women should behave, leading to gender stereotypes and differentiated behavioral characteristics. The purpose of this research is to examine the relationship between gender and civility, and how we react to those who behave uncivilly given their gender. (...) The results of Study 1 showed that even in a fictional and gender-neutral society, uncivil behaviors were associated with stereotypically masculine characteristics, and those who behaved uncivilly were dehumanized. In Study 2, gender differences were observed in incivility. Women were harsher when facing uncivil transgressors than men, especially if the transgressor was another woman. Our findings support the notion that gender norms are applied to civility, leading those supposedly equal social norms to unequal perceptions and evaluations. (shrink)

The article argues that there are different ways of justifying suspension of judgement. We suspend judgement not only privatively, that is, because we lack evidence, but also positively, that is, because there is evidence that provides reasons for suspending judgement: suspension is more than the rational fallback position in cases of insufficient evidence. The article applies the distinction to recent discussions about the role of suspension for inquiry, Turri's puzzle about withholding, and formal representations of suspension.

I will argue here a) that we have a right to have opportunities to meaningful relationships, b) that such a right is distinct from a right focusing only on protecting access to more basic social interactions, and c) that to the extent that we have rights to both kinds of social interactions, the one focused on more meaningful relationships should have priority because it secures an interest of greater importance for us.

The aim of this paper is to examine a special subgroup of emotion: self-referential emo- tions such as shame, pride and guilt. Self-referential emotions are usually conceptualized as (i) essentially involving the subject herself and as (ii) having complex conditions such as the capacity to represent others’ thoughts. I will show that rather than depending on a fully fledged ‘theory of mind’ and an explicit language-based self-representation, (i) pre-forms of self-referential emotions appear at early developmental stages already exhib- iting their (...) characteristic structure of the intentional object of the emotion being identical with or intricately related to the subject experiencing the emotional state and that (ii) they precede and substantially contribute to the development of more complex representations and to the development of a self-concept, to social interaction and to ways of understand- ing of other minds. Although Ian Hacking’s meta-concept is frequently applied to historical cases, few theorists have questioned the very idea of a style of reasoning. Hacking himself considers Donald Davidson’s conceptual scheme argument to be the most formidable challenge to the style idea, but Hacking has set up a straw man in Davidson. Beyond Hacking’s own conclusion, that Davidson's narrow concern with meaning incommensurability does not apply to styles, which are not incommensurable in that way, there is the more obvious point that styles, (...) which do not organize or fit the world, are not the kind of schemes with which Davidson is concerned. In fact, Hacking agrees with Davidson, in that both propose we can argue over a topic only when we employ the same style of reasoning (a suggestion which I contend is not necessarily the case). Hacking has a more serious problem, in that he cannot remain a Kantian without justifying his style idea with a transcendental argument. But this kind of argument is only available to those who support a univocal notion of reason, which the very idea of a style seems to outlaw. He has overlooked the challenges which arise out of Arthur Fine’s NOA. Hacking’s attention to historical detail and unwillingness to employ transcendental arguments in support of his view renders him immune to Fine’s arguments against inference to the best explanation. But the list of the necessary and sufficient criteria which identify styles of reasoning cannot prevent the proliferation of (bogus) styles. Moreover, Fine’s call for openness in inquiry shifts the burden of proof against Hacking and calls for him to prove: 1) that we cannot understand the history of science without the style meta-concept and 2) that whenever we encounter a mystery, our first order of business should be to stand back and uncover the style of reasoning which makes the predicament possible, instead of getting directly to the business of solving the problem. According to Fine, some puzzles just happen. And there is no guarantee that uncovering the style, which identifies the topic as a topic, will have anything to do with solving the mystery. Not only is there no such guarantee, but Hacking’s position, if it is to sidestep Davidson’s critique, actually requires that styles play only the minimal role of identifying topics. Styles must be fairly trivial. Fine thinks it is deeply unnatural to view science as entertainment. Philosophers are not to shine their lights on the action and watch it unfold. Rather, we are all to join the performance, thereby eliminating the artificial boundary between actor and audience which we mistakenly call upon to reinforce the notion that the raw material of science constrains our reflections about it. The book discusses the central notion of logic: the concept of logical consequence. It shows that the classical definition of consequence as truth preservation in all models must be restricted to all admissible models. The challenge for the philosophy of logic is therefore to supplement the definition with a criterion for admissible models. -/- The problem of logical constants, so prominent in the current debate, constitutes but a special case of this much more general demarcation problem. The book explores the (...) various dimensions of the problem of admissible models and argues that standard responses are unwarranted. What is 'intellectual property'? This book examines the way in which this important area of law is constructed by the legal system. It argues that intellectual property is a body of rules, created by the legal system, that regulate the documented forms of abstract objects, which are also defined into existence by the legal system. Intellectual property law thus constructs its own objects of regulation and it does so through the application of a collection of core concepts. By analyzing the (...) metaphysical structure of intellectual property law and the concepts the legal system uses to construct 'intellectual property', the book sheds new light on the nature of this fascinating area of law. It explains anomalies between social and intellectual property uses of concepts such as authorship - here dubbed 'creatorship' - and originality and it helps to explain the role of intellectual property from a structural perspective. Post-war Japan has seen profound and rapid social change and transformation. One of the most visible areas of change in Japan has been medicine, and particularly the ethical practices and policies that guide medical decision-making. The formal discipline of bioethics, Seimei Rinri in Japanese, has grown by leaps and bounds since the late 1970s, when it began to appear in the curriculum and professional activities of Japanese medical schools and philosophy departments. The introduction of bioethics to Japan was timely, as (...) innovation in medicine and technology was evolving in ways that revealed that the intersection of medicine, traditional Japanese values, and new cultural trends was an area of great moral complexity. In its infancy, bioethics in Japan was more or less an import from the United States, where the discipline took its roots. Quickly, however, it became clear that Japan's history and tradition would call for a different approach, and the engagement of slightly different ethical issues. Organ transplantation, for example, sparked much greater controversy in Japan than it ever did in the United States. Today, Japan has one of the most dynamic bioethics programs in the world, and it is one that reflects both traditional Japanese culture and the need for inter-cultural engagement in an increasingly global world. Through a series of original chapters written by bioethicists and covering a range of ethical issues, this anthology shows that, in contrast to previous assumptions, Japanese bioethics has, in fact, taken on an identity that is undoubtedly separate from its American origins. Rich philosophical questions raised by medicine, human subjects research, and psychiatric care are being posed by scholars in a way that reflect Japanese tradition and is no longer simply reflective of, or shaped by, American traditions and philosophical problems. The book highlights and showcases these trends through a series of chapters written by some of the leading scholars in contemporary Japanese bioethics, many of whom were pioneers of the field when it began and are now nearing retirement. The phrase ‘person‐centred care’ (PCC) reminds us that the fundamental philosophical goal of caring for people is to uphold or promote their personhood. However, such an idea has translated into promoting individualist notions of autonomy, empowerment and personal responsibility in the context of consumerism and neoliberalism, which is problematic both conceptually and practically. From a conceptual standpoint, it ignores the fact that humans are social, historical and biographical beings, and instead assumes an essentialist or idealized concept of personhood in which (...) a person is viewed as an individual static object. From a practical standpoint, the application of such a concept of personhood can lead to neglect of a person's fundamental care needs and exacerbate the problems of social inequity, in particular for older people and people with dementia. Therefore, we argue that our understanding of PCC must instead be based on a dynamic concept of personhood that integrates the relevant social, relational, temporal and biographical dimensions. We propose that the correct concept of personhood in PCC is one in which persons are understood as socially embedded, relational and temporally extended subjects rather than merely individual, autonomous, asocial and atemporal objects. We then present a reconceptualization of the fundamental philosophical goal of PCC as promoting selfhood rather than personhood. Such a reconceptualization avoids the problems that beset the concept of personhood and its application in PCC, while also providing a philosophical foundation for the growing body of empirical literature that emphasizes the psychosocial, relational, subjective and biographical dimensions of PCC. The question of whether art is a source of knowledge is a question of epistemic as well as of aesthetic interest which has significant pedagogical implications as well. This issue, both in its epistemic and aesthetic dimensions, is addressed here under the general perspective of the contemporary cognitivist - anti-cognitivist debate. Consequently, it is asked: a) can art be a means of knowledge and if it does, is knowledge obtained through art of the same kind with scientific knowledge? and b) (...) if we accept that art actually offers some kind of knowledge, is this knowledge relevant to its aesthetic value, does it constitute an essential part of its functioning as art? The paper discusses the plausibility and consistency of the answers given to these questions either from the cognitivist or the anti-cognitivist point of view and argues that the importance and role attributed to art within the educational praxis, as well as its educational value per se, significantly depends on the kind of approach we adopt in regard to these questions. In this paper, we resume the general framework for pedagogical reflection from Kant, in order to show the scope and limits of the philosophies of education that currently have dealt with the moral character education, and so, to be able to suggest some general guidelines that allow us to take the «moral work» of education, as the cultivation and formation of consistent thinking.

More and more these days it is asked whether aesthetics is still possible. A question that, given the context and phrasing, seems to direct us towards its answer. Conferences and meetings, books and journal specials examine the issue of aesthetics, talk about rediscovery or return of aesthetics. Well known philosophers and aestheticians underscore the need to reconsider the foundations of aesthetics and set new directions for aesthetics today (Berleant, 2004) or attempt to expand aesthetics beyond aesthetics–like Welsch, for example who (...) tries to extend aesthetics beyond art to society and the life-world (Welsch, 1997). Others underline the need to revisit the aesthetic experience (Shusterman, 1999; Iseminger, 2002, Fenner, 1996) and examine the relevance or irrelevance of the aesthetic with art (Carroll, 2001). It seems that it is strongly recommended to turn to aesthetics on the condition however to carefully re-approach the meaning and import of the term in the present situation. The aesthetic that Passmore condemned as “dreary”(Passmore, 1954), the one Sparshott considered a formless conception, vague and loose in application (Sparshott, 1982), the same that Danto emphatically argues that has nothing to do with the definition of art or arts in general (Danto, 1981) returns to claim its rightful place in the fields of philosophy and critical theory (Levine, 1994, Michaud, 1999), as well as artistic creation. And one cannot but wonder: what does this return mean? What was the degree of aesthetics decline that we need to discuss about recovery or for new implementations of aesthetics? (shrink)

Art education literature has not given great deal of attention to that which constitutes the very content of art education, i.e. art. This reluctance to deal with art seems justified, given that there exists no overall accepted definition or interpretation of what art actually is. In this paper, we argue that, despite the difficulty, it is absolutely necessary to try to understand and reflect on the multidimensional and polyvalent phenomenon of art. We claim that without a deep understanding of the (...) nature, the role and scope of art, the field of art education can not be adequately delineated. Without this understanding, questions about the kind of objects and values which should be studied within art education are held over, its content risks being hetero-defined and its special contribution underestimated. Beginning with an understanding of art as a complex phenomenon, deeply implicated in historical and cultural transformations and changes, this paper argues for the necessity of a critical rethinking of art. We try to show that the question “what is art?” is a key question in order to draw attention to the multiplicity and the open nature of the artistic phenomenon, upon which our educational choices will be found. Our object is not to impose one and only answer as a unique and unwavering option, but to describe an educational condition which recognizes the multiple practices and the many points of view as parts of the organized activity and knowledge about art, while putting them under critical examination .
