The individual right of access to one’s own data is a crucial privacy protection long recognized in U.S. federal privacy laws. Mobile health devices and research software used in citizen science often fall outside the HIPAA Privacy Rule, leaving participants without HIPAA’s right of access to one’s own data. Absent state laws requiring access, the law of contract, as reflected in end-user agreements and terms of service, governs individuals’ ability to find out how much data is being stored and how (...) it might be shared with third parties. Efforts to address this problem by establishing norms of individual access to data from mobile health research unfortunately can run afoul of the FDA’s investigational device exemption requirements. Regulatory policy for genomic testing may be subject to biases that favor reliance on existing regulatory frameworks even when those frameworks carry unintended legal consequences or may be poorly tailored to the challenges genomic testing presents. This article explores three examples drawn from genetic privacy regulation, oversight of clinical uses of genomic information, and regulation of genomic software. Overreliance on expedient regulatory approaches has a potential to undercut complete and durable solutions.

This paper examines nurses’ international migration within the broader context of female migration, particularly against more studied groups of women who have migrated for employment in care‐giving roles. We analyze the similarities and differences between skilled professional female migrants (nurses) and domestic workers (nannies and in‐home caretakers) and how societal expectations, meanings, and values of care and ‘women's work’, together with myriad social, cultural, economic and political processes, construct the female migrant care‐giver experience. We argue that, as the recruitment of (...) foreign workers gains visibility, strategies are introduced to better prepare female migrant care‐givers for the marketplace. Sophistics is the paradigm of a discourse that does things with words. It is not pure rhetoric, as Plato wants us to believe, but it provides an alternative to the philosophical mainstream. A sophistic history of philosophy questions the orthodox philosophical history of philosophy: that of ontology and truth in itself. In this book, we discover unusual Presocratics, wreaking havoc with the fetish of true and false. Their logoi perform politics and perform reality. Their sophistic practice can shed crucial light (...) on contemporary events, such as the Truth and Reconciliation Commission in South Africa, where, to quote Desmond Tutu, "words, language, and rhetoric do things," creating things like the new "rainbow people." Transitional justice requires a consistent and sustainable relativism: not Truth, but truth for, and enough of the truth for there to be a community. Philosophy itself is about words before it is about concepts. Language manifests itself in reality only as multiplicity; different languages perform different types of worlds; and difficulties of translation are but symptoms of these differences. This desacralized untranslatability undermines and deconstructs the Heideggerian statement that there is a historical language of philosophy that is Greek by essence and today is German. Sophistical Practice constitutes a major contribution to the debate among philosophical pluralism, unitarism, and pragmatism. It will change how we discuss such words as city, truth, and politics. First, I love Greek language, a language which allow me to perceive what a language is, and what translation could mean. Then, I think it is because of Heidegger. At the time, we used to study classical antiquity and the pre-socratics through Heidegger and Nietzsche’s work. My own philosophical question was : « Is it possible to be Presocratic in some other way than the Heideggerian one? » The answer determinated my interest and passion for the sophists. I found it (...) extraordinary when I realized that Gorgias and his treatise « On Nature or the Non-Existent » presented a new way of thinking about Parmenides. If you are a Heideggerian, Parmenides is the origin of philosophy, the origin of thought. But very quickly, only fifty years after Parmenides, Gorgias came and said: « Look, what Parmenides says about Being, he could say about Non-being, and I myself can say it about Non-being. So, is Being an origin, an “Es gibt”, "There Is", just needing to be unconcealed? Or is it simply a product of Parmenides’ poem : Being is an effect of saying, and I can show it ». The Emancipation Proclamation is one of the most important documents in American history. As we commemorate its 150th anniversary, what do we really know about those who experienced slavery? In their pioneering book, Envisioning Emancipation, renowned photographic historian Deborah Willis and historian of slavery Barbara Krauthamer have amassed 150 photographs—some never before published—from the antebellum days of the 1850s through the New Deal era of the 1930s. The authors vividly display the seismic impact of emancipation on African Americans born (...) before and after the Proclamation, providing a perspective on freedom and slavery and a way to understand the photos as documents of engagement, action, struggle, and aspiration. In this article, Barbara Applebaum examines “the inability to disagree claim” as it arises in objections made by those who want to ban “critical race theory” from being taught in schools and universities. Employing insights from the recent scholarship around willful hermeneutical ignorance, she discerns the important role that marginalized conceptual resources play in conditions of just and constructive dialogue. When such resources are misinterpreted and denied uptake, the resulting harm impedes the epistemic agency of marginally situated knowers. Applebaum (...) claims that many high-profile anti–“critical race theory” arguments put forth by politicians, scholars, and others are a form of willful hermeneutical ignorance, and she concludes by showing how more just communications, in which disagreement is distinguishable from dismissal, can be achieved. Prominent recent scholarship in global political justice has focused on creating conceptual space for international NGOs ? and sometimes also corporations and states ? as fully-fledged participants in global governance. While acknowledging the achievements of international non-state actors, I argue that core global governance tasks ? of global distribution, regulation or administration ? should not be assigned to them. Drawing from neo-republican theory, I contend that such actors fall short of the formal criteria that are necessary for constituting a global (...) public actor, because they do not have a global function and orientation. The distinction between public and private actors matters, since it conditions our expectations for them: both categories of actors are asked to avoid dominating individuals, but public actors must, in addition, protect individuals from third-party domination. The problem of closeness was posed by Philippa Foot in the article “The Problem of Abortion and the Doctrine of Double Effect”. Foot criticizes the classic version of the principle of double effect which distinguishes direct from indirect intention. On this basis, she considers it justified to cause bad effects which were foreseen but not intended. She believes that if we consider causing a bad effect to be justified then the way we do it is irrelevant, while the reference to (...) the direct/indirect distinction may lead to absurd solutions in some cases that allow us to distinguish two events in one action. These constitute, respectively, the object of direct and indirect intention and they are much too close for an application of the principle of double effect, such as when a doctor performs a craniotomy. The root of the problem of closeness is the question about the possible criterion that would allow us to determine which of the effects of an action are intended and which are merely foreseen. The starting point of the analysis of the problem of closeness in this article is the manner in which Foot outlines it in her article. In the second and more extensive part of the article, a number of contemporary attempts to solve the problem of closeness are presented, while the third section is an attempt to answer the question of why the discussion of the problem of closeness seems to remain deadlocked. The theme for next year's encounter will be "The Economic Factors in Social and Environmental Violence." This theme will build on the dialogue generated by the topics of the previous two years, namely, environmental and social violence. Papers will be prepared by Sulak Sivaraksa, John B. Further, who ultimately [End Page 241] decides if the other is or is not enemy/neighbor? Unno pointed out that, following Matthew 5, if God does not discriminate good from evil, then who can determine who is just and unjust? This comment pointed to the great problem for minorities in North American society.Unno also made some comments on Lochhead's use of liberation theology: If all economic systems are prone to misuse, then does a critique of capitalism do us much good?Lochhead's reply to Unno began with the issue of dualism and non-dualism. Here, Lochhead talked about a "soft" dualism, in that our world is constituted by relationships such that God and neighbor are the names that appear in this discourse. Like Martin Buber's path in I and Thou, dualistic construction comes out of relationships. Lochhead clarified that this dualism is not the same as a hard dualism, which is what Unno referred to as subject/object dualism. This led to the relevant question: What kind of violence is involved in the construction of the other? If God is a name for something beyond me, then how can the construction of the self in relationship to God be a form of violence? And would not this nonviolent, soft dualistic construction hold for any other person or living being? Lochhead then suggested that it is when relationships somehow degenerate into I-it, in Buber's terms, that the construction can become violent.Much rich insight was brought to light when the dialogue opened for general discussion. José Cabezón asked if violence demands the construction of the other? He pointed out that for the human realm differentiation is necessary for human life. Stephanie Kaza contributed to the discussion by suggesting that biological necessity is very hard for people to understand. There can be different bases of knowing, and religious knowing is from a privileged point of view for understanding our relationship with the natural environment. In preparing to write this paper, I found myself repeatedly stopped by conflicting conceptions of the structure of address into which I was inserting myself. It was not clear to me what I, as a white deconstructor, was doing talking about Zora Neale Hurston, a black novelist and anthropologist, or to whom I was talking. Was I trying to convince white establishment scholars who long for a return to Renaissance ideals that the study of the Harlem Renaissance is not a (...) trivialization of their humanistic pursuits? Was I trying to contribute to the attempt to adapt the textual strategies of literary theory to the analysis of Afro-American literature? Was I trying to rethink my own previous work and the re-referentialize the notion of difference so as to move the conceptual operations of deconstruction out of the realm of abstract linguistic universality? Was I talking to white critics, black critics, or myself?Well, all of the above. What finally struck me was the fact that what I was analyzing in Hurston’s writings was precisely, again and again, her strategies and structures of problematic address. It was as though I were asking her for answers to questions I did not even know I was unable to formulate. I had a lot to learn, then, from Hurston’s way of dealing with multiple agendas and heterogeneous implied readers. I will focus here on three texts that play interesting variations on questions of identity and address: two short essays, “How It Feels to Be Colored Me” and “What White Publishers Won’t Print,” and a book-length collection of folktales, songs, and hoodoo practices entitles Mules and Men. Barbara Johnson is professor of French and comparative literature at Harvard University. The ancient history of flamenco is pure hypothesis, partly owing to the “ Dark Ages “ which shrouded the folk expression of a large portion of Andalusia from soon after the victory of the Catholic Kings at Granada in 1492 until the emancipation laws of Charles III in 1783. Although flamenco as such is a product of the nineteenth century, the hypothesis may be taken right back to pre-Iberian days when there was a flourishing civilization in the south of Spain, (...) with its capital, Tartessos, more or less where Seville—or Cadiz—is now, perhaps the first Empire in the West. The Iberians inhabited the north and the east but the towns along the Andalusian coast were founded by Phoenicians from Tyre (Cadiz) and Phocaeans from Asia Minor (Málaga). The text describes an experimental form of combining sociological research with collective artistic activity during the 17th Lublin Night of Culture. The study involved collecting TST (twenty statement tests) from festival participants. The "bridge" element between research and artistic activity was the choice of a framework identity or a counterpoint to the test – in the form of an aphorism. The artistic activity took the form of a flash mob using symbols identifying participants with selected aphorisms, and then proposing new (...) identifications. The data science era is characterized by data-driven automated decision systems (ADS) enabling, through data analytics and machine learning, automated decisions in many contexts, deeply impacting our lives. As such, their downsides and potential risks are becoming more and more evident: technical solutions, alone, are not sufficient and an interdisciplinary approach is needed. Consequently, ADS should evolve into data-informed ADS, which take humans in the loop in all the data processing steps. Data-informed ADS should deal with data responsibly, guaranteeing nondiscrimination (...) with respect to protected groups of individuals. Nondiscrimination can be characterized in terms of different types of properties, like fairness and diversity. While fairness, i.e., absence of bias against minorities, has been widely investigated in machine learning, only more recently this issue has been tackled by considering all the steps of data processing pipelines at the basis of ADS, from data acquisition to analysis. Additionally, fairness is just one point of view of nondiscrimination to be considered for guaranteeing equity: other issues, like diversity, are raising interest from the scientific community due to their relevance in society. This paper aims at critically surveying how nondiscrimination has been investigated in the context of complex data science pipelines at the basis of data-informed ADS, by focusing on the specific data processing tasks for which nondiscrimination solutions have been proposed. Doktryna moralna Kościoła katolickiego odnosząca się do kwestii bioetycznych stanowi jedno ze stanowisk obecnych w polskiej debacie bioetycznej, co wydaje się zrozumiałe zważywszy na deklarowaną przynależność większości Polaków do tegoż Kościoła. Katoliccy moraliści stoją na stanowisku, że reprezentowana przez nich doktryna nie ma czysto religijnego charakteru. Odwołują się do kategorii prawa naturalnego, wyprowadzając z niego obowiązek szacunku dla życia każdej istoty ludzkiej, od momentu jej powstania aż do naturalnej śmierci, stąd zdecydowanie negatywnie oceniana jest aborcja, eutanazja, a także proceder niszczenia (...) ludzkich zarodków. Obok punktów spornych istnieją też takie kwestie bioetyczne, w których stanowisko Kościoła katolickiego nie budzi w społecznej debacie kontrowersji, np. transplantologia. (shrink)

Pendant la Renaissance nous observons plusieurs changements à l’égard de la femme lettrée. Bien que le sexe féminin est exclu de tout enseignement formel, les érudites revendiquent le droit à une formation intellectuelle et s’avèrent d’excellentes autodidactes. Au-delà des frontières, elles maintiennent une correspondance de haut niveau via des réseaux qui se développent entre elles. Anna Maria van Schurman (1607-1678) est une de ces humanistes qui maintient une correspondance active avec ses contemporains lettrés, et qui s’oppose au fait qu’elle est (...) regardée comme exception en tant qu’érudite. Selon van Schurman chaque femme qui a le temps et les moyens doit se vouer à l’étude. This paper departs from the assumption that the critique of neoliberalism should not restrict itself to a criticism of an economic project. Another possible criticism of neoliberalism consists of a critique of how this specific form of life forms subjects. In this paper, we argue that a critique of a form of life is only justified in a reasonable way if it starts from the experiences of suffering produced by this form of life. As we will show, we must criticise (...) neoliberalism not because it is inadequate for solving problems, since for a specific portion of the world population it has been extremely effective, but because it causes suffering. Suffering, unlike mere unsolved problems, represents sufficient grounds for highlighting the existence of a normative problem in a form of life. According to Max Horkheimer, the first step of a critical project committed to the transformation of a form of life are the crises of the present, which are not fully understood through the theoretical tools of “problem solving” or “learning processes”, as Rahel Jaeggi resorts to in her critical theory of society. A long-misinterpreted Roman provincial coin shows a mythological scene in order to make a remarkable claim: that Iphigeneia, Orestes, and Pylades fled from the land of the Taurians to Philadelphia in Lydia , and there set up their stolen image, identified by the Philadelphians as their patron Artemis Anaitis. This Persianized goddess was generally depicted as an Anatolian image almost identical to the Artemis of Ephesos; it is the bond between the two goddesses that may be the immediate basis of (...) this coin's alliance with Ephesos, but the long-term intent may have been to form a voting bloc within the provincial association of cities. Philadelphia, though a relatively recent foundation, often allied itself with the oldest and greatest of Asia's cities and petitioned Roman emperors in order to raise its rank to rival that of its eminent neighbor Sardis. With this coin Philadelphia sought not only to gain allies, but, by grounding its history in the depth of mythological time, to advance itself among its rivals in Roman Asia. (shrink)

The fact that the term ‘feminism’ was only coined at the end of the 19th century and that there was no generally recognized founding figure in the battle for women’s rights makes it hard to delineate any widely accepted feminist tradition. Extensive interest in the ‘woman question’ across the century, however, led to widespread debate about sexual difference, gender hierarchy and the rights and duties of women. What would now be considered feminist ideas covered a wide range of issues including (...) the meaning of sexual difference, the intellectual and practical capacities of women, the oppressive nature of marital and family life as well as the entitlement of women to education and to legal and political rights. Feminist ideas were articulated in many different forms: in literature, periodical essays, and increasingly in the second half of the century in polemical pamphlets and journals. These ideas underwent considerable change across the century as the radicalism of the late 18th and early 19th centuries gave way to a more moderate approach in the mid 19th century - and then to a reassertion of sexual radicalism as part of feminism in the later 19th century. The figure of Mary Wollstonecraft — first as a source of inspiration, then as a pariah figure and finally as one anticipating the ‘new woman’ of the 19th century is seen here as encapsulating the pattern of feminist ideas across the century. When The Emperor of All Maladies was published in late 2010, I knew it would be near the top of my stack of books to read. Since I am a PhD student in the History of Science and Medicine, reading a notable book on the history of cancer and its treatments is a must. Sadly, at the time of its publication, my mother had just died unexpectedly at age 82 of a disease for which she had never received a prior (...) diagnosis: cancer, or acute myelogenous leukemia, to be exact. From diagnosis to death took a mere six days. So I hesitated to take this in-depth look at cancer, a disease that left my family and me stunned and grieving from such a sudden loss. Dans cet article, je retrace et discute l’itinéraire philosophique d’Axel Honneth, depuis La Lutte pour la reconnaissance jusqu’à ses récents essais Le Droit de la liberté et L’Idée du socialisme. Dans la première partie, le concept programmatique de pathologie sociale sera mis en relation avec celui de « sécularisation de la théodicée » formulé par Ernst Cassirer – à savoir, l’attribution de la responsabilité de la souffrance humaine à la société – et avec l’héritage des Lumières légué par Jean-Jacques Rousseau. Dans la deuxième partie, une fois précisée la position occupée par Honneth dans la tradition de la théorie critique francfortoise, j’aborderai ses propositions théoriques ; je distinguerai notamment deux modèles normatifs correspondant à deux phases successives de la pensée honnethienne : la lutte pour la reconnaissance d’une part, qui s’appuie sur une anthropologie formelle à valeur universelle ; et la théorie de la liberté sociale d’autre part, qui réactualise la doctrine hégélienne de l’éthicité en s’appuyant sur un modèle historique et internaliste de critique sociale reconstructive. Dans la troisième partie, je me pencherai sur la « divinisation du social » inhérente au projet d’une critique des pathologies sociales, ainsi que sur la confiance excessive qu’Honneth semble accorder à la force normative de l’intersubjectivité. This article retraces and discusses the philosophical itinerary of Axel Honneth, from the groundbreaking book Struggle for Recognition up to the recent essays Freedom’s Right and The Idea of Socialism. In the first section, I examine Honneth’s programmatic concept of social pathology in relation to Ernst Cassirer’s idea of the secularisation of theodicy (i. e. the attribution of responsibility for human suffering to society) and to the enlightenment legacy of Jean-Jacques Rousseau. In the second section, after assessing Honneth’s position in (...) the tradition of critical theory, I analyse his philosophical views. I identify two different theoretical frameworks in Honneth’s work: on the one hand, the theory of the struggle for recognition; on the other hand, the recent theory of social freedom. While the first is grounded in a formal and allegedly universal anthropology, the second draws on the Hegelian doctrine of the ethical life and develops a historicist and internalist model of reconstructive social criticism. Finally, in the third section, I critically address the “divinisation of the social” entailed in Honneth’s project of social pathologies’ critique, and argue that Honneth’s trust in the normative power of intersubjectivity might be excessive.
