Access to surrogacy is often cast in the language of rights. Here, I examine what form such a right could take. I distinguish between surrogacy as a right to assisted procreation, and surrogacy as a contractual right. I find the first interpretation implausible: it would give rise to claims against the state that no state can fulfil, namely the provision of sufficient surrogates to satisfy the need. Instead, I argue that the right to surrogacy can only be plausibly understood as (...) a contractual right. I then investigate two different sets of harms that are often employed to argue against such a contractual interpretation of the right to surrogacy: harm to women's interests in a gendered society, and harm to the sense of self of the surrogate. I assess both of these through the analytical lens of vulnerability. I find neither of them to be convincing arguments against surrogacy contracts. In conclusion, I agree that surrogacy contracts should be carefully regulated, but I disagree with those who call for prohibition of the right to surrogacy as a contractual right. (shrink)

Indigenous communities have always cultivated social studies learning that is interactive, dynamic, and integrated with traditional knowledges. To confront the assimilative and deculturalizing education that accompanied European settlement of the Americas, Montana has adopted Indian Education for All (IEFA). This case study evaluates the Digital Storywork Partnership (DSP), which strives to advance the goals of IEFA within and beyond the social studies classroom through community-centered research and filmmaking. Results demonstrate the potential for DSP projects to advance culturally revitalizing education, community (...) connectedness, and identity-development. The DSP offers a model for social studies education that is not only culturally affirming and revitalizing for Indigenous communities, but also holds potential for use in all communities. We conclude with recommendations for educators, scholars, and community members engaged in similar efforts. (shrink)

This book should be essential reading for anyone interested in the new reproductive technologies, biomedical ethics, and women's health.

The moral error theory generally does not receive good press in metaethics. This paper adds to the bad news. In contrast to other critics, though, I do not attack error theorists’ characteristic thesis that no moral assertion is ever true. Instead, I develop a new counter-argument which questions error theorists’ ability to defend their claim that moral utterances are meaningful assertions. More precisely: Moral error theorists lack a convincing account of the meaning of deontic moral assertions, or so I will (...) argue. (shrink)

As with all other moral realists, so-called relaxed moral realists believe that there are moral truths. Unlike metaphysical moral realists, they do not take themselves to be defending a substantively metaphysical position when espousing this view, but to be putting forward a moral thesis from within moral discourse. In this paper, I employ minimalism about truth to examine whether or not there is a semantic analysis of the claim ‘There are moral truths’ which can support this moral interpretation of one (...) of moral realism’s key theses. My results are both discouraging and encouraging: Whilst I will argue that the claim ‘There are moral truths’ cannot be shown to be both moral and capable of demarcating relaxed realism from irrealism on the basis of a convincing semantic analysis that would be compatible with relaxed commitments, the moral interpretation of moral realism can be secured by modifying our understanding of what distinguishes relaxed realism from error-theoretic irrealism. Yet, we will see that this moral interpretation of moral realism does not ‘tumble out’ of the semantics provided for its central claims. Rather, hard work needs to be done before we can fully relax. According to Aristotle, Plato's efforts at metaphysical explanation not only fail, they are nonsensical. In particular, Plato's appeals to Forms as metaphysically explanatory of the sensibles that participate in them is "empty talk" since "'participating' means nothing". I defend Plato against Aristotle's charge by identifying a particular, substantive model of metaphysical predication as the favored model of Plato's late ontology. The model posits two basic metaphysical predication relations: self-predication and participation. In order to understand the participation relation, it is important (...) first to understand how Plato's Forms are self-predicative paradigms. According to the favored model, Forms are self-predicative paradigms insofar as they are ideal, abstract encoders of structural essences. Sensibles participate in Forms by exemplifying the structures encoded in the Forms. Given plausible conditions on metaphysical explanation, Plato's appeals to abstract Forms as metaphysically explanatory of sensibles is a reasonable competitor for Aristotle's appeals to natural, substantial forms. At the very least, Plato's appeals to a participation relation are not empty. (shrink)

It is generally accepted that there are two kinds of normative concepts : evaluative concepts, such as good, and deontic concepts, such as ought. The question that is raised by this distinction is how it is possible to claim that evaluative concepts are normative. Given that deontic concepts appear to be at the heart of normativity, the bigger the gap between evaluative and deontic concepts, the less it appears plausible to say that evaluative concepts are normative. After having presented the (...) main differences between evaluative and deontic concepts, and shown that there is more than a superficial difference between the two kinds, the paper turns to the question of the normativity of evaluative concepts. It will become clear that, even if these concepts have different functions, there are a great many ties between evaluative concepts, on the one hand, and the concepts of ought and of reason, on the other. Much thought has been devoted to how metaethical disagreement between moral realism and expressivism can be saved once minimalism starts creeping. Very little thought has been given to how creeping minimalism affects error-theories’ disagreement with their metaethical competitors. The reason for this omission, I suspect, is found in the belief that whilst locating distinctive moral realist and expressivist positions within a minimalist landscape poses a severe challenge, no such difficulties are encountered when differentiating error-theories from moral realism and expressivism. In (...) the first part of this paper, I show that this belief is mistaken: Insofar as moral realists and error-theorists are still taken to disagree, creeping minimalism renders their disagreement moral, but makes these positions metaethically indistinguishable. In the second part of the paper, I present a modified inferentialist solution to the problem of creeping minimalism which seeks to put error-theories back on the metaethical map. Yet, this too comes at a cost, in that it significantly modifies our interpretation of error-theories. Whichever way we turn, then, creeping minimalism not only forces us to re-phrase metaethical positions in a way that is compatible with minimalism, but also requires us to change our very understanding of these positions. Who owns frozen human embryos? Are "surrogate motherhood" arrangements dangerous for women? Should access to in vitro fertilization be limited or increased? With the development of complex reproductive technologies and the ensuing controversies in reproductive ethics, there is an urgent need for more careful examination of moral principles, current practices, and social policies pertaining to reproduction. The issues examined in this collection of nine papers focusing of the Canadian experience include abortion, the cryopreservation of embryos, the selective termination of fetuses (...) within multiple pregnancies, social policy for gestational "surrogacy," and the regulation of in vitro fertilization. Adopting a feminist perspective, the book places reproductive autonomy at the center of debates about the control of reproduction. (shrink)

Ascribing moral responsibility in collective action cases is notoriously difficult. After all, if my individual actions make no difference with regard to the prevention of climate change, the alleviation of poverty, or the outcome of national elections, why ought I to stop driving, donate money, or cast my vote? Neither consequentialist nor non-consequentialist moral theories have straightforward responses ready at hand. In this contribution, I present a new suggestion which, based on thoughts about causal overdetermination along the lines of Mackie’s (...) INUS account, aims to show that causally overdetermined collective action cases are morally arbitrary in a way that makes it possible to ascribe moral responsibility even if individual actions make no difference. As this article is published, Robert Larmer and I have been engaged in a debate that is now eighteen years long, often with gaps of many years between ripostes, about the nature and significance of miracles. The Larmer/overall oeuvre now includes six works, including the two published here. I am grateful to the editors of Dialogue for giving me the opportunity to respond to Larmer’s most recent entry in the debate.

One of the defining features of the capability approach to health, as developed in Venkatapuram's book Health Justice, is its aim to enable individual health agency. Furthermore, the CA to health hopes to provide a strong guideline for assessing the health-enabling content of social and political conditions. In this article, I employ the recent literature on the liberal concept of vulnerability to assess the CA. I distinguish two kinds of vulnerability. Considering circumstantial vulnerability, I argue that liberal accounts of vulnerability (...) concerned with individual autonomy, align with the CA to health. Individuals should, as far as possible, be able to make health-enabling decisions about their lives, and their capability to do so should certainly not be hindered by public policy. The CA to health and a vulnerability-based analysis then work alongside to define moral responsibilities and designate those who hold them. Both approaches demand social policy to address circumstances that hinder individuals from taking health-enabling decisions. A background condition of vulnerability, on the other hand, even though it hampers the capability for health, does not warrant the strong moral claim proposed by the CA to health to define health as a meta-capability that should guide social policy. Nothing in our designing social policy could change the challenge to health agency when we deal with background conditions of vulnerability. (shrink)

This contribution considers whether or not it is possible to devise a coherent form of external skepticism about the normative if we ‘relax’ about normative ontology by regarding claims about the existence of normative truths and properties themselves as normative. I answer this question in the positive: A coherent form of non-normative error-theories can be developed even against a relaxed background. However, this form no longer makes any reference to the alleged falsity of normative judgments, nor the non-existence of normative (...) properties. Instead, it concerns a specifically inferentialist construal of error-theories which suggests that error-theorists should abstain from any claims about normative ontology to focus exclusively on claims about the inferential role of normative vocabulary. As I will show, this suggestion affords a number of important advantages. However, it also comes at a cost, in that it might not only change the letter, but also the spirit of traditional error-theories. (shrink)

International migration has a female face in the beginning of the twenty-first century; since at least 1990, a total of 49 percent of international migrants have been women (UN 2008).1 Many women relocate in pursuit of goals that they can’t realize in their countries of origin, and many women move on their own to developed countries as caregivers to the very old or the very young, as nurses to attend to the sick in hospitals, and as domestic workers.2 How should (...) we regard their decisions to do so? One way of thinking about such moves is to deplore the fact that women have to move in order to attain certain goals in their lives; it would be more desirable to live in a world that would not make such moves necessary... The “demand” for selective termination of pregnancy is a socially constructed response to prior medical interventions in women's reproductive processes, themselves dependent on cultural views of infertility.

This chapter provides an introductory overview of quasi-realism and its key challenges.

Within the social sciences, much controversy exists about which status should be ascribed to the rationality assumption that forms the core of rational choice theories. Whilst realists argue that the rationality assumption is an empirical claim which describes real processes that cause individual action, instrumentalists maintain that it amounts to nothing more than an analytically set axiom or ‘as if’ hypothesis which helps in the generation of accurate predictions. In this paper, I argue that this realist-instrumentalist debate about rational choice (...) theory can be overcome once it is realised that the rationality assumption is neither an empirical description nor an ‘as if’ hypothesis, but a normative claim. In this reply, I argue that the worries raised by Kurth and this coauthors are not fatal for the perceptual theory of emotions. A first point to keep in mind in discussing the analogy argument in favor of that account is that what counts is the overall balance of similarities and differences, given their respective weight. In any case, I argue that none of the alleged differences between sensory perceptual experiences and emotions are such as to rule out that emotions (...) are a kind of perceptual experience which can confer epistemic justification of our evaluative beliefs. Finally, I suggest that the perceptual theory is in a position to nicely capture what happens when we disagree about evaluative issues. (shrink)

Political philosophers are divided on the question of whether society should guide individuals in their projects and goals in light of the competing, yet overlapping, values of moral independence and human well-being. The lively neutralism-perfectionism debate appears to be significantly muted, however, when it comes to children who, all parties assume, should be guided by adults in their plans of life. Thus, in their stimulating new book, Family Values: the Ethics of Parent-Child Relationships, liberals Harry Brighouse and Adam Swift affirm (...) the role of the family in directing and enabling children’s flourishing. My paper challenges this distinction between parents and children in the liberal position to argue that the idea that it is appropriate to direct children to enable them to flourish, entails in fact, a commitment to policies that promote and enable the flourishing of all. There are various programmes currently advocated for ways in which children might encounter philosophy as an explicit part of their education. An analysis of these reveals the ways in which they are predicated on views of what constitutes philosophy. In the sense in which they are inquiry based, purport to encourage the pursuit of puzzlement and contribute towards creating democratic citizens, these programmes either implicitly rest on the work of John Dewey or explicitly use his work as the main warrant (...) for their approach. This article explores what might count as educational in the practice of children ‘doing’ philosophy, by reconsidering Dewey’s notion of ‘experience’. The educational desire to generate inquiry, thought and democracy is not lost, but a view that philosophy takes its impetus from wonder is introduced to help re-evaluate what might count as educational experience in a Deweyan sense. Quasi-realist expressivists have developed a growing liking for minimalism about truth. It has gone almost unnoticed, though, that minimalism also drives an anti-Archimedean movement which launches a direct attack on expressivists’ non-moral self-image by proclaiming that all metaethical positions are built on moral grounds. This interplay between expressivism, minimalism and anti-Archimedeanism makes for an intriguing metaethical encounter. As such, the first part of this dissertation examines expressivism’s marriage to minimalism and defends it against its critics. The second part then turns (...) to the anti-Archimedean challenge to expressivism and shows how to ward off this challenge by securing expressivism’s non-moral, metaethical status without having to abandon minimalism about truth. Domesticated animals need to be treated as fellow citizens: only if we conceive of domesticated animals as full members of our political communities can we do justice to their moral standing—or so Sue Donaldson and Will Kymlicka argue in their widely discussed book Zoopolis. In this contribution, we pursue two objectives. Firstly, we reject Donaldson and Kymlicka’s appeal for animal citizenship. We do so by submitting that instead of paying due heed to their moral status, regarding animals as citizens misinterprets (...) their moral qualities and thus risks treating them unjustly. Secondly, we suggest that Donaldson and Kymlicka’s reinforced focus on membership should draw our attention to the moral standing of a further ‘species’, namely robots. Developments within artificial intelligence have advanced rapidly in recent years. With robots’ gaining ever greater capacities and abilities, we need to ask urgent questions about the moral ramifications of these technical advances. (shrink)
